Permit Class NEW Permit Number 45-16 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission ermft for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Barbara Jemison, PO Box 665, Ocracoke, NC 27960 !Authorizing development in Hyde County at adjacent North Pond off the Pamlico Sound, at 34; North Pond Road, in Ocracoke ,as requested in the permittee's application dated 1/3/16 including attached workplan I dated 10/12/15 and 1 dated '.This permit, issued on April 14, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may oe subject to Imes, imprisonment or crvu action; or may cause the permit to be null and void. Excavation 1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) Excavation shall not exceed -3 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department r' personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee 'Barbara Jemison Permit No. 45-16 Page 2 of 3 ADDITIONAL CONDITIONS 4) This permit approves only the use of a long reach hydraulic excavator operated from a location landward of the normal water level. The use of any other excavation equipment or methodology may require additional approval. Spoil Disposal 5) All excavated materials shall be confined above normal water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 6) . The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Maintenance Clause 7) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to initiation of any phase of this project. 9) No excavation or filling of any vegetated wetlands is authorized by this permit. O) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 12) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Barbara Jemison ' NOTE: NOTE: NOTE: Permit No. 45-16 Page 3 of 3 ADDITIONAL CONDITIONS The permittee is advised that any development or land disturbing activity that is considered non - water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission (EMC) Tar Pamlico River buffer regulations in place at the time of such development. The U.S. Army Corps of Engineers authorized the proposed project by way of Tier II Programmatic General Permit 198000291 and assigned SAW 201600149, which was issued 4/8/16. The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 16-0073. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Warlick North Pond Ocracoke Island Hyde County Project Setting The t0.50 acre project site is located off SR 1351, North Pond Road in the Pamlico Shores residential subdivision on the north side of Ocracoke Village adjacent North Pond and the Pamlico Sound, Hyde County, North Carolina. The site is located in the southwest comer of North Pond. This corner has a western shoreline that is stabilized with a concrete bulkhead and the southern shoreline has a natural sandy estuarine beach. The project's western shoreline is comprised of lots 18, 19 and 20 and are owned by Ms. Barbra Jemison. Lots 18 and 19 are developed as one lot with a single family residence, a 5' x 36' dock on the landward side of the concrete bulkhead and a 6' x 40' pier in North Pond. Lot 20 is developed with a single family residence and a continuation of the same concrete bulkhead. Lot 20 is landlocked without shoreline on North Pond. The western shoreline is uplands with an elevation of t3' above the normal water level (NWL). The vegetation on these lots is native grasses such as salt meadow hay and the woody vegetation is red cedar and loblolly pine. The southern shoreline of the project site is comprised of a 15' wide undeveloped lot that runs from SR 1350, Pamlico Shores road to North Pond and lot 22 of the Pamlico Shores residential subdivision. The long narrow 15' wide lot is owned by a co -applicant, Mr. Peter Warlick and Lot 22 is owned by co -applicant Mr. John W. Brown. Lot 22 is developed with a single family residence. The southern shoreline is a sandy estuarine beach that transitions to uplands t2.5' to 3.0' above the NWL. The undeveloped part of the southern shoreline is vegetated with native grasses including salt meadow hay, american beach grass, pennywort, golden rod and sea oats. The mowed vegetation around the residence is bermuda grass. Evidence suggest that the southern shoreline of the Pamlico Shores subdivision adjacent North Pond has been accreting sand over the last 20 years which is supported and/or documented by a third party appeal of a CAMA permit in February of 1995. The issue that led to the appeal was over rights to develop accreted land. This site of the appeal is located 300' to the east of the current project site. A CAMA General permit was issued in April 2015 to extend an existing pier 10' offshore and relocate an open boatlift further offshore to avoid the accreting sand. The boat lift was originally authorized and constructed in 2004. This pier and boatlift are 100' to the east of the current project site. The projects nearshore area was investigated in August 2015 by DCM staff to assess the habitat and other estuarine resources present. This investigation revealed a sandy bottom with no discernable rooted submerged aquatic vegetation (SAV) present although a large mass of eel grass was laying on the bottom deposited by wave action from the large shoal system further offshore. Water depths in the project site were 3' below the NWL at the existing pier on lots 18 and 19. Water depths shallowed as you move from the pier landward to the southern shoreline. North Pond is designated as SA HQW by the Environmental Management Commission and Coastal Waters by the North Carolina Marine Fisheries Commission and is open to shellfishing. Project Description The applicants propose to undertake excavation of an area 50' x 52' below, the NWL in North Pond and another 50' x 61' in uplands for a total of 50' x 113' boat basin with a project depth of minus 3' below the NWL. The stated purpose of the excavation is to maintain boat access to lots 18 and 19 and to restore boat access to lot 20. The excavation will start on the 3' contour offshore lots 18 and 19 adjacent the south side of the existing pier. The excavation is to be conducted mechanically with a track excavator supported by logging mats. A logging mat system/road will be used to support a closed body dump truck that will back to the excavator. The equipment will access the shoreline across the lots owned by Brown and Warlick. The spoil material will be trucked to an upland location owned by Barbra Jamison and to an upland location owned by the contractor. Project Impacts The project as proposed will disturb/impact 2,600 ft2 of North Pond bottom and convert 3,050 ft2 of uplands to open water. The initial excavation activities will result in the loss of 567 cubic yards of sand from a stable and accreting sandy estuarine beach and nearshore area. Indications are with the active sand transport in and adjacent to the project site, the project will require future maintenance to maintain a 3' water depth. There will be continued impacts associated with maintenance excavation and removal of sand from the littoral transport.. The project as proposed will maintain and improve boat access to the 5' x 40' pier servicing the residence on lots 18 and 19. The excavation is to be accomplished with an excavator and dump truck. The spoil is to be placed directly into the truck and hauled to an upland stock pile site in the Village. Staff has reviewed the general and specific use standards for Estuarine Waters and Public Trust Area specifically the use standards for navigation channels, canals and boat basins including 7H.0208(b)(1)(A-H) and have determined that the proposal is consistent. The permit conditions should prohibit the double handling of spoil material below the normal water level (NWL), and limit the excavation to minus 3' below the NWL. A condition should also require notification of DCM prior to undertaking any maintenance excavation activities once the original excavation has been completed. Repeated maintenance excavation will be necessary to maintain the project dimensions due to the amount of littoral sand movement. Staff feels that at a minimum annual maintenance will be required. Evidence to support this assertion is supported by the atypical accretion of sand seaward of a bulkhead. Repeated maintenance events could result in enough sediment removal that could reverse the current trend of accretion. Without e condition documenting the frequency of maintenance events, this Division will not be able to adequately monitor the maintenance during the initial 3 year development period. The southern shoreline of the project is composed of a narrow 15' wide undeveloped lot that runs from SR 1350 to North Pond, and lot 22 a developed lot with a single family residence. These lots are owned by Mr. Peter Warlick and Mr. John W. Brown respectively. The properties are sandy estuarine beach that transitions to uplands t 2.5' to 3' above the NWL. The vegetation on the undeveloped lot composed of native grasses including salt meadow hay, American beach grass, pennywort, golden rod and sea oats. The vegetation on the developed lot is composed of mowed Bermuda grass. Existing site improvements consist of single-family residences, driveways, and septic systems. Buffer Establishment around Basin New boat basins (such as the one you are proposing to construct) are considered by the Division as a modification of the existing shoreline. You are required to establish a new buffer around the shoreline of the basin. All associated new upland development (such as parking lots, buildings, etc.) and any new impervious surfaces shall not be located within the newly established buffer or any existing protected buffers. 6. The Permittee shall replant the vegetation within temporarily disturbed areas associated with this project in an "in kind" manner immediately following construction. This technique is often used to keep waterways navigable. it is also used as a way to replenish sand on some public beaches, where sand has been lost because of coastal regions. Conventional dredging is the most common type of dredging. Excavators are used on the ban or mounted on boats to dig out the silts and transport them elsewhere for either; recycling, re -use or disposal. These come in all shapes and sizes to be able to operate on the full range of waterways, from narrow canals to the biggest rivers. A backhoe/dipper dredge (aka track excavator) has a backhoe like on some excavators. Small backhoe dredgers can be track -mounted and work from the bank of ditches or in shalbw water edges with the utilization of matting to minimize impacts on waters during the project. A backhoe dredger is equipped with "equipment diapers" to Prevent Potential release of Petroleum products in open waters and a half -open shell. The shell is filled moving towards the machine. Dredged material is loaded in barges or other off-loading machinery (ie; closed body dump truck). This machine is mainly used in harbors and for other shallow water dredging. A plain suction dredger has no tool at the end of the suction pipe to disturb the material. This is often the most commonly used form of dredging with the purpose of gathering up bottom sediments and disposing of them at a different location. This proposed project contains a significant amount of "above NWL" material to be dredged/excavated. The suction dredger is not designed or recommended for this application. The conventional lone reach backhoe/dipper can be used for both "above N`* L and below NWL" dredginglexcavating activity for this project. The use of a long reach backhoeldipper will enable the body of the excavator to remain above "N`"L", thus preventing a potential of release of petroleum products in open waters. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located off SR 1351 at 34 North Pond Road adjacent Northern Pond of the Pamlico Sound in Ocracoke, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to excavate an area of Northern Pond and adjacent uplands 50' wide by 113' long for the purpose of obtaining boating access to two residences. Final water depths are proposed to be -3' NWL. The area appears to have been accreting sand for 20 years and therefore is considered to be an active sediment transport area and will need maintenance events. A scoping meeting was conducted on August 25, 2015 with representatives for the applicant, state, and federal agencies. The Northern Pond at this location is classified SA HQW by the Environmental Management Commission and is open to shellfish harvesting. The NCWRC has reviewed the permit application and still has the same concerns with the proposal as discussed in the scooping meeting. These concerns include the following: - The application states the proposal is to provide boating access to lots 18, 19, and 20. Lot 18 i currently has a pier that provides vessel' access, while it appears lot 20 has never had demonstrated boating access. It would be difficult to allow significant impacts within SA HOW waters to provide boating access for a lot that has never demonstrated boating access. The applicant is proposing mechanically -excavate a 52' x 53' area below normal water level and a 50' x 61' area of upland to a depth of-3' NLW in North Pond on Ocracoke Island. The purpose is to create a boat basin giving several lots water access that has been lost over the years dues to sediment accretion. This area is not a designation Primary Nursery Area (PNA), but there is a large amount of Submerged Aquatic Vegetation (SAV) just outside of North Pond that could be negatively affected by potential sedimentation and turbidity cause by the excavation. In order to reduce the potential negative impacts to SAV, as well as the fish that use it as habitat, a moratorium from April 1— September 30 is requested. Adherence to the moratorium can be avoided by the use of a turbidity curtain around the excavation site during work. The curtain should remain in place for 72 hours or until turbidity conditions return to normal whichever is longer. Warinck North Pond Ocracoke Island Hyde County Project Setting The t0.50 acre project site is located off SR 1351, North Pond Road in the Pamlico Shores residential subdivision on the north side of Ocracoke Village adjacent North Pond and the Pamlico Sound, Hyde County, North Carolina. The site is located in the southwest corner of North Pond. This comer has a western shoreline that is stabilized with a concrete bulkhead and the southern shoreline has a natural sandy estuarine beach. The project's western shoreline is comprised of lots 18, 19 and 20 and are owned by Ms. Barbra Jemison. Lots 18 and 19 are developed as one lot with a single family residence, a 5' x 36' dock on the landward side of the concrete bulkhead and a 6' x 40' pier in North Pond. Lot 20 is developed with a single family residence and a continuation of the same concrete bulkhead. Lot 20 is landlocked without shoreline on North Pond. The western shoreline is uplands with an elevation of t3' above the normal water level (NWL). The vegetation on these lots is native grasses such as salt meadow hay and the woody vegetation is red cedar and loblolly pine. The southern shoreline of the project site is comprised of a 15' wide undeveloped lot that runs from SR 1350, Pamlico Shores road to North Pond and lot 22 of the Pamlico Shores residential subdivision. The long narrow 15' wide lot is owned by a co -applicant, Mr. Peter Warlick and Lot 22 is owned by co -applicant Mr. John W. Brown. Lot 22 is developed with a single family residence. The southern shoreline is a sandy estuarine beach that transitions to uplands f2.5' to 3.0' above the NWL. The undeveloped part of the southern shoreline is vegetated with native grasses including salt meadow hay, american beach grass, pennywort, golden rod and sea oats. The mowed vegetation around the residence is bermuda grass. Evidence suggest that the southern shoreline of the Pamlico Shores subdivision adjacent North Pond has been accreting sand over the last 20 years which is supported and/or documented by a third party appeal of a CAMA permit in February of 1995. The issue that led to the appeal was over rights to develop accreted land. This site of the appeal is located 300' to the east of the current project site. A CAMA General permit was issued in April 2015 to extend an existing pier 10' offshore and relocate an open boatlift further offshore to avoid the accreting sand. The boat lift was originally authorized and constructed in 2004. This pier and boatlift are 100' to the east of the current project site. The projects nearshore area was investigated in August 2015 by DCM staff to assess the habitat and other estuarine resources present. This investigation revealed a sandy bottom with no discernable rooted submerged aquatic vegetation (SAV) present although a large mass of eel grass. was laying on the bottom deposited by wave action from the large shoal system further offshore. A garden rake was used to rake the sand bottom for rooted SAV and hard clams. No rooted SAV Barbara Jemison John W. Water depths in the project site were 3' below the NWL at the existing pier on lots 18 and 19. Water depths shallowed as you move from the pier landward to the southern shoreline. North Pond is designated as SA HQW by the Environmental Management Commission and Coastal Waters by the North Carolina Marine Fisheries Commission and is open to shellfishing. Project Description The applicants propose to undertake excavation of an area 50' x 52' below the NWL in North Pond and another 50' x 61' in uplands for a total of 50' x 113' boat basin with a project depth of minus 3' below the NWL. The stated purpose of the excavation is to maintain boat access to lots 18 and 19 and to restore boat access to lot 20. The excavation will start on the 3' contour .offshore lots 18 and 19 adjacent the south side of the existing pier. The excavation is to be conducted mechanically with a track excavator supported by logging mats. A logging mat system/road will be used to support a closed body dump truck that will back to the excavator. The equipment will access the shoreline across the lots owned by Brown and Warlick. The spoil material will be trucked to an upland location owned by Barbra Jamison and to an upland location owned by the contractor. Project Impacts The project as proposed will disturb/impact 2,600 ft' of North Pond bottom and convert 3,050 ft' of uplands to open water. The initial excavation activities will result in the loss of 567 cubic yards of sand from a stable and accreting sandy estuarine beach and nearshore area. Indications are with the active sand transport in and adjacent to the project site, the project will require future maintenance to maintain a 3' water depth. There will be continued impacts associated with maintenance excavation and removal of sand from the littoral transport.. The project as proposed will maintain and improve boat access to the 5' x 40' pier servicing the residence on lots 18 and 19. I have talked to the representative of the Division of Environmental Management (DEMO, Ms. Deborah Sawyer, regarding your request to use live concrete in bags as a riprap material. Ms. Sawyer indicated that DEM would not object to this as long as the concrete was placed in a geo-textile fabric bag. For more information about the geo-textile bags, please contact Ms. Sawyer at (919) 946-6481. I am enclosing the information about the gabions as you requested.
