Let me start by saying, thanks for contacting me, if you need input from navigation on anything please do not hesitate to
ask. We like to work closes with DENR to ensure that we do not create new encroachments and to help us clean up what
is there. So again if you have any questions I am more than willing to help.
I will start with your question first, the setback and harbor line are basically the same thing. They both restrict
construction towards the channel. The biggest difference between them are how they are authorized. Congress created
the harbor lines (most were created between 1930 and the late 1950's), where as the setback is a district policy that has
been in effect since the early 1950's. Since most of the harbor lines are less restrictive than the setback, we have kept
the harbor lines and moved the setback lines to match the harbor line.
As for this dock, if they remove any piles form inside the setback (I will use setback but it is really the setback/harbor
line) they can not go back in the setback. If the can re -use any existing pilings in a new configuration then we would not
have any concerns with that. so in this case it looks like they plan to leave the 4 piles for the boat lift in place, and the 2
mooring piles on the opposite side of the dock from the boat lift in place as well. the setback splits these structures in
half, as you can see on the image you sent me, so 2 of the boat lift piles and one of the mooring piles are in the
setback. If they remove the piles from the setback holding the dock then they would not be able to replace them even
in the same place. They can put them on the line and anchor a floater over the line. Basically if a pile is removed from
the setback and can not be replaced, or added to (sistering). This is in place to eventually pull our encroachments back
behind the setback line.

I have attached a proposal for the docking facility at 915 Front Street in Beaufort. It appears that the applicant is looking
to maintain the existing footprint of the fixed platform and replace it with a combination of hog slat and floating
platform at the terminus. It appears that the existing structure exceeds the harbor line. I wanted to see if the
Navigation Section would have any objections to the replacement in the existing footprint.
Additionally, I just started covering the area of Beaufort, can you give me a brief description of the difference between
the Harbor Line and a traditional setback line?
