This.permit, issued on June 1, 2017 is subject to compliance with the application (where consistent
.with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1). Unless specifically altered herein, this Minor Modification authorizes the following modifications to
the originally authorized project design; fixed pier to floating dock with finger docks, associated
mooring pilings, rip rap revetment; timber boardwalk, and kayak launch, all as expressly and
specifically set forth in the attached letter and workplan drawing. Any additional development
activities may require a modification of this permit.
2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
.3), This permit authorizes a reduction in slip count to a maximum of 15 formalized boat slips.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
iuilified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
"persopnel when the project is inspected for compliance.

ADDITIONAL CONDITIONS
Shoreline Stabilization
4) The riprap shall not extend waterward more than 2 feet from the mean normal high water level at any
point along its alignment at the time of construction.
5) The alignment of the authorized rip rap shall be staked by a representative of the Division of Coastal
-Management within a maximum of 30 days prior to the start of construction. Failure to initiate
Tconstruction within 30 days; or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be re -staked by DCM within a maximum of 30 days prior to the new expected start of
construction.
The rip rap material shall consist of clean rock or masonry materials such as, but not limited to, granite,
marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the approved
alignment by wave or current action.
The rip rap material shall be clean and free of any pollutants except in trace quantities.
General
This Minor Modification shall be attached to the original Permit No. 94-16, which was issued on
9/15/16, and both documents must be readily available on site when Division personnel inspect the
project for compliance.
All conditions and stipulations of the active permit remain in force unless specifically altered herein.
A minor modification application processing fee of $100 was received by DCM for this project.
The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2016-01535.
The Division of Water Resources assigned the proposed project DWR Project No. 20160699.

State Permit No. 94-16 was issued on 9/15/16 for the reconfiguration of a marina on the New River, Onslow
County. The permit expires on 12/31/19.
The applicant is requesting to make several minor changes to improve the functionality of the reconfigured
marina. A list of desired changes is stated on the attached letter from the City of Jacksonville dated
4/17/17.

Dear Ryan:
We are writing to confirm prior conversations that Pat Donovan -Potts and I have had with you concerning the
City of Jacksonville's desire to modify its current permit. We understand that modification of the permit will
be required because of our intent to adjust the planned reconfiguration of the Jacksonville Riverwalk Marina
from that authorized by the permit. To that end, we have enclosed a 3-sheet drawing set that shows the
updated layout and details of the revised shoreline treatment. We have also enclose a check in the amount
of $100 to cover the modification review and processing fee.
You may recall that the reconfigured marina authorized by the permit was to incorporate the following
features:
• 16 slips to support vessels from 20 to 30 feet in length
• Fixed 5-foot wide, 269-foot long timber (shore -parallel) dock with 5.5-foot wide floating finger piers
anchored with piles
• 40 mooring or tie -piles
• Fixed 8-foot wide, 67-foot long fixed timber pier with open and covered fishing platforms
• A 13-foot x 5-foot floating dock for launching one (1) kayak
A 269-foot long bulkhead stabilizing the shoreline
• A 6-foot wide, 269-foot long elevated timber promenade with slats to maintain pervious area
• Sanitary sewer pump out station at end of fixed pier
The existing marina has a structure setback from the navigation channel of 30 feet (south side)
The enclosed drawing encompasses several changes that we desire so as to improve the functionality of the
reconfigured marina. A summary of the features shown by the drawing are as follows:
• 15 slips to support vessels from 20 to 30 feet in length
• Floating 6-foot wide, 220-foot long shore parallel dock with 4-foot wide floating finger piers. The
landward edge of floating docks were set at the elevation -3.5 feet NAVD (-3.0 feet MLW) to provide
sufficient water depths for boats mooring at slips, which minimizes sediment resuspension and future

• Fixed 8-foot wide, 67-foot long fixed timber pier with open and covered fishing platforms (no change
from permitted structure)
• A 13-foot x 17-foot wide floating dock for launching two (2) kayaks
• A 265-foot long riprap revetment at a 2H:1V slope stabilizing the shoreline, with toe to be set a
maximum 2 feet seaward of MHW line
• A 12-foot wide, 255-long elevated timber boardwalk with slats/grating placed over revetment to
maintain pervious area
• Sanitary sewer pump out station at end of fixed pier (no change)
• The proposed dock layout has a structure setback from the navigation channel of —34 feet (south
side) — equivalent to existing structure setback.
Again, the revised layout improves the functionality of the marina by providing sufficient under -keel clearance
for boats which again, will minimize sediment resuspension and future maintenance dredging. The floating
dock system incorporated into the revised layout improves ingress/egress to boats throughout the tidal range,
reduces the need for boaters to readjust mooring lines, and greatly enhances security for boaters by
incorporating a controlled access point. The relocation of the timber boardwalk to the north side of the site
increases the setback distance from the main navigation channel while minimizing conflicts between
motorized and non -motorized boats.
While total square footage of floating dock, floating kayak dock, and fixed timber observation/fishing pier is
the same as the equivalent structures in the authorized plan, the total number of piles will be significantly
reduced. This should greatly reduce the temporary impacts of noise and sediment resuspension associated
with pile driving operations during the construction phase. Lastly, a timber boardwalk straddling a riprap
revetment shoreline that covers the same footprint as the authorized plan will eliminate the bulkhead. The
rock revetment will absorb rather than reflect the boat- and wind -generated waves, providing a better
mooring condition within the marina while minimizing scour and sediment resuspension near the shoreline.
We are hopeful that the information provided herein and by the attached drawing will be sufficient for the
processing of a permit modification. Please however, do not hesitate to contact Pat Donovan -Potts

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The proposed modification
to reconfigure an existing permit (94-16) to provide docking for up to 15 vessels, timber fishing pier with
covered and open platforms, floating dock to launch kayaks, boardwalk over revetment, and sanitary sewer
pump out station. The project area is located in designated Primary Nursery Area (PNA).
PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early
post -larval to juvenile and include finfish, crabs, and shrimp. Species inhabit PNAs because they afford food,
protection, and proper environmental conditions during vulnerable periods of their life history, thus protection
of these areas are imperative. Shallow soft bottom within PNA is an important foraging habitat for juvenile
and adult fish and invertebrates, and aids in storing and cycling of sediment, nutrients, and toxins between the
bottom and water column. Soft bottom habitat is used to some extent by most native coastal fish species in
North Carolina. The habitat is particularly productive and, by providing refuge from predators, is an important
nursery area.
The proposed kayak launch area appears to have part of the structure located in an area which was surveyed to
be -1' at MLW. From the scaled drawings, it seems as though the floating structure below the freeboard will
extend 18" into the water. For this reason, I would suggest that the kayak launch area be moved along the
timber pier in a direction away from the shoreline, towards deeper water until a minimum depth of -2'
MLW is achieved for all parts of the floating structure. This action would serve to allow fish,
invertebrates, and water to move underneath the structure unimpeded. Additionally, this action would
eliminate the likelihood of adverse impacts to the shallow bottom habitat as well as eliminate the need for
permanent stops to be added to the structure.

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to modify the work associated with your Department of the Army (DA)
permit issued on September 26, 2016, which authorized the reconfiguration of an existing 19-slip
commercial docking facility to a 16-slip public docking facility, including reconfiguration of the
pier, additional floating dock and fishing area at 15 Kerr Street, in the New River, Onslow
County, North Carolina. The requested modification is to make several minor changes to
improve the functionality of the reconfigured marina.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 19800291 (copy enclosed). The permit is hereby modified. 1t is understood that all
other conditions of your permit remain applicable. The expiration date of your DA permit is
December 31, 2021.
