Hi Ryan
Our client is looking at making a couple of minor modifications to the Riverwalk Marina facilities. See first figure for
2017 permitted features. The second figure is the proposed 2018 changes
1. The vessel pump -out facility was relocated from the observation pier to the dedicated location and slip on the
south end of the floating dock system. The relocation was prompted for operational, safety, and security
reasons. The original location of the pump -out facility was located on the seaward end of the observation pier.
A portion of this 28-foot long pier edge is shared with a covered pavilion area with seating. In order for vessels
to utilize the pump -out facility, the seating and railing along the seaward edge would have to be removed to
allow vessels to tie -off to cleats spaced along this edge. The removal of the railing and seating area pose a safety
and security issue when vessel are not present as visitors may accidently fall into the deep water (>10 feet
deep). The roof overhand from the pavilion may also conflict with boat superstructure and
canopies. Depending on tide level, access to the fixed pier from the boat would be more
challenging. Relocating the pump -out facility to a dedicated location on the south end of the floating dock
system solves the aforementioned conflicts. A dedicated slip allows vessels to moor to a floating finger pier
where there is secure dedicated mooring hardware without conflicts with other pier uses. The floating dock also
facilitates access since the height differential stays constant through the tide level. The sewage discharge into
the municipal sanitary system does not change with the relocation.
2. The kayak dock is being re -configured and moved up behind the pavilion on the north side of the marina parallel
to the pavilion walkway. The size (square footage) doesn't change, just the location and configuration.
After speaking to Gregg, it appears either a letter of refinement, or at worst, a minor CAMA permit mod may be two
options for consideration. Of course, we will wait for your review and direction as to which way to proceed.

Are you sure the condition states Sturgeon? My letter references a PNA moratorium from April 1—September 30. Might
need to address that with Gregg if it states sturgeon.
But to answer the question as to whether or not relief would be granted for this work if a turbidity curtain is used
around the project during work, then yes I will give relief. As I discussed with Ms. Donovan on the phone Friday the
ability to isolate the work area within a turbidity curtain should isolate potential negative impacts from the surrounding
waterbody.

As a follow up to our Pat Donovan-Brandenburg's phone conversation with Shane Staples of NC Marine Fisheries on
Friday (February 16th), we are requesting an adjustment to the following condition of Major Development permit no. 94-
16:
In order to protect Atlantic Sturgeon populations, no in water work shall be permitted between April 1 and
September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with
appropriate resource agencies.
We are asking for a modification to the above condition to allow for the City of Jacksonville's contractor to install the
wooden pilings that are to support the planned fixed structures and serve as moorings over a 30-day period from mid -
March to mid -April as well as, the 12 concrete dock guide piles over 15 days from mid- to end -May. As discussed with
Mr. Staples, this work will be performed "behind" a turbidity curtain that will essentially isolate the work from any
migratory or spawning species.
Your assistance in this matter is greatly appreciated. As such, please do not hesitate to contact us should you have
questions and/or require additional information concerning our request.
