From the time this property was subdivided around 1975 to the present time, erosion has taken away from 60' on the north end of the property line to approximately 90" on the south end with lesser amounts in the middle. This land is lost forever and now the bay is rising and the wind force which blows from the south and builds up the water level then from the north to move it back out into Currituck Sound has increased causing faster erosion. The concrete blocks which were placed along the water line facing Knotts Bay cannot slow or stop the erosion and flooding is taking place when the blocks were laid down in 1994 to now. The bay low water mark is approximately one foot higher now. That leaves an average of 16" from the top of the block to the land level. This new bulkhead will extend the height 12" which matches the existing bulkhead on the property next to us on the north end. The bulkhead would extend from the property line on the north to the property line on the south, facing Knotts Bay. Starting on the north end, concrete blocks were placed against the erosion escarpment at that time in 1994. A total of 155 blocks 151/2" high x 27" wide by 48" long, were placed. Over the years, strong winds have washed over the blocks causing erosion. Details of this is included on the drawings. The total length where blocks occur is 626'6". Total fill material from the proposed bulkhead to the existing erosion escarpment located on the landward side of the gravel behind the bulkhead is 226.8 cubic yards. The total surface is 4,943 square feet. The bulkhead would be placed tight against the cement blocks which would add support. Areas without these blocks, the bulkhead would be placed 12" from the erosion escarpment, filled depth 2.5' which includes 54' along the Knotts Bay side to the area where wet lands start and rip rap begins. Also, along both sides of the canal and along the end of the canal the total length of this is 639'.6". Total fill material between the bulkhead and the erosion escarpment is 59 cubic yards. The total surface is 639,5' times 1 foot out times 2.5 feet fill equals 59 cubic yards. In addition to the bulkhead we purpose to build a retaining wall along the tree line of the marsh land on the south end of the property. Water builds up in the marsh and flows out onto our grass land. In order to stop this, the retaining wall would be 12" above ground. This area of land has been determined by the USACE visit on 7/28/16, the marsh area is USACE 404 wet land that extends 30' landward of the vegetation line where the retaining wall is proposed. The wall will be constructed 30' from the vegetation line and would be a total of 264lineal feet. p c. Q l PCI kfigl 1m Charles E. Starting on the north end, concrete blocks were placed against the erosion escarpment at that time in 1994. A total of 155 blocks 151/2" high x 27' wide by 48" long, were placed. : •. it I„tC?i; SNIy'I i 1 Intt7 l'3M Vim, I .fy7` I,O L -14ILe I k M p1mi E ^BF 9?_ _-._-._ - _ 9 0 _ -- _ 111 _- _-_______9l Jam. zo_ m o \ m - o / ! ,n01fn0 _ ------- p E • p v p ___._._.•HMM.. From the time this property was subdivided around 1975 to the present time, erosion has taken away from 60' on the north end of the property line to approximately 9W on the south end with lesser amounts in the middle. OCT 7 - 2016 A Project Narrative -Charles Holden Major Permit application DCM-EC The primary purpose of this project is to stop the erosion from wind driven, northeastern, and from due east that wash water against the bank. From the time this property was subdivided around 1975 to the present time, erosion has taken away from 60' on the north end of the property line to approximately 90' on the south end with lesser amounts in the middle. This land is lost forever and now the bay is rising up and the wind force which blows from the south and builds up the water level then from the north to move it back into the Currituck Sound has increased causing faster erosion. The concrete blocks which were placed along the water line -facing Knotts Island Bay cannot slow or stop the erosion and flooding that is taking place when the blocks were laid down in 1994 to now. The bay low water mark is approximately one foot higher now. That leaves an average of 16" from the top of the block to the land level. This new bulkhead will extend the new height 8" (above grade) which matches the existing bulkhead on the property next to us on the north end. The bulkhead would extend from the property line on the north towards the property line to the south, - facing Knotts Island Bay. Starting on the north end, concrete blocks were placed against the erosion escarpment at that time in 1994. Two separate sections with a total of 155 blocks 15 %" high x 27" wide by 48" long, were placed. Over the years, strong winds have washed over the blocks causing erosion. Details of this are included on the drawings. The total length where blocks occur is 626' 6". Total fill material from the proposed bulkhead to the existing erosion escarpment located on the landward side of the gravel behind the bulkhead is -226.8 cubic yards. The total area is -4,943 square feet. The bulkhead would be placed tight against the cement blocks which would add support. A -260' long canal extends from Knotts Island Bay westward into the property that has an unhardened shoreline. Along this shoreline, the bulkhead would be placed 12" to 24" from the erosion escarpment for a total of -556'. Also, a 60' section of unhardened shoreline along Knotts Island Bay south of the concrete blocks will be bulkheaded. The total length of these sections are -616'. Total fill material between the bulkhead and erosion escarpment is -114 cubic yards. The total surface area is -1,232 square feet. In addition to the bulkhead we propose to build a retaining wall along the tree/brush line of the marsh land on the south end of the property. No fill material will be placed in conjunction with the retaining wall. Additionally, a -60' x 6' section of riprap will be placed along both the retaining wall section and the remaining unprotected shoreline at the south property line to protect that area. Along with this project, a 180' long x 6' wide pier with a 20' x 20' platform at the end with four boat dock tie-ups is proposed. PROJECT SUMMARY: The applicant proposes to construct a bulkhead waterward of existing concrete block bulkhead sections and unhardened shoreline areas, place riprap along a 404-wetland shoreline, construct a retaining wall within a 404-wetland area and construct a four -slip docking facility. Project Setting The site of the proposed development is located at 141 Foxx Lane (off of SR# 1370), Knotts Island, Currituck County, and is adjacent to Knotts Island Bay. The property is made up of two adjacent Lots that total ±431,182 ftz (±9.9 acres) in area. The majority of the sites elevation is s1.5' above Normal Water Level (NWL) but it does have areas of ±24 above NWL located within the northwest area of the property. Man-made features include a single-family dwelling and multiple storage sheds of varying sizes. The upland area is vegetated with yard grasses, various upland trees and shrubs. According to the USDA's Natural Resources Conservation Service's Web Soil Survey, the soil on the property is made up of Conetoe loamy sand (CnA) and Nimmo loamy sand (No). USACE 404-wetlands exist within the southern portion of the property. There is a distinct tree/brush line that separates wooded wetlands from a mowed ±30' wide wetland area. Based on available information, there appears to be no archaeological sites on this property or nearby The site has ±746.5' of shoreline adjacent to Knotts Island Bay and ±543.5' within a canal for a total shoreline length of ±1,290'. An overgrown, shallow ditch/canal runs along the northern property line. A concrete block bulkhead that was backfilled with gravel begins at the mouth of this ditch and follows the shoreline contour southward for ±446.5'where it ends at the mouth of the canal. The canal extends in a westward direction and is ±270' long x 45' wide with an unhardened shoreline. A culvert exits at the end of the canal that provides water transfer to 404-wetlands. The concrete block bulkhead begins again on the south side of the canal mouth and continues an additional ±180'. The remaining ±120' of shoreline is unhardened and adjacent to both a non -wetland area and a 404-wetland area. A ±90' diameter man-made pond is located ±100' north of the canal mouth adjacent to the shoreline. This pond is not connected to Knotts Island Bay, but does have wetland plants such as cattails and arrowhead growing within it. The concrete blocks have sunk into the substrate since installation (indicated as 1994) ±16" below the adjacent ground elevation and NWL is now an average of 4' landward of the blocks. An erosion escarpment that ranges from ±0.5' to 1' is located an average of 8' landward of the blocks. A ±6' wide area of gravel is located on the waterward side of the concrete blocks due to being displaced through wave action. The shoreline of the canal and the remaining shoreline south of the concrete block bulkhead has an erosion escarpment that is ±1 to 2' in height and NWL is located at the escarpment. The adjacent property to the north is a large tract that has a single-family dwelling, storage sheds, a bulkheaded shoreline and a ±200' pier with several slips. The adjWproperty 0he south is undeveloped USACE 404-wetlands. ID&I Charles & Carol Holden Field Investigation Report Page 3 The waters of the Knotts Island Bay are classified as SC by the Environmental Management Commission and are not open to shellfish taking. Water depths within project area range from ±1' to 1.5' below NWL adjacent to the concrete block bulkhead and ±1.5 to 2.5' below NWL in the open waters. The bottom substrate within the project area is made up of fine sands. Submerged Aquatic Vegetation (SAV) was observed growing within the project area and include, but are not limited to, wild celery (Vallisneria Americana) and widgeon grass (Ruppia maritime). SAV coverage is estimated to be moderate up to ±125' waterward of the concrete block bulkhead at which point it became sparse. Water-milfoil (Myriophyllum spicatum) was observed growing in dense patches within the moderate area of SAV's. It should be noted that SAV's were not observed adjacent to the concrete block bulkhead due to the washed out gravel. Development Proposal The applicant proposes to stabilize the shoreline by constructing ±1,230' of wooden bulkheading. Along the shoreline where the concrete block bulkhead is present (±626.5'), the proposed bulkhead will be constructed on the immediate waterward side of the blocks. Along the unhardened canal shoreline (±543.5') and unhardened shoreline adjacent to Knotts Island Bay (±60'), the bulkhead will be installed <_2' waterward of NWL. The proposed bulkhead along Knotts Island Baywill transition to a retaining wall for±30' along a USACE 404-wetlands shoreline and then extend landward through the wetlands for ±240' staying 2' off of the tree/brush line. The portion of retaining wall landward of NWL will be constructed with aluminum flashing and will have a height of 12" above the substrate. No fill will be associated with the retaining wall. The applicant has indicated that disturbance limits will extend no more than 8' landward of the erosion escarpment (with the exception of the pond area where it will be less) and an 8' wide swath along the area of the proposed retaining wall. To add strength to the retaining wall along the shoreline and protect the remaining ±30 of wetland shoreline, the applicant proposes to install ±60' of riprap with a waterward toe extending 6' beyond NWL. To provide water access and docking, the applicant proposes to construct a 18O'x6' pier with a 2O'x2O' platform ±125' south of the northern property line. Two 17'xl' finger piers and a 1 O'x1' finger pier will be installed on each side of the pier and platform to create four fRU D The proposed docking facility will not encroach within the 15' setback and meets the'/a width rule. Water depths within the proposed slips are >_2' below NWL. OCT 2 6 2016 Anticipated Impacts DCM- MHD CITY • The construction of the bulkhead and riprap along the proposed alignments will result in the filling of ±4,098 ftz of Estuarine Waters and Public Trust Area AEC's with clean fill from an upland source. The construction of the bulkhead along the proposed alignment will result in the filling of ±2,506 ftz of Estuarine Shoreline AEC. Charles & Carol Holden Field Investigation Report Page 4 • The construction of the bulkhead along the proposed alignment will result in the placement of ±341 cubic yards of fill material below NWL. • The construction of the retaining wall along the proposed alignment will result in the disturbance of 2,160 ft2 of USACE 404-wetlands. • The proposed docking facility will result in the shading of approximately ±1,568 ftz of Estuarine Waters and Public Trust Area AEC's • The proposed docking facility create 4 formalized slips in water depths that are >_2' below NWL. • It is not anticipated that the proposed docking facility will have any negative impacts to navigation. VAN DER VAART Secretary CoastaiManagement ENVIRONMENTAL OVALITV MEMORANDUM TO: Courtney Spears, Asst. Major Permits Coordinator Division of Coasta6 Management FROM: Charlan Owen ICP, NE DCM District Planner BRAXTON DAVIS Director SUBJECT: Major Permit Request by Charles and Carol Holden to install 1,230 linear feet of wooden bulkhead with retaining wall and 60 linear feet of riprap, and construct a 6 foot wide by 180 foot long pier with a 20 foot by 20 foot terminus platform, two (2) 1 foot wide by 17 foot long finger piers and a 1 foot wide by 10 foot long finger pier on Knotts Island Bay; at 141 Foxx Lane, in the community of Knotts Island, Currituck County. Date: October 26, 2016 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007 as amended through June 24, 2009. Overview: The subject property consists of two (2) adjoining lots totaling 9.9 acres with a combined shoreline of 1,290 linear feet, 746.5 feet along Knotts Island Bay and 543.5 feet along a connecting 45 foot wide by 270 foot long manmade canal. Water depths range from 1 to 1.5 feet below Normal Water Level (NWL) along the shoreline and 1.5 to 2.5 feet in the open waters. Section 404 wetlands, with wooded and mowed areas, are located on the south side of the property. The site is vegetated with yard grasses and various upland trees and shrubs. An overgrown, shallow ditch/canal runs along the northern property line. The majority of the sites elevation is 1.5 feet above NWL with areas of 2 to 4 feet above NWL to the northwest. The subject property is primarily located within the AE floodzone. Existing site improvements consist of a single family house, multiple storage sheds and a 90 foot diameter manmade pond. Existing shoreline improvements consist of two (2) sections of concrete block bulkhead along the bay totaling 626.5 linear feet, a 446.5 foot long section north of the manmade canal and a 180 foot long section south of the manmade canal; and, a culvert at the end of the manmade canal. The culvert exits the end of the canal and provides water transfer to the Section 404 wetlands. The concrete blocks have sunken into the substrate approximately 16 inches below the adjacent ground elevation, making NWL an average of 4 feet landward of the blocks. An erosion escarpment ranging from .5 foot to 1 foot is located an average of 8 feet landward of the blocks. A 6 foot wide area of gravel is located waterward of the blocks due to displacement from wave action. The natural shoreline of the canal and the remaining natural shoreline south of the bulkhead have erosion escarpments 1 to 2 feet in height with NWL located at the escarpments. The wooden bulkhead will be installed immediately waterward of the concrete block bulkhead and approximately 2 feet waterward of NWL along the unhardened shorelines of the canal and bay. The bulkhead will transition to a retaining wall for 30 feet along the Section 404 wetlands shoreline and then extend landward through the wetlands for 240 feet. The retaining wall landward of NWL will be constructed from aluminum flashing and will have a height of 1 foot above NWL. No fill will be associated with the retaining wall. Riprap will be installed along the wetland shoreline extending 6 feet beyond NWL. The pier and associated improvements will create four (4) boat slips. The waters of the Knotts Island Bay in this area are classified as SC and are closed to shellfish taking. Submerged Aquatic Vegetation (SAV) was observed growing in the project area. SAV coverage is estimated to be moderate up to 125 feet waterward of the shoreline. SAV was not observed adjacent to the bulkhead due to the washed out gravel. There appear to be no archaeological sites on this property. Anticipated impacts: resulting from this project are expected to include: the filling of 4,098 sq. ft. of Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC) and 2,506 sq. ft. of Estuarine Shoreline AEC; the disturbance of .28 acre of Estuarine Shoreline AEC and 2,160 sq. ft. of Section 404 Wetlands, and; the shading of 1,568 sq. ft. of Public Trust Area/Estuarine Waters AEC. Basis for Determination: The property is located within the "Knotts Island/Gibbs Woods" subarea and is designated as "Limited Service Areas (Areas Preferred for Low Density Development)" on the Currituck County Future Land Use Map (FLUM). Areas of Environmental Concern (AECs) are designated as "Conservation Areas" as indicated on Page 11-1. As indicate on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long- term management and protection of significant, limited, or irreplaceable areas. VAN DER VAART .. .l'crnlrn3• " BRAXTON DAVIS Coastal Management l""""' ENVIRONMENTAL QUALITY MEMORANDUM: TO: Courtney Spears, DCM Assistant Major Permit Coordinator FROM: Shane Staples, DCM Fisheries Resource Specialist SUBJECT: Charles and Carol Holden, Knott's Island DATE: 10/28/16 A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the subject permit application for proposed actions that impact fish and fish habitats. The applicant proposes to construct 1,230' feet of wooden bulkhead along the shoreline in Knott's Island Bay. The bulkhead will be positioned immediately waterward of an existing concrete block bulkhead that is currently along 627' of shoreline; along the remainder of currently unhardened shoreline the bulkhead alignment will be 52' waterward of NWL. At the southern terminus of the bulkhead where a large area of wetlands begins the applicant proposes 60'.of rip -rap 6' wide along the toe of the wetlands at NWL. Behind the rip -rap 270' retaining wall is proposed to run through a large section of 404 wetlands with no fill proposed behind it. To provide water access and docking the applicant is proposing a 180' x 6' pier with a 20'x 20' platform and two 17' x 1' finger piers and a 10' x 1' finger pier alongside the pier to create 4 boat slips. This off has no comments for the bulkhead or rip -rap portions of the project and minor concerns for the docking facility. According to the application depths in the boats slips is 22' below NLW; this depth is marginal but acceptable. However, this permit should be conditioned that no dredging be allowed as much of it is SAV habitat and a proposed dredge or access channel would likely have a significant impact on habitat in the area. The retaining wall seems to serve no purpose running through the middle of the 404 wetlands. Even.without proposed fill a solid wall through wetlands is likely to cut of hydrologic connectivity as well as collect sediment resulting in loss of wetland habitat. These wetlands especially near open water are critical to fish and fish habitats since they filter run-off from uplands before it enters open waters and for this reason I would recommend removing the retaining wall from the project application to reduce the potential for adverse impacts to wetland impacts. Contact Shane Staples at (252) 949-3950 or shane.staples@ncdenr.gov with further questions or concerns. State of North Corolina I Enviromnental Quality I Coaaad Management 400 Commerce Avenue I Morehead City, NC 28557 252.808-28091252-247-3330(fu) Received OCT r - tat A Project Narrative - Charles Holden Major Permit application DCM rC The primary purpose of this project is to stop the erosionfrom wind driven, northeastern, and from due east that wash water against the bank. The concrete blocks which were placed along the water line facing Knotts Island Bay cannot slow or stop the erosion and flooding that is taking place when the blocks were laid down in 1994 to now. The bay low water mark is approximately one foot higher now. That leaves an average of 16" from the top of the block to the land level. This new bulkhead will extend the new height 8" (above grade) which matches the existing bulkhead on the property next to us on the north end. The bulkhead would extend from the property line on the north towards the property line to the south, facing Knotts Island Bay. Starting on the north end, concrete blocks were placed against the erosion escarpment at that time in 1994. Two separate sections with a total of 155 blocks 15 %:" high x 27" wide by 48" long, were placed. Water builds up in the marsh and flows out onto our grass land. In order to stop this, the retaining wall would be 12" above ground level. This area of land has been determined by the USACE visit on 7/28/2016 to be a USACE 404-wetland area that extends 30' landward of the tree/brush line where the retaining wall is proposed. The wall will be constructed 24" from the vegetation line and would be a total of -270' including a 30' section along the shoreline. The pier will start at the new bulkhead, 125' from the north en&n pperbi line into Knotts Island Bay. 1TEUE Y Ep All salt treated wood -2.5 CCA OCT 17 2016 All bolts, nuts, washers, tie rod's - Hot dip galvanized All nails -16 D galvanized DCM- MHD CITY Note: Narrative revised by staff to reflect corrected calculations and project changes as approved by Charles Holden on 101612016 DO MP-1 APPLICATION for Receive Major Development Permit SEP 20 2016 (last revised 12/27106) ®CM -EC North Carolina DIVISION OF COASTAL MANAGEMENT 1. The property is made up of two adjacent Lots that total ±431,182 ft2 (t9.9 acres) in area. The majority of the sites elevation is 51.5' above Normal Water Level (NWL) but it does have areas of t24 above NWL located within the northwest area of the property. There is a distinct tree/brush line that separates wooded wetlands from a mowed t30' wide wetland area. Based on available information, there appears to be no archaeological sites on this property or nearby The site has t746.5' of shoreline adjacent to Knotts Island Bay and t543.5' within a canal for a total shoreline length of t1,290'. An overgrown, shallow ditch/canal runs along the northern property line. A concrete block bulkhead that was backfilled with gravel begins at the mouth of this ditch and follows the shoreline contour southward for t446.5' where it ends at the mouth of the canal. The canal extends in a westward direction and is t270' long x 45' wide with an unhardened shoreline. A culvert exits at the end of the canal that provides water transfer to 404-wetlands. The concrete block bulkhead begins again on the south side of the canal mouth and continues an additional t180'. The remaining t120' of shoreline is unhardened and adjacent to both a non -wetland area and a 404-wetland area. A t90' diameter man-made pond is located t100' north of the canal mouth adjacent to the shoreline. This pond is not connected to Knotts Island Bay, but does have wetland plants such as cattails and arrowhead growing within it. The concrete blocks have sunk into the substrate since installation (indicated as 1994) 1-16" below the adjacent ground elevation and NWL is now an average of 4' landward of the blocks. An erosion escarpment that ranges from t0.5' to 1' is located an average of 8' landward of the blocks. A t6' wide area of gravel is located on the waterward side of the concrete blocks due to being displaced through wave action. The shoreline of the canal and the remaining shoreline south of the concrete block bulkhead has an erosion escarpment that is t1 to 2' in height and NWL is located at the escarpment. The adjacent property to the north is a large tract that has a single-family dwelling, storage sheds, a bulkheaded shoreline and a t200' pier with several slips. The adjacent property to the south is undeveloped USACE 404-wetlands. RECEIVED OCT 17 2016 DCM- MHD CITY l Charles & Carol Holden Field Investigation Report Page 3 The waters of the Knotts Island Bay are classified as SC by the Environmental Management Commission and are not open to shellfish taking. Along the unhardened canal shoreline (±543.5') and unhardened shoreline adjacent to Knotts Island Bay (±60'), the bulkhead will be installed :52' waterward of NWL. The proposed bulkhead along Knotts Island Bay will transition to a retaining wall for±30' along a USACE 404-wetlands shoreline and then extend landward through the wetlands for 240' staying 2' off of the tree/brush line. To provide water access and docking, the applicant proposes to construct a 180'x6' pier with a 20'x20' platform ±125' south of the northern property line. Two 17'xl' finger piers and a 10'xl' finger pier will be installed on each side of the pier and platform to create four formalized slips. The proposed docking facility will not encroach within the 15' setback an"GffPJE*0h rule. Water depths within the proposed slips are >2' below NWL. Anticipated Impacts OCT 17 2016 • The construction of the bulkhead and ri ra along the proposed ali rTrt3 IIHD CITY riprap g p p g r wl result in the filling of ±4,098 ft2 of Estuarine Waters and Public Trust Area AEC's with clean fill from an upland source. • The construction of the bulkhead along the proposed alignment will result in the filling of ±2,506 ft2 of Estuarine Shoreline AEC. C" Charles & Carol Holden Field Investigation Report Page 4 • The construction of the bulkhead along the proposed alignment will result in the placement of ±341 cubic yards of fill material below NWL. • The construction of the retaining wall along the proposed alignment will result in the disturbance of ±2,160 ft2 of USACE 404-wetlands. • The proposed docking facility will result in the shading of approximately ±1,568 ft2 of Estuarine Waters and Public Trust Area AEC's . The proposed docking facility create 4 formalized slips in water depths that are >_2' below NWL. • It is not anticipated that the proposed docking facility will have any negative impacts to navigation.
