Lumina Ave., Wrightsville Beach, NC 28480 Authorizing development in New Hanover County at Banks Channel, 401 N. Lumina Ave. Wrightsville Beach , as requested in the permittee's application dated 11/19/15 (MP-11 and 2/3/16 (MP-4), incl. attached workplan drawings (2), 1-2 of 2, Sheet I dated 9/5/15 and Sheet 2 dated 9/15/15. This permit, issued on April 7, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Dockine Facility 1) This permit authorizes boat lift and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Joe & Patricia Green ADDITIONAL CONDITIONS Permit No. 42-16 Page 2 of 2 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes one additional boat slip, for a maximum of 3 formalized boat slips. 6) Should the adjacent property to the north be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: This pertnit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2016-00450), which was issued on 3/8/16. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 16-0174. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. NOTE: An application processing fee of $250 was received by DCM for this project. (not calculated due to dimension) Existing covered platform = 20' x 10' = 200 sq. ft. (access credit through platform included) Total = 200 sq. ft. The expansion would provide docking space for the total up to three (3) vessels at this location. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the %width rule, the eight square foot rule and the pier width rule. The proposed structure would be located entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include standard conditions for private docking facilities. The applicant proposes to expand an existing private docking facility within Banks Channel. The project is located at 401 N. Lumina Avenue in Wrightsville Beach, New Hanover County. Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PTA. Waters at the project site are classified as SB and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2005 Town of Wrightsville Beach Land Use Plan and offer the following comments. The general area of the project is classified Developed, while the AECs impacted by the work are classified as Conservation/Resource Protection. In general, the Town of Wrightsville Beach allows development in Conservation/Resource Protection classified AECs which is consistent with the State's minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some policies, which exceed the State's minimum use standards including those for piers and marinas. However, none of these more restrictive policies seem to be applicable to this project. This project appears to be consistent with the Town of Wrightsville Beach Land Use Plan. Lumina Ave., adjacent to Banks Channel, between the Atlantic Ocean and Greenville Sound. The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property travel east on Eastwood Road (N.C. HWY 74) from Military Cut -Off Road for approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (N.C. HWY 74) approximately 1 mile and proceed to cross the bridge over Banks Channel. Veer left at the light onto N. Lumina and continue to travel north approximately 0.25 miles until you reach the property of interest, which will be on the left hand side. The applicant currently maintains a two-story single family residence on the project site. The property is adjacent to residential properties with existing single family structures and private docking facilities. Highground vegetation consists of ornamental landscaping. The lot is approximately 0.12 acres in size and has an average elevation of approximately 4' above normal high water (NHW). The project site has approximately 52 linear feet of shoreline frontage stabilized by an existing timber retaining wall, which is landward of NHW. There are no coastal wetlands currently located on the property. Waterward of the NHW boundary in this area is an intertidal strip of sand, which is approximately 60' in width (see Sheet 1 of 2). The applicant currently maintains an existing docking facility within Banks Channel. An access pier, measuring approximately 154' in length by 6' in width extends in a westerly direction from the existing retaining wall. The pier terminates onto a covered platform, measuring approximately 20' in length by 16' in width, which is oriented towards the south creating an "L-shaped" configuration. An access ramp leadsfrom the platform onto a floating dock, measuring approximately 32' in length by 6' in width, which runs in the same alignment as the access pier. The existing facility was authorized to the property owner through CAMA General Permit No. 57507-D on September 16, 2011. The existing docking facility currently accommodates up to two (2) vessels. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of project site as Conservation. There are no known archaeological sites located in the project vicinity. The waters of Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to expand an existing private docking facility within Banks Channel. A new boatlift, measuring approximately 13' in length by 13' in width would be constructed on the northern side of the most waterward end of the existing access pier, located just landward of the existing covered platform. The application states that the existing water depth in the location of the proposed structure would be approximately -4' at normal low water (NLW). The proposed expansion of the existing docking facility would accommodate up to three (3) slips at this location (see Sheets 1 and 2 of 2). 10. ANTICIPATED IMPACTS: The proposed structure would incorporate an additional 169 sq. ft. of Estuarine Waters and Public Trust Areas. The proposed structure would encroach into the adjacent 15' Riparian Corridor Setback Area requirement to the north; however, the applicant has obtained a waiverfrom the property ownerto the north (Tillery). The proposed structure would extend approximately 145' into a waterbody, which measures approximately 1,000' across.
