Authorizing development in New Hanover County adj. to Banks Channel, at 21 Sandy Point,
Wilmington , as requested in the petmittee's application letter dated, incl. attached
workplan drawing (1), labeled 2 of 2, dated 3/12/18.
This permit, issued on May 10, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) Unless specifically altered herein, this Minor Modification authorizes the reconfiguration of the
permitted docking facility, all as expressly and specifically set forth in the modification request and in
the original permit application. No other structure, whether floating or stationary, shall become a
permanent part of this docking facility without permit modification. No non -water dependent uses of
structures shall be conducted on, in or over Public Trust waters without permit modification.
2) This Minor Modification hereby deletes Condition No. 6 of the original permit.

This permit action may be appealed by the petmittee or other Signed by the authority of the Secretary of DEQ and the
qualified persons within twenty (20) days of the issuing date. Chairman of the Coastal Resources Commission.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) Should the adjacent property to the south be sold prior to the initiation of construction of the structures
authorized by this Minor Modification, the permittee shall be required to obtain a signed riparian corridor
waiver from the new property owner prior to the placement of any structures within the 15 foot riparian
corridor.
4) This Minor Modification authorizes a maximum of 4 formalized boat slips.
5) This Minor Modification shall be attached to the original permit No. 26-16, which was issued to the
permittee on 2/22/16, and copies of both documents shall be readily available on site when Division
personnel inspect the project for compliance.
6) All conditions and stipulations of the active permit remain in force under this Minor Modification, unless
specifically altered herein.
7) The pemuttee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain.any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2016-00150), which was issued on 1/26/16.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR No. 2016-0059.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: A minor modification processing fee of $100 was received by DCM for this project.

Dear Ms. Goldenberg:
Through coordination with the North Carolina Division of Coastal Management, we have
teamed of your request to modify your existing Department of the Army (DA) permit, issued on
January 26, 2016. Your recent request involves the reconfiguration and replacement of the
authorized floating docks on the south side of the fixed pier, and installation of a new boat Iift in
an existing slip, reducing the square footage of the platform area from 260sf to 204s£ This
project is located at 21 Sandy Point, Figure 8 Island, adjacent to Banks Channel and Middle
Sound, in Wilmington, New Hanover County, North Carolina. Coordinates are: 34.26732 N,
-77.75256 W.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 197800056 (copy enclosed). The permit is hereby modified. It is understood that all
other conditions of your permit remain applicable.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified. Your Department of the Army permit will expire on December 31, 2021.

SUBJECT Permit Modification Request to State Permit No. 26.16, Fredericka Goldenberg, 21 Sandy Point, Figure
Eight Island, near Wilmington, in New Hanover County
Mr. Ed Flynn, acting agent for Fredericka Goldenberg, is requesting a Minor Modification to State Permit No. 26-16, for
the reconfiguration and replacement of the authorized floating docks on the south side of the fixed pier, and installation
of a new boat lift in an existing slip. The request states that the slip count of the facility will not change, and that the
platform area will be reduced from 260 ft2 to 204 ft2 (see Sheet 2 of 2). The proposed modifications will encroach into
the 15' riparian corridor setback area to the south (Newcomb) for which a waiver has been obtained.
State Permit No. 26-16 was originally issued February 22, 2016 for construction of a docking facility adjacent to Banks
Channel on Figure Eight Island. This permit is currently due to expire on December 31, 2019.
This office has no objection to the modification of State Permit No. 26-16. Mr. Flynn has submitted a check (check No.
6951) in the fee amount of $100.
By copy of this memo, DCM is requesting that the USACE, DWR, DCM-Fisheries, and the LPO provide any
comments that your agency may have on the proposed project to Heather Coats of DCM's Wilmington office
within 14 days of receipt of this memo.

The enclosed application is to request a minor modification to CAMA Major
Permit Number 26-16, issued to Fredericka Goldenberg, 21 Sandy Point,
Wilmington, N. C. 28411, on February 22, 2016.
The request is to modify the existing docking arrangement on the left side
of the fixed pier by turning the docks/boatlift 90 degrees so that access is
coming straight in off the channel rather than from the side which requires
the vessel to have to utilize the riparian area of the adjacent neighbor.
There are currently three sips, which will remain the some, a boatlift will be
installed in the slip adjacent to the fixed pier and the square footage of the
floating docks will be reduced from 260 sq. ft. to 204 sq. ft.
The new dock arrangement will not extend any closer to the riparian line as
the existing docks/boatlift.
