No, non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without.perrnitmodification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconstructed docking facility. Any sewage discharge at the ieconstructed docking facility shall be considered a violation of ihis.permit for which the permittee-.is responsible. This prohibition shall be applied and enforced throughout the.entire existence of the permitted structure. (See attached, sheet. for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the. issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. (72 sq. ft. not calculated for access credit) Proposed floating dock = 12 ft. x 24 ft. = 288 sq. ft. Total = 360 sq. ft. The docking facility would provide docking space for up to four (4) vessels at this location. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the eight square foot rule and the pier width rule. Specifically, the project is consistent with the use standards set forth in NCAC 07H .0208(b)(6)(G)(iii) due to the official pier head line established by the Town of Wrightsville Beach and would not exceed the 1/3 width nor extend farther waterward than the adjacent structures. The proposed structures would be located entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include standard permit conditions for docking facilities. This project is consistent withthe 2005:Wrightsville BeachXii, USe'Plan no The applicant proposes to replace an existing private docking facility within Banks Channel. The project is located at 13 Bahama Drive in Wrightsville Beach, New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT. Waters at the project site are classified as SB and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2005 Town of Wrightsville Beach Land Use Plan and offer the following comments. The general area of the project is classified Developed, while the AECs impacted by the work are classified as Conservation/Resource Protection. In general, the Town of Wrightsville Beach allows development in Conservation/Resource Protection classified AECs which is consistent with the State's minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some policies, which exceed the State's minimum use standards including those for piers and marinas. PROJECT DESCRIPTION The project site is located at 13 Bahama Drive in the Town of Wrightsville Beach, adjacent to Banks Channel, in New Hanover County. To locate the project site from the WiRO take US Hwy 74/76 to Wrightsville Beach. Travel across the drawbridge and keep left on West Salisbury Street/US 74. Turn left on North Lumina at the stoplight and travel approximately 0.3 miles to Parmele Blvd. and turn left. Take the first left onto Bermuda Drive and the second right onto Bahama Drive. The property of interest will be located on the left. The project site is approximately 0.14 acres in size, which the applicant currently maintains a single-family residence. The highground is vegetated primarily with maintained lawn grass and ornamental landscaping. The project site has approximately 62 linear feet of shoreline frontage along Banks Channel, which is stabilized by a timber bulkhead and Normal High Water (NHW) meets the bulkhead. There are currently no coastal wetlands along the applicant's shoreline. The applicant also maintains a private docking facility, which consists of a fixed uncovered platform, measuring approximately 14' in length by 12' in width, which is located just waterward of the existing bulkhead. An access pier, measuring approximately 65' in length by 6' in width extends towards the west into the canal. An access ramp leads to an existing floating dock, measuring approximately 24' in length by 12' in width, which runs parallel to the shoreline and canal. The application states the existing water depths within the existing docking facility range from approximately -4.0' to -5.0' at normal low water (NLW). DCM was not able to locate a previous permit for the existing facility; however, based on historical aerial photography the existing docking facility appears to have been in place since the 1980's (See Sheet 1 of 2 and Project Narrative). The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground portion of the property as Conservation. The waters of Banks Channel and Middle Sound are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to replace an existing private docking facility within Banks Channel. Once the existing docking facility is entirely removed, the applicant states that the new docking facility would be re -built within the same dimensions of the existing docking facility, aforementioned. The application states the associated pilings for the new floating dock would be installed to allow dockage on all sides, which would provide docking space for up to four (4) vessels within existing water depths ranging from approximately -4.0' to -5.0' at NLW (See Sheets 1 and 2 of 2 and Project Narrative). 10. ANTICIPATED IMPACTS The proposed structures would incorporate approximately 846 sq. ft. of Estuarine Waters and Pubic Trust Area, essentially within an area currently usurped by the existing docking. The proposed structures would extend approximately 102' into a waterbody, which measures approximately 341' across. This distance exceeds the quarter width of the waterbody, however it does not exceed the established pierhead alignment nor the Town of Wrightsville Beach pierhead line and in fact the proposed structures would be located approximately 2' to 14' more landward that the adjacent docking facilities. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement and would accommodate up to four (4) vessels within water depths ranging from approximately -4.0' to -5.0' at NLW.
