1) This permit authorizes only the reconstracted,docks, piers, and;other structures and uses located in or
over the: water thatare,expressly andspecrfically.set forth in the permit application. No other
structure; whether floating or; stationary, shall ecome a permanentpart of this;reconstructed docking 1
facility without permit modification. No, non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without.perrnitmodification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconstructed docking facility. Any sewage discharge at the ieconstructed docking facility shall be
considered a violation of ihis.permit for which the permittee-.is responsible. This prohibition shall be
applied and enforced throughout the.entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the. issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.

3) The, permittee, shall:maintain the authorized,worMn•good condition and in conformance with;the terms
and conditions of this permit. The permittee is not relieved of, this requirement if he/she abandons the
permitted activity without having it transferre ,6 a.third party.
4) The permittee shall install and maintain athi§•expense any signal lights or signals prescribed bythe U.S.
Coast,Guard, through regulation or otherwise, on,the authorized facilities. At a -minimum, permanent
reflectors shall be attached.to the structure in. order to make'4more•visible during'hours:ofdarkness or
inclement weather.
5)This permit authorizesa maximum of 4 formalized boat'slips.
6) The reconstructed pier and associated structures.shall have a minimum setback distance of 15 feet
between any parts of.the structure and the adjacent property owner's riparian access corridor.
7) The authorized structures and associated activity.shall not exceed the established Wrightsville Beach pier
headline.
8) No attempt shall be. made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the•authorized work.
General
9) The permittee and/or his other contractor shall meet with a.representative of the.Division prior to..
project initiation.
10) This permit does not authorize the interference with any existing or proposed Federal project, and the
pen ittee•shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future,operatioris undertakeri by the'United States in the,public
interest.
11) No excavation or filling of any open water area or vegetated"wetlands is authorized by this permit.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizati ohs, that maybe required.
NOTE: The U:S. Army Corps of Engineers authorizedthe proposed project by way of General.Permit
197809M (Action ID No. SAW-2016-00637), which was issued on 3110/16.

The total area of floating dock and platform was calculated as follows:
Shoreline length = 62 ft. x 8 ft. = 496 sq. ft. allowable
Proposed uncovered platform = 12 ft. x 6 ft. = 72 sq. ft. (72 sq. ft. not calculated for access credit)
Proposed floating dock = 12 ft. x 24 ft. = 288 sq. ft.
Total = 360 sq. ft.
The docking facility would provide docking space for up to four (4) vessels at this location. It appears that the
project is consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the eight square foot
rule and the pier width rule. Specifically, the project is consistent with the use standards set forth in NCAC
07H .0208(b)(6)(G)(iii) due to the official pier head line established by the Town of Wrightsville Beach and
would not exceed the 1/3 width nor extend farther waterward than the adjacent structures. The proposed
structures would be located entirely over open water. If the project is determined to be consistent with NCAC
07H .0208(b) and (6), it is recommended that any permit issued should include standard permit conditions for
docking facilities.

This project is consistent withthe 2005:Wrightsville BeachXii, USe'Plan no
The applicant proposes to replace an existing private docking facility within Banks
Channel. The project is located at 13 Bahama Drive in Wrightsville Beach, New
Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Town of Wrightsville Beach
Land Use Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation/Resource Protection.
In general, the Town of Wrightsville Beach allows development in
Conservation/Resource Protection classified AECs which is consistent with the State's
minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some
policies, which exceed the State's minimum use standards including those for piers and
marinas. However, none of these more restrictive policies seem to be applicable to this
project.
This project is consistent with the 2005 Town of Wrightsville Beach Land Use Plan.

You have our approval, in accordance with the attached conditions to replace an existing private
docking facility as described in your application received by the N.C. Division of Water Resources
(DWR) on March 25, 2016. After reviewing your application, we have decided that the impacts are
below the threshold for written authorization as long as all conditions of General Water Quality
Certification Number 3900 (GC3900) is met. This certification may also be viewed on our website at
http://vortal.nedenr.org/web/wg/sw-p/ws/401/certsandpemuts.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.
Conditions of Certification:
1. Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to return
the attached Certificate of Completion to the 401/Wetlands Unit, North Carolina Division of
Water Resources, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
If you do not accept any of the conditions of this Certification (associated with the approved
wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative

On January 1, 2011, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general and special conditions.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to

Ydur proposal continues to be consistent with the provisions and objectives of general

If any change iri your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization

On March 25, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and
Land Resources received a copy of the LAMA Major Permit Application for the subject project.
Staff review of the plans and specifications on April 28, 2016 has determined that the
development activities proposed at this time will not pose a threat to surface water quality from
stormwater runoff. The Director has determined that projects that are reviewed and approved by
the Division as not posing a,water quality threat from stormwater runoff should not be subject to
the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater
rules. By copy of this letter, we are informing you that this project will not require a stormwater
management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater
runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES)
stormwater discharge requirements. You are required to have an NPDES permit for stormwater
discharge from projects meeting these criteria. All temporary built -upon area associated with the
construction of the project must be removed within 30 days of completion of the project, or when
it is no longer needed, whichever occurs first.

9. PROJECT DESCRIPTION
The project site is located at 13 Bahama Drive in the Town of Wrightsville Beach, adjacent to Banks Channel,
in New Hanover County. To locate the project site from the WiRO take US Hwy 74/76 to Wrightsville Beach.
Travel across the drawbridge and keep left on West Salisbury Street/US 74. Turn left on North Lumina at the
stoplight and travel approximately 0.3 miles to Parmele Blvd. and turn left. Take the first left onto Bermuda
Drive and the second right onto Bahama Drive. The property of interest will be located on the left.
The project site is approximately 0.14 acres in size, which the applicant currently maintains a single-family
residence. The highground is vegetated primarily with maintained lawn grass and ornamental landscaping.
The project site has approximately 62 linear feet of shoreline frontage along Banks Channel, which is stabilized
by a timber bulkhead and Normal High Water (NHW) meets the bulkhead. There are currently no coastal
wetlands along the applicant's shoreline. The applicant also maintains a private docking facility, which consists
of a fixed uncovered platform, measuring approximately 14' in length by 12' in width, which is located just
waterward of the existing bulkhead. An access pier, measuring approximately 65' in length by 6' in width
extends towards the west into the canal. An access ramp leads to an existing floating dock, measuring
approximately 24' in length by 12' in width, which runs parallel to the shoreline and canal. The application
states the existing water depths within the existing docking facility range from approximately -4.0' to -5.0' at
normal low water (NLW). DCM was not able to locate a previous permit for the existing facility; however,
based on historical aerial photography the existing docking facility appears to have been in place since the
1980's (See Sheet 1 of 2 and Project Narrative).
The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground portion of the
property as Conservation. The waters of Banks Channel and Middle Sound are classified SB by the Division of
Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine
Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to replace an existing private docking facility within Banks Channel. Once the existing
docking facility is entirely removed, the applicant states that the new docking facility would be re -built within the
same dimensions of the existing docking facility, aforementioned. The application states the associated pilings
for the new floating dock would be installed to allow dockage on all sides, which would provide docking space
for up to four (4) vessels within existing water depths ranging from approximately -4.0' to -5.0' at NLW (See
Sheets 1 and 2 of 2 and Project Narrative).
10. ANTICIPATED IMPACTS
The proposed structures would incorporate approximately 846 sq. ft. of Estuarine Waters and Pubic Trust
Area, essentially within an area currently usurped by the existing docking. The proposed structures would
extend approximately 102' into a waterbody, which measures approximately 341' across. This distance
exceeds the quarter width of the waterbody, however it does not exceed the established pierhead alignment
nor the Town of Wrightsville Beach pierhead line and in fact the proposed structures would be located
approximately 2' to 14' more landward that the adjacent docking facilities. The proposed structures would not
encroach into the adjacent 15' Riparian Corridor Setback Area requirement and would accommodate up to four
(4) vessels within water depths ranging from approximately -4.0' to -5.0' at NLW. Minor increases in turbidity

period is provided by law when such time is necessary to complete the review. If you have not been noted of a final
action by the initial deadline stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from March 15, 2016 you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will
be held within five working days from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for a development permits
in Areas of Environmental Concern as designated under the CAMA: On March 11, 2016,
Tom Tomlinson proposed to replace a failing bulkhead at 304 Gull Rd, adjacent to Old
Topsail Creek, in Hampstead, Pender County, and on March 15, 2016, Nancy Gerald
proposed to expand an existing docking facility at 13 Bahama Dr., adjacent to Banks
Channel, in Wrightsville Beach, New Hanover County. Copies of the applications can be
examined or copied at the office of Jason Dail (PN Co.), or Robb Mairs (NH Co.), N.C. Dept. of
Environmental Quality, Division of Coastal Management, 127 Cardinal Drive Ext., Wilmington,
NC 28405, (910-796-7215) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to April 15, 2016 will be considered
in making the permit decision. Later comments will be accepted and considered up to the time
of permit decision. Project modification may occur based on review and comment by the public
and state and federal agencies. Notice of the permit decision in these matters will be provided
upon written request.
