This decision is based on my findings that your request violates NCGS 113A-120(a)(8) which requires that all applications be denied which are inconsistent with CAMA guidelines and Local Land Use Plans. You have applied to construct a single family residence with a uncovered deck, stormwater retention containment drain system and gravel driveway, which is inconsistent with 15 NCAC 7H. 0209(d)(10) the development shall be located a distance of 30 feet landward of the normal water level. The development is inconsistent with or 15A NCAC 07H .0209(d)(10)(F) & (J) no existing waterfront residential structure that encroaches into the buffer is within 100 feet of the center of the lot. Also more than 200 square feet of decking is proposed within the 30 foot buffer. Your application is also inconsistent with our Local Land Use Plan. On page 42 & 43 of the Land Use Plan, you will find that chapter 4.1. which reads in part, that CAMA has established a permitting program that is not to stop development, but rather to ensure the compatibility of development with continued productivity and value of critical land , waters and natural resources. Section 4.1.A.2 Estuarine Shoreline includes chapter 15A NCAC 71-1.0209 OF THE Coastal Area Management Act.
