This permit, issued on June 2, 2016 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Urban Waterfront Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the boardwalk, sidewalk, and parking lot and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee City of Elizabeth City ADDITIONAL CONDITIONS Bulkhead & Riprap — Shoreline Stabilization Permit No. 57-16• Page 2 of 4 2) The alignment of the authorized bulkhead and riprap shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 3)' The bulkhead shall be constructed prior to any backfrlling activities. 4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. `:5) The backfill material shall be clean and free of any pollutants except in trace quantities. 6), All backfill material shall be obtained from a high ground source and confined behind the permitted ¢` bulkhead. d , - 7) The riprap material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the site by wave'or current action. Y '8) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 19)' ' No excavation, or other land disturbing activities, is permitted except for that which may be required for a . the construction of the bulkhead wall. ` Sedimentation and Erosion Control -10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.) i r Stormwater Management 1,1) The Division Energy, Mineral and Land Resources is currently reviewing a stormwater management plan permit application to determine if the proposed project is in compliance with North Carolina's P P PP P P P J P stormwater management rules. The permittee shall receive a Stormwater Management Permit, and provide a copy of this permit to DCM, prior to the initiation of any development activities authorized by this permit. Any violation of the permit approved by the DEMLR shall be considered a violation of this t CAMA permit. i-• Docking Facility `•12) This permit authorizes only the dock with finger piers and "T" head platform, fishing pier, floating dock, } kayak launch, and other structures and uses located in or over the water that are expressly and ` specifically set forth in the permit application. No other structure, whether floating or stationary, shall ' become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. Y. 1 ` t .k City of Elizabeth City ADDIITIONAL CONDITIONS Permit No. 57-16 Page 3 of 4 13) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 14) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 15) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make them more visible during hours of darkness or inclement weather. 16) This permit authorizes ten (10) formalized boat slips. No formalized boat slips are authorized at the fishing pier. 17) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 18) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. 19) This permit does not authorize the excavation or filling of any vegetated wetlands, even temporarily. 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written consent of the Division of Coastal Management. 21) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. NOTE: The Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned DWR Project No. 16-0336, which was issued on 4/8/16. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit 198000291 and has assigned the project Action Id. PROJECT NARRATIVE Received Coast Guard Park Elizabeth City, North Carolina DCM-EC March 7, 2016 The City of Elizabeth City is proposing to improve a site located on the Pasquotank River that they purchased in August 2014 to create a public waterfront park to be called Coast Guard Park. The site is approximately 26,065 sf according to topographic survey of the existing shoreline that was performed during October 2015, but only 24,659 sf based on a boundary survey performed by Edward T. Hyman, Jr. PLS which was based on the shoreline as it existed in September 2000. Only 1,146 sf of the site is located outside the 75' Area of Environmental Concern. As this boundary survey is the latest available, the boundary conflicting with the shoreline and existing bulkhead line are all shown on the design plans for the park. The changes in the shoreline are due to a combination of a vinyl sheet pile bulkhead that was installed by a previous owner and deterioration of the wooden bulkhead that was located along the north side of the site. The City obtained a CAMA Minor Permit that was issued on February 13, 2015 to perform demolition work on several buildings that occupied the site as well as structures over the water that were in poor condition. Building demolition was completed near the end of March 2015. One building was retained and improved. The remaining building covers 3,812 sf of the site and is located mostly within the 30' AEC. Also remaining is 1,080 sf of gravel drive which is located mostly within the 75' AEC. The square footage of buildings demolished on this site is 4,097 sf with 424 sf of that having been within the 30' AEC and only 383 sf having been outside the 75' AEC. Other existing site improvements include a water and sewer service to the remaining building which contains one restroom and site lighting that has been partially installed. The waterfront park will provide water access to the public. Site improvements will include construction of a parking lot, boardwalk, fishing pier, boat docks, a floating canoe/kayak launch and a floating crew boat launch and installation of shore stabilization using riprap and steel sheet pile bulkhead. The existing building will be utilized for storage and rental of canoes and kayaks and will provide the only available restroom facilities during hours of rental operation. A new steel sheet pile bulkhead will be installed along the northern shoreline where the existing bulkhead has completely deteriorated. Riprap will be installed to stabilize the southern shoreline adjacent to the existing building and on the eastern shoreline adjacent to a pier belonging to the College of the Albemarle. A 6' wide wooden boardwalk will follow the landward alignment of the existing and proposed bulkhead. An 8' wide fishing pier will extend from the boardwalk 78' into the river. Dockage is considered to be transient and will be limited to 24 hours. The 12' X 16' floating canoe/kayak launch will be connected to the western facing portion of the boardwalk by a hinged section and will include features to provide access in accordance with ADA requirements. The 6' wide 50' long floating crew boat pier will be anchored by attachment to piles along the boardwalk adjacent the north side of the building. A portion of the concrete sidewalk and a corner of the proposed asphalt will fall within the 30' AEC; however, the total proposed within the AEC is 404 square feet which is less than the 424 sf of building that was recently removed from within the AEC. Construction will include the use of equipment such as barge mounted cranes for pile installation and a backhoe and/or bulldozer for site grading and installation of stone for the parking lot and installation of the riprap. Rock material and asphalt will be delivered to the site using a dump truck and a paver will be utilized to spread the asphalt over the proposed parking lot. All piles for the bulkhead, docks and piers are to be driven or pushed in and will not be washed in. It is understood that installation of piles shall not be performed between February 15th and July 1 s' for the protection of fish spawning in the area. Stormwater runoff from the parking lot and concrete sidewalk across the front of the building will collected in an underground piped drainage system that will route the stormwater to the existing piped drainage system in Riverside Avenue. No stormwater treatment is required as the net increase in impervious coverage is only 1,048 square feet. This increase represents coverage equaling 6.52% of the pervious area existing prior to the demolition of the buildings removed last year. (25,065 sf land - 8,989 sf of building and gravel = 16,076 sf; 16,076 sf/1,048 sf = 6.52%) As development of this site will create a maximum land disturbance of only 0.52 acres, no erosion control permit is required for this site. Erosion control measures will be provided regardless of permit requirements to insure that there is no erosion or sedimentation that will impact off site properties, drainage patterns or adjacent waters. Construction plans to be provided to contractors for bidding will include protections such as silt fence along adjacent property lines, inlet protection for the two new drop inlets and the existing curb inlet in Riverside Avenue, a gravel construction entrance, and proper seeding and mulching of all disturbed earth. PROJECT SUMMARY: The applicant is proposing to develop a waterfront recreational site along the Pasquotank River in Elizabeth City. Site improvements will include a pier with 10 mooring facilities (slips), a kayak and canoe rental site and launch, a fishing pier, a boardwalk paralleling the shoreline, and new bulkheading and riprap for erosion control. City of Elizabeth City Field Investigation Report Page 2 Project Setting The applicant, The City of Elizabeth City, purchased the property in question at 708 Riverside Avenue in 2015 for a public park and water access. At the time of purchase there were four dilapidated buildings on the property, three derelict buildings over the water and a number of piers and docks in various stages of disrepair. The city removed over 10,000 square feet (sf) of structures from the water and approximately 5,177sf of structures from the land, as shown on the plans and the enclosed aerial photograph. A large amount of trash, debris and vessels were removed from the property and from in the water. Currently there is a mix of ballast stones, brick, concrete and metal debris along approximately 200' of the shoreline and the remaining 254' of shoreline has a bulkhead that was constructed by the previous owners in 2014. The waters within the project area are "Joint" and as such are Estuarine Waters. Water depths along the bulkhead are between -4' and -8'. Depths 78' offshore from the property are between -23' and -28'. There are no wetlands or submerged aquatic vegetation on or adjacent to the subject property. Vegetation on the property is limited to a small amount of weeds and domestic grasses. There are no known geologic formations or archaeological sites associated with the applicant's property. The property, as with much of the Elizabeth City's waterfront, has undetermined debris subsurface. The property consists of 24,659 sf (.56 acres) with 445' fronting on the Pasquotank River. The entire tract is located within the Flood Zone AE (Elevation 5). The property is partially zoned Industrial along the water and Central Business along the front access drive, and is designated as Urban Waterfront. Develooment Proposal The city proposes to construct the following: 1) A parking lot, and concrete walkway to access an existing building and a proposed boardwalk, 2) four light poles, 3) a 328' long boardwalk, 4) 10 slip dock with four finger piers and a "T" platform, 5) a floating dock, 6) a kayak launch, 7) a fishing pier, 8) riprap, 9) bulkhead, and, 10) landscaping. 1) Parking lot and concrete: The property consists of 24,659sf (.56ac), and of that 23,513sf falls within the 75' Area of Environmental Concern (AEC). To date the current owner has removed—5,177sf of Q impervious lot cover from the AEC under CAMA Minor Permit #2-13-2015A. Removal LLI U was undertaken in March of 2015. At the time of purchase, the property in question N 0 had a total of 8,989sf of impervious lot cover within the 75' AEC. To allow for the increased lot cover the applicant proposes to install a stormwater system to remove runoff from the parking lot will be collected in an underground drainage system and piped to an existing storm water drain on Riverside Avenue. The, proposed structures will be a minimum of 22 from the eastern riparian line. Neither proposed pier will be greater than 78'. The average water depth, at the end of the docking facility is — 24'. According to the application narrative, the proposed docking facility will be for the public to dock boats, kayak, canoe, and fish, I have reviewed the rules and would like to offer the following: 15A NCAC 07H .0208, USE STANDARDS (a) General Use Standards (3). (C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking; Consistent: NIA (D) A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls, Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not apply to marinas; Consistent: No boathouse proposed. (E) The total area enclosed by an individual boatlift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift; Consistent: No boatlifts proposed. (F) Piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use; Consistent: Single story proposed. (G) Pier and docking facility length shall be limited. Consistent: The length will not exceed the length of adjacent piers. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100 foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. Consistent: The piers will be less than 100'. (1) Piers and docking facilities shall not Interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. Consistent: The docking facility will be set back greater than the minimum 15, requirement, (J) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. Consistent: The pier location does not involve any shellfishing franchise. (7) Bulkheads: (A) Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level; City of Elizabeth City Recommendations Page 3 Consistent: Bulkhead shall be an average of 3.6' waterward of NWL. The alignment is the minimum necessary to repair a pocket eroded along the applicant's property. (B) Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources; Consistent: No wetlands. (C) Bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead; Consistent: Applicant will obtain backfill from a local high ground commercial source. (D) Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met; (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g, steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule; Consistent (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; Consistent: The hardship is the level of debris along the shoreline left by prior owners and a failure to maintain the property. The proposed alignment Is the minimum necessary to provide a straight bulkhead and establish a boardwalk and fishing pier access for the public. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; Consistent (III) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management; and, Consistent (v) the property to be bulkheaded is in a non -oceanfront area. Consistent (E) Where possible, sloping rip -rap, gabions, or vegetation shall be used rather than bulkheads. Consistent: Rlprap Is proposed in appropriate areas. 15A NCAC 07H .0209 COASTAL SHORELINES (9) Urban Waterfronts, (1) Description. Urban Waterfronts are waterfront areas, not adjacent to Outstanding Resource Waters, in the Coastal Shorelines category that lie within the corporate limits of any municipality duly chartered within the 20 coastal counties of the state. In determining whether an area is an urban waterfront, the following criteria shall be met as of the effective date of this Rule: (A) The area lies wholly within the corporate limits of a municipality; and, Consistent: Within City limits, (B) the area has a central business district or similar commercial zoning classification where there is minimal undeveloped land, mixed land uses, and urban level services such as water, sewer, streets, solid waste management, roads, police and fire protection, or in an area with an industrial or similar zoning classification adjacent to a central business district. Consistent: Commercial/Industrial with all city services. (2) Significance, Urban waterfronts are recognized as having cultural, historical and economic significance for many coastal municipalities. Maritime traditions and longstanding development patterns make these areas suitable for maintaining or promoting dense development along the City of Elizabeth City Recommendations Page 4 shore. With proper planning and stormwater management, these areas may continue to preserve local historical and aesthetic values while enhancing the economy. (3) Management Objectives. To provide for the continued cultural, historical, aesthetic and economic benefits of urban waterfronts. Activities such as in -fill development, reuse and redevelopment facilitate efficient use of already urbanized areas and reduce development pressure on surrounding areas, in an effort to minimize the adverse cumulative environmental effects on estuarine and ocean systems. While recognizing that opportunities to preserve buffers are limited in highly developed urban areas, they are encouraged where practical. Consistent: Redevelopment of a waterfront site involving considerable debris and derelict structure removal of the property and adjacent waters. (4) Use Standards; (A) The buffer requirement pursuant to Subparagraph (d)(10) of this Rule is not required for development within Urban Waterfronts that meets the following standards; (1) The development must be consistent with the locally adopted land use plan; Consistent: Providing public access. (ii) Impervious surfaces shall not exceed 30 percent of the AEC area of the lot. Impervious surfaces may exceed 30 percent if the applicant can effectively demonstrate, through a stormwater management system design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. The stormwater management system shall be designed by an individual who meets any North Carolina occupational licensing requirements for the type of system proposed and approved during the permit application process. Redevelopment of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible; and, Consistent: Drainage plan provided. (iii) The development shall meet all state stormwater management requirements as required by the NC Environmental Management Commission; Conditionally Consistent: Pending review. (B) Non -water dependent uses over estuarine waters, public trust waters and coastal wetlands may be allowed only within Urban Waterfronts as set out below. (i) Existing structures over coastal wetlands, estuarine waters or public trust areas may be used for commercial non -water dependent purposes provided that the structure promotes, fosters, enhances or accommodates public benefit. Commercial, non -water dependent uses shall be limited to restaurants and retail services. Residential uses, lodging and new parking areas shall be prohibited. (ii) For the purposes of this Rule, existing enclosed structures may be replaced and or expanded vertically provided that vertical expansion does not exceed the original footprint of the structure, is limited to one additional story over the life of the structure and is consistent with local requirements or limitations. Overview: The .56-acre subject property has approximately 455 linear feet of shoreline along the Pasquotank River. The site is minimally vegetated with weeds and domestic grasses. The site has an undetermined debris subsurface. The property is located within the AE Floodzone. Water depths adjacent to the property range from -4 feet to -8 feet and water depths 78 feet offshore range from -23 feet to -28 feet. A 3,812 sq. ft. metal building is currently located on the site. In March 2015, under CAMA Minor Permit #2-13-2015A, approximately 5,177 sq. ft. of impervious surface was removed as part of a site cleanup that also included the removal of over -water structures and in -water pilings. Approximately 254 linear feet of bulkhead is located along the shoreline. The remaining shoreline contains a mix of ballast stones, brick, concrete and metal debris. Site development will result in a 1,143 sq. ft. increase in impervious surface from the amount that existed before cleanup. To accommodate the increase, parking area stormwater runoff will be collected in an underground drainage system and piped to a stormwater drain on Riverside Avenue. The elevated boardwalk will be located along the shoreline and include two (2) stairs and a ramp. The pier with "T" head platform, finger piers and tie pilings will accommodate ten (10) boat slips. The floating dock will be used for canoe and small sailboat launching. Bulkhead will be installed an average of 3.63 and a maximum of 12 feet waterward of Normal Water Level (NWL). Riprap will be installed an average distance of 5.5 feet and a maximum of 8 feet waterward of NWL. The site will be utilized as a public waterfront park named Coast Guard Park. The existing metal building will include restrooms and canoe and kayak rental and storage. Restrooms will be open during the hours of rental operation. The city received Public Beach and Coastal Waterfront Access Grant Program funding in early 2014 for site acquisition and in early 2015 for over -water and in -water site cleanup and minor property improvements. The waters of the Pasquotank River in this area are classified as SC and Joint waters in this and are closed to shellfish harvesting. There is no Submerged Aquatic Vegetation (SAV) adjacent to the property. There are no known geological formations or archaeological resources associated with the property. Anticipated Impacts resulting from this project are expected to include: the filling of 1,030 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), .40 acre of Estuarine Shoreline AEC, and 1,146 sq. ft. of Uplands outside of an AEC, and; the shading of 2,898 sq. ft. of Public Trust Area/Estuarine Waters AEC and 2,026 sq. ft. of Estuarine Shoreline AEC. Basis for Determination: The Pasquotank County/Elizabeth City 2004 Land Use Plan identified the project site as "Downtown Mixed Use". As indicated on Page 165 of the Elizabeth City Future Land Use Plan Map (FLUPM), "Conservation/Open Space" areas include parks, coastal wetlands, estuarine waters, estuarine shoreline, public trust waters, and non -coastal '404' wetlands. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 708 Riverside Avenue along the Pasquotank River in Elizabeth City, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to develop a waterfront recreational site, including shoreline stabilization, piers, slips, kayak / canoe rental site and launch, boardwalk, upland park development, and parking. A scooping meeting was conducted on February 16, 2016 detailing the proposal. The Pasquotank River at this location is classified SC by the Envirommental Management Commission and is designated an anadromous fish spawning area (AFSA) by the NC Division of Marine Fisheries and NCWRC. The City of Elizabeth City proposes to develop a waterfront recreational site on the Pasquotank River that will include pier with 10 slips, a small craft rental site with kayak launch, a fishing pier, a boardwalk along the shoreline along with bulkhead and rip -rap. The Pasquotank River is designated by the Division of Marine Fisheries as an Anadromous Fish Spawning Area (AFSA) in the project area. This designation means the waterbody is vital to the spawning migration of anadromous fish such as herring and alewife. In order to reduce potential negative impacts to these species during their spawning migration it is recommended that this project adhere to an in -water work moratorium from Feb 15 —June 30.
