Any violation of these terms may -ct to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes the construction of the pier, platform, and floating dock, and uses located in or li over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Signature ofPermittee 'y Pet�yerponat ADDITIONAL CONDITIONS This permit authorizes a maximum of four (4) formalized boat slips Permit No. 77-16 Page 2 of 3 No portion of the authorized docking facility shall exceed one quarter the width of the water body as measured from the waterward edge of Coastal Wetlands on either side of the water body. Any portion of the permitted access pier built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts 4 of the structure and the adjacent property owner's riparian access corridor, which is determined by j; drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that 3 intersects with the shore at the point where the upland property line meets the water's edge. ' .17), No tie piles are authorized in association with the authorized docking facility. 8) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent ' reflectors shall be attached to the structures in order to make it more visible during hours of darkness or inclement weather. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 11) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with z T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Upland Development 1;2)- Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the gravel walkway, all as expressly and specifically set forth in the attached permit application and workplan drawings. Sedimentation and Erosion Control I3) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. I This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. .;18) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 19) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.izov/iie-es/maminal/niaiiatee guidelines.Ddf. 'NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Nationwide Permit 14 and General Permit 56 and assigned SAW 2016-01274. 1"", 'isibTE: The N.C. This intersection is known locally as Monkey Junction. Turn left onto Piner Road and travel approximately 1 mile east until you reach Myrtle Grove Road. The applicant is proposing to construct a gravel walkway with associated 404 wetlands impact and a private docking facility into Myrtle Grove Sound adjacent to the AIWW in New Hanover County. The project is located at 1525 Salty Bay Landing. Areas of Environmental Concern (AEC's) impacted by the proposal are C W, ORW, EW and PT. Waters at the project site are classified as SA-ORW and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover County Joint Land Use Plan and offer the following comments. The general area of the project is classified as Resource Protection. In general, Wilmington -New Hanover County allows development in Resource Protection classified AECs, which is consistent with the State's minimum use standards. The 2006 Wilmington -New Hanover County Joint Land Use Plan contains some policies, which exceed the State's minimum use standards, including those policies related to new dredging activities. Since this project is maintenance dredging and not new dredging, none of these standards appear to be applicable to this proposal.
