Docking Facility
1) This permit authorizes the construction of the pier, platform, and floating dock, and uses located in or
li over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit authorizes a maximum of four (4) formalized boat slips

No portion of the authorized docking facility shall exceed one quarter the width of the water body as
measured from the waterward edge of Coastal Wetlands on either side of the water body.
Any portion of the permitted access pier built over Coastal Wetlands shall not exceed six feet in width
and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of
the decking.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
4 of the structure and the adjacent property owner's riparian access corridor, which is determined by
j; drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
3 intersects with the shore at the point where the upland property line meets the water's edge.

8) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
' reflectors shall be attached to the structures in order to make it more visible during hours of darkness or
inclement weather.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
11) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
z T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
Upland Development
1;2)- Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the gravel walkway, all as
expressly and specifically set forth in the attached permit application and workplan drawings.
Sedimentation and Erosion Control
I3) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
I4) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property.

which may be caused from existing or future operations undertaken by the United States in the public
interest.
19) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

'NOTE:
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE:
The U.S. Army Corps of Engineers authorized the proposed project by way of Nationwide
Permit 14 and General Permit 56 and assigned SAW 2016-01274.

Quality Certification 3900 and assigned the project DWR Project No. 20160485.
• NOTE:
Future development of the permittee's property may require a modification of this permit.

such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

An application processing fee of $400 was received by DCM for this project. This fee also

If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
[phone] within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your

9. PROJECT DESCRIPTION:
The applicant's property is located at 1525 Salty Bay Landing in New Hanover County, adjacent to the AIWW and Myrtle Grove
Sound. To find the property one would travel south from Wilmington on South College Road (NC 132) to the intersection of South
College, Carolina Beach Road (NC 421) and Piner Road. This intersection is known locally as Monkey Junction. Turn left onto
Piner Road and travel approximately 1 mile east until you reach Myrtle Grove Road. Turn right onto Myrtle Grove Road and travel
south for approximately 1.65 miles until you reach Salty Bay Landing, which will be on the left. Turn onto Salty Bay Landing and
continue down the unimproved road until your reach the property of interest on the left.
The property is a residential lot approximately 1.0 acres and has an average elevation of approximately 8' above normal high water
(NHW). Outside of an existing gravel driveway and small timber shed, there are no existing structures on the applicant's property:
Highground vegetation consists of hardwoods and other woody species including: Oak, Pines, Cedar and Dogwood. Vegetation
bordering the eastern highground area of the property supports §404 and coastal wetlands vegetation including: Wax Myrtle
(Myrica cerifera L.), Marsh -elder (Iva frutescens), Grounsel-bush (Baccharis halimifolia), Sea Oxeye (Borrichia frutescens), Salt
Meadow Grass (Spartina patens) and Black Needlerush (Juncus roemarianus). The coastal wetlands transition to an area
consisting primarily of Smooth Cordgrass (Spartina alternillora) in an area approximately 380' in width. It appears through the
provided survey that the U.S. Army Corps of Engineers (USACE) has delineated the existing §404 wetlands on -site. The N.C.
Division of Coastal Management (NCDCM) flagged the coastal wetlands boundary on January 19, 2016 (see Sheet 3 of 3).
The property has approximately 100' offrontage along the AIWW and Myrtle Grove Sound, which the application states this section
of the waterbody measures approximately 1,400' across. Watenvard of the applicant's property is a natural channel, measuring
approximately 200' in width within Myrtle Grove Sound between the open water area and the AIWW channel. There is an existing
private pier located to the north of the applicant's property along the same shoreline, which is located to the edge of this natural
channel. There is a community marina basin and access channel to the AIWWto the south of the applicant's property (The Tides
HOA), which this natural channel connects to the access channel of this marina basin.
The currentjoint City of Wilmington and New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and
the adjacent high ground portion of the project area as Resource Protection. In the project area, the waters of Myrtle Grove Sound
are classified as SA-ORW by the NC Division of Water Resources, and they are CLOSED to the harvest of shellfish. These waters
are designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries.
PROPOSED PROJECT:
The applicant proposes to construct a gravel walkway with associated §404 Wetlands impact and a private docking facility into
Myrtle Grove Sound. The application states a gravel walkway, measuring approximately 200' in length by 9' in width would be
constructed along the most northern end of the property, which would be within jurisdictional §404 wetlands. The application
states the walkway would be to help facilitate the construction of the access pier to the proposed docking facility and to reduce the
cost of construction.
Once the gravel walkway reaches the upper limits of coastal wetlands, a fixed pier, measuring approximately 810' in length by 6' in
width would extend towards the east into Myrtle Grove Sound. The pier would then terminate onto a fixed platform, measuring
approximately 12' in length by 12' width, creating a "T-head" configuration. An access ramp would then lead onto a floating dock,
measuring approximately 40' in length by 9' in width, which would run in the same alignment as the access pier. Based on the
survey, the floating dock would be located at the edge of the natural channel within the -2.0' normal low water (NLW) contour. The
applicant states that the proposed docking facility would provide mooring for up to four (4) vessels. As proposed and per the
riparian survey, the proposed docking facilitywould be located within the established pier length to the north, within the applicant's
area of riparian access, would not encroach into the adjacent 15' riparian corridor setback area requirement, nor the natural
channel. The application states the proposed docking facility would not exceed the current 114 distance rule and would be
approximately 615' from the near edge of the 80' setback from the AIWW.
The application did not include proposed upland development plans for this property; however, the provided survey depicts a
proposed dwelling footprint, measuring approximately 60' x 70' (4,200 sq. ff.), which would be ap ximately 15% impervious area
within the 575' Area of Environmental Concern (AEC) and would be located landward oU�(iAeBuffer.

10. ANTICIPATED IMPACTS:
The proposed gravel walkway would result in the impact of approximately 1,800 sq. ft. of § 404 wetlands (0.04 acres), which would
be located between the highground and the access pier. The application states the walkway would be to help facilitate the
construction of the access pier to the proposed docking facility and to reduce the cost of construction. The proposed access pier
would shade approximately 2,940 sq. ft. of coastal wetlands would incorporate approximately 2,154 sq. ft. of Public Trust Area and
Estuarine Waters. As proposed, the applicant's proposal would not encroach into the 80' federal setback requirement from the
AIWW channel. Based on the provided riparian survey, the proposed structures would not encroach into the adjacent 15' riparian
corridor setback area requirement. The proposed structures would allowthe facility to accommodate up to four (4) vessels in water
depths of approximately -2.0' @ NLW. The proposed structures would extend approximately 340' into a waterbody, which
measures approximately 1,400' across. Based on the survey, the floating dockwould be located to the edge of the natural channel
at the -2.0' normal low water (NLW) contour. As proposed, the docking facility appears to not exceed the 1/4 width rule and the
established pier length, aforementioned. Minor increases in turbidity should be expected during construction; however, no long
term impacts are anticipated.

The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for development permits in
Areas of Environmental Concern as designated under the CAMA in Wilmington, New Hanover
County: On April 21, 2016, Dellaine Risley proposed to construct a private docking facility at
2010 Deep Creek Run, adjacent to Middle Sound and the AIWW, and on April 26, 2016 Peter
Donat proposed to construct a walkway and private docking facility at 1525 Salty Bay
Landing, adjacent to Myrtle Grove Sound and the AIWW. On May 5, 2016, Jim Jordan
proposed to construct a new bulkhead at the corner of E. Yacht Dr. and NE 161h St., adjacent
to the AIWW, in Oak Island, Brunswick County. The applications can be examined or copied at
the office of Robb Mairs (NH Co.) or Holley Snider (BR Co.), N.C. Dept. of Environmental
Quality, Division of Coastal Management, 127 Cardinal Drive Ext., Wilmington, NC 28405,

Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to June 3, 2016 will be considered in
making the permit decision. Later comments will be accepted and considered up to the time of
permit decision. Project modification may occur based on review and comment by the public

The Division of Coastal Management hereby acknowledges receipt of your application, through your
acting agent Mr. Trip Pippin, for the proposed development located at 1525 Salty Bay Landing, adjacent
to Myrtle Grove Sound/AIWW, near Wilmington, in New Hanover County. It was received as complete
on April 26, 2016 and appears to be adequate for processing at this time. The projected deadline for
making a decision is July 10, 2016. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those circumstances, this
letter will serve as your notice of an extended review. However, an additional letter will be provided on
or about the 75th day.
If this agency does not render a permit decision within 70 days from April 26, 2016 you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal
review agencies for their comments. If additional information is required based on this review, the
agencies may contact you directly.

The total area of platform and floating dock were calculated as follows:
Shoreline length =100 ft. x 8 sq. ft. = 800 sq. ft. allowable.
Platform =12' x 12'=144 sq. ft. (72 sq. ft. applied for credit)
Floating dock = 40' x 9' =360 so. ft.
Total = 432 sq. ft.
The construction of the docking facility would provide docking space for the total up to three (4) vessels. The proposed floating dock and
platform would be located entirely over open water and appears the docking facility would be CONSISTENT with NCAC 07H .0208(b)(6)(G).
As proposed, the docking facility would be located at the edge of the natural channel and would be CONSISTENT with NCAC 07H .0207.
This office has no objection to the proposed work, provided ft is consistent with state and federal permitting requirements regarding the fill of
§404 wetlands. If the project is determined to be consistent with 15A NCAC 07H .0209 COASTAL SHORELINES (d) and built in
accordance with NCAC 07H .0208(b)(6)(iii), this office has no objection to the proposed work, provided it is consistent with all other state
and federal permitting requirements. Any permit issued should include standard conditions for private docking facilities.

This project is consistent and not in conflict with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update.
The applicant is proposing to construct a gravel walkway with associated 404 wetlands
impact and a private docking facility into Myrtle Grove Sound adjacent to the AIWW in
New Hanover County. The project is located at 1525 Salty Bay Landing.
Areas of Environmental Concern (AEC's) impacted by the proposal are C W, ORW, EW
and PT. Waters at the project site are classified as SA-ORW and are not open to the
harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County Joint Land Use Plan and offer the following comments.
The general area of the project is classified as Resource Protection.
In general, Wilmington -New Hanover County allows development in Resource
Protection classified AECs, which is consistent with the State's minimum use standards.
The 2006 Wilmington -New Hanover County Joint Land Use Plan contains some policies,
which exceed the State's minimum use standards, including those policies related to new
dredging activities. Since this project is maintenance dredging and not new dredging,
none of these standards appear to be applicable to this proposal.
This projectappears to be consistent with the 200 Wilmington -New Hanover County
Joint Land Use Plan.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Donat,
You have our approval, in accordance with the attached conditions and those listed below, to
impact 0.04 acres of 404 wetlands in order to construct a private docking facility as described
within your application received by the Division on May 13, 2016. After reviewing your
application, we have decided that the impacts are covered by General Water Quality Certification
Number 3900 (GC3900).
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and
Sediment Control, Non -discharge, and stolmwater regulations. Also, this approval to proceed
with your proposed impacts or to conduct impacts to waters as depicted in your application shall
expire upon expiration of the 404 Permit. This Certification can also be found on line at:

This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and

The Additional Conditions of the Certification are:
This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you
change your proj ect, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must be
given a copy of this approval letter and General Certification and is responsible for complying
with all conditions. Any new owner must notify the Division and request the Certification be
issued in their name {15A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[15A NCAC 02H .0502 (b) and 15A NCAC 02H .0506 (4)] The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification, and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be
exceeded as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion
control practices must be used to meet this standard. Turbidity curtains shall be used as
appropriate. Please notify this Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific projectshall remain in effect for the life of the project,
regardless of the expiration of this Certification.
5. The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [15A
NCAC 02H 10507 (c) and 15A NCAC .02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a
manner consistent with State water quality standards (including any, requirements

All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington
Regional Office at 910.796.7215 and after hours and on weekends call [phone].
Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3), 15ANCAC 02B .0200 (3)(f), and GS 143 Article 21A].
8. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
9. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the,property
during normal business hours 15A NCAC 02H.0502(e).
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division of Water Resources, 1617

On May 13, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and Land
Resources received a copy of the CAMA Major Permit Application for the subject project. Staff
review of the plans and specifications on May 19, 2016 has determined that the development
activities proposed at this time will not pose a threat to surface water quality from stormwater
runoff. The Director has determined that projects that are reviewed and approved by the
Division as not posing a water quality threat from stormwater runoff should not be subject to the
stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules.
By copy of this letter, we are informing you that this project will not require a stormwater
management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater
runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES)
stormwater discharge requirements. You are required to have an NPDES permit for stormwater
discharge from projects meeting these criteria. All temporary built -upon area associated with the
construction of the project must be removed within 30 days of completion of the project, or when
it is no longer needed, whichever occurs first.

A North Carolina Division of Coastal Management (DCM)Fisheries Resource Specialist has reviewed the,
subject permit application for proposed actions that impact fish and fish habitats.' The applicant
proposes to. construct .a docking facility within surrounding waters classified as primary nursery area
(PNA), able to support shellfish (SA) and outstanding resource waters (ORW). Depths at the landward
end of the.floating dock was identified at -2ft at normal low water (NLW), which terminates at the edge .
of a'natural channel within. Myrtle,Grove'Sound.
In general terms, docking facilities have the potential to slow water movement which can increase
shoaling and reduce water depths. Due to the PNA designation it should be noted that I would object to
any future requests for dredging at this
