Expanded Docking Facility
This permit authorizes the addition of a floating dock and gangway, and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a -permanent part of this expanded docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
=2)' No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the reconfigured docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the

ADDITIONAL CONDITIONS
3) This permit authorizes a maximum of three (3) formalized boat slips.
14)_ " Should the property to the south be sold prior to the initiation of construction of the expanded docking
facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15-foot
riparian corridor setback and submit it to the Division of Coastal Management.
5)" The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6)'; ' The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structures in order to make it more visible during hours of darkness or
inclement weather.
'7)^,- No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
r waters at or adjacent to the authorized work.
General
-8) ; In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
10); No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
'14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3900 and assigned the project DWR Project No. 20161082.

such activity for this determination. The permittee is farther advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified
party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance
requires additional approval. Please read your permit carefully prior to starting work and review all project
plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that
he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

8. PROJECT SUMMARY:
The project proposed is to add a third slip and a 6' x 31' floating platform to an existing 2-
slip private docking facility.
9. Narrative Description
The Jason Davis project is located within "The Pond", which connects to Bogue Sound at
210 Pond Drive, Atlantic Beach, Carteret County. The project area is found by turning
right off of the Atlantic Beach Causeway onto Old Causeway Road. Follow Old Causeway

for approximately 1,088 feet and turn left onto Pond Drive. Continue on Pond Drive until

The high ground property adjacent to the project area has approximately 60 feet of
bulkheaded shoreline abutting a man-made basin (The Pond) and is an average elevation
of 3' above NHW. The high ground area currently has an existing 2-slip docking facility, a
single family home and bulkhead. It is covered with typical grasses and shrubbery. There
are no wetlands along the shoreline of this property.
The Town of Atlantic Beach Land Use Plan classifies this property as Residential Low
Density with all parts of the AEC classified Conservation. There are residential properties
to the north and south of the project area. "The Pond "is not designated as Primary Nursery
Area, is closed to the taking of shellfish and carries a classification of SA/HQW. The
existing basin has a width of approximately 700' within the project area, however there is
a shoaled area within the middle of the basin that designates the channel area and boating
route. Water depths are a range of 3.75' to 8.25' �at nlw depending on location. No shellfish
or SAV were observed within the project area. Riparian Access Lines are drawn 90
degrees from the channel of the basin and in this case could run as property line
extensions.
10. Project Description:
The current proposal is to add a third slip and a floating platform along the south side of
the existing 2-slip docking facility and property.
The applicant is proposing to install a third slip area (max boat length of 25') along the
South side of the existing 2-slip docking facility and a floating platform. The proposed
floating platform would abut the most southern riparian access line, would be located 6'
waterward of nhw (existing bulkhead) and would be accessed by a 3' x 12' gangway. The
floating platform dimensions would be 6' x 31' and would not exceed a maximum distance
of 37' waterward of the existing bulkhead due to the close proximity (12') of the channel.
The width of the existing basin is approximately 700 feet, however the existing shoaled
area within the middle of the basin designates the channel and navigation route, therefore
the piers along the basin area are limited in length. The proposed floating platform is
between longer piers within 200' of the applicant's property, would not be longer than the
established pier head length and would not exceed the 1/3 limitation of the water body
width (125'). The allowable distance from the bulkhead is a maximum of 42', however the
proposal is for a maximum 37' from nhw. The water depths within the slip area range from
-6.5' nlw to -8.25' nlw depending on location. A maximum of 480 square feet of platform
is allowed for this project. There is 277 sf existing with 183 sf proposed for a total of 460
sf.

11. Anticipated Impacts:
The floating platform placement would shade and incorporate 183 ft2 of open water area.
The water depths at nlw are adequate to prevent adverse impacts from turbidity. There
should be no undue interference to navigation from the floating platform due to the fact
that all proposed development would not exceed a maximum distance of 37' from the
existing bulkhead (nhw) and would be 12' landward of the existing channel edge and
would not accommodate boats larger than 25' in length.

The following are my comments and recommendations regarding the aforementioned proposal. The
proposal is for the addition of 1 new slip area (total of 3) and a 6' x 31' floating platform at the existing 2
slip private docking facility. The water depths within this area are-7.25'to -8.25' nlw within the new slip
area.
The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office
recommends the project be authorized as proposed on plats dated received 10/12/16 contingent upon
all applicable general conditions and the following standard conditions:
The floating platform should not exceed a maximum distance of 37' from normal high water
(bulkhead) due to the channel location (approximately 12' from the proposed platform).
No more than three slips (2 existing and 1 new) should be authorized.

Consistency Determination: The request is consistent with/not in conflict the Town of Atlantic Beach
Land Use Plan certified by the RC on July 24, 2008 and amended on March 25, 2010.
Overview: The project site is located at 210 Pond Drive., Atlantic Beach, Carteret County, North
Carolina. The applicant is adding a third slip and a 6' x 31' floating platform to an existing 2-slip private
docking facility. The property is located adjacent to a man-made basin known locally as "The Pond".
Existing site improvements include a driveway, single-family home, 2-slip docking facility, boat ramp,
and 60' of bullheaded shoreline. Vegetation on the parcel include typical grasses and shrubbery. There
are no wetlands along the shoreline of the property.
AECs involved include Estuarine Waters and Public Trust Area. "The Pond" carries a surface water
classification of SA (Shellfish Area) and HQW (High Quality Water). "The Pond" is not a Primary Nursery
Area, and is closed to the taking of shellfish. No shellfish resources or Submerged Aquatic Vegetation
(SAV) were observed at the project area. A review of archaeological resources was not provided.
Anticipated impacts resulting from the project include: the incorporation and shading of 182 ft2 of open
water. The water depths are adequate to prevent impacts from turbidity. There should be no
interference to navigation.
Basis for Determination:
The project is subject to the 2008 Town of Atlantic Beach Core Land Use Plan. The Town of Atlantic
Beach Future Land Use Map (FLUM) designates the site as a "Residential Low Density". The project
appears consistent with the Future Land Use designations.

time. The projected deadline for making a decision is 12/26/16. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 10/12/16, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request
and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing

8. PROJECT SUMMARY:
The project proposed is to add a third slip and a 6' x 31' floating platform to an existing 2-
slip private docking facility.
9. Narrative Description
The Jason Davis project is located within "The Pond", which connects to Bogue Sound at
210 Pond Drive, Atlantic Beach, Carteret County. The project area is found by turning
right off of the Atlantic Beach Causeway onto Old Causeway Road. Follow Old Causeway

for approximately 1,088 feet and turn left onto Pond Drive. Continue on Pond Drive until
you are almost at the road terminus. The property will be located on the right.
The high ground property adjacent to the project area has approximately 60 feet of
bulkheaded shoreline abutting a man-made basin (The Pond) and is an average elevation
of 3' above NHW. The high ground area currently has an existing 2-slip docking facility, a
single family home and bulkhead. It is covered with typical grasses and shrubbery. There
are no wetlands along the shoreline of this property.
The Town of Atlantic Beach Land Use Plan classifies this property as Residential Low
Density with all parts of the AEC classified Conservation. There are residential properties
to the north and south of the project area. "The Pond "is not designated as Primary Nursery
Area, is closed to the taking of shellfish and carries a classification of SA/HQW. The
existing basin has a width of approximately 700' within the project area, however there is
a shoaled area within the middle of the basin that designates the channel area and boating
route. Water depths are a range of 3.75' to 8.25"at nlw depending on location. No shellfish
or SAV were observed within the project area. Riparian Access Lines are drawn 90
degrees from the channel of the basin and in this case could run as property line
extensions.
10. Project Description:
The current proposal is to add a third slip and a floating platform along the south side of
the existing 2-slip docking facility and property.
The applicant is proposing to install a third slip area (max boat length of 25') along the
South side of the existing 2-slip docking facility and a floating platform. The proposed
floating platform would abut the most southern riparian access line, would be located 6'
waterward of nhw (existing bulkhead) and would be accessed by a 3' x 12' gangway. The
floating platform dimensions would be 6' x 31' and would not exceed a maximum distance
of 37' waterward of the existing bulkhead due to the close proximity (12') of the channel.
The width of the existing basin is approximately 700 feet, however the existing shoaled
area within the middle of the basin designates the channel and navigation route, therefore
the piers along the basin area are limited in length. The proposed floating platform is
between longer piers within 200' of the applicant's property, would not be longer than the
established pier head length and would not exceed the 1/3 limitation of the water body
width (125'). The allowable distance from the bulkhead is a maximum of 42', however the
proposal is for a maximum 37' from nhw. The water depths within the slip area range from
-6.5' nlw to -8.25' nlw depending on location. A maximum of 480 square feet of platform
is allowed for this project. There is 277 sf existing with 183 sf proposed for a total of 460
sf.

11. Anticipated Impacts:
The floating platform placement would shade and incorporate 183 ft2 of open water area.
The water depths at nlw are adequate to prevent adverse impacts from turbidity. There
should be no undue interference to navigation from the floating platform due to the fact
that all proposed development would not exceed a maximum distance of 37' from the
existing bulkhead (nhw) and would be 12' landward of the existing channel edge and
would not accommodate boats larger than 25' in length.
