This permit, issued on June 27, 2016 is subject to compliance with the application (where consistent .with the permit), all applicable regulations, special conditions and notes set forth below..Any violation of these terms may `be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. W 2)', This - qualifie Boat Basin Excavation Excavation shall not exceed -6 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. No excavation of vegetated wetlands is authorized by this permit in association with the excavation of the boat basin. Shoreline Stabilization The alignment of the permitted bulkhead shall be verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. (See attached sheets for Additional Conditions) xmit action may be appealea by me permittee or omi persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Permit No. 64-16 Page 2 of 3 The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. The fill material shall be clean and free of any pollutants except in trace quantities. Boathouse Facility This permit authorizes only the boathouse, 4' wide catwalk and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this boathouse facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the boathouse facility. Any sewage discharge at the boathouse facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent .. reflectors should be attached to the structure in order to make it more visible during hours of darkness or E inclement weather. l'• 40) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. i f 14 The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 12) ' No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters ator adjacent to the authorized work., F 13)_ This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. { Sedimentation and Erosion Control • 14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property. 3 # 15) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Earr & Nancy De Hoog Permit No. 64-16 Page 3 of 3 ADDITIONAL CONDITIONS 16) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 17) The temporary placement or double handling of excavated or fill materials within waters is not authorized. 18) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). 19) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written consent of the Division of Coastal Management. 20) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE:. The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit 198000291 and assigned the project Action ID No. SAW-2016-00908, which was issued on 6/27/16. -NOTE: The N.C. Division of Water Resources authorized the project by way of General Water Quality Certification 3900 and assigned the DWR Project No. 16-0471, which was issued on 5/27/16. NOTE: The permittee is advised that any development or land disturbing activity that is considered non - water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. L-- u c5 De Hoog Boat House We propose to build a boat house on Broad Creek according to the enclosed diagram. Also included in this permit is a fill area across the wetland to gain access to the higher elevation of land by the canal bank. It would be approximately 25' x 50'. This would give us access to the strip of land that we currently cannot access. The boathouse would go on the side of the canal and we would be digging out a small section of land that is high ground. This would allow us to build the boathouse we would like to have. My wife has had 8 spinal surgeries, and I would like to make the boathouse and boat wheelchair accessible in the event that she would have to use a wheelchair in the future. We would also like to build the boathouse with 4' wide catwalks for handicap access. Also by digging out this small strip of land we would not block more than % of the canal. The tract is an upland ridge developed with an access road off HWY 264 to two different shops, one of which has living quarters. Two different borrow ponds have been dug on the property to support the development of the property. A home is planned adjacent to the borrow pond and shop closest to the creek and bottomland swamp associated with Broad Creek. Broad Creek is channelized in this area with a highground spoil bank that filled wetlands leaving an area of wetlands between the upland ridge and spoil bank. The wetlands still drain and have a hydraulic surface connection to Broad Creek. The upland ridge is vegetated with various hardwoods and loblolly pines. The wetland between the ridge and spoil bank is vegetated with wax myrtle, red cedar, sweet gum and tupelo gum. The spoil bank is vegetated mainly with loblolly pines. Water depth in the creek range from minus 8' below the normal water level (NWL) in the center to minus 4' at the bank. The creek has an average width of 71' in the project location. Broad Creek at this location is classified as Inland Waters by the Wildlife Resources Commission and SC NSW by the Environmental Management Commission. Broad Creek is closed to shellfishing. Project Description The applicant proposes to develop small boat access by excavating into the spoil bank a right triangle shaped upland basin 18' x 30'. The applicant will excavate an area f6' x 32' below the NWL to have a consistent 6' water depth in the footprint of the proposed boathouse. The triangle shaped upland basin will be stabilized with 50' of bulkhead. The ±80 cubic yards of spoil material from the basin excavation will be sloped, graded and seeded on the adjacent existing upland spoil bank. The proposed boathouse roof will have a dimension of 24' x 36'. There will be a 4' wide catwalk that will be constructed around the perimeter of the boathouse under the roof. The boathouse will encroach into the creek channelization 17'. Access to the proposed basin and boathouse is to be accomplished by filling an area across the wooded wetlands 25' wide by 50' long. A 1'diameter x 25' long culvert pipe is proposed for the center of the filled access to maintain surface flow in the wooded wetland. This portion of the Pamlico River is not a Primary or Secondary Nursery Area, and is closed to the taking of shellfish. No SAV (Submerged Aquatic Vegetation) was observed. The project is located in flood zone AE, a Special Flood Hazard Area according to the FEMA Flood Insurance Rate Map. A review of archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include: riprap and backfill along 100 linear feet of shoreline, the permanent filling of 175 sq. ft. of Coastal Wetlands, and the filling of 925 sq. ft. of high ground. The classification helps local governments in the planning area to mitigate risks to life and property associated with storm and flood hazards. The overlay includes the coastal shoreline AECs with rules that protect stream margins and water quality. And, the classification offers a higher level of protection for functional but less essential non -coastal wetlands. The Conservation II Classification is an overlay that places additional limitations on the compatible uses and activities of the underlying land classifications. The Conservation II Classification overlays approximately 175,000 acres in the Agriculture -Forestry -Rural Housing, Transition, and Towns and Community Centers classifications" (pg III-39). Transition: "This land classification includes areas that are expected to undergo more urban -type development during the planning period and beyond. This development may be associated with job growth in neighboring counties or it may be associated with the economic development policy to encourage water -oriented development for second home and retirement communities. These areas have reasonable access to the highway system; however, septic tanks will be the dominant means of wastewater treatment. The classification is subdivided into Water -Oriented Development, located on the north and south of the Pamlico River, and the US 17/264 Sector, located northwest of the City of Washington. Additionally, the permittee shall report spills including: any oil spills of 25 gallons.or more and any spill regardless of amount that causes sheen on surface waters. Other Conditions 9. ReOnenerClause, Earl and Nancy Dehoog and their authorized agents shall conduct their activities in a manner consistent with State water quality standards (including any requirements resulting from compliance with section 303(d) of the Clean Water Act) and any other appropriate requirements of Statelaw and federal law. Earl and Nancy Dehoog shall require their contractors (and/or agents) to comply with all of the terms of this Certification, and shall provide each of their contractors (and/or agents) a copy:ofthis Certification,, A copy of this.Certification shall be included in the construction contract and available on the job site at all times. If DWR determines that such standards or laws are not being met (including the failure to sustain a designated onachieved use) or that State or federal law is being violated, or that further conditions are necessary to assure compliance, DWR may reevaluate and modify this certification to include conditions appropriate to assure compliance with such standards and requirements in accordance with 15A NCAC2H.0507(d). Earl and Nancy De Hoog Broad Creek Beaufort County Pantego, NC Project Setting The 32 acre project site is located at 23538 HWY 264 east in the Pantego community adjacent Broad Creek off Pantego Creek and the Pungo River in Beaufort County, North Carolina. The tract is an upland ridge developed with an access road off HWY 264 to two different shops, one of which has living quarters. Two different borrow ponds have been dug on the property to support the development of the property. A home is planned adjacent to the borrow pond and shop closest to the creek and bottomland swamp associated with Broad Creek. Broad Creek is channelized in this area with a highground spoil bank that filled wetlands leaving an area of wetlands between the upland ridge and spoil bank. The wetlands still drain and have a hydraulic surface connection to Broad Creek. The upland ridge is vegetated with various hardwoods and loblolly pines. The wetland between the ridge and spoil bank is vegetated with wax myrtle, red cedar, sweet gum and tupelo gum. The spoil bank is vegetated mainly with loblolly pines. Water depth in the creek range from minus 8' below the normal water level (NWL) in the center to minus 4' at the bank. The creek has an average width of 71' in the project location. Broad Creek at this location is classified as Inland Waters by the Wildlife Resources Commission and SC NSW by the Environmental Management Commission. Broad Creek is closed to shellfishing. Project Description The applicant proposes to develop small boat access by excavating into the spoil bank a right triangle shaped upland basin 18' x 30'. The applicant will excavate an area f6' x 32' below the NWL to have a consistent 6' water depth in the footprint of the proposed boathouse. The triangle shaped upland basin will be stabilized with 50' of bulkhead. The ±80 cubic yards of spoil material from the basin excavation will be sloped, graded and seeded on the adjacent existing upland spoil bank. The proposed boathouse roof will have a dimension of 24' x 36'. There will be a 4' wide catwalk that will be constructed around.the perimeter of the boathouse under the roof. The boathouse will encroach into the creek channelization 17'. Access to the proposed basin and boathouse is to be accomplished by filling an area across the wooded wetlands 25' wide by 50' long. A 1'diameter x 25' long culvert pipe is proposed for the center of the filled access to maintain surface flow in the wooded wetland. Also included in this permit is a fill area across the wetland to gain access to the higher elevation of land by the canal bank. It would be approximately 25' x 50'. This would give us access to the strip of land that we currently cannot access. The boathouse would go on the side of the canal and we would be digging out a small section of land that is high ground. This would allow us to build the boathouse we would like to have. My wife has had 8 spinal surgeries, and I would like to make the boathouse and boat wheelchair accessible in the event that she would have to use a wheelchair in the future.
