Authorizing development in Beaufort County at adjacent to Pamlico River, at 2545 Bayview
Road, near the Town of Bath, as requested in the permittee's application dated 6/28/16, including attached workplan
drawings (4) 1-4 of 4 dated revised 6/27/16.
This permit, issued on August 30, 2016 is subject to compliance with the application (where consistent
with -the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Reconfigured Docking Facility
1) This permit authorizes the construction of a 30'x28' boathouse, and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this reconfigured docking facility without
permit modification. No non -water dependent uses of structures shall be conducted on, in or over
Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
ggalified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
.your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed 840 square feet.
4) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors.shall be attached to the structures in order to make it more visible during hours of darkness or
inclement weather.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
9) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project and assigned SAW 2016-
01509.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3900 and assigned the project DWR Project No. 20160719.
NOTE: The permittee is advised that any development or land disturbing activity that is considered non -
water dependent is not authorized within 50 feet of the normal water level unless specifically
exempted by Environmental Management Commission (EMC) Tar Pamlico buffer regulations in
place at the time of such development.
NOTE: An application processing fee of $250 was received by DCM for this project..

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-
2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified
party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance
requires additional approval. Please read your permit carefully prior to starting work and review all project
plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that
he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact
Department personnel at any time for assistance. By working in accordance with the permit, you will be
helping to protect our vitally important coastal resources.

Dallas E. Dickerson has submitted a CAMA Major Permit request for development onsite his
property. The proj ect site is a single-family residential lot with a bulkhead shoreline located off SR
1746 at 2545 Bayview Road on the Pamlico River near the Town of Bath in Beaufort County, North
Carolina. The project site is approximately 0.75acres in size and has approximately 180 linear feet of
shoreline. Man-made features on the lot include a single-family residence, 70' long pier with a f 12'
x f16' L-head platform, 8' x 14'and 4' x 16' finger piers that create 2 uncovered boatlifts. Water
depth at the terminal end of the pier structure range from 3.5' and 4.0' below Normal Water Level
(NWL). The existing number of slips is two. Landward of the NWL the elevation gradually slopes
upward to an approximate elevation of t7' above the NWL. The lot is mostly vegetated with lawn
grasses and ornamental shrubs. The Pamlico river is approximately 2.5 miles in width at this
location.
The property upstream is an undeveloped timberland which is owned by Weyerhaeuser. The
downstream property is a single-family residential dwelling with a bulkheaded shoreline and a pier
with an uncovered boatlift. This pier is approximately 100' from the proposed development.
The Pamlico River is classified as SB NSW by the Environmental Management Commission
at the project site. The Pamlico River at this location is designated Coastal Waters, is not open to
shell fishing and is not a Primary Nursery Area. No SAV's were observed during the on -site field
visit.
Project description
The applicant proposes to construct a 30'x 28' roof over two existing uncovered boatlifts to
create an 840 square foot boathouse.
Anticipated impacts
The construction of the 30' x 28' roof over the existing boatlifts will result in a total
platform square footage of 1,032 square feet, which is under the maximum 1,440 square feet
allowed for this property. The development will not cause a hazard to navigation and doesn't
exceed one quarter width of the waterbody.

Staff has reviewed the proposed project with regard to rules found in Subchapter 7H concerning development
in a Public Trust Area. It is staff s recommendation that the proposed project appears consistent with 15A NCAC
07H .0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that
"The total square footage of shaded impact for docks and mooring facilities allowed shall be eight square feet per
linear foot of shoreline with a maximum of 2,000 square feet". The applicant has proposed to construct an 840
square foot boathouse roof. With the addition of the boathouse the total platform square footage for the docking
facility will be 1,032 square feet which is below the maximum allowed.
Staff recommends the following conditions be included if the project is permitted.
No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
2. This permit authorizes only the structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, may
become a permanent part of this docking facility without permit modification. No non -water dependent uses
of structures may be conducted on, in or over public trust waters without permit modification.
3. This permit authorizes a maximum of two boat slips.
4. The boathouse shall have sides extending no farther than one-half the height of the walls and covering only
the top half of the walls.
5. The boathouse shall not have a second story use.

Consistency Determination: The request is consistent with/not in conflict with the Town of
Bath CAMA Workbook Land Use Plan certified by the CRC on July 27, 2007 September 28,
2007, provided that all applicable local, state, and federal development guidelines are met.
Overview: The applicant is requesting to construct a 30' x 28' roof over two existing uncovered
boatlifts. The project site is .75 acres and is located at 2545 Bayview Rd, Town of Bath, Beaufort
County. Existing site improvements consist of a single-family residence, pier, L-head platform,
and two finger piers that create two (2) uncovered boatlifts.
The Pamlico River is classified as SB (Primary Recreation, Salt Water)/NSW Nutrient Sensitive
Waters). This Pamlico River at his location is designated Coastal Waters, is not designated as
a Primary Nursery Area and is not open to the taking of shellfish. No Submerged Aquatic
Vegetation (SAV) habitat was observed. A review of shellfish resources, historic resources and
archaeological resources was not provided.
Anticipated impacts resulting from this project are expected to include: the 30' x 28' roof over
the boatlifts would shade ±840 ft2 (0.019 acres) of non -vegetated wetlands river bottom.
Basis for Determination:
The Town of Bath CAMA Workbook Plan Future Land Use Map (FLUM) designates the land as
"Low Density Residential" and the water as "Conservation Area". AECs involved include Public
Trust Areas and Estuarine Water.
The following LUP policies may be applicable to this request:
3(e), pg. 37: "Bath supports all development with AEC's in strict accordance with standards set
forth in 15A NCAC 7H, except where local regulations and policy are more stringent."

On July 21; 2016, the Washington Regional Office of the Division of Energy, Mineral, and Land Resources
received a copy of your CAMA Major application for proposed roof over two existing uncovered boatlifts
project, located at 2545 Bayview'Road, near Town of Bath, Beaufort County, NC. Staff review of the
plans and specifications has determined that the project, as proposed, consists of activities that will not
pose surface water quality threats from stormwater runoff since no new impervious area is proposed.
The Director has determined that projects that are reviewed and approved by the Division as not posing
water quality threats from stormwater runoff should not be subject to the stormwater management
permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing you by way of this
letter that your project will not require a State Stormwater management permit at this time,
The stormwater rules require the Division to permit the common plan of development, therefore, any
future development on the property, regardless of whether a SEC plan or CAMA Major permit is also
required, will require a Stormwater Management Permit application and permit issuance from the
Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on the
subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 21-1.1000
and may result in appropriate enforcement actions by this Office.
Please keep in mind that this determination does not affect'your legal obligation to obtain other permits
and approvals, which may be required by Federal, State, or local government agencies, rule or law. If

The Department of Environment and Natural Resources hereby gives public notice as required by N.C.G.S.
113A-119(b) that an application for a development permit in an Area of Environmental Concern as designated under
the Coastal Area Management Act (CAMA) was received on 1 July 2016. According to the said application submitted
by Dallas E. Dickerson, applicant proposes to construct 30' x 28' roof over two existing uncovered boatlifts on the
Pamlico River, near the Town of Bath, in Beaufort County, North Carolina.
A copy of the entire application maybe examined or copied at the office of Jonathan R. Howell, District

Bayview Road on the Pamlico River near the Town of Bath in Beaufort County, North Carolina.
It was received on 1 July 2016, and appears to be adequate for processing at this time. The
projected deadline for making a decision is 14 September 2016. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day. Kelly Spivey,
Field Representative for the Division of Coastal Management is responsible for processing your

have any questions.
If this agency does not render a permit decision within 70 days from the 1 July 2016, you
may request a meeting with the Director of the Division of Coastal Management and permit staff
to discuss the status of your project. Such a meeting will be held within five working days from
the receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice, at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
