The permit was issued on December 20, 2016 and expires on December 31, 2019. The action proposed in your submittal is to dredge approximately 28,600 cubic yards of the Hatteras Inlet Connector Channel ("South Ferry Channel') by means of sidecast dredge. In reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with the permit. This Letter of Authorization serves as approval of the activities described in your event notification dated March 6, 2019, and plans labeled Sheets 1-4 dated revised March 5, 2019, and includes an extension of the moratorium to allow the authorized work through April 15, 2019. All other permit conditions remain in effect Please note this letter does not authorize any work not expressly described above, nor does it eliminate the need to obtain any other additional state, federal or local permits, approvals or authorizations that may be required.. This letter serves as written notice of project initiation as required in Condition 7 of the permit. Please find attached to this letter revised permit drawings dated March 05, 2019, which provide the location of the proposed channel for the upcoming event. The project includes maintenance dredging within a portion of the Hatteras Inlet Connector Channel, which runs between the inlet gorge and the ferry channel in proximity to Ocracoke Island. This channel is locally referred to as the "South Ferry Channel'. The attached plan view drawing shows the location of the proposed channel, the disposal area, and previously mapped submerged aquatic vegetation (SAV) resources in the vicinity. The channel is proposed to be dredged by the US Army Corps of Engineers (USACE) side cast dredge Mein. Material dredged from the channel will be sidecasted to either side of the proposed channeL Dare County, the USACE, and the NC Division of Water Quality are all moving expeditiously to ensure the project can start as soon as possible. Due to recent weather delays that postponed the necessary conditional surveys used to develop the plans and cost estimates for the project, the project is running several weeks behind the ideal schedule. The actual dredging of the channel is anticipated to last approximately 21 days; however, the timing of when the dredging can begin is dependent on several factors outside of the control of the USACE Navigation Branch. , At the time of this letter, it is anticipated that the project will be conducted between March 15, 2019 and April 15, 2019. As you are aware, a Major CAMA Permit (#129-16) was issued by the State of North Carolina Division of Coastal Management (DCM) to Dare County in December 2016 for the maintenance of the connector channel, The permit was subsequently modified in March 2018. The permit prohibits maintenance activities from April 1 to September 30 without prior approval from the DCM in consultation with appropriate resource agencies. On behalf of Dare County, we request consideration of 2 weeks of relief for this particular maintenance event In support of this request, we bring to your attention the fact that no maintenance dredging was required of the channel in 2018 during the dredge moratorium. Clearly, the channel conditions are highly dependent on weather conditions but Daze County is using the best available data to maintain the channel in such a way as to minimize the need for dredging within the dredge moratorium. RECEIVED MAR 0 6 2019 MP SECTION WIRO The modified permit allows for maintenance of a 200 ft. wide channel to a depth of -12 ft. MLW. Based on the February 26, 2019 survey, removal of approximately 28,600 cy of material would be required to achieve a channel depth of -10 ft. MLW within the proposed channel shown on the attached drawings, which includes a 150 foot wide channel and a 50'foot widener in the area pinched between the two shoals encroaching on the channel. As required by the permit, we have contacted Don Field with NOAA to determine if any updated imagery is available for the project area to delineate SAV habitat. Mr. Field responded that they do not have any update aerial imagery, however he indicated that new imagery is expected in May or June of this year. In the CAMA Major Permit, DCM indicated that DMF staff may perform SAV surveys in proximity to the proposed dredge location to provide an updated determination of the presence or absence of SAV resources. As described in the attached letter of request, they are anticipating 21 days of dredging for 28,600 cy of material and a project end date of April 15 (and thereby need approval for an extension from the April 1 moratorium). Dredging would be confined to a maximum depth of -12' MLW and a maximum channel width of 200'. It should also be noted that Ken has indicated in the attached email to Anthony that dredging on the outgoing tide may not be feasible "based on feedback from the USACE dredge operators', although encouraged (but not required) in the CAMA permit. Let me know if you have any questions, comments or concerns. I'm also attaching Anthony Scarbraugh's response to this request.
