REGAN Secretary BRAXTON DAVIS Dues"r U60 March 23, 2018 This letter is in response to the 3/20/18 request by APTIM, on behalf of Dare County, in which it was requested that Major Permit No. 129-16 be modified to extend the channel corridor towards the inlet gorge, as detailed in your memo dated 3/22/18. Major Permit No. 129-16 was issued to Dare County on 12/20/16. This Permit was last modified on 3/14/18 to increase the channel width to 200ft. and expand the project area. The project is located within Pamlico Sound and the Hatteras Inlet complex, adjacent to the northeast tip of Ocracoke Island. Your modification request as described and/or depicted in your submittal dated 3/22/18, to include workplan drawings (4) all dated "Revised 3/22/18", is hereby authorized as a refinement to CAMA Major Permit No. 129-16. All existing conditions remain in effect, including the expiration date of 12/31/19. This Letter of Refinement is provided to you as a record of the authorization, and should be included with the Permit file. Wilmington, North Carolin Tel: +1 910-791-949, Brad.Rosov@aaptim.con Subject: Dare County Hatteras Inlet Channel Maintenance Project: Request for Refinement Dear Mr. Trowell: In 2016, Dare County sought permission to conduct maintenance dredging of the Hatteras Inlet Connector Channel as needed on a year-round basis, in the same manner that the USACE maintains Rollinson Channel and the Hatteras to Hatteras Inlet Connector Channel, as well as other federally authorized navigation channels throughout the state. A Major CAMA Permit (#129-16) was subsequently issued by the State of North Carolina Division of Coastal Management (DCM) to Dare County in December 2016 for the maintenance of the connector channel. This permit prohibits maintenance activities from April 1 to September 30 without prior approval from the DCM in consultation with appropriate resource agencies. A DOA permit (SAW-2016-02140) was also subsequently issued to Dare County for the proposed action in March 2017. The DOA permit included a special condition under the heading "ESA" prohibiting maintenance of the channel from April 1 to September 30 without notification to the Corps of Engineers Regulatory Division in coordination with the appropriate resource agencies. Since the permits were issued, Dare County has coordinated with the DCM and US Army Corps of Engineers (USACE) to obtain relief from the dredge window for dredge operations conducted in May and September of 2017. In order to conduct advanced maintenance dredging of the connector channel and minimize the need to request relief from the USACE and DCM for future maintenance events conducted between April 1 and September 30, Dare County requested (and was granted) modifications of both the DOA Permit (SAW-2016-02140) and Major CAMA Permit (#129-16) to increase the allowable width of the channel from 100' to 200'. This modification was expected to allow the County, in cooperation with the NC Division of Water Resources and the USACE, to conduct advanced maintenance dredging as time and financial resources permit. With this in mind, the next maintenance event of the Hatteras Inlet Connector Channel has been scheduled to occur imminently. The USACE plans to mobilize to the project area on March 20, 2018 and start working in the Hatteras Inlet Connector Channel throughout the week as weather conditions allow. They were able to update their previous survey which is shown on the attached updated plan set. Based on the channel conditions and budgeted funds, the USACE is aiming to dredge the channel to approximately 150 ft. wide to a depth of approximately 10 ft.Kst��\%vLga t]C D shallowest part of the shoal running parallel to the inlet gorge. G I Y MAR 2 � 2018 MP SECTION MHD { ,- County previously requested an expansion of the Connector Channel Corridor due to the migration of the inlet gorge to the east (towards Hatteras Inlet). That request was granted and the Connector Channel Corridor was modified and expanded slightly eastward. At this time, however, based on the March 17, 2018 hydrographic survey conducted by the USACE, the proposed Hatteras Inlet Connector Channel will require dredging outside the modified Connector Channel Corridor due to additional shoaling. The County is respectfully requesting a refinement to the permit that will expand the Connector Channel Corridor further eastward such that it encompasses the footprint of the proposed Hatteras Inlet Connector Channel. The modified Connector Channel and the proposed modification to the Corridor are both depicted in the attached plan set. As required in Condition #8 of the Major CAMA Permit #129-16 and Condition #7 of the DOA permit SAW-2016-02140, an underwater archeological survey of any previously "un- dredged areas" identified by the Division of Coastal Management is required to be conducted by a qualified archeologist prior to the dredging. This survey has been completed and it should be noted that the archeological survey area is inclusive of the entirety of the proposed Connector Channel Corridor. Attached are engineering drawings dated March 21, 2018 showing the previously permitted channel (100-foot width) and the proposed widened channel (150foot width). Also shown on the drawings is the footprint of the proposed expansion of the Connector Channel Corridor. Please contact me anytime should you have any questions or need anything in addition.
