Permit Class Permit Number NEW 35-96 STATE OF NORTH CAROLINA Department of Environment, Health & Natural Resources and Coastal Resources Commission 4 rr.Tt for Major Development'in an Area of Environmental Concern pursuant to NCGS 113A-118 % Excavation and/or filling pursuant to NCGS 113-229 Issued to Coral Bay Club, P. O. Box 112, Atlantic Beach, NC 28512 28405 authorizing development in Carteret County at Hoop Hole Creek. at Coral Bay Club dock facility , as requested in the permittee's application dated revised 12/5/95 including attached workplan drawings, 5, date stamped revised 12/5/95. This permit, issued on MARCH 8. 1996 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. Launch Area Excavation 1) Excavation will be conducted below the mean high water level and limited to the area adjacent the boat ramp as shown on the December 5, 1995 workplan. 2) Excavation will not exceed 4 feet below the elevation of mean low water level. 3) The temporary placement or double -handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 4) No vegetated wetlands will be excavated or filled. (See attached sheet for Additional Conditions) This permit action may be appealed by the petmittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1999 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit #35-96 Page 2 of 3 ADDITIONAL CONDITIONS 5) All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands within adequate dikes of other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 6) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 25 NTUs or less 7) The spoil, and other disturbed areas, will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) working days of project completion. Boat Ramp Installation 8) The new concrete boat ramp will be poured "in the dry" on the upland and pushed into place. 9) Clean-up and excavation to receive the new ramp will be only that needed to prepare adequate grade for the new ramp. Bulkhead Installation 10) The alignment of the proposed bulkhead must be staked by a representative of the Division of Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of construction. Failure to initiate construction within thirty (30) days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be re -staked by DCM within a maximum of thirty (30) days prior to the new expected start of construction. 11) The bulkhead must be constructed prior to any backfilling activities. 12) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 13) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles, or other suitable materials approved by Department personnel. No excavation is permitted, except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 14) The bulkhead backfill material will be clean and free of any pollutants, except in trace quantities. Permit #35-96 Page 3 of 3 ADDITIONAL CONDITIONS Dock Construction 15) The dock facility and associated structures shall hava a minimum setback distance of 15' between any parts of the structure and the adjacent property lines as extended perpendicular to the channel into the water at the points where they intersect the shoreline. NOTE: The permittee may apply to the Dept. of Administration, State Property Office for voluntary Easement for the pier pursuant to N.C.G.S. 146-122(c). Marina Operation 16) No sewage, whether treated or untreated, shall be discharged at any time from boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 17) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of this marina without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 18) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 19) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 20) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having the permit transferred to a third parry. 21) This permit to authorize renovation of the Coral Bay Club facility is issued only for boats that are under 24 feet, open and not equipped with marine heads. PROJECT SUMMARY: The applicant proposes to reconfigure an existing 16-slip dock/marina, rebuild an existing boat ramp, construct 181' of high ground bulkhead, and conduct maintenance excavation adjacent the existing boat ramp. FIELD INVESTIGATION REPORT: CORAL BAY CLUB, INC./CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The applicant's property is located on both sides of NC Highway 58 in Atlantic Beach, adjacent Hoop Pole Creek, off Bogue Sound, in Carteret County. A clubhouse, parking lots, manager's cottage, and assorted miscellaneous amenities are all located on the south side or ocean side of NC 58. On the north side or sound side of NC 58 is an approximate 3.5-acre parcel from which an existing 16-slip small boat dock/marina originates. The dock measures 129' in length, is 8' wide with a 2'-wide catwalk on each side of the dock. The slips are currently 10' wide and there are eight 10'-long finger piers. But other than the existing dock and an old concrete boat ramp on the site, the parcel remains undeveloped. Coral Cay Condominiums are located immediately to the west while an undeveloped maritime forest complex is adjacent to the east. Along the shoreline of Hoop Pole Creek is a 15' to 25' fringe of intertidal marsh dominated by Snartina alterniflora which grades up to a higher marsh dominated by S. patens. Water depths of Hoop Pole Creek adjacent the dock area are very shallow, with a maximum depth of approximately -4' below MHW near the end of the dock. Water depths adjacent the boat ramp average -1' below MHW. Aerial photography indicates the presence of a shallow channel from Bogue Sound to the basin area around the dock. Hoop Pole Creek is classified as SA waters by the Division of Environmental Management and is open to shellfishing. Project Description The applicant proposes to reconfigure the existing 16-slip dock/marina, rebuild a 15' X 35' concrete boat ramp, construct 181' of high ground wooden bulkhead, and conduct maintenance excavation (30' X 25' X -4') adjacent the boat ramp. In reconfiguring the boat dock/marina, the applicant proposes to shorten the existing access pier to 100' and add an 8' wide by 138' "T" shaped platform. Ten 25' slips will be located on the outside of the dock and measure 14' in width. There would be six slips inside the "T" and would also be 14' wide. Seven finger piers are proposed. The applicant also proposes to construct 181' of low bulkhead landward of all wetlands. In addition, maintenance excavation in the area adjacent the boat ramp is proposed. Spoils would be placed on the high ground of the property and would measure 125' X 200'. Finally, a new 15' wide by 35' long boat ramp is also proposed. W. C' FIELD INVESTIGATION REPORT: CORAL BAY CLUB, INC./CARTERET COUNTY PAGE #3 Anticipated Impacts Although the reconfiguration of the dock would not increase the number of slips, it would slightly increase the footprint of the structure. Public Trust coverage would increase by 1,906 ft. The existing structure currently covers approximately 4,404 ft2 of Public Trust Area, while the proposed reconfiguration would result in 6,310 fe of Public Trust coverage. The size of the slips would increase from 10' wide to 14' wide but shallow water leading to the dock would limit access to only small boats. The applicant also states that the dock is for small boats (< 24') with no heads or cabins only. Consequently, it appears that the dock/marina is not subject to the mandatory water classification of prohibited by Environmental Health. The maintenance excavation for the boat ramp would result in the direct loss of 750 fP of shallow estuarine habitat. Limited increases in turbidity would be expected to occur during excavation activities as well as during construction of the new "T" platform. It would also be expected that the impact to the adjacent aquatic resources as a result of the minor turbidity increases would be minimal. Approximately 25,000 fe of high ground would be disturbed for the installation of the spoil disposal area. Approximately 2,700 ft2 of additional high ground would be disturbed due to the installation and backfill of the bulkhead. The general area of the project is classified as Developed Residential, while the AECs impacted by the proposed work are classified as Conservation. The Conservation classification is discussed on Pages III-2 and III-3. The Town of Atlantic Beach allows use consistent with local zoning and the 7H Use Standards in Conservation areas, with certain exceptions, none of which appear to be applicable to this proposal. Applicable policies contained in the Atlantic Beach LUP include Resource Protection Policies for Marinas and Floating Home Development and Resource Production and Management Policies for Residential, Commercial, and Industrial Development Impacts on Resources. Atlantic Beach allows the construction of all marinas, docks, and piers which comply with the 15A NCAC 7H minimum use standards. Marine Resource Areas policies recognize the importance of estuarine waters and public trust areas and state support for the state AEC regulations for development in these areas. Bulkhead Construction policies are included on Page IV-7 of the Plan. Atlantic Beach does not oppose bulkhead construction in estuarine shoreline areas when the construction fulfills the use standards set forth in 15A NCAC 7H and the local ordinance which governs bulkheading. Based on the above policies, this proposal appears to be consistent with the 1993 Town of Atlantic Beach Land Use Plan, provided all state and local requirements are met. These recommendations are necessary due to the following attributes of Hoop Pole Creek. 1) While Hoop Pole Creek is not a designated Primary Nursery Area (PNA), sampling of this water body during May and June of 1992 and 1993 indicated that it is functioning as a PNA. Juveniles of commercially and recreationally important species such as spot Leiostomus xanthurus, Atlantic menhaden Brevoortia tyrannus, and brown shrimp Penaeus aztecus were taken in normal (Atlantic menhaden and brown shrimp) to record numbers (spot) during sampling. We also request that the cement slab for- tiie boat ram? poured on an upland site and push into place once hardened. This procedure would avoid the contact ofwet cement with the aquatic environment which has been shown to be toxic to marine organisms in the immediate vicinity. NARRATIVE DESCRIPTION: Project Setting The applicant's property is located on both sides of NC Highway 58 in Atlantic Beach, adjacent Hoop Pole Creek, off Bogue Sound, in Carteret County. A clubhouse, parking lots, manager's cottage, and assorted miscellaneous amenities are all located on the south side or ocean side of NC 58. On the north side or sound side of NC 58 is an approximate 3.5-acre parcel from which an existing 16-slip small boat dock/marina originates.. The dock measures 129' in length, is 8' wide with a 2'-wide catwalk on each side of the dock. The slips are currently 10' wide and there are eight 10'-long finger piers. But other than the existing dock and an old concrete boat ramp on the site, the parcel remains undeveloped. Coral Cay Condominiums are located immediately to the west while an undeveloped maritime forest complex is adjacent to the east. Along the shoreline of Hoop Pole Creek is a 15' to 25' fringe of intertidal marsh dominated by Snartina alterniflora which grades up to a higher marsh dominated by S. patens. Water depths of Hoop Pole Creek adjacent the dock area are very shallow, with a maximum depth of approximately -4' below MHW near the end of the dock. Water depths adjacent the boat ramp average -1' below MHW. Aerial photography indicates the presence of a shallow channel from Bogue Sound to the basin area around the dock. Hoop Pole Creek is classified as SA waters by the Division of Environmental Management and is open to shellfishing. Project Description The applicant proposes to reconfigure the existing 16-slip dock/marina, rebuild a 15' X 35' concrete boat ramp, construct 181' of high ground wooden bulkhead, and conduct maintenance excavation (30' X 25' X -4') adjacent the boat ramp. In reconfiguring the boat dock/marina, the applicant proposes to shorten the existing access pier to 100' and add an 8' wide by 138' "T" shaped platform. Ten 25' slips will be located on the outside of the dock and measure 14' in width. There would be six slips inside the "T" and would also be 14' wide. Seven finger piers are proposed. The applicant also proposes to construct 181' of low bulkhead landward of all wetlands. In addition, maintenance excavation in the area adjacent the boat ramp is proposed. Spoils would be placed on the high ground of the property and would measure 125' X 200'. Finally, a new 15' wide by 35' long boat ramp is also proposed. FIELD INVESTIGATION REPORT: CORAL BAY CLUB, INC./CARTERET COUNTY PAGE #3 Anticipated Impacts Although the reconfiguration of the dock would not increase the number of slips, it would slightly increase the footprint of the structure. Public Trust coverage would increase by 1,906 ft. The existing structure currently covers approximately 4,404 ft' of Public .Trust Area, while the proposed reconfiguration would result in 6,310 ftZ of Public Trust coverage. The size of the slips would increase from 10' wide to 14' wide but shallow water leading to the dock would limit access to only small boats. The applicant also states that the dock is for small boats (< 24') with no heads or cabins only. Consequently, it appears that the dock/marina is not subject to the mandatory water classification of prohibited by Environmental Health. The maintenance excavation for the boat ramp would result in the direct loss of 750 ft' of shallow estuarine habitat. Limited increases in turbidity would be expected to occur during excavation activities as well as during construction of the new "T" platform. It would also be expected that the impact to the adjacent aquatic resources as a result of the minor turbidity increases would be minimal. Approximately 25,000 fO of high ground would be disturbed for the installation of the spoil disposal area. Approximately 2,700 ftz of additional high ground would be disturbed due to the installation and backfill of the bulkhead. The applicant proposes to use silt fences to prevent sedimentation problems from occurring. M.
