This permit, issued on June 10, 2016 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Submerged Log Retrieval 1) Unless specifically altered herein, this permit authorizes only the submerged log recovery located in or over the water that are expressly and specifically set forth in the permit application. Any additional development and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (252) 946-6481 for this determination. (See attached sheets for Additional Conditions) This permit action maybe appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Signature of Permittee a Jeremy Coley Permit No. 61-16 Page 2 of 3 . , ADDITIONAL CONDITIONS ,'2) If it becomes necessary to remove, dredge or excavate any bottom sediment in order to remove any log, a modification of this permit must be requested. This permit authorizes only the removal of logs by grappling or pulling logs directly from the bottom without a significant disturbance of the bottom. 3) No logs, timbers, trees or other debris shall be removed, repositioned, or stored so as to create a navigational safety hazard. Logs, etc. not intended to be taken to a shore support site shall be repositioned as close to the original position as possible. 4) ' Development of shore -based support facilities may require a modification of this permit, or other state permits or authorizations. The permittee shall notify the Division of any such plans. `5) - This permit does not authorize the removal or salvage of any object or material other than submerged logs. 6)' To minimize impacts to anadromous fish, log removal shall not be conducted from February 15 to June 30 of any year without prior approval of the Division of Coastal Management in consultation with appropriate resource agencies. -7) Log removal shall be conducted outside the immediate vicinity of the bank and shall not disturb bank stability. 8) " In order to protect important structure and habitat opportunities to anadromous fish species, logs in less than 6' of water shall remain in place. 9) No attempt shall be made by the permittee to prevent the free and full use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity shall not interfere with the public's right to free navigation on all navigable waters of the United States. 10) The permittee shall install and maintain at his expense any signal lights or signals through regulation or otherwise, on all work vessels in order to make them more visible during hours of darkness or inclement weather. 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. NOTE: Erosion & Sedimentation Control An Erosion and Sedimentation Control Plan may be required for this project if more than an acre of land will be disturbed for the storage and staging areas. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Division of Energy, Mineral and Land Resources. In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Jeremy Coley Permit No. 61-16 Page 3 of 3 ADDITIONAL CONDITIONS 13)' Appropriate sedimentation and erosion control devices, measures or structures shall be implemented at the offloading site to ensure that eroded materials do not enter adjacent wetlands and watercourses (e.g. silt fence, diversion swales or berms, etc.). Department of Natural & Cultural Resources 14) The permittee shall obtain and maintain in good standing all required permits including a valid Recovery Permit issued by the NC Department of Natural and Cultural Resources (DNCR) and signed by the State Archeologist as required under GS 121, Article 3. The DNCR permit and conditions shall be available on site for inspection at any time during the log retrieval operations. General 15) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 16); Except as specified in the plans attached to this permit, no excavation, fill, or mechanized land clearing shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within the waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 17). The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned this proposed project Action ID No. SAW-2016- 00726. It is staff s recommendation that the proposed project appears consistent with 15A NCAC 07H .0208. If the permit is issued, staff would suggest that all standard conditions be applied. General 1. The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. The Milltail Creek site is located entirely within the Alligator River National Wildlife Refuge. In Milltail Creek, the site extends from the location where Boat Bay connects to the creek to a location approximately 1,000 feet west of where the canal along Dry Ridge Road North connects to the creek. Milltail Creek is located within Dare County. In the Scuppernong River, the site extends from a location approximately 4,200 feet south of the US64/NC94 Highway to a location approximately 2,300 feet northeast of Ramp Road. The river borders the Pocosin Lakes National Wildlife Refuge, State-owned property and a few privately owned parcels. The Town of Columbia is located along a portion of the project length on the east side of the river, and its Extraterritorial Jurisdiction (ETJ) extends to the west side of the river. The remainder is in Tyrrell County. The terminus of Riverneck Road is an NC Department of Transportation (NCDOT) right-of-way located in Tyrrell County. Salvage of submerged logs within the 2-mile-long section of Milltail Creek and the 2-mile-long section of the Scuppernong River and extraction of logs from the Scuppernong River at the terminus of Riverneck Road are proposed. Logs will be brought to the surface using log tongs and winches. Approximately two (2) logs a day will be salvaged. Logs recovered from the creek will be floated to the extraction site using a log raft. No upland development is proposed. No wetland impact is proposed. Short term turbidity during salvage is anticipated. Milltail Creek is closed to shellfishing at the project location. PROJECT DESCRIPTION The applicant proposes to remove +/- 2 logs per day from the Scuppernong River and Milltail Creek. The project site will consist of a two mile stretches on the Scuppernong River and Milltail Creek. The logs will be sitting on the bottom substrate or partially submerged and will be brought to the surface using log tongs and winches. Logs from both sites will be towed to a landing site at the end of Riverneck Road, (SR 1211) where the logs will be extracted onto a gooseneck trailer using a winch. The applicant is proposing to use log mats at the recovery site to minimize land disturbances. Recovered logs from Milltail Creek will be floated to the extraction site by constructing a log raft.
