This permit, issued on June 27, 2016 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be'subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Reconfigured Docking Facility "1) This permit authorizes only the piers, finger pier, boathouse, boat lift, 7-pile timber dolphins, and 1 other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses ` of structures shall be conducted on, in or over Public Trust waters without permit modification. `2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the E reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be i considered a violation of this permit for which the permittee is responsible. This prohibition shall be i applied and enforced throughout the entire existence of the permitted structure. Signature of Permittee Permit No. 63-16 Page 2 of 3 ADDITIONAL CONDITIONS This permit authorizes one (1) new boat slip for a total of three (3) formalized boat slips. 4)` The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. Footprint of the boathouse shall not exceed 576 square feet. The authorized boathouse shall be single story, and shall not be designed to allow for second story use. '6) Should the lot at 108 Hampton Road owned by Five C's Inc. to the northeast be sold prior to the initiation of the reconfigured docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15-foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the reconfigured docking facility. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not, relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8)' . The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structures in order to make it them visible during hours of darkness or inclement weather. )) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. r3) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. -NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit 198000291 and assigned SAW-2016-00867, which was issued 6/27/16. The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 2016-0473. r Y '� i 3E 1 Gregory Conn 120 Hampton Road Coinjock, NC PROJECT NARRATIVE: The scope of the project is to construct a new open pile timber pier, timber roof structure with Boatlift and four 7 pile treated timber dolphins. All of the timber shall be treated in accordance with the American Wood Preserver's Assoc. recommendations. All hardware shall be hot dipped galvanized. The Owner, located on the Site, has numerous vessels and is constructing this pier, roof structure and dolphins for their private recreational use. The Owner currently owns the Fair Trade (60 ft. power boat with a 6 ft. draft) and two smaller power boats (21' and 301). The 21 ft. boat will be moored in the boatlift. The mooring dolphins will be used to safely moor the Owner's vessels and for the future boat purchases that are anticipated in the new 12 months. This waterway is noted for heavy current activity. The 30 ft. boat shall be moored at the platforms. The improvements are within the required setbacks as determined by the Army Corps of Engineers and the pier size is within the allowable square footage allowed by CAMA. Proiect Setting The site of the proposed development is located at 120 Hampton Road (SR#1143), Coinjock, Currituck County, adjacent to the AIWW. To access the site, turn onto Worth Guard Road (located ±.8 miles north of the canal) and follow the road down to the canal (old bridge crossing site) and turn right onto Hampton Road and continue for ±500'. The property is located on the northwest side of the AIWW approximately 500' north of the US- 158 bridge (NCDOT Bridge #15). It is ±76,432 ft2 (±1.76 acres) in size, has elevations that range from ±1' to 4' above Normal Water level (NWL) and is vegetated with yard grasses, loblolly pines, deciduous trees and bushes. Man-made features on the property within the highground area include a single-family dwelling, small guest house, driveway, garage and several out -buildings. Based on available information, there appears to be no archaeological sites on this property. The shoreline of the property is ±321' in length and has been stabilized with riprap. A gravel Road known as Hampton Road (SR#1143) runs parallel to the shoreline ±8' landward of NWL. The area between the road and NWL is vegetated with yard grasses and loblolly pines and is void of wetlands. Existing structures include a concrete boat ramp as well as a ±26'x4 pier adjacent to the north side of the ramp and a ±30'x5' adjacent to the south side of the ramp. Three remnant mooring piles are located ±25' waterward of NWL. The adjacent riparian property to the north is residential in nature and the shoreline has been stabilized by riprap and a bulkhead. The bulkheaded section of this property is peninsula shaped and extends ±30' into the canal beyond the applicant's shoreline and is ±25' to 35' in width. On the north side of this bulkheaded area is open water with a docking facility that extends out even with the end of the peninsula. The adjacent riparian property to the south is also residential in nature and has a riprapped shoreline and several older and smaller piers. The waters of the AIWW are classified as SC and are closed to shellfish taking. Water depths adjacent to the shoreline are ±1' to 2' below NWL and remain shallow for±8' out into the AIWW at which point water depths begin to drop quickly to 12'+ below NWL. The waterbody width within the project area ranges from ±235' to 249'. The bottom substrate within the project area is made up of fine sands and patches of Submerged Aquatic Vegetation (SAV) have begun to grow in the shallow areas adjacent to the shoreline. Overview: The 1.76 acre subject property has approximately 321 linear feet of shoreline along the Coinjock Canal/Atlantic Intracoastal Waterway (AIWW). The AIWW is approximately 235 feet to 249 feet wide at this location. Water depths range from 1 to 2 feet below Normal Water Level (NWL) adjacent to the shoreline and remain shallow for 8 feet out into the AIWW at which point the depths drop quickly to 12 feet and greater below NWL. Site elevations range from 1 to 4 feet above NWL. The property is vegetated with yard grasses, loblolly pines, deciduous trees and bushes. The property is located in the AE floodzone. Existing site improvements consist of a single-family house, a guest house, garage, several out -buildings and a driveway. Existing shoreline improvements consist of riprap, a concrete boat ramp bounded by a 4 foot wide by 26 foot long pier to the north and a 5 foot wide by 30 foot long pier to the south, and three (3) remnant mooring pilings located 25 feet waterward of NWL. Hampton Road (SR #1143) is an approximately 12 foot wide gravel road that runs parallel to the shoreline and across the subject property, approximately 8 feet landward of NWL. Anticipated impacts resulting from this project are expected to include: the shading of 2,256 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AECs). Basis for Determination: The property is located within the "Barco-Coinjock-Airport" subarea and is designated as "Full Service Areas (Areas Preferred for Community Centers)" on the Currituck County Future Land Use Map (FLUM). Areas of Environmental Concern (AECs) are designated as "Conservation Areas" as indicated on Page 11-1. The purpose of the Conservation class is to provide for the long-term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The Conservation class is applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features. The existing timber piers at 120 Hampton Road currently encroach into the navigation setback limit, but due to the nature of this narrow channel, we are willing to consider minimal development as long as we limit the encroachment. In the configuration proposed, we would not authorize the construction of these facilities, but instead would require the proposal be modified in order to keep all structures and pilings at least 55 feet from the edge of the federal channel (100 from the channel centerline). I have included an aerial image of a docking facility located about 0.5 mile north of your site, which depicts the type of facility and offset we would consider. The yellow line on the image depicts the 55 foot distance between the dock facility and the navigation channel. We estimate your current proposal would place the piles and structures approximately 90 feet from the channel centerline, and if you we to dock large vessels on the outside of the piers, then it could propose a navigational safety issue. We would require an alteration to your proposal be made before any further consideration is provided. PROJECT SUMMARY: The applicant proposes to remove two existing finger piers and construct a three slip docking facility with a boathouse and four 7-pile timber dolphins on the Coinjock AIWW. Project Setting The site of the proposed development is located at 120 Hampton Road (SR#1143), Coinjock, Currituck County, adjacent to the AIWW. To access the site, turn onto Worth Guard Road (located t.8 miles north of the canal) and follow the road down to the canal (old bridge crossing site) and turn right onto Hampton Road and continue for ±500'. The property is located on the northwest side of the AIWW approximately 500' north of the US- 158 bridge (NCDOT Bridge #15). It is ±76,432 ft2 (t1.76 acres) in size, has elevations that range from t1' to 4' above Normal Water level (NWL) and is vegetated with yard grasses, loblolly pines, deciduous trees and bushes. Man-made features on the property within the highground area include a single-family dwelling, small guest house, driveway, garage and several out -buildings. Based on available information, there appears to be no archaeological sites on this property. The shoreline of the property is ±321' in length and has been stabilized with riprap. A gravel Road known as Hampton Road (SR#1143) runs parallel to the shoreline t8' landward of NWL. The area between the road and NWL is vegetated with yard grasses and loblolly pines and is void of wetlands. Existing structures include a concrete boat ramp as well as a t26'x4 pier adjacent to the north side of the ramp and a t30'x5' adjacent to the south side of the ramp. Three remnant mooring piles are located +25' waterward of NWL. The adjacent riparian property to the north is residential in nature and the shoreline has been stabilized by riprap and a bulkhead. The bulkheaded section of this property is peninsula shaped and extends ±30' into the canal beyond the applicant's shoreline and is t25' to 35' in width. On the north side of this bulkheaded area is open water with a docking facility that extends out even with the end of the peninsula. The adjacent riparian property to the south is also residential in nature and has a riprapped shoreline and several older and smaller piers. The waters of the AIWW are classified as SC and are closed to shellfish taking. Water depths adjacent to the shoreline are ±V to 2' below NWL and remain shallow for t8' out into the AIWW at which point water depths begin to drop quickly to 12'+ below NWL. The waterbody width within the project area ranges from ±235' to 249'. The bottom substrate within the project area is made up of fine sands and patches of Submerged Aquatic Vegetation (SAV) have begun to grow in the shallow areas adjacent to the shoreline. The waters of the canal are also subject to strong currents that switch direction depending on the wind tide. This is a unique situation in the area and is caused by water flowing back and forth between the Currituck Sound and the North River. Development Proposal RECEIVED MAY 16 2016 The applicant proposes to remove the existing finger piers that are locate her side of the existing boat ramp and construct a new docking facility on both the north a th @MWfery boat ramp. The proposed docking facility is designed to meet the required 55'setback from the edge of the federal channel (100' from the centerline of the channel). Gregory Conn Field Investigation Report Page 3 Adjacent to the north side of the boat ramp, a t18'x6' pier will extend from the shoreline to a 112'x8' platform that will parallel the shoreline heading to the north. The platform will end 8' from the riparian corridor line and a 7-pile dolphin will be installed between the platform and riparian corridor line. Adjacent to the south side of the boat ramp, a t2O'x6' pier will extend from the shoreline to a 48'x8' platform that will parallel the shoreline heading to the south. A 32'x18' (576 ft2) boathouse with a 14'x12.5'boat lift will be installed at the southern end of this platform and will be accessed by a 43'x4' "L-shaped" finger pier that will be located on the landward side of the boathouse. Three 7-pile dolphins will be installed within this section as follows: one located at the northern end of the platform adjacent to the boat ramp, one adjacent to the south end of the boathouse and one installed ±81' south of the boathouse (18' north of the riparian corridor line). The proposed docking facility was designed to include three formalized slips. It meets the 1/4 width requirement and a 15' waiver was acquired from the adjacent riparian property owner to the north. Water depths along the docking facility range from t4' to t12' below NWL. *It should be noted that it appears that the applicant has ownership interest/riparian rights along the shoreline waterward of the adjacent property to the south addressed as 124 Hampton Road. A signed notification form from this adjacent owner was submitted indicating no objection and acknowledging the applicant's ownership interest. All of the timber shall be treated in accordance with the American Wood Preserver's Assoc. recommendations. All hardware shall be hot dipped galvanized. The Owner, located on the Site, has numerous vessels and is constructing this pier, roof structure and dolphins for their private recreational use. The Owner currently owns the Fair Trade (60 ft. power boat with a 6 ft. draft) and two smaller power boats (21' and 30'). The 21 ft. boat will be moored in the boatlift.
