This permit, issued on December 22, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconstructed docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires farther Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. ADDITIONAL CONDITIONS Permit No.128-16 Page 2 of 4 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 28 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the south. 7) Should the adjacent property to the north be sold prior to the initiation of construction, the permittee. shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 8) No portion of the reconstructed docking facility shall extend outside of the existing footprint of the facility. No pilings shall be installed or replaced within the federal channel setback. 9) The existing marine pumpout sewage disposal facility shall be maintained for the life of the marina. 10) Prior to any construction authorized under this permit, the permittee shall meet on -site with a representative of the Division to ensure that the required pumpout facility is in place and operable. 11) The marina/docking facility shall display a sign showing the location of the on -site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier(s). 12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Excavation 13) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the appropriate resource agencies. 14) Excavation shall not exceed -5' feet below normal low water. In no case shall the depthdexcavatioi — exceed the depth of connecting waters. W �2 U N p 15) No excavation shall take place at any time in any surrounding waters outside of the alignn -B of Ow arepC indicated on the workplan drawing(s). Q N W W 9 W Zi C) Crocker's Landing Association, Inc. Permit No.128-16 Page 3 of 4 ADDITIONAL CONDITIONS 16) Excavation shall be accomplished solely by mechanical means. Use of any other method of excavation may require modification of this permit. Spoil Disposal 17) The disposal areas shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. 18) All excavated materials shall be confined above normal high water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 19) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 20) No spoil material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 21) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Maintenance Clause 22) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Bulkhead 23) The alignment of the authorized bulkhead shall not exceed a distance of two feet waterward of the existing deteriorated bulkhead. 24) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. Permit No.128-16 Page 4 of 4 ADDITIONAL CONDITIONS 25) The bulkhead shall be constructed prior to any backfilling activities. 26) The bulkhead shall be structurally tight so as to prevent seepage of backfrll materials through the structure. 27) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 28) All backfrll material shall be clean and free of any pollutants except in trace quantities. General 29) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 30) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 31) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 32) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Nationwide Permits 3 & 35 (Action ID No. SAW-2016-02193), which was issued on 12/5/16. NOTE: The N.C. They plan to replace the existing timber bulkhead (approx. 90') with a new vinyl bulkhead approx one foot waterward of the old bulkhead. Also included in the proposal is a plan to dredge a 10' wide X 180' long area directly in front of the existing concrete bulkhead and also in front of the existing bulkhead. The plan is to dredge to a depth of 5' at normal low water. The dredge spoil will be deposited on the spoil island at the southeast corner of Motts Channel and ICW. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body." It is the staff s recommendation the replacement of the existing floating docks would continue to provide private docking space for up to 28 vessels. It appears that the project is CONSISTENT with the use standards set forth in 15A NCAC 07H .0208(b)(6); however, it appears the project is INCONSISTENT with NCAC 07H .0208 due to the proposed replacement docking system encroaching into the USACE AIW W setback requirement; however, the new facility would not encroach any further into the setback than the existing configuration as it currently remains. It is recommended that the applicant continue to display "no sewage discharge" signage and a "pump -out available" signage located adjacent to the pump -out facility to remain CONSISTENT with the Rule in 15 NCAC 7H.0208 (b) (5) (M) which states, "marinas shall post a notice prohibiting the discharge of any waste from boat toilets and listing the availability of local pump -out services." It is the staffs recommendation that the construction of a new vinyl bulkhead waterward of an existing deteriorating timber bulkhead are CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (7) (D)(ii) Use Standards for Bulkheads and Shore Stabilization Measures states "the bulkhead alignment extends no further below approximate mean high water or normal water level than necessary to allow recovery of an area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from unusual geographic or geologic features". The proposed alignment would tie into the existing bulkhead to the east and is necessary to avoid impacts resulting from disturbance of the existing deteriorating timber bulkhead. It is the staffs recommendation that the proposed maintenance excavation is CONSISTENT with the Rules of 15 A NCAC 07H.0208 (b) (1) which states, "Navigation channels, canals, and boat basins shall be aligned or located so as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as defined by the MFC, or areas of coastal wetlands except as otherwise allowed within this subchapter." PROJECT DESCRIPTION: The project site is located at 1324 Airlie Road, adjacent to the Atlantic Intracoastal Waterway (AIW W), in the City of Wilmington, New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel east on Eastwood Road (US Hwy 74n6) towards Wrightsville Beach. Turn right before the draw bridge on to Airlie Road and travel approximately 0.2 miles. The project site will be located on the left hand side of the road. Existing upland development on the property includes a two story commercial use building and parking lot at an elevation approximately of 5' above NHW. The shoreline is stabilized by an existing timber bulkhead adjacent to the existing building and a concrete bulkhead along the remainder of the property's shoreline. Upland vegetation consists of maintained lawn grass and ornamental landscaping. The existing marina consists of 3 main floating docks, arranged in a horseshoe configuration with 10 floating finger piers (6 off the inner spine and 4 off the outer spine), and associated tie pilings creating 28 boat slips. The most landward finger piers contain boatlifts for each of the slips (slip # 1-9, 20 and 21; see sheet 2 of 3). The existing finger piers off the outer spine used for wet dockage. The outside area of the floating docks creates an additional 275 linear feet of docking space. The marina also provides a portable marine pump -out facility. The marina basin is approximately 180' in length by 120' in width along the AIW W. The City of Wilmington Land Use Plan classifies adjacent waters and high ground area of project site as Commercial. There are no known archaeological sites located in the project vicinity. The waters of AIW W are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. RECEIVED PROPOSED PROJECT: OCT 18 2016 The applicant proposes to replace existing floating structures associated with the Crocker's Landing Marina, construct a new bulkhead waterward of an existing bulkhead and perform maintenance dredging. A ed1*H6rQ$1F*' of new bulkhead is proposed to be constructed approximately 1'-2' waterward of the existing timber bulkhead adjacent to the two-story building. The existing bulkhead adjacent to the two-story building is a timber bulkhead and the existing bulkhead adjacent to the parking lot is a concrete bulkhead (see site plan pg. 2 of 3). The new bulkhead will be composed of vinyl sheet piles. No new work is proposed to the existing concrete bulkhead. The applicant is also proposing to replace the existing floating dock system and associated pilings back in the same footprint. The floating dock system consists of an inner floating spine that runs parallel to the shoreline and measures approximately 5' in width by 150' in length. As shown on site plan (see site plan pg. 2 of 3) five (5) floating finger piers, each measuring approximately 4' in width by 30' in length branch off from this inner spine and allows for 9 formalized slips (slips 3-9, 20-21) which are incorporated by existing boatlifts. No work is proposed to be done to any of the existing boatlifts. There is an additional section of floating dock approximately 15' waterward of the main inner spine and running parallel to the bulkhead and measures approximately 5' in width by 42' in length. A single floating finger pier measuring approximately 4' in width by 24' in length branches off from the floating dock and allows for 2 formalized slips (see site plan pg. 2 of 3, slips 1-2) which are incorporated by existing boatlifts. No work is proposed to be done to these boatlifts. An existing access ramp measuring approximately 4' in width by 20' in length leads down from the deck of the two-story building to a floating spine that runs perpendicular to the shoreline and measures approximately 10' in width by 125' in length. This floating spine allows for 3 formalized slips on the southern side (see site plan pg. 2 of 3, slips 22-24). There is an existing floating dock measuring approximately 8' in width by 16' in length that is moored to the inside of the perpendicular floating spine and is used primarily for launching of self- propelled watercraft. The floating spine that is perpendicular to the shoreline connects to an existing outer floating spine that is parallel to the shoreline and measures approximately 12' in width by 150' in length. Four (4) floating finger piers branch off of the outer floating spine, each measuring approximately 4' in width by 36' in length. This arrangement allows for 10 formalized slips within the 4 floating finger piers (see site plan pg. 2 of 3, slips 10-19), and 4 formalized slips (see site plan pg. 2 of 3, slips 25-28) along the waterward perimeter of the outer spine. The proposed replacement of the floating dock system would continue to provide space for a total of 28 formalized slips. Crrker's Landing Association, Inc. Page 3 rkm The proposed dredge area would measure approximately 180' in length by 10' in width along the inner spine of the floating dock system. Approximately 200 cubic yards of material is proposed to be removed by mechanical dredging. The proposal would achieve a final depth of approximately -5' @ Normal Low Water from existing depths of approximately -2' NLW. The application includes authorization from the property manager for use of the spoil disposal island located at the confluence of the AIWW and Motts Channel (USACE Disposal Site No. 0248) on the portion currently owned by Agnus Beane. 10. ANTICIPATED IMPACTS: The proposed floating dock system replacement would incorporate approximately 14,700 sq. ft. of Public Trust Area and Estuarine Waters, which is currently usurped by the existing floating dock system. The new facility would continue to accommodate up to 28 vessels in accordance with the deeded slips recorded in New Hanover County Register of Deeds, Map Book 37 Page 16. No work is proposed to be done to the existing boatlifts which incorporate the existing slips off of the inner floating spine. The proposed new bulkhead would fill approximately 180' of Estuarine Waters and Public Trust Area The backfill for the proposed bulkhead would also disturb approximately 1,800 sq. ft. of highground area. The proposed marina replacement would continue to extend approximately 145' into a waterbody measuring approximately 500' across and would continue to encroach into the 80' USACE AIWW setback requirement by approximately 20'-30'. The marina would also extend approximately 20' past the r/4 width distance but would not exceed the 1/3 width distance or the established pier head line along this section of the AIW W. The proposed floating docks would not encroach into the adjacent 15' riparian corridor setback requirement to the south. The section of floating dock currently encroaching on the riparian property to the north would be replaced in the same footprint and continue to encroach in accordance with the easement and signed waiver provided in the application. The proposed maintenance excavation would impact approximately 1800 sq. I of shallow bottom area. The disposal of the approximate 200 cubic yards of material would impact highground within the allocated spoil disposal area measuring approximately 800' in length by 250' in width as indicated in the application. That's the only place it might possibly be written. Most of the permits for the docks in that area were issued sometime prior to 1990. In the late 1980s or early 1990s, the Corps established the 80' setback policy on the Atlantic Intracoastal Waterway in order to protect Its navigation servitude and for safety reasons. Docks constructed since that time are held to the 80' setback. As you will see, the right of way line and the 80 foot channel setback line impact the existing docks. I was told by Trip Pippen with Pippen Marine Construction that he and the owners were under the impression that all of the facilities on the west side of the waterway (Bridge Tender, Crockers, Dockside...) were originally permitted under a 50 foot setback from the channel. I spoke with Todd Horton with the USACE about this possibility and was told that he thought that if there was an exception, it would have been granted by the town, not the Corps. He indicated it would be more of a local pierhead line than a channel setback line. He also said that in these cases, there usually is dialogue with the town documented in the file and that he found nothing that would support this on the west side of the channel. Tony, I take it from your reply below that the town claims no pierhead line on the west side, is that correct? Pretty clearly, the facilities on the west side all encroach the 80 foot channel setback line so it seems like this would have come up at least at the time of initial construction if not down through the years when repair permits were pulled. I also am attaching an image from Google Earth with the Corps right of way line (in yellow) and 80 foot channel setback line (in red) are shown. Any insight on this will be appreciated as the client's plans and permit applications are in limbo until we get this answered.
