Any violation of these terms may oe suoject to tines, imprisonment or civil action; or may cause the permit to be null and void. Bulkhead 1) The alignment of the authorized bulkhead/riprap shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The authorized bulkhead shall be constructed landward of nomial high water and Coastal Wetlands. (See attached sheets. for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be .accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Erosion & Sedimentation -Control 9) In order to protect water quality, runoff' from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 10) Appropriate sedimentation and erosion control devices, measures or structures shall. be implemented to ensure that.eroded materials do not enter adjacent wetlands, watercourses and properly (e.g. silt fence, diversion swales or berms; etc.).: At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completioji of backfilting activities. .11) A ground cover sufficienttorestrain erosion shall be provided within 30 calendar days of completion of ' any phase of grading on cut or filled slopes. General 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior. to project initiation. 13) This Major Modification shall be attached to the.original of Permit No. 39-16, which was issued to the permittee on 3%23/16, and copies of all documents shall be readily available on site when Division personnel inspect the project site for compliance. 14) All conditions and stipulations of the active permit remain in force under this Major Modification unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The project is located at 916 S. Anderson Blvd., adjacent to Topsail Sound in Topsail Beach, Pender County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT. Waters at the site are classified as SA and are not open to shell fishing. The area is not a Primary Nursery. Area. I have reviewed this proposal for consistency with the Topsail Beach Land Use Plan and offer the following comments. The general area of the project is classified Developed, while the AECs impacted by the work are classified as Developed/Conservation. In general, the Topsail Beach Land Use Plan allows development in Developed/Conservation classified AECs which is consistent with the State's minimum use standards. The Topsail Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these more restrictive policies appear to be applicable to this project. This project is consistent with the Topsail Beach Land Use Plan Update. Historically, prior to 1954, lot 13, Block 15, (916 S. Anderson Blvd) was a salt water channel reaching to within 50 ft of Anderson Blvd. Over the years much of this channel has filled in However, 4 to 6 times per year during high tides, salt water fills the majority of the lot (Incl 2). During storms, salt water encompasses the entire area of the former channel. The area flooded, and current wetland areas are much more extensive than that depicted in the proposed permit modification. In fact the adjacent homes on lots 15B, 16 B and 17B have been flooded twice in the last twenty years. 2. Topsail Sound (Banks Channel) is Outstanding resource Waters (ORWs) as designated by the state of North Carolina. As such, it should be protected from over development, such as proposed. Removing existing wetlands from ORWs and mitigating their fill by artificially created wet lands in a non ORWs environment is not the same, and should not be permitted. This is especially true in this case where the wetlands could be preserved by placing the bulk head, if required, landward of the wetlands. In addition, the wetlands are more extensive than those shown on the proposed permit modification. (Incl 3). 3. Quinn Ventures LLC is advertising and promoting this property as suitable for construction of three single family dwellings with all permits in hand. (Incl 3) The Town of Topsail Beach indicates that no permits have been issued and construction of three dwelling on one and a half lots is a violation of cumin wain Nc DCM IL, JUN 0 9 2016 4. To CAMA Major Permit 39-16 Page Two PROJECT DESCRIPTION: The permittee is requesting approval; through this CAMA major permit modification to State Permit No. 39-16, to allow for the construction of a bulkhead and the filling of approximately 1,742 sq. ft. of "404" type wetlands. The relative information of the new project is described below. The subject property is located at 916 S. Anderson Blvd., adjacent to Topsail Sound, in Topsail Beach, Pender County. To find the property from the Wilmington Regional Office, take Highway 17 North from Wilmington approximately 20 miles and turn right on N.C. State Highway 210. Travel approximately 2.8 miles to the intersection of NC 210 and NC 50. Turn right onto NC 50/NC 210 and travel approximately 1.9 miles onto Topsail Island. Turn right onto S. Topsail Dr. /NC 50 and travel approximately 6.8 miles to a point approximately 500 feet south of Crews Avenue. The property is not marked; however, it is immediately south of Bush Marina and just north of South Beach Yacht Club. Existing man-made features include what looks to be an old subsurface bulkhead which runs approximately 20' north from the southwestern corner of the property and an old dilapidated pier that spans from the property's shoreline. The high ground portion is elevated approximately 3'-5' above the normal high water (NHW) level. Vegetation on the tract is natural and includes mostly scrub vegetation. A 0.04 acre section of "404" type wetlands exist near the center of the property. This area has been delineated and purportedly confirmed by the US Army Corp of Engineers. In addition, there is a narrow section (6-15' in width) of Coastal Wetlands along the western property boundary that traverses 2/3 d of the shoreline. The property has approximately 75 linear feet of shoreline that is naturally vegetated and stabilized. Water depths in the vicinity of the proposed water dependent structure(s) range from -1.1' to -4.5', relative to normal low water (NLW). Residential and commercial properties border the site to the north, south and east and Topsail Sound to the west. The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to fill approximately 1,742 sq. ft. of "404" type wetlands and install a bulkhead along the property's shoreline, just above the normal high water (NHW) line. As designed, and according to sheet 1 of 1 of the application package, dated received by DCM on June 6, 2016, the applicant intends to extend a bulkhead along the property's western shoreline, bordering Banks Channel. The bulkhead would be located approximately 10' above the location of the normal high water line, and approximately 2'-3' above the upper limits of Coastal Wetlands. Due to a sharp change in elevation (sand berm located just above the normal high water line), the area of Coastal Wetlands on this site is only 6'-15' wide. The proposed wall would tie in, or abut the existing walls located on either side of the applicant's property. The total length of the proposed bulkhead would be approximately 75 linear feet. Following completion of the bulkhead, the applicant proposes to place fill material behind the wall. In addition, the applicant proposed to fill a 1,742 sq. ft. section (or 23' x 76' area) of "404" type wetlands that are centrally located within the "belly" of the property. A delineation of the wetlands boundary has been conducted (by Land Management Group) and has been verified by the US Army Corp of Engineers.
