Surratt, authorizing development in the Estuarine Shoreline (AEC) at 113 SE 38th St., inOakIsland, as requested in the permittee's application, dated 4/04/2016. Thist permit, issued on 4/29/2016, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: the construction of a single family residence with associated development. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on 4/04/2016. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at (910)278-5024 for a final inspection at completion of work. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2019 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. (6) Unless specifically allowed in-15A NCAC-07k1_0209(d)(10),andshown-on the permitted plan drawing, alP- ---- development/constrvction shall be located a distance of 30 feet landward of the normal high water. No portion of the roof overhang shall encroach into the 30 ft. buffer. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. i (8) Any proposed for grading within the 30' buffer from the normal high water must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. (10) This permit does not allow any disturbance or fill in the wetlands as shown on the survey dated 41212016. (11)The proposed retaining wall shall be located landward of all wetlands. The retaining wall shall be constructed prior to any back filling activities and shall be structurally tight so as to prevent seepage of backfill materials through the structure. RE 'FIVED DCM WILMINGTON, NC JUL 2 0 2016 S I G N A T U DATE: PERMITTEE April 23, 2016 Dear Ms. Coleman: My husband and I have some concerns about the property listed for a CAMA permit at 113 SE 381' Street in Oak Island, NC. We are residents on the same street (108 SE 38`" St.) and have questions about the development of the above property. Our concerns are mostly about damage to the wetlands that border the Davis Canal and extend on to this property. Our concerns are as follows: 1) What will be the required setback from the canal for the permanent single family dwelling 2) How many trees and grasses will be removed during construction 3) What steps will the builder/ owner take as far as filling in the property to create a level building surface 4) Will the owner be required to remediate wetlands in another part of Oak Island 5) Will the owner attempt to maintain as much of the natural vegetation as is possible 6) How much fill will be necessary/ will be allowed by law 7) How far above the existing, but unpaved road, will the house structure rise 8) Will the entire property be subject to being completely filled in order to build a safe structure 9) Is the area of the property considered a flood plain and what are the rules that might apply to building a home on that flood plain 10) Will the owner be held to the maximum height limit for homes on the island (41 ft.) We realize that property owners' rights are held very sacred in the state of North Carolina. We express these concerns as we have watched the recent unbridled growth on our island. We would like to have some assurances that the property which we are discussing and its owner does not disregard the attempt and desire by many on the island to have managed, healthy, but environmentally sound building.
