(MP-1) & "Revised 9/19/19" (MP-4), incl the att workplan drawings (2) Sheets 1-2 of 2 dated 9/19/19.
This permit, issued on February28, 2020 -, is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to tines, imprisonment or civil action; or may cause me permit to oe nuu anu voiu.
Residential Marina Expansion
1) This permit authorizes only the pier, gazebo and boat lifts, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this residential marina
without permit modification. No non -water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) The authorized docking facility shall not exceed the quarter width of the water body.
(See attached sheets for additional conditions)
This permit action may be appealed by the pennittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
residential marina. Any sewage discharge at the residential marina shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
4) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or, otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit authorizes an additional 2 formalized boat slips located at the residential marina expansion
located off Lot 14 for a maximum of 18 formalized boat slips.
7) The residential marina expansion shall display a sign showing the location of the nearest pumpout
facility, including other appropriate waste disposal information, at the entrance and exit from the main
pier.
8) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
9) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches are permitted.
Lattice is specifically excluded from being used under this authorization.
10) The roof of the gazebo shall not be designed for second story use.
11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
12) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
General
13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management. .
14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

ADDITIONAL CONDITIONS
15) This Major Modification shall be attached to the original Permit No. 105-16, which was issued to the
permittee on 10/24/16, and copies of both documents must be readily available on site when Division
personnel inspect the project for compliance. .
16) All conditions and stipulations of the active permit remain in force under this Major Modification,
unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to any authorizations
required from the Town of Oak Island.
NOTE: The permittee is advised that if water utilities or new wells are required to service the authorized
development, plans and specifications for all new waterlines should be submitted and approved
by the Public Water Supply Section prior to the initiation of construction. Furthermore, water
supply wells must be approved by the county in which the subject property is located, and local
cross -connection requirements may be required. Public Water Supply can be contacted at (910)

NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2017-00629.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2016-0599 v2.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The site is comprised of many different habitat types, such as coastal marsh, maritime forest and bottomland hardwood
forest, which all contain different woody, herbacious and shrub vegetation. Within the area of the proposed work, the
vegetation consists primarily of Spartina altemaffora, Distichlis spicata and Juncus.

9. PROJECT DESCRIPTION:
The applicant's property is located along E. Yacht Drive between NE 6151 and 62rd Street, adjacent
the Atlantic Intracoastal Waterway (AIWW), in the Town of Oak Island, Brunswick County. To
find the project site, travel south on US Highway 17 to NC Highway 133 South. Travel
approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-133.Turn onto Dosher Cutoff
and then turn right on Southport -Supply Rd. SE/ NC-133. Travel approximately 0.8 mile and turn
left onto NC-133. Travel on NC-133 to Oak Island and turn right on East Oak Island Drive. Travel
approximately 1.7 miles to NE 62n° Street. Make a right onto 62"d Street and follow to the street
end. The project site will be located along E. Yacht Drive between NE 61st and NE 62nd Streets
and adjacent to the Atlantic Intracoastal Waterway.
The property consists of a 14-acre parcel, comprised of approximately 4.24 acres of uplands.
Elevations on the property range from 0 to 10 feet above Mean High Water (MHW). The property
is permitted for a 14 lot subdivision called the Village at Lucas Cove that is not fully developed,
but is currently under construction. The project site is bordered by a single family residential
development to the south, east and west along E. Yacht Drive and the AIWW to the north. The
properties consist of areas of high ground that are separated by "404" wetlands in areas with
lower elevations and coastal wetlands are present adjacent to the high ground and along the
shoreline. There are two upland hummocks along the eastern and western portions of the
property nearest the AIWW. High ground vegetation on the tract consists of mature hardwood
trees, including Eastern Red Cedar (Juniperus virginiana) and Wax Myrtle (Myrica cerfera)
located within areas having lower elevations. Coastal Wetlands are present at lower elevations
and consist of Black Needlerush (Juncus roemerianus), Giant Cord Grass (Spartina
Cyanocorodies), Salt Meadow Grass (Spartina patens) intermixed with some Spike Grass
(Distichlis spicata), Sea lavender (Limonium spp.) and Glasswort (Salicomia spp.) landward of
the Mean High Water (MHW) boundary. The Coastal Wetlands located water ward of MHW
consist primarily of Smooth Cord Grass (Sparfina alterniflora). The wetlands range in width from
10 to 200 feet. The wetlands on the site are fed by two water features on the property, one near
the eastern property boundary and one adjacent to the AIWW. The creek adjacent to the eastern
property boundary is connected to a tidal pond that is approximately 400 feet long and 60 feet
wide extending north to south on the property. A small creek contiguous with the AIWW extending
north to south essentially bisects the property and likely conveys storm water runoff from the high
ground adjacent to Yacht Drive.
State Permit No. 105-16 was issued on October 24, 2016 for the development of a 14-Lot
subdivision including, a bulkhead, wooden access bridge with gravel approach, paved road,
wooden walkway, and a 16-slip docking facility. The applicant was authorized to impact
approximately .0445 acres (19,384 square feet) of "404" type wetlands for the construction of the
subdivision Lots and associated infrastructure. A new 1,055 linear ft. vinyl bulkhead was
constructed along the shoreline adjacent to the eastern property boundary connecting to the
existing 100 linear ft. bulkhead. A gravel access road was constructed to provide access to Lot
14 via a vehicular access bridge, measuring approximately 151 feet in length and 13 feet in width,
spanning wetland areas. The 16-slip docking facility is located near the western boundary of the
property and is accessed from the common area located between Lots 4 and 5. The wooden
access pier extends approximately 306 feet to a gazebo measuring approximately 16 feet wide
by 16 feet long. The wooden access pier then extends into the AIWW where it connects via

ramp to a floating docking system. The main spine is a floating dock, measuring approximately
8 feet wide by 292 feet long, oriented parallel to the federal channel. There are nine (9) finger
piers each measuring approximately 4 feet wide by 42 feet long creating sixteen (16) boat slips
extending perpendicular to the shoreline.
The Town of Oak Island Land Use Plan classifies the high ground portion of the project area as
R6A High Density Residential. The waters of the Atlantic Intracoastal Waterway (AIWW) are
classified as SA NC Division of Water Resources. They waters of the AIWW ARE designated as
Primary Nursery Area (PNA) by the NC Division of Marine Fisheries and are CLOSED to the
harvesting of shellfish. There are no known archaeological sites within the project vicinity.
PROPOSED PROJECT:
The applicant is proposing a major modification to construct an additional docking facility from Lot
14 with a covered gazebo and two boatlifts for a total of 18 slips at the Village at Lucas Cove
subdivision. A proposed 205 linear ft. pier would extend from the high ground of Lot 14, which is
developed with a single-family home and is owned by the developer, to a private 18 ft. long by 16
feet wide covered gazebo with two adjacent boatlifts, one to the east measuring 12 feet in length
by 12 feet in width and one to the west measuring 12 feet in length by 14 feet in width. As
proposed the docking facility would be within the same riparian corridor as the previously
permitted 16 slip docking facility and would not encroach into the adjacent 15 ft. riparian corridor
setback. The proposed docking facility would be located approximately 37 feet landward of the
USACE 80 feet federal channel setback in this location. Water depths adjacent to the proposed
docking facility are approximately -8 feet at Mean Low Water (MLW) relative to NAVD88.
10. ANTICIPATED IMPACTS:
The proposed docking facility would result in additional shading of approximately 210 square feet
of Coastal Wetlands and additional incorporation of approximately 1572 square feet of open water
within the Coastal Wetland, Estuarine Waters and Public Trust Areas AECs. As proposed, the
docking facility would not extend beyond the quarter width of the waterbody nor encroach into the
80 feet federal channel setback in this location. The proposed docking facility would not encroach
into either of the 15 feet adjacent riparian property setbacks, but would be within the same riparian
corridor as the previously permitted 16 slip docking facility. Temporary increases in turbidity
during construction should be expected to result.

Southern Environmental Group, Inc. (SEGi) has been retained by Mr. David Purser, of C&D Homes, LLC (see
Attachment 1), herein referred to as the "Applicant", to seek a Major Modification to CAMA Major Permit No.
105-16. That being said, attached please find the CAMA Major Permit Application packet (Attachment 2), which
information regarding the Applicant's proposed pier, gazebo and two boat lifts, to be located on his property,
within the Lucas Cove Subdivision, in Brunswick County, North Carolina (see Attachment 3).
Site Information and History:
Lucas Cove S.D. was issued CAMA Major Permitj)(5-I10which authorized upland development, such as roads,
infrastructure and single-family dwellings, as well as a vehicular bridge, elevated footbridges and a 16-slip,
docking facility (see Attachment 4). Several houses, the vehicular bridge, footbridges and docking facility have
been constructed (see Attachment 5). The proposed work will take place within uplands, on the Applicant's
property, extend out over coastal wetlands and through lands owned by Lucas Cove, and terminate landward of %,
the distance of the waterbody, which is the Atlantic Intracoastal Waterway. The average mean -low water depth, at
the waterward end of the structure, is approximately -7.7'. Please see Attachment 6, for details of the project.
Proposed Work:
The Applicant intends to construct a 205' x 6' pier and the 18' x 16', covered gazebo, a 12' x 14' boat lift and a
12' x 12' boat lift (see Attachment 6). Typical marine construction materials will be utilized to build the proposed
structure. To ensure protection of the West Indian manatee (Trichechus manalus), the work will be undertaken
between November I and May 31. If this is not possible, the Applicant will adhere to the US Fish and Wildlife's
guidance entitled "GUIDELINES FOR AVOIDING IMPACTS TO THE WEST INDIAN MANATEE,
Precautionary Measures for Construction Activities in North Carolina Waters" (see Attachment 7).

The additional docking facility would provide docking space for two additional vessels at this
location for a total of 18 formalized slips. The applicant's current docking facility is located in -8 to
-10 ft. of water at MLW NAVD88, the proposed docking facility expansion would be located in
water depths measuring approximately -8 ft. at MLW.
It is staff's recommendation that the proposal appears to be consistent with the use standards
set forth in NCAC 07H .0208(b)(5) and NCAC 07H .0208(b)(5). This office has no objection to
the proposed project provided it is consistent with all other state and federal permitting
requirements. Any permit issued should include standard conditions for docking facilities.

Title 15A Subchapter 18C Section .0301 Rules Governing Public Water Systems, Plans and
Specifications should be submitted and approved by the Public Water Supply Section for all -
new waterlines prior to construction beginning. Please indicate if you are providing water
service to the individual boat slips. If water service is being provided your system may
meet the requirements of a Public Water Supply System as it contains 15 or more
connections, plans and specs will need to be submitted (currently showing Town of Oak
Island as the provider, please verify prior to approval). Please also be aware of our
separation requirements in regards to water/sewer according to 15A NCAC 18C
Section .0906 Rules Governing Public Water Systems. Check with the local water system for
cross -connection requirements for this project. Public Water Supply Section guidelines are
listed in Appendix B, Figure 2 in the Rules Governing Public Water Systems but the water
system may have additional requirements.

At their meeting of August 26, 2016 the Board of Adjustment passed a motion to approve
the application for a Variance for relief from the towns dock regulations. The Board of
Adjustment in addition to their approval of the proposed docking area has required three
conditions: that lighting installed on the property must comply with the provisions for
town lighting in Chapter 18 — Division 1 I and shall be installed in a manger that prevents
trespass onto adjoining properties and controls glare on the public right-of-way and on
public trust waters, watercraffs docked or stored at the facility shall not be used as living
quarters, and that the docking facility shall be compliant with NC Fire Code Chapter 45.
The Board of Adjustment held an evidentiary hearing and considered the application at
their meeting on August 26, 2016 at 10:00 a.m. The Board of Adjustment of the Town of
Oak Island upon 4/5" vote approved your request with the above conditions. The General
Statutes do not specify an amount of time the applicant has to build after being granted a
variance. Please note that before you can begin construction, you must obtain the proper
permits from the Development Services Department. Please record this variance permit at
the Brunswick County Register of Deeds. The variance runs with the land, regardless of
owner, and lasts in perpetuity.

Consistency Determination:
This project is consistent with the 2017 Town of Oak Island Comprehensive Land Use Plan.
The applicant proposes a major modification to construct an additional docking facility
from Lot 14 with a covered gazebo and two boatlifts for a total of 18-slips at the Village
at Lucas Cove in Oak Island.
I have reviewed this proposal for consistency with the Town of Oak Island CAMA Land
Use Plan and offer the following comments.
The general area of the project is classified as R6A-Higher Density Residential. Waters
at the project site are classified as SA and are not open to the harvesting of shellfish. The
area is a Primary Nursery Area. Areas of Environmental Concern (AEC's) are CW, EW
and PTA.
Oak Island allows development in Residential classified AECs, which is consistent with
the State's minimum use standards. The Oak Island Land Use Plan contains some
policies, which exceed the State's minimum use standards. However, none of these
policies appear to be applicable to this project.
This project is consistent with the Town of Oak Island Land Use Plan Update.

The Division of Water Resources (DWR) has received a copy of your CAMA Major application
request dated received by this office on December 20, 2019. DWR issues approval in the form
of a Water Quality Certification (WQC) in conjunction with the CAMA Major Permit and General
Permit(s) 198000291 or 197800056 issued by the US Army Corps of Engineers (USACE). This
Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in
your application do not require written authorization to utilize GC 4175. However, you are required
to follow the conditions listed in the attached certification. You should get or otherwise comply
with any other federal, state and local requirements before you go ahead with your project
including (but not limited to) erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by

With this correspondence, Southern Environmental Group, Inc. (SEGi) is notifying you of the proposed
construction of a docking facility, which is to take place on property adjacent to land depicted as being owned
by the Town of Oak Island, by the Brunswick County GIS system. SEGi has been retained by the property owner,
C&D Homes, LLC (Mr. David Purser), to notify the adjacent property owner(s), which is required as part of the
Coastal Area Management Act (CAMA) Major Permit application process.
The Applicant intends to construct a 205' x 6' pier, 18' x 16' covered gazebo and two (2) 14' x 12' boat lifts
(see Attached Site Plan).
To assist you in the decision -making process, attached you will find the Project Narrative (i.e. CAMA Major
Permit Application Cover Letter), CAMA Application and Site Plan. Should you have any objections to this
proposal, please send your written comments to Ms. Tara MacPherson, of the Division of Coastal Management,
at the Wilmington District Office, 127 Cardinal Drive Extension, Wilmington, North Carolina 28405, within 10

Hi Dana -
Tara asked me to weigh in on this. Am I correct that you sent notice to Mr. Giangoia via certified mail return receipt
requested, but it was not signed for when delivery attempted and was not collected otherwise from the post office? Did
they sign for the notice you did last February at the same address but are not signing now (because- you assume- of his
health issues)?
Have you or your clients made any other attempts to directly notify the neighbor? Phone call? Email? These other
methods can work too if certified mail does not as long as you document it.
The Chair of the CRC, through a fairly recent third -party case, has directed DCM to strictly follow the adjacent riparian
owner notification rules, and so that's why we are being more strict in having proof of notice as part of a complete
application as required per 71 .0204. Proof of notice is part of a complete permit application, and one certified mail
delivery attempt is not enough to move forward. Please attempt notice in some other way and document your efforts.
A simply google search indicates that Mr. and Mrs. Giangoia are registered to vote at the E Yacht Drive OI address. See if
your client has an email address for them, a phone number, and then try contacting them directly.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent
for C & D Homes, LLC for State approval for development of the subject property located in the Lucas
Cove Subdivision at Property ID 236PP014 & 23611001, adjacent to the AIWW, on Oak Island in
Brunswick County. It was received as complete on December 10, 2019 and appears to be adequate for
processing at this time. The projected deadline for making a decision is February 23, 2020. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 10, 2010 you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status
of your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designerfconsultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

Good Morning, Can we set up a site visit for the Lucas Cove project? I need to make sure that everything is good to go
onsite before we can modify the permit.
We do need to submit this as a major modification to State Permit No. 105-16 since it is in the same riparian
corridor. Can you modify to reflect that and add that permit to the MP-1? Permit No. 56-17 was actually for another
property altogether.
A few other things:
1. Drawing sheet 1 of 2 is not 1"=20 ft. scale. What should the scale be for that?
2. Are the water depths on Sheet 2 of 2 at NLW or MLW? It does not say -8 ft. at so I was not sure.
3. Boat lift dimensions are on the drawing as 12 x 12 and 14 x 12 and on the MP4 (1f), in the narrative, and MP-4
(8) are listed as both 14 x 12, please confirm.
4. Property owner notifications need to be updated to reflect the adjacent riparian properties (same for the
original submittal for Permit No. 105-16 if you do not have them). I think we already talked about this though
