as authorized by the State of North Carolina, North Carolina Department of
Environmental Quality and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management'
Issued to James & Theme Cherry, authorizing development in the Estuarine Shoreline - ORW (AEC) at 5 Sandy Point,
in Wilmington, NC, as requested in the permittee's application, dated May 23, 2016. This permit, issued on June 3,
2016, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject perrlittee to a
fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: Demolition of existing structure & driveway
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on May 25, 2016.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit
(4) A copy of this permit shall be posted or available on site. Contact this office at 910-798-7118 for a final inspection at
completion of work.

This permit action may be appealed by the pemrltee or other qualified persons
within twenty (20) days of the issuing date. ThIs perm2 must be on the project
site and accessible to the permit officer when the project is inspected `or
compliance. Any maintenance work or project modification not covered under
tlas permit, require funherwribn permit approval. All work must cease when this
permit ores on:

In issuing this permit it is agreed that this praect Is consistent with the local Land
Use Plan and aA applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division or Coastal
Management.

(5) The amount of impervious surface shall not exceed 25% of the lot area within 575 feet of Normal High Water
(Estuarine Shoreline - ORW Area of Environmental Concern), in this case, no new impervious is authorized.
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of Normal High Water. No portion of the
roof overhang shall encroach into the 30 ft. buffer.
(7) All unconsoiidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been property stabilized with a vegetative cover.
(8) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional
stonnwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in
a vegetated state.
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.

may be susceptible to erosion and/or flooding. I acknowledge that the Local Permit Officer has explained to me the particu-
lar hazard problems associated with this lot. This explanation was accompanied by recommendations concen ing stabiliza-

This notice is intender) to make you, the applicant, aware of the
special risks and conditions associated with development in this
arsa, which is subjeetto natural hazards such u storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive anAEC Hazard Noticz. and acknowledge
that notice in writing bethre a permit for development can ba
isatied.
The Camntission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to
the ,development. Permits isued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled it they become imminently threatenedby
changes in shoreline configuration. The structrire(s) must be
relocated) or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the sonual Ia,tg-tcrm
average mean erosion rate for the area where your property is
loca0.:d is feet per yasr.

Studies also indicate that the shoreline could move as much as

structures such as bulkheads, seawid Is, revotmmts, groins, jetties
and breakwaters are prohibited. Temporary snnd bags may be
authorized under certain conditions.
The applicant most acknowledge this information and requirements
by signing this notice in the space balow. Without the proper
signature, `ohs application will not be complete.

SPECIAL NOTE: This hazard notice is requiredfor development
i n areas subject to sudden and massive storms and erosion. Permits
issued for dcvelopmatt in this area expire on Decantbt r31 of the
third year following the year in which the permit was issued.
Shortly before work begins on the project site, the Local Permit
Officer must be contacted to determine the vegetation tine and
setback distance at your Site. If the property has seen lithe change
since the time of permit issuance., and the proposed development
can still meet the setback requirement, the LPO will inform you
that you may ih:gin Nvork. Substantial progress on the project
must be made within 60 days of this sotback determination, or
the setback must be remeasured. Also, She occurrence of a major
shoreline change as the result ofa storm within die 6q-day period
will necessitate remensurement of the setback. It is important

approval to continue the work after the permit has expired.
