Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been property stabilized with a vegetative cover. (8) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. The site is located east and adjacent to the intersection of Futch Creek Road and Decoy Lane in Wilmington, North Carolina. The subject site is comprised of four parcels, each independently owned: • 1001 Futch Creek Road, Parcel Identification Number (PIN) R02919-001-001-000, owned by Mr. Wayne Beagle • 1005 Futch Creek Road, PIN R02919-001-030-000, owned by Mr. Doug Klem • 1004 Creekside Lane, PIN R02919-001-025-000, owned by Mr. Jason Lanier • 8209 Decoy Lane, PIN R02919-001-007-000, owned by Mr. David Frey There is a topographic depression located on the central portion of the site, primarily located on the Klem, Lanier, and Beagle parcels. During periods of moderate to heavy rain, water collects in the topographic depression. The standing water has no point of discharge and encroaches into the street and surrounding residential properties. The proposed solution includes a drainage swale, weir box, drainage pipes, and rip -rap spillway. The rip -rap spillway will be located within 30-feet of coastal wetlands. Therefore, a permit as per the Coastal Area Management Act (CAMA) is needed. On March 29, 2015, Mr. John Policarpo of the United States Army Corps of Engineers conducted a site visit and determined there are no wetlands located within the topographic depression. Since the Beagle/Kem parcels are the most affected by the flood events, Mr. Klem will act as the primary applicant. The remaining owners are co -applicants.
