Dear Mr. Jim Busby:
I have reviewed the information submitted to this office in your inquiry concerning the necessary
filing of an application for a minor development permit under the Coastal Area Management Act.
After making a site inspection on February 16, 2016. 1 have determined that the activity you propose
is exempt from needing a minor development permit as long as the project remains in accordance
with your project scope submittal, which was received by this office on February 11, 2016 and meets
the conditions specified below. If your plans should change and your project will no longer meet
these conditions, please contact me before proceeding.
15A NCAC 07K .0209 Any structure, or part thereof, consistent with current CRC rules may be
maintained, repaired or replaced in a similar manner, size and location as the existing structure
without requiring a permit, unless the repair or replacement would be in violation of the criteria set
out below:
(1) the development must not disturb a land area of greater than 200 square feet on a slope
of greater than 10 percent;
(2) the development must not involve removal, damage, or destruction of threatened or
endangered animal or plant species;
(3) the development must not alter naturally or artificially created surface drainage channels;
(4) the development must not alter the land form or vegetation of a frontal dune;
(5) the development must not be within 30 feet of normal water level or normal high water
level; and
(6) the development must be consistent with all applicable use standards and local land use
plans in effect at the time the exemption is granted.

Structures may be repaired in a similar manner, size, and location as the original structure. No
expansions or additions are permissible and the following specific conditions apply:
1. The project consists of the repair and replacement of concrete and the expansion of a catch
basin area to promote stormwater infiltration.
2. The project shall adhere to the scope of work that was submitted to this office.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any

Re: Proposed Project: Driveway Repair at 17 E. Atlanta St
Zack,
Further to our conversation this afternoon, we would like to eliminate a drainage issue in our driveway
behind 17 E. Atlanta. This driveway also services 19 E. Atlanta. We own both of these houses, and we
own the driveway.
There is a catch basin in the middle of the driveway (see diagram) which is clogged with sand, and no
practical way to prevent future clogging. We propose to remove a section of the concrete measuring
approximately 15' x 15' surrounding the existing catch basin. We will excavate in that 15' x 15' area
approximately 3' deep around the existing catch basin, which will remain. We will then line the
excavated hole with filter cloth, fill with stone, and cover with filter cloth. This will serve as a storm
water infiltration system. We will then pour a 4" concrete slab over the repaired area.
There is an additional 13' W x 9' L section of driveway which abuts Atlanta Street behind 15 E. Atlanta.
We also own this part of the driveway. This section is cracked and buckled. There are TOWB water and
sewer lines running beneath this section. We propose to remove and replace the cracked and buckled
concrete. I spoke with Jonathan Babin ofTOWB Public Works who visited the site. He gave the go
ahead from his standpoint, and said that he would have someone mark where the water and sewer lines
run. He also gave the OK to form a ridge where the driveway abuts Atlanta Street which will divert run-
off water to the east end of the street rather than flowing down our driveway.
We are requesting a CAMA exemption for this project.
