This permit, issued on March 7, 2016 is subject to compliance with the application (where consistent wish the permit), all applicable regulations, special conditions and notes sef forth below. Any violation of these terms may -besubject to fines, imprisonment or civil action; or may cause the permit to be null and void. Doeking Facility. 1) This permit authorizes only the addition of a finger pier and two boat lifts, and other uses located in or over the water that are expressly and specifically set forth in the. permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the r' expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the petmittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. ' r (See attached sheet for Additional Conditions) 1 .. Brock Permit No. 33-16 Page 2 of 2 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance'with the terms and conditions of this permit. The permittee. is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain of his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent . reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 2 formalized boat slips at the expanded dock. -6) The expanded dock and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. 7) , ` No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. ;, q);: -, No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. ---NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. -NOTE: �.s NOT i;. The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2016-00336), which was issued on 2/25/15. The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 20160125. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The penmittee is further advised that many non -water dependent activities are not authorized within 30 feet of,the normal high water level. An application processing fee of $250 was received by DCM for this project. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS I I3A-121.1 or 113-229. Existing Piers= 6' wide by 113' long = 678 sq. ft. (not counted- access) 2"d Access Pier 7' wide by 14' long = 98 sq. ft. Existing Fixed Platform = 16' wide by 23'long = 368 sq. ft. (16' x 16' covered) Existing Step -Down Platform= 3' wide by 16' long = 48 sq. ft. Existing Floating Platform-— 8' wide by 33' long = 264 sq. ft. Total= 874 sq. ft. (778 sq. ft. existing + 96 sq. ft. proposed) , The construction would provide docking space for an additional two (2) slips for a total of six (6) vessels at this location. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b) (k), including the '/. width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open water. This office has no objection to the proposed work provided it is consistent with all other state and federal permitting requirements. It is recommended that any permit issued should include standard conditions for private docking facilities. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number 3883 (GC 3883). This Certification allows you to use the General Permit 198700056 when issued by the US Army Corps of Engineers and the CAMA Major Permit when issued by the Division of Coastal Management. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non - discharge, and stormwater regulations. Also, this approval to proceed with your proposed Impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the General Permits or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this General Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur Approved plans and specifications for this project are incorporated by reference and are enforceable parts of this permit (15A NCAC 02H .0501 and .0502). 3. Turbidity Standard The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as described in 15 A NCAC 2B..0221. Appropriate sediment and erosion control practices must be used to meet this standard. Turbidity curtains s hall be used as appropriate. Please notify this Office if any turbidity Issues arise at §10.796.7215 4. Any final construction plans for this project must include or reference the application and plans approved by the DWR under the authorization letter and certification. The applicant will also be required to evaluate all acquired permits to assure that they are consistent and all relative Impacts are accounted for and shown on the construction plans .[15A NCAC 02H .0502 (b) and 15A NCAC 02H .0506 (4)] 5. The permitee shall require its contractors and/or agents to comply with the terms of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project a copy of this certification. A copy of this certification including all conditions shall be available at the project site during the construction and maintenance of this project. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from hydrocarbons or other potential toxic chemicals. In the event of a hydrocarbon or chemical spill, the permitee/contractor shall immediately contact the Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington Regional Office at 910.796.7215 or Steve Lewis at 919.807.6308 and after hours and on weekends call the USCG National Response Center at 1.800.424.8802. PROJECT DESCRIPTION: The subject property is located at 1182 B N. Anderson Blvd., adjacent to Topsail Sound, in Topsail Beach, Pender County. To find the property from the Wilmington Regional Office, take Highway 17 North from Wilmington approximately 20 miles and turn right on N.C. State Highway 210. Travel approximately 2.8 miles to the intersection of NC 210 and NC 50. Turn right onto NC 50/NC 210 and travel approximately 1.9 miles onto Topsail Island. Turn right onto S. Topsail Dr. NC 50 and travel approximately 5.4 miles. The property will be located on the right off of a shared drive way with 1180 N. Anderson Blvd. Existing man-made features include a single family residential dwelling, a bulkhead, and a private docking facility with two (2) separate access piers. High ground vegetation consists of lawn grass and ornamental shrubs. The high ground portion is elevated approximately 3'-5' above the normal high water (NHW) level. There is an existing bulkhead which runs the perimeter of the property's shoreline, for a total length of approximately 225'. Existing coastal wetland vegetation includes Smooth Cord Grass (Spartina alterniora) which borders the SW portion of the properties shoreline. The pier located on the southern portion of the property extends approximately 127' into a water body measuring approximately 1307' across. A 16'wide by 23'long partially covered fixed platform is attached to the waterward end of the pier. Two (2) jet ski lifts each measuring approximately 4' in width by 6' in length are attached to the north side of the pier. There is also a stepdown fixed platform 3' in width by 16' in length attached to the north side of the pier. The second access pier, located on the northern portion of the property is approximately 7' in width by 14' in length and is attached by a ramp to a floating dock 8' in width by 33' in length. The pier and floating dock extend approximately 62' into a waterbody measuring approximately 1307' across. There is an existing 12' wide by 12' long boat lift attached to the southern side of the floating dock. The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Based on visual observations made by DCM staff during the January 2016 site visits, there appears to be Submerged Aquatic Vegetation (SAV) in the surrounding area; however, there does not appear to be any within the immediate vicinity of the proposed project. The waterward extent of the existing docking facility is approximately 123' from the U.S. Army Corps of Engineers federal channel setback. Water depths in the vicinity of the existing water dependent structure(s) range from 4' to -6', relative to normal low water (NLW). Residential properties with private docking facilities border the site to the north and south. PROPOSED PROJECT: The applicant proposes to expand an existing docking facility by installing a finger pier and two (2) boatlifts. The proposed finger pier, 4' in width by 24' in length, would be attached to the northern side of the existing access pier located on the southern portion of the property. The finger pier would run parallel to the shoreline and extend from the spine of the existing pier and contain two (2) proposed boatlifts (each measuring approximately I V x 13') one on each side of the proposed finger pier. A total of two (2) additional slips are being proposed with this development plan, making a total of six (6) slips on the property. Water depths in the vicinity of the proposed structure range from 4' to -6' (at normal low water). RECEIVED JAN 21 2016 Brock Page 3 10. ANTICIPATED EWPACTS: The proposed structures would incorporate approximately 239 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed structures would extend approximately 130' feet offshore and terminate just inshore of the existing pier -head line, which is located at the waterward end of the existing pier. The proposed finger pier and boatlifts are well landward of the established pier -head line. The adjacent property owner to the south (Ormond) has waived the 15'Riparian Corridor Setback Area requirement even though the existing and proposed structures do not appear to encroach. The second existing access pier on the northern portion of the property meets the 15' Riparian Corridor Setback Area requirement of the adjacent property owner to the north (Nicholson). The docking facility would remain consistent with the 'A width rule and established pier head line. Minor increases in turbidity should be expected during construction.
