This permit, issued on November 23, 2016 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be suoject to tines, imprisonment or civn action; or may cause the permit to be nun and void. Docking Facility 1) This permit authorizes only the addition of a boatlift and the replacement of the floating dock, jet ski dock, octagonal platform, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification: 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Donald c& Barbara Britton ADDITIONAL CONDITIONS Permit No.124-16 Page 2 of 3 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 3 formalized boat slips. 6) Should the adjacent property to the east be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 7) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. M� MN� G General 10) This permit does not authorize any new impervious surfaces within 30 feet of the normal high water line. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations, undertaken by the United States in the public interest. 14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the pemuttee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water line. One thing I wasn't clear on was whether the existing octagonal platform is currently roofed, or if they are proposing a roof , as indicated on the label on the plan (but not shown on the side view). Do you recall whether or not it is currently roofed? If not, just make sure they know they can't build any new roofed area landward of the bulkhead in the 30' buffer. If existing, they can rebuild it as is. Fixed Platform = 14 ft. x 14 ft. = 196 sq. ft. Walkway/Catwalk = 3 ft. x 12 ft. = 36 sq. ft. Floating Dock = 60 ft. x 6 ft. = 360 sq. ft. (not calculated in overall square footage due to alignment) Jet Docks = 10 ft. x 13 ft. = 130 sq. ft. Boatlift = 13 ft. by 13 ft. = 169 sq. ft. (incorporated but no calculated in overall square footage) Total = 722 sq. ft. (362 sq. ft. calculated toward allowable square footage) It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the 1/4 width rule and the eight square foot rule. The proposed structures would be located entirely over open water. The proposed docking facility would allow for a maximum of three (3) formalized slips. The applicant proposes to install a new boat lift and replace the existing fixed platform, floating dock and jet docks for an existing private docking facility. The project is located at 133 Gazebo Court adjacent to Inlet Point Canal and Myrtle Grove Sound in Wilmington, New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT. Waters at the project site are classified as SA and are open to the harvesting of shellfish. The area is a Primary Nursery Area. I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover County CAMA Land Use Plan and offer the following comments. The general area of the project is classified as Resource Protection. In general, Wilmington -New Hanover County allows development in Resource Protection classified AECs, which is consistent with the State's minimum use standards. The Wilmington -New Hanover County Land Use Plan contains some policies, which exceed the State's minimum use standards, however none of these policies are applicable to this project. This project appears to be consistent with the 2006 Wilmington -New Hanover County Joint Land Use Plan Update. VAN DER VAART Secretary TRACY DAVIS Director On September 8, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on September 12, 2016 has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed, whichever occurs first. PROJECT DESCRIPTION The project site (property) is located at 133 Gazebo Court (off NC Hwy 421), off Inlet Point Canal which is adjacent to the AIWW/Myrtle Grove Sound, in Wilmington, New Hanover County. To locate the property from Market Street travel south on College Road (NC Hwy 132) and continue south for approximately 5 miles on Carolina Beach Rd. (NC Hwy 421). Make a U-turn, take the first right into the Inlet Point Subdivision onto Inlet Point Drive and keep right at the fork to continue on Inlet Point Drive for approximately 0.1 miles. Take a left on Gazebo Court and continue for approximately 0.2 miles. The project site will be located on the left side of the road. There is a gate at the entrance to the subdivision and the gate code is #4633. Existing structures on the project site include a single family residence and private docking facility. The project site is approximately 0.35 acres and is vegetated primarily with domestic grasses and ornamental landscaping. The project site has approximately 245' of shoreline frontage along Inlet Point Canal that has been stabilized by a fiberglass composite bulkhead. Approximately 140' of the property's shoreline frontage is deeded as a community docking easement for the Inlet Point HOA. No wedand vegetation is present water -ward of the existing bulkhead and normal high water (NHW) meets the bulkhead. The existing docking facility consists of an existing octagonal fixed platform measuring approximately 14' x 14' that extends from the northwest corner of the bulkhead. An access ramp leads from the platform onto a floating dock, which measures approximately 60' in length by 6' in width running parallel to the shoreline. Two (2) existing jet docks that together measure approximately 10' x 13' are located at the southeast end of the existing floating dock. The New Hanover County Land Use Plan classifies the adjacent waters as Conservation and the adjacent high ground portion as Developed. The waters of Inlet Point Canal and Myrtle Grove Sound are classified as SA, by the NC Division of Water Resources. These waters are designated as PNA by the NC Division of Marine Fisheries and are closed to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to install a new boat lift and replace the existing fixed platform, floating dock, and jet docks for an existing private docking facility. The applicant states that a boatlift measuring approximately 13' in length by 13' in width would be installed west of the existing octagonal fixed platform. The applicant is proposing to replace the octagonal fixed platform which measures approximately 14' in width by 14' in length. The proposal includes a new walkway measuring approximately 3' in width by 12' in length that would allow for access between the proposed boatlift and fixed platform. The proposal also includes replacement of the existing 6' in width by 60' in length floating dock as well as the replacement of the existing jet docks measuring approximately 10' in width by 13' in length. All of the existing structures would be replace within their existing footprint. The proposed docking facility expansion would provide docking space for up to three (3) vessels within existing water depths of approximately -5' at mean low water (MLW). The community maintains an active CAMA Major Permit (#160-05) for maintenance excavation. 10. ANTICIPATED IMPACTS The proposed new boatlift and walkway would incorporate an additional 205 sq. ft. of Estuarine Waters and Public Trust Area. The replacement of the existing fixed platform, floating dock, and jet docks in the same footprint would continue to incorporate approximately 686 sq. ft. of Estuarine waters and Public Trust Area. The proposed structures appear to conform to the 1/4 width rule and the established pier lengths within the man-made channel. The proposed structures would encroach into the eastward adjacent 15' Riparian Corridor Setback Area requirement with the proposed jet docks. The applicant has received a waiver from the property owner for this encroachment. The Inlet Point Harbor Architectural Review Committee has approved the proposal and the location of the proposed boatlift in regards to the adjacent community docking easement. This proposal would allow for a maximum of three (3) formalized slips. Minor turbidity increases should be expected during construction.
