This permit, issued on October 5.2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docldn¢ Facility 1) This permit authorizes only the dock, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the pemtittee is responsible. This prohibition shall be applied and eltet ; throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) O C T 1 0 p r This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee Randolph & Sylvia Brecheisen ADDITIONAL CONDITIONS Permit No.108-16 Page 2 of 3 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes 1 formalized boat slip. 6) In accordance with commitments made by the permittee, and in order to satisfy fisheries habitat resource concerns, the existing boat lift shall be removed and relocated from the adjacent shared pier to this docking facility. Physical stops shall be placed on the boat lift at a minimum height of 18" above the bottom substrate to prevent the lift from disturbing the bottom substrate. The physical stops shall remain in place for the life of the docking facility. 7) Should the existing boat lift not be relocated to the new permitted docking facility, the existing lift referenced in the application shall be removed in its entirety prior to the constriction of the authorized docking facility. 8) In accordance with commitments made by the permittee, and in order to satisfy fisheries habitat resource concerns, the dock shall be constructed as a fixed step-down platform, rather than the floating dock shown on the plans. The fixed step down shall be utilized for temporary tie up only. 9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 10) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 11) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 12) The authorized boathouse and covered platform shall be single story, and shall not be designed to allow for second story use. 13) No attempt shall be made by the permittee to prevent the full and firz use by the publif6Cggvabllee� waters at or adjacent to the authorized work. OCR 10 Jp$ 14) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance y4tll J C T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging gQi excAvation " within the PNA shall be permitted. Dredging in any manner, including "kicking" withHOat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. �Y Randolph d& Sylvia Erecheisen Permit No. 108-16 Page 3 of 3 ADDITIONAL CONDITIONS General 15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 18) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Pen -nit 197800056 (Action ID No. SAW-2016-01386), which was issued on 7/13/16. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 16-0660, NOTE: An application processing fee of $250 was received by DCM for this project. The applicant proposes to remove an existing boatlift associated with an existing shared pier and construct a new private pier with a covered platform, floating dock and boatlift. The project is located at 216 shoreline Drive adjacent to the AIWW in Sunset Beach, Brunswick County. Areas of Environmental Concern (AEC's) impacted by the proposal are ES, EW, CW and PTA. Waters at the project site are classified as SA and are not open to the harvesting of shellfish. The area is a Primary Nursery Area. I have reviewed this proposal for consistency with the Town of Sunset Beach Land Use Plan and offer the following comments. The general area of the project is classified Residential, while the AECs impacted by the work are classified as Conservation. In general, the Town of Sunset Beach allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Town of Sunset Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. Provided all local, state and federal requirements can be met, this project appears to be consistent with the Town of Sunset Beach Land Use Plan. I'm also attaching his initial comments for the project. Also, my notes do show that Gregg said at the scoping meeting that he was previously under the impression that the existing float was to be removed and relocated, and that since not the case, he thought that a fixed step-down was acceptable. Again, at this point, I see the options we have to move forward are to explore.removal of the existing float with the neighbor to serve as a net minimization of impacts, to modify to a fixed step-down as suggested, or we can move forward with issuance of the permit with the condition that the floating dock isn't authorized. In the latter case, your client would have the option to seek a variance from the Coastal Resources Commission. Please let me know if you have any questions or how your client would like to proceed. This reason is why new floating docks are not authorized in areas with no water at MLW. By adding anew floating dock and slip the impact is increased, rather than decreased, which was the original intent of moving the structures to the new pier. I still believe a step down can offer safe access to the vessel, and not create the additional impact. Because it is not a slip where a vessel can tie up, it removes the potential for a vessel to sit on the bottom during periods of insufficient water. In response to concerns expressed from DEQ staff during the Scoping Meeting that stops that have historically deteriorated over time and are a maintenance issue, the dock system is proposed to be supported by a cradle. The cradle dimensions of (4) 2" x 10" supports were designed by our structural engineer to support all anticipated live and dead loads. Access Pier = 5 ft. x 92 ft. = 460 sq. ft. (credited for access) Covered T-Head =10 ft. x 12 ft. =120 sq. ft. Floating Dock = 8 ft. x 15 ft. = 120 sq. ft. Fixed platform = 2' x 5' =10 sq. ft. Boatlift =10 ft. x10 ft. = 100 sq. ft. (not counted toward overall allowable square footage) Total = 250 sq. ft. It is the staffs recommendation that the proposal to construct a private docking facility with a covered "t-head", floating dock and boatlift is CONSISTENT with the Rules of 15 NCAC 7H.0205 (d) Use Standards for Coastal Wetlands, Rules of 15 NCAC 7H.0206 (d) Use Standards for Estuarine Waters, Rules of 15 NCAC 7H.0207 (d) Use Standards for Public Trust Areas. The construction of the pier, covered "t-head", floating dock, and boatlift would provide docking space for two (2) vessels. Depending on which measurement is determined to be an accurate representation of the width of the waterbody for the proposed private docking facility, the project may or may not be found to be INCONSISTENT with the rule in 15A NCAC 07H.0208 (b) (6) (G) (i) which states, "Pier and docking facility length shall be limited by: not extending more than one-fourth the width of a natural water body, or human made canal basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier -head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body." Due to the limited amount of water, approximately +0.10'-+0.36' at MLW in the vicinity of the proposed docking facility as shown in the attached drawings, there could be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers to access the docking facility at periods of low water. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to shallow bottom within primary nursery areas. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be INCONSISTENT with NCAC 07H .0208(a)(2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed so as to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. This office would have no objections to the proposed project provided that stops are installed on the boatlift and a fixed cradle is constructed for the floating dock as previously described in order to maintain a minimum of 18" of clearance beneath the structures at all times for the life of the structures. This recommendation is provisional upon any concerns from other state and federal agencies. The applicant proposes to remove an existing boatlift associated with an existing shared pier and construct anew pier, gazebo, floating dock and boatlift. The surrounding waters are classified as primary'nursery area (PNA), able to support shellfish (SA), high quality waters (HQW), and are closed to shellfish harvest. Oyster resource is evident within the footprint of the existing shared pier and throughout the vicinity. Water depths at the site are +0.10ft to +0.36ftat mean low water (MLW). A field visit was conducted by staff on 3/4/2016 to determine potential configuration options that avoid and minimize impact to PNA habitafand oyster resource. The shared pier ha's an existingboatlift_ with oyster resource present within the footprint and an existing 8ft x 20ft floating dock that currently sits on the PNA bottom at MLW. Staff identified that movement of the boatlift and floating dock with associated stops to a new pier would be considered avoidance and minimization as compared to repair of existing structures and left in place. On 4/27/2016 a scoping meeting was held to discusstheproject, where the applicant identified the existing floating dock would not be moved to the proposed new pier. Without the removal of the existing floating dock from the shared pier, an additional floating dock is not.viewed as avoidance and minimization. Furthermore, the existing floating dock would.continueto cause.adverse impact while the. proposed floating dock would result in additional significant adverse impactto PNA bottom through prop kicking and direct vessel contact, due to no water available at MLW: The proposal can move forward as proposed.if.the existing boatlift and floating dock from the shared pier are removed, and the proposed boatlift and. floating dock are conditioned withstops. Both the boatlift and.floating dock should be removed from the existing pier before construction on the proposed pier. If this is not the case, then it is recommended that the proposed floating dock be replaced with a fixed platform and step down that will allow safe access to the vessel. Stops are recommended for the boatlift: The existing boatlift should be removed before construction of the proposed lift begins. RECEIVED JUN 21 2016 DCM- MHD CITY Brecheisen Page Two PROJECT DESCRIPTION The applicant's property is located at 216 Shoreline Dr. E., adjacent to the connector channel between Mary's Creek and Turtle Creek in the town of Sunset Beach, Brunswick County. Directions from Highway 17 south of Shallotte: Turn Left onto Seaside Rd. SW/NC-904 and travel approximately 3.60 miles. Turn right onto Sunset Blvd N/NC -179 Bus and travel approximately 1.86 miles. Turn right onto Shoreline Dr. W/NC- 179 Bus. And travel approximately 1.73 miles. Enter the roundabout and take the 31 exit onto Shoreline Dr. E. Travel approximately 0.21 miles to the project site located on the right. The project area consists of a 36,200 square foot lot adjacent to the connector channel between Mary's Creek and Turtle Creek. The applicant currently maintains a single family residence and a shared private docking facility located on the property boundary between 216 and 218 Shoreline Dr. E. The applicant's property has approximately 102 feet of shoreline frontage along the southern rear of the property which is stabilized with natural vegetation. The elevation of the high ground area of the lot measures approximately 12 feet above normal high water (NHW). High ground vegetation consists mainly of lawn grasses and ornamental shrubs as well as some existing hardwoods. The high ground portion of the site is bordered by Coastal Wetlands consisting primarily of Smooth Cord Grass (Spartina alternifloro) and Black Needle Rush (luncus roemerianus) that extends approximately 45' waterward from the high ground escarpment. Waterward of the coastal wetlands are intertidal areas incorporated by oyster beds ranging from approximately 20' in width to approximately 45' in width. The applicant currently shares an existing pier along the eastern property boundary with the adjacent property owner. The existing shared pier is approximately 70' in length by 5' in width and terminates at a covered, fixed "t-head" approximately 8' in width by 10' in length. An existing ramp approximately 4' in width by 15' in length extends waterward to an existing floating dock that is approximately 8' in width by 16' in length and is in an area void of water at mean low water (MLW). There is an existing derelict boatlift approximately 13' in width by 13' in length that was originally permitted in 2006 under GP # 44828D. The boatlift is located along the western side of the existing floating dock that is also in an area void of water at MLW. The connector channel between Mary's Creek and Turtle Creek was denied a permit for maintenance dredging in 1996 and again in 1998 by the Division of Coastal Management on the basis that the proposed dredge channel was within highly functioning Primary Nursery Area habitat. The applicant is proposing to remove the boatlift due to an oyster bed that has incorporated the substrate beneath the entirety of the existing boatlift. All 4 pilings appear to have maintained their structural integrity and it is possible that this office could have authorized a maintenance and repair exemption for the applicant to maintain the mechanical components of the existing boatlift. The existing structures other than the boatlift are proposed to remain as they currently exist. The MLW contour is located approximately 25' feet waterward of the edge of the oyster beds. The waters of the AIWW are classified SA by the Division of Water Resources and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes to remove an existing boatlift associated with an existing shared pier and construct a new private pier with a covered platform, floating dock, and boatlift. The proposed new private docking facility would try to utilize an area that is void of oyster bed. The proposed project would consist of a pier originating from the center portion of the lot approximately 40' from the eastern property boundary and measuring approximately 95' in length by 5' in width. Approximately 75' would extend waterward beyond the MHW boundary and approximately 50' would extend waterward of the edge of marsh. The pier would terminate at a covered, fixed "t-head" measuring approximately 12' in width by 10' in length. A ramp measuring approximately 4' in width by 11' in length is proposed off of the Western side of the pier extending westward to the 8' in width by 15' in length floating dock. The applicant is proposing to construct a wooden cradle to support the floating dock at a fixed elevation of approximately 2' above the substrate to keep the floating dock from resting on the bottom during periods of low water. A second fixed platform measuring approximately 2' in width by 5' in length is proposed to be attached to the eastern side of the proposed covered platform as an access to the proposed boatlift measuring approximately 10' in width by 10' in length. The applicant is proposing to include stops on the boatlift to prevent use during periods of low water. Water depths in the vicinity of the proposed boatlift and floating dock measure approximately +0.10-+0.36 at MLW. The proposed configuration would allow for docking of up to two (2) vessels. 11. ANTICIPATED IMPACTS The proposed private docking facility would incorporate approximately 650 sq. ft. of Estuarine and Public Trust Area and would shade approximately 200 sq. ft. of Coastal Wetlands, consisting primarily of Smooth Cord Grass. Water depths in the vicinity of the proposed slips measure approximately +0.10'-+0.36'at MLW. As proposed, there could be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers to access the docking facility at periods of low water. Minor increases in turbidity should be expected during construction. The proposed docking facility would be located approximately 12' landward of the edge of the channel, keeping it open for navigation. Islands of coastal wetlands exist waterward of the proposed structure, with a distinct small island directly waterward and to the south of the proposed boatlift. A larger composite of coastal wetlands exists further waterward and to the south of the distinct smaller marsh island. The proposed docking facility would extend a total distance of approximately 102' into the water body as measured from the mean high water boundary of which approximately 60' would extend into open water within a water body which measures approximately 180' in width to the most restrictive small island of coastal wetlands. If the measurement is pulled to coastal wetlands further waterward that are more representative of the edge of the waterbody, the width would measure approximately 342'. The most restrictive measurement of the width of the waterbody at approximately 180' would NOT conform to the 1/4 width rule but would meet the 1/3 width of the waterbody. The less restrictive, more representative measurement of the width of the waterbody would conform to the 1/4 width rule. As proposed, the private docking facility would exceed the established pier head alignment of the directly adjacent piers by approximately 3', however this rule would not apply since the proposed pier and adjacent piers measure less than 100' over open water. The structure, as proposed, would not encroach into either of the adjacent 15' riparian corridor setbacks. The proposed configuration of the docking facility would provide docking space for up to two (2) vessels. EXISTING CONDITIONS: 216 Shoreline Drive is an existing developed residential property on the mainland of Sunset Beach, NC, and is adjacent to the Atlantic Intracoastal Waterway (AIWW) (SA; HQW). The property has access to the AIWW by a narrow, shallow unnamed channel that is adjacent to the waterway. There is an existing pier located on the eastern property line which is shared with the adjacent property owner. The existing pier accesses a gazebo, floating dock and boat lift. The existing boat lift is located west of the floating dock within the riparian corridor of 216 Shoreline Drive. The existing dock system is in poor condition and the boat lift is located within an oyster shell bed. 2. PROPOSED DEVELOPMENT: The applicant would like to remove the existing boat lift, and construct a new fixed pier with gazebo, small floating dock and boat lift. The site does not currently meet the Rules of the Coastal Resources for General Permit authorization for piers and docking facilities, with a minimum 18-24 inches of water depth between the bottom of the proposed structure and bottom substrate at normal low water level, therefore is pursuing a CAMA Major Permit for the proposed improvements. The applicant and Elizabeth Nelson with Cape Fear Engineering, met representatives from the Division of Coastal Management (Sean Farrell) and Marine Fisheries (Gregg Bodnar) on site on March 4, 2016, to explore the best options for the existing site conditions. It was agreed that relocation of the dock system to an area without oyster shells rather than maintenance to the existing system would be preferred. Due to the lack of depth at low tide, the applicant is willing to provide stops on the proposed boat lift. Comments were expressed during the pre -application scoping meeting with NCDEQ that often the stops are not sufficient to support the system long term. In response, the applicant is willing to provide (4) — 2" x 10" boards that will cradle and support the proposed floating dock.
