This permit, issued on March 15, 2016 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Bulkheads/Rinrap
1) The bulkheads shall be constructed in the same alignment as depicted on the attached.workplan
drawing 1 of 9, revised 3/15/16.
2) The bulkheads shall be constructed prior to any backfilling activities. h' $
3) The bulkheads shall be structurally tight so as to prevent seepage of backfill ml,; thconAi then- ,
structure.
4) The bulkheads shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2019
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
5) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent
its movement from the site by wave or current action.
6) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite or
broken concrete.
7) The fill material shall be clean and free of any pollutants except in trace quantities. Metal products,
organic materials, or unsightly debris shall not be used.
8) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
9) No backfill material is to be placed within 30 feet of the normal high water line, except that which will be
used to backfill the area behind the permitted bulkheads.
Excavation
10) In order to protect juvenile finfish resources, no excavation shall be permitted between April 1 and
September 30 of any year without prior approval of the North Carolina Division of Coastal Management
in consultation with appropriate resource agencies.
11) Excavation shall not exceed -8 feet below the normal low water. In no case shall the depth of
excavation exceed the depth of the connecting waters.
12) The temporary placement of double handling of excavated materials within waters or vegetated wetlands
is not authorized.
Spoil Disposal/Estuarine Beach Renourishment
13) All excavated materials shall first be placed in a barge and allowed to properly dewater before being
placed in the estuarine beach renourishment area.
14) All excavated material to be placed into the estuarine beach renourishment area shall be confined behind
a turbidity curtain installed between the estuarine beach renourishment area and the existing sound to
prevent spillover of solids into any surrounding waters. A 24-hour period after completion of
renourishment shall elapse prior to removal of the turbidity curtain to prevent unnecessary siltation into
the adjacent waterbody.
15) Prior to the initiation of any beach renourishment activities, the area designated for beach renourishment
and the turbidity curtain shall be inspected and approved by a representative of the Division of Coastal
Management.

Sedimentation and Erosion Control
16) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
17) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
18) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within 30 calendar days of project completion.
Maintenance Clause
19) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any
maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
U.S. Army Corps of En¢ineers Conditions
20) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant shall
implement the U.S. Fish & Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements within. The guidelines can be found at:

21) Should Federal Aids to Navigation (ATON) need to be relocated to facilitate this operation, 30 days'
notification is requested. This request can be sent to the Coast Guard District Five Office at:

22) To address concerns from the United States Coast Guard: The following information shall be provided a
minimum of 10 days prior to dredge operations commencing:
Any dredging or other operational activity that impacts the safe navigation of Federal Waterways.
a. Dates (inclusive) of operation.
b. Hours of operation (24 hours/daylight hours only).
c. Names of involved vessel(s).
d. Working and standby frequencies.
e. Specific location (mile marker/channel).
f. Any specific instructions or concerns that would be pertinent to the mariner.

23) The permittee understands and agrees that, if future operations by the United States requires the removal,
relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice
from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby,
without expense to the United States or the state of North Carolina. No claim shall be made against the
United States or the state of North Carolina.on account of any such removal or alteration.
24) Approval of the structure was based on a determination that there would be no obstruction to navigation.
Issuance of this permit should not be construed as relieving the permittee of taking proper steps to ensure
the structure and moored boats will not be damaged by wave wash.
25) No attempt shall be made by the permittee to prevent the free and full use by the public of all navigable
waters at or adjacent to the authorized work. The permitted activity shall not interfere with the public's
right to free navigation on all navigable waters of the United States.
26) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before
completion of the work will, without expense to the United States and in such time and manner as the
Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -
project condition.
General
27) The permittee and/or his or her contractor shall meet with a repof the Division prior to

28) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of the permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having transferred it to a third party.
29) No vegetated wetlands shall be excavated or filled, even temporarily.
30) The permit shall not be assigned, transferred, sold or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
31) This permit does not authorize any structural work to either of the existing docking facilities.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the pemrittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2016-

This letter is in response to your correspondence, which was received by the Division of Coastal Management on
January 14, 2016, regarding your concerns about the proposed development by the Blockade Runner Hotel, at 226
S. Lumina and 275 Waynick Blvd., adjacent to Banks Channel, in Wrightsville Beach, New Hanover County. The
proposed project consisted of dredging with estuarine beach spoil placement and shoreline stabilization. The
proposed project has been determined to comply with the Rules of the Coastal Resources Commission and as such,
a permit has been issued to authorize the development. I have enclosed a copy of the permit.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party Appeal. The Chairman
of the Coastal Resources Commission will consider each case and determine whether to grant your request to file for
a Contested Case Hearing. The hearing request must be filed with the Director, Division of Coastal Management, in

Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary
that the standard review time be extended. An additional 75 days is provided by G.S.113A-122(c)
which would make May 20, 2016, the new deadline for reaching a decision on your request.

Dear Mr. Baggett:
Reference your application for a Department of the Army permit to dredge two existing docking
facilities, enhance an estuarine beach area with the dredged material, construct a new bulkhead
waterward of the existing bulkhead, and expand an existing rip -rap stormwater outfall pipe
below MHW. This proposed project is located at 275 Waynick Blvd, and 226 S. Lumina Ave.
adjacent to Banks Channel, in Wrightsville Beach, New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and objectives
of the CAMA-Corps Programmatic Permit process (GP 291 copy attached) for construction
activities that receive authorization from the State of North Carolina. Therefore, you may
commence construction activity in strict accordance with applicable State authorization, attached
Federal special conditions, and the approved plan. Failure to comply with the State authorization
or conditions of the Federal permit could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for any
other reason, plans revised to show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any such change or alteration.
Such action is necessary as revised plans must be reviewed and the authorization modified. Your
Department of the Army permit will expire on December 31, 2016.

5. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US
Army Corps of Engineers (USACE) prior to implementation.
6. The docks and piers extending over wetlands will be elevated sufficiently (a minimum of
3 feet) above the wetland substrate to prevent total shading of vegetation, substrate, or other elements of the
aquatic environment.
7. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon
due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or
obstructions caused thereby, without expense to the United States.
8. Approval of the structure is based on determinations that there would be no obstruction to
navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this permit
should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored
boats will not be damaged by wave wash.
9. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to
prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for
reason other than safety.
10. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to
reduce the reach of waters or wetlands.
11. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the
construction or maintenance of this project, within waters or wetlands. This permit does not authorize
temporary placement or double handling of excavated or fill material within waters or wetlands outside the
permitted area. This prohibition applies to all borrow and fill activities connected with this project.
12. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the
event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it
to the N.C. Division of Water Resources at (919) 791-4200, and the North Carolina Emergency Management
Office at 1-800-858-0368, and provisions of the North Carolina Oil Pollution and Hazardous Substances
Control Act will be followed.
13. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace
quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly
debris will not be used.

14. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who
will initiate the required coordination procedures.
15. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project with a copy of this
permit. A copy of this permit, including all conditions, shall be available at the project site during
construction and maintenance of this project.
16. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This
shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices
around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of
all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter I I3A Article 4).
17. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity
in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina
Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes
and reservoirs, and 10 NTU's or less in trout waters, are not considered significant.
18. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such time and
manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland
to its pre -project condition.
19. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army
Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Dear Mr. Huggett:
Reference the application of Mr. William Baggett of the Blockade Runner Beach Resort, to
dredge two existing docking facilities, enhance an estuarine beach area with the dredged
material, construct a new bulkhead waterward of the existing bulkhead, and expand an existing
rip -rap stormwater outfall pipe below MHW. Total impacts proposed to waters of the U.S. are
2,700 sq ft of temporary impacts associated with dredging, 190 sq. ft. of fill for the expansion of

Banks Channel, in Wrightsville Beach, New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.

if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States.
8. Approval of the structure is based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.
9. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
10. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
11. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
12. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 791-4200,
and the North Carolina Emergency Management Office at 1-800-858-0368, and provisions of the
North Carolina Oil Pollution and Hazardous Substances Control Act will be followed.
13. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from gie�iDal

14. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
15. The permittee shall require its contractors and/or agents to comply with the terms
and conditions of this permit in the construction and maintenance of this project, and shall
provide each of its contractors and/or agents associated with the construction or maintenance of
this project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
16. The permittee shall employ all sedimentation and erosion control measures
necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside
the permit area. This shall include, but is not limited to, the immediate installation of silt fencing
or similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must
remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973
(North Carolina General Statutes Chapter I I3A Article 4).
17. The activity will be conducted in such a manner as to prevent a significant increase
in turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
18. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre -project condition.
19. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Provided that the Town of Wrightsville Beach authorizes the proposed development within the Town's property, it is the staffs
recommendation that the shoreline stabilization along the project site is consistent with the Rules of 15 NCAC 71-1.0208 (b) (7) (D)(ii) Use
Standards for Bulkheads and Shore Stabilization Measures states "the bulkhead alignment extends no further below approximate mean high
water or normal water level than necessary to allow recovery of an area eroded in the year prior to the date of application, to align with
adjacent bulkheads, or to mitigate the unreasonable hardship resulting from unusual geographic or geologic features".
It is the staffs recommendation that the proposed excavation of the area around the existing boat basins within Banks Channel appears to
be consistent with15 NCAC 071-1.0208 (b)(1) and (2). It is the opinion of this office that the area for the proposed excavation is located in
an area that has been historically impacted and in continuous use for docking and navigational purposes.
It is the staffs recommendation that the proposed estuarine beach re -nourishment is consistent with the Rules of 15 NCAC 71-1.0208 (b)(8).
It is the staffs recommendation that the shoreline stabilization along the project site is consistent with the Rules of 15 NCAC 71-1.0209.
Provided that the Town of Wrightsville Beach authorizes the proposed development within the Town's property, it is recommended that any
permit issued should also include standard permit conditions for shoreline stabilization, maintenance excavation and estuarine beach re -
nourishment.

Dear Mr. Mairs,
We have received, on January 8th, the information pertaining to the
Blockade Runner Hotel's proposed extension of the bulkhead, along with
some dredging and beach re -nourishment. The letter was delayed, due to
the company once again using my old address, but this letter is within the
30 day window specified.
Our objections begin with the environmental impact of the extension of the
bulkhead westward and the related extension of the drainage pipe and rip
rap. We have reason to believe that this is very likely to cause a negative
impact on our adjacent waterfront property at 224 and 222 South Lumina
Ave. Anticipated sand and drainage flow build up into our property will have
a deleterious effect on our waterfront and use of our property. It is our belief
that an environmental analysis needs to be done. Such a bulkhead
extension is not normative along the sound front at Wrightsville Beach.
We also object to the dredging of the north riparian corridor between our
properties. As you know the hotel `Pelican Dock's' finger piers and support
pilings are already non -conforming by reason of significant intrusion into
our riparian corridor. Dredging will allow boats to dock there whose beams
can extend even further into the corridor and limit our access to it. Our
future plans to construct a pier there will create further trouble.
Finally, it appears that the plan increases the size and scope of the parking
area at the foot of the pier. This is the only place in a residential area of the

understood as grandfathered in, but not its use as a full-fledged commercial
marina. What is the allowed number of slips? Is it legal for the pier to
extend beyond the normal boundary line in the channel, which interferes
with sight lines and access to our property, as well as with other fast boat
traffic in the area? We believe that CAMA should have an interest in these
matters, as well as the Town.
We ask you to take our objections seriously and let us know what we
should do next in responding to this proposal.

Dear Mr. Mairs,
We have received, on January 8th, the information pertaining to the
Blockade Runner Hotel's proposed extension of the bulkhead, along with
some dredging and beach re -nourishment. The letter was delayed, due to
the company once again using my old address, but this letter is within the
30 day window specified.
Our objections begin with the environmental impact of the extension of the
bulkhead westward and the related extension of the drainage pipe and rip
rap. We have reason to believe that this is very likely to cause a negative
impact on our adjacent waterfront property at 224 and 222 South Lumina
Ave. Anticipated sand and drainage flow build up into our property will have
a deleterious effect on our waterfront and use of our property. It is our belief
that an environmental analysis needs to be done. Such a bulkhead
extension is not normative along the sound front at Wrightsville Beach.
We also object to the dredging of the north riparian corridor between our
properties. As you know the hotel 'Pelican Dock's' finger piers and support
pilings are already non -conforming by reason of significant intrusion into
our riparian corridor. Dredging will allow boats to dock there whose beams
can extend even further into the corridor and limit our access to it. Our
future plans to construct a pier there will create further trouble.
Finally, it appears that the plan increases the size and scope of the parking
area at the foot of the pier. This is the only place in a residential area of the

The applicant proposes to perform maintenance excavation of an existing marina area and
create an estuarine beach area with the dredged material, construct new shoreline
stabilization within Banks Channel. The project is located at 275 Waynick Blvd., and
226 South Lumina Avenue in Wrightsville Beach.
Areas of Environmental Concern (AFC's) impacted by the proposal are PT, ES and EW.
Waters at the project site are classified as SB# and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Wrightsville Beach Land Use
Plan Update and offer the following comments.
The general area of the project is classified as Developed and Conservation.
In general, the Wrightsville Beach Land Use Plan contains policies, which allows
development in Developed and Conservation classified AECs, which is consistent with
the State's minimum use standards. The Wrightsville Beach Land Use Plan contains
some policies, which exceed the State's minimum use standards. However none of these
policies appear to be applicable to this project.
This project is consistent with the 2005 Wrightsville Beach Land Use Plan Update.

You have our approval, in accordance with the attached conditions to impact 2,890 square feet of
open waters in order to perform maintenance dredging of an existing marina, to create a sound -side
beach with the dredged spoil, and to construct shoreline stabilization as described in your application
received by the N.C. Division of Water Resources (DWR) on January 12, 2016. After reviewing
your application, we have decided that the impacts are below the threshold for written authorization
as long as all conditions of General Water Quality Certification Number 3900 (GC3900) is met. This
certification may also be viewed on our website at

This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.
Conditions of Certification:
1. Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to return
the attached Certificate of Completion to the 401/Wetlands Unit, North Carolina Division of

If you do not accept any of the conditions of this Certification (associated with the approved

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes to conduct maintenance dredging and utilize the spoil for an estuarine beach nourishment,
construct bulkheads and install 25ft x 15ft rip rap stabilization around an existing storm water outfall
pipe. The surrounding waters are classified as SBq and are closed to shellfish harvest. There are small
amounts of coastal wetlands around the outfall pipe. Existing depths relating to the dredging are -4 to -
11ft at normal low water.
There are two dredge footprints located at either end of the property at each docking facility, both
previously excavated. 275 Waynick Blvd excavation footprint is 90ftx30ftx-7ft and 226 Waynick Blvd
excavation is 90ftx80ftx-8ft and 45ftxlSftx-6ft respectively. Approximately 1,175cy of spoil will be
Placed above the mean high water line, waterward of the bulkheads, to nourish an estuarine beach. A
moratorium on in water work, to include dredging, from 1 April to 30 September is
recommended to reduce the negative effects on critical fish life history activities, to include
spawning migrations and nursery functions. It is also recommended that a turbidity curtain be
placed between the nourishment area limit to prevent spoil from being reintroduced into
estuarine waters. The turbidity curtain should remain in place for 24 hours after completion of
nourishment activities.
The 50ft timber bulkhead along 226 Waynick is approximately 22ft waterward of an existing bulkhead
and as proposed would incorporate approximately 2,200ft2 of area landward of the high water line.
Bulkheads at the high water line removes the existing gentle slope and can increase scour in front of the
structure, further altering the slope. It is suggested that the bulkhead be placed closer to the existing
bulkhead line to incorporate as little area as possible and preserve the natural slope.

Dear Mr. Mairs,
After discussion with your office and our neighbor, we have decided per your suggestion to modify the
proposed Pelican Dock bulkhead construction and install some additional measures. Although we
understand that our proposed plan as originally submitted lies well within the scope permitted by the
rules and regulations from your office, we are certainly sensitive to the concerns of our neighbors.
In recognition of the objections that have been discussed and at the request of the local CAMA office,
we are willing to move back the construction of the bulkhead by Pelican Dock, approximately seven (7)
feet landward, so that it falls more in line with the proposed CAMA bulkhead line in front of the hotel.
We would additionally install a barrier, at the Pelican Dock lot, thirty (30) feet from the normal high
water, which approximately falls on the existing Pelican Dock bulkhead depicted in the application
drawing, that would separate the existing Pelican Dock stone lot from the gained area inland of the new
Pelican Dock bulkhead.

9. PROJECT DESCRIPTION:
The project site is located at 275 Waynick Blvd. and 226 South Lumina Ave. adjacent to Banks Channel, between the Atlantic
Ocean and Greenville Sound within the Town of Wrightsville Beach, in New Hanover County. To locate the properties from the
Wilmington Regional Office (WiRO) travel east on Eastwood Road approximately 3 miles towards Wrightsville Beach. From the
drawbridge, continue heading east on Causeway Drive (U.S. Highway 76) approximately 1 mile and proceed to cross the bridge
over Banks Channel. Take the immediate right onto Waynick Blvd. (U.S. Highway 76) and travel south approximately 0.3 miles
until you reach the project sites, which will be located on the right.
The properties average approximately 3'-6' above normal high water (NHW). The property located at 275 Waynick Blvd. is located
directly across the street from the Blockade Runner Beach Resort, which borders both Banks Channel to the west and the Atlantic
Ocean to the east. Highground vegetation consists of maintained lawn grass and ornamental landscaping. The property is
approximately 2.9 acres with approximately 270' of shoreline frontage along Banks Channel, currently stabilized with a low timber
bulkhead. Waterward of the timber bulkhead is an intertidal estuarine sandy beach area approximately 90' in width to the normal
low water (NLW) boundary. There are two patches of Coastal Wetlands located on the north end of the property approximately 34'
waterward of the timber bulkhead, which consists primarily of Smooth Cordgrass (Spartina aftemiflora). The applicant maintains a
docking facility located on the southern end of this property, which consists of an access pier, covered and uncovered platforms,
access ramp to a floating dock and two (2) boat lifts. The application states that this docking facility currently accommodates up to
eight (8) vessels, which consists of mixed type of vessels.
The property located at 226 South Lumina Ave., which is the adjacent residential riparian property to the north, was purchased by
the applicant in 2013 per the provided deed. The property consists of gravel parking areas on both sides of Waynick Blvd. The
eastern portion of the property borders Snyder Street and the western portion of the property borders Banks Channel with
approximately 50' of shoreline, which is currently stabilized by a low timber knee wall. There is an existing docking facility located
waterward from this property into Banks Channel. An access pier, measuring approximately 80' in length by 6' in width extends
towards the west into Banks Channel. The pier terminates onto an uncovered platform, measuring approximately 30' in length by
15' in width and then into covered platforms, measuring approximately 13' in length by 12' in width and 22' in length by 12' in width.
An access ramp leads onto a floating dock, measuring approximately 20' in length by 10' in width, which then leads onto a floating
dock, measuring approximately 120' in length by 6' in width, which runs perpendicular to the channel and shoreline along the
northern end of docking facility. Another access ramp leads onto a floating dock, measuring approximately 20' in length by 10' in
width, which then leads onto a floating dock, measuring approximately 56' in length by 6' in width and 16' in length by 6' in width
creating two (2) "L-shaped" configurations on the southern side of the docking facility. There are two (2) cluster dolphin pilings
located between the northern and southern floating docks, which historically appearto have accommodated two (2) largervessels.
There is also a single mooring piling located approximately 36' south of the southern floating docks.
Located between the applicant's two waterfront properties is the Town of Wrightsville Beach street end right-of-way at the end of
Snyder Street, which consists a well building. Waterward of the building is a stormwater outfall pipe and associated rip -rap along
the approximately 30' of shoreline.
The existing docking facility located at 226 South Lumina Ave. has historically been known as the Pelican Dock(s), which appearto
have been utilized by private and commercial vessels. The existing docking facility is considered non -conforming due to our
current regulations, which the facility exceeds the adjacent established pier lengths and beyond the Town of Wrightsville Beach
Pier head Line. The docking facility encroaches into both of the adjacent 15' Riparian Corridor Setback Areas to the north and
south; further, portions of the docking facility extend into the Town's riparian oorridorto the south. The existing facility also exceeds
the total square foot allowance. Based on DCM database and permit review, this office was only able to locate routine
maintenance excavation permits and repairs to the existing docking facility over the years; however, through historical aerial
photography review through INC DOT and New Hanover County GIS, it appears there has been a docking facility in this location
since the late 1960's. The application states that the existing docking facilities together currently accommodates up to 16 vessels of
mixed types within water depths ranging from approximately 4to -11' @ normal low water (NLW). The applicant recently received
a Certificate of Exemption from Requiring a CAMA Permit (01509-D) on 12118/2015 to reftLM ntV[m®sting docking
facility (See Sheet 1 of 9 and Project Narrative).

The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the
project area as Developed. The waters of Banks Channel, which are included in the Wrightsville Recreational Area, are classified
SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine
Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to perform maintenance excavation of an existing marina area and create an estuarine beach area with the
dredged material, construct new shoreline stabilization within Banks Channel.
Maintenance Excavation and Estuarine Beach Re -nourishment: The application states that the area of excavation around the
existing docking facility, located on the southern portion of 275 Waynick Blvd. would measure approximately 90' in length by 30' in
width to a final project depth of approximately -7' @ NLW. The application also proposes areas of excavation around the existing
docking facility located at 226 South Lumina Ave., in areas measuring approximately 90' in length by 80' to a final project of
approximately -8' @ NLW and 45' in length by 15' in width to a final project depth of approximately 4@ NLW. The application
states the excavation of the existing basins would be accomplished by a barge mounted mechanical excavator and would result in
the removal of approximately 1,175 cubic yams (cy) of shallow sandy bottom material. The application also states, once de -
watered on the barge, the excavated material would then be placed onto the intertidal estuarine sandy beach above the NHW
boundary, which ranges from approximately 4' to 22' waterward of existing timber bulkhead. This proposal is consistent with the
previous authorization for Carolina Yacht Club (State Permit No. 69-09), which is located approximately 0.16 miles south of project
site.
Shoreline Stabilization: The applicant proposes to construct a new timber bulkhead along the shoreline of 275 Waynick Blvd.,
measuring approximately 310 linear feet, which would be approximately 2' waterward of the existing timber bulkhead and an
approximately 50 linear feet bulkhead 2' waterward of the existing timber knee wall located at 226 South Lumina Ave. The
applicant also proposes to construct an approximately 50 linear feet timber bulkhead along the NHW boundary in an area along a
shoreline currently un-stabilized. Approximately 25 linear feet would be along the applicant's shoreline and 25 linear feet along the
at the Town's right-of-way at the end of Snyder Street, which would be constructed around the existing stormwater pipes within the
right-of-way and the well pump station. Additionally, the applicant is proposing to place rip -rap at the location of the existing
stormwater outfall pipe in an area of approximately 25' in length by 15' in width, essentially within the same footprint as the existing
rip -rap, which appears to have been displaced over the years. The class II limestone or granite would be located approximately
15' waterward of the NHW boundary, and would be also be partially located within of the applicant's property and partially located
within the Town of Wrightsville Beach's right-of-way located at the end of Snyder Street (See Sheets 1 through 9 of 9 and
Project Narrative).
10. ANTICIPATED IMPACTS:
The proposed maintenance excavation would disturb approximately 2,700 sq. ft. of shallow bottom area, previously impacted. The
proposed excavation would result in the placement of approximately 4,350 sq. ft. of high ground area along the shoreline, just
landward of the NHW boundary. The application states that the material would be clean, compatible sand. The proposed shoreline
stabilization would result in approximately 9,920 sq. ft. of high ground for the fill material and tie -back anchor system. The
proposed rip -rap material along the existing stormwater outfall pipe would impact approximately 190 sq. ft. of Estuarine Waters and
Pubic Trust Area and approximately 190 sq. ft. of high ground area, essentially within an area previously impacted. Minor
increases in turbidity should be expected during construction.

NARRATIVE
We are proposing to maintain, replace and renourish the water front amenities that are currently
existing at the Blockade Runner, located at 275 Waynick Blvd., Wrightsville Beach, NC 28480. The
facility offers a wide variety of water dependent activities to their guests among which are boating,
sailing, fishing, swimming, sightseeing, sunbathing, kayaking, paddle boarding and yoga. Due to the
years of use, erosion and storms; the beach and the bulkheads have been heavily worn and are in need of
renourishment and replacement.
We are proposing to construct approximately 420' of bulkhead (as per plans). The new wall will
provide years of shoreline protection and help to prevent further erosion. The area in between the old
deteriorated and new wall will be backfilled with clean fill and landscaped to prevent any runoff.
We are also proposing to perform a maintenance dredging of both docking facilities along with
extending the town's outflow pipe and rebuilding the 15' x 25' rip rap diffuser in front of it. During
heavy rains the drain pipe creates a significant amount of surface runoff due to the velocity of the water.
It is our intention to add approximately 10 cubic yards of additional granite rip rap to help slow the
water's velocity and reduce the amount of run off, thereby reducing the frequency for the need to dredge.
On the maintenance dredging we are proposing to remove approximately 1,175 cubic yards from the areas
shown on the plans. The sand spoil will be removed using a bucket to barge method and allowed to
dewater before being utilized as estuarine (beach) renourishment. Similar to Carolina Yacht Club (permit
#69-091 where the beach offers a safe, calm place for young children to play in the water without having
to be in the surf. It also allows an area for sunbathing, paddle boarding, kayaking and beach yoga. All
sand placed on the beach as renourishment will be similar to and compatible with the beach sand that
currently exists.
The Blockade Runner has been a Wrightsville Beach landmark for years. It is one of the few
places that offer their guests the ability to enjoy both the ocean, Banks Channel and 2 different beaches.
Where else can you take your family out fishing in the morning, enjoy the ocean and the beach in the
afternoon and then go out for an evening cruise and walk on Masonboro Island. All of the items that we
are proposing currently exist. We are simply asking to preserve and maintain what is already there, and to
keep the Blockade Runner and Wrightsville Beach one of the most enjoyable and safest places to bring
your family for a vacation or a week end stay.

Blockade Runner Beach Resort c/o William Bagged, for the proposed development located at 275 Waynick Blvd. and
226 South Lumina Ave., adjacent to Banks Channel, in the Town of Wrightsville Beach, New Hanover County. It was
received as complete on December 21, 2015, and appears to be adequate for processing at this time. The projected
deadline for making a decision is March 7, 2016. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 21, 2015, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review, the agencies may contact you

attached to said property, all of which shall be deemed realty
and conveyed by this deed, and all rents, issues and profits
which may arise or he had from any portion or all of said property.
The above described real property is sold subject to

1. Deed of trust dated May 15, 1964 in favor of Pilot
Life Insurance Company, recorded in Book 722, Page 464 in theNew
Hanover County Registry, securing an original indebtedness in the
amount of $900,000.00. Also, assignment of rents and profits
dated May 15, 1964 in favor of Pilot Life Insurance Company recorded
in Book 722, Page 468 in said Registry. Grantee assumes and agrees
to pay the principal balance due on the note secured by said deed
of trust, namely, $510,000.00, together with interest, and to
assume and perform all of Grantor's obligations under said note,

Beach, if said dividing line between said lots was extended in perpendicular line from low water mark of
the ocean to low water mark of Banks Channel, running thence in a northwardly direction along the
western line of Lumina Avenue to the dividing fine between Lots 37 and 38, if said dividing line was
extended perpendicularly to Banks Channel, thence westwardly along the dividing line between Lots 37

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following application was submitted for a development permit in an
Area of Environmental Concern as designated under the CAMA: On December 21, 2015, the
Blockade Runner Resort proposed to perform maintenance excavation of an existing basin
area, renourish a sound -side beach with the fill, and construct shoreline stabilization at
275 Waynick Blvd, and 226 S. Lumina Ave., adjacent to Banks Channel, in Wrightsville
Beach, New Hanover County. A copy of the application can be examined or copied at the
office of Robb Mairs, N.C. Dept. of Environmental Quality, Division of Coastal Management,
127 Cardinal Drive Ext., Wilmington, NC 28405, (910-796-7423) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to January 29, 2016 will be
considered in making the permit decision. Later comments will be accepted and considered up
to the time of permit decision. Project modification may occur based on review and comment by
the public and state and federal agencies. Notice of the permit decision in these matters will be
provided upon written request.
