1) Unless specifically altered herein, this Minor Modification authorizes the stormwater infiltration system,
all as expressly and specifically set forth in the attached workplan drawing.
2) This Minor Modification shall be attached to the original Permit No. 35-16, which was issued on
3/15/16, and copies of both documents shall be readily available on site when Division personnel
inspect the project for compliance.
3) All conditions and stipulations of the active permit remain in force under this Minor Modification,
unless specifically altered herein.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be _accessible on -site to Department
personnel when the project is inspected for compliance.

December 31, 2019

suspended sediments in adjacent waters.
5) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
6) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of

any phase of grading on cut or filled slopes.

SUBJECT Permit Modification Request to State Permit #35-16, Four Seasons Management Services, Inc.
(Blockade Runner), 275 Waynick Blvd., Wrightsville Beach, in New Hanover County
Mr. Robert S. Clements with James Scott Construction and acting agent for the Blockade Runner is
requesting a minor modification to State Permit #35-16, which was just authorized on March 15, 2016 for
maintenance excavation of an existing marina area, estuarine beach re -nourishment and the construction of new
shoreline stabilization within Banks Channel. State Permit #35-16 is due to expire on December 31, 2019.
Mr. Clements is requesting a modification to State Permit #35-16 to allow for the installation of a stormwater
infiltration system along the owners' shoreline adjacent to Banks Channel. Mr. Clements states the purpose of the
system is to intercept stormwater runoff from existing culverts on the north and south ends of the property that
discharge directly into Banks Channel, and divert it into a proposed infiltration system. The proposed system would
be located landward of the existing and recently authorized timber bulkhead, which appears to be approximately 30'
landward of the normal high water (NHW) boundary.
Mr. Clements states the system includes diverter structures on each outfall, 18" HDPE or aluminum pipe to
infiltration system, and three (3) 24" perforated pipes in a gravel trench. The system would infiltrate stormwater from
a 1.5" design for the 3.5 acre drainage basin.
The agent has submitted a check (check No. 1519) in the amount of $100 for the modification request along
with the letters provided to the adjacent riparian property owners. As proposed, this office has no objection to the
proposed project modification as long as there are no objections from the other agencies to this proposal. It appears
that the project continues to be CONSISTENT with the use standards set forth in 15A NCAC 07H .0209.
By copy of this memo, DCM is requesting that the DWR, DMF-Shellfish Section, DEMLR and Public
Water Supply Section provide any comment that your agency may have on the proposed project to Heather
Coats of DCM's Wilmington office within 14 days of receipt of this memo.

5) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent
its movement from the site by wave or current action.
6) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite or
broken concrete.
7) The fill material shall be clean and free of any pollutants except in trace quantities. Metal products,
organic materials, or unsightly debris shall not be used.
8) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
9) No backfill material is to be placed within 30 feet of the normal high water line, except that which will be
used to backfill the area behind the permitted bulkheads.
Excavation
10) In order to protect juvenile finfish resources, no excavation shall be permitted between April 1 and
September 30 of any year without prior approval of the North Carolina Division of Coastal Management
in consultation with appropriate resource agencies.
11) Excavation shall not exceed -8 feet below the normal low water. In no case shall the depth of
excavation exceed the depth of the connecting waters.
12) The temporary placement of double handling of excavated materials within waters or vegetated wetlands
is not authorized.
Spoil Disposal/Estuarine Beach Renourishment
13) All excavated materials shall first be placed in a barge and allowed to properly dewater before being
placed in the estuarine beach renourishment area.
14) All excavated material to be placed into the estuarine beach renourishment area shall be confined behind
a turbidity curtain installed between the estuarine beach renourishment area and the existing sound to
prevent spillover of solids into any surrounding waters. A 24-hour period after completion of
renourishment shall elapse prior to removal of the turbidity curtain to prevent unnecessary siltation into
the adjacent waterbody.
15) Prior to the initiation of any beach renourishment activities, the area designated for beach renourishment
and the turbidity curtain shall be inspected and approved by a representative of the Division of Coastal
Management.

Sedimentation and Erosion Control
16) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
17) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
18) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within 30 calendar days of project completion.
Maintenance Clause
19) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any
maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
U.S. Army Corps of Eneineers Conditions
20) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant shall
implement the U.S. Fish & Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements within. The guidelines can be found at:

21) Should Federal Aids to Navigation (ATON) need to be relocated to facilitate this operation, 30 days'

22) To address concerns from the United States Coast Guard: The following information shall be provided a
minimum of 10 days prior to dredge operations commencing:
Any dredging or other operational activity that impacts the safe navigation of Federal Waterways.
a. Dates (inclusive) of operation.
b. Hours of operation (24 hours/daylight hours only).
c. Names of involved vessel(s).
d. Working and standby frequencies.
e. Specific location (mile marker/channel).
f. Any specific instructions or concerns that would be pertinent to the mariner.

23) The permittee understands and agrees that, if future operations by the United States requires the removal,
relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice
from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby,
without expense to the United States or the state of North Carolina. No claim shall be made against the
United States or the state of North Carolina.on account of any such removal or alteration.
24) Approval of the structure was based on a determination that there would be no obstruction to navigation.
Issuance of this permit should not be construed as relieving the permittee of taking proper steps to ensure
the structure and moored boats will not be damaged by wave wash.
25) No attempt shall be made by the permittee to prevent the free and full use by the public of all navigable
waters at or adjacent to the authorized work. The permitted activity shall not interfere with the public's
right to free navigation on all navigable waters of the United States.
26) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before
completion of the work will, without expense to the United States and in such time and manner as the
Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -
project condition.
General
27) The permittee and/or his or her contractor shall meet with a representative of the

28) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of the permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having transferred it to a third party.
29) No vegetated wetlands shall be excavated or filled, even temporarily.
30) The permit shall not be assigned, transferred, sold or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
31) This permit does not authorize any structural work to either of the existing docking facilities.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

BLOCKADE RUNNER INFILTRATION SYSTEM NARRATIVE
The NC Coastal Federation, in conjunction with the Blockade Runner Hotel (BR), proposes to install a
stormwater runoff infiltration system along the BR Banks Channel frontage. The purpose of the system is
to intercept stormwater runoff from existing culverts on the north and south ends of the property that
discharge into Banks Channel and divert it into a proposed infiltration system. All components of the
system will be located behind the existing and proposed bulkheads in uplands between the bulkheads
and Waynick Blvd.
The infiltration system includes diverter structures on each outfall, 18" HDPE or aluminum pipe to the
infiltration system, and 3-24" perforated pipes in a gravel trench. Runoff from the outfalls will be 100%
diverted to the infiltration system. Once the storage and infiltration capacity of the infiltration system is
exceeded, overflow weirs in each diverter structure will discharge into the existing outfalls to Banks
Channel.
The system will infiltrate runoff from a 1.5 inch design storm for the 3.5 acre drainage basin. The drainage
basin includes the BR property, state and local roadways, and private property. Overall impervious
coverage in the basin is estimated at 85%. The 1.5" design storm was selected as a reasonable target in
conformance with generally accepted water quality objectives. The project is not subject to regulatory
permitting as a stormwater management system nor state and local design criteria.

modification to the major Cama permit. We are proud to be part of this public/private funded project to
help filter run-off into Banks Channel. We have added this project as a modification to the proposed
major Cama application currently under review for the Banks Channel area in front of the Blockade
Runner Hotel.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

Heather,
I spoke with the engineer(Larry Sneeden) about the proposed changes to the infiltration system for the Blockade Runner
that is adjacent to Wrightsville Beach well #4 and we have no objection to the proposal. The engineer stated that the
infiltration pipes located within 160' of the well will be solid pipe so the stormwater will be discharged away from the
well now. If you need further information from me, let me know.

Dear Mr. Baggett:
Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to modify the work associated with your Department of the Army (DA)
permit issued on March 22, 2016, which authorized maintenance excavation of an existing
marina area, estuarine beach renourishment and the construction of a new shoreline stabilization
within Banks Channel, in Wrightsville Beach, New Hanover County, North Carolina. The
requested modification is for the reconfiguration of the south section of the existing bulkhead.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 19800291 (copy enclosed). The permit is hereby modified. It is understood that all
other conditions of your permit remain applicable. The expiration date of your DA permit is
December 31, 2016.
