Carpenter, 1620 Brownsburg Road, Marlinton, WV 24954 Authorizing development in Currituck County at adj. to Currituck Sound, at 116 Seahorse Lane, in Walnut Island Estates S/D, in Grandy, as requested in the permittee's application dated 6/6/16, including attached drawings (2), both dated 6/6/16. This permit, issued on September 29, 2016 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to tines, imprisonment or civil action; or may cause the permit to be nuu ano voiu. Shoreline Stabilization 1) The alignment of the permitted bulkhead shall be verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 2) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 3) No backfill material shall be placed within 30 feet of the normal water line, except that which will be used to backfrll the area behind the permitted bulkhead. 4) The bulkhead shall be constructed prior to any backfrlling activities. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2019 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Kathy Bennett & Aaron Carpenter ADDITIONAL CONDITIONS Permit No. 96-16 Page 2 of 3 5) The temporary placement or double handling of fill materials within water or vegetated wetlands is not authorized. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) No excavation, or other land disturbing activities, is permitted except for that which may be required for the construction of the bulkhead wall. This permit does not authorize any excavation waterward of the approved alignment. 8) All backfill material shall be clean and free of any pollutants except in trace quantities. 9) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 10) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 13) No excavation or filling of any vegetated wetlands is authorized by this permit 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 16) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 2016-0731. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. According to the USDA's Natural Resources Conservation Service's Web Soil Survey, the soil on the property is made up of Newhan fine sand (NeC) and is vegetated entirely of yard grasses. Existing man-made features include a camper/mobile trailer, concrete slab and storage shed. The nonlinear shoreline is ±135' in length and is hardened by a failing wooden bulkhead of unknown age. High ground material is eroding through the bulkhead sheeting boards and the tiebacks are failing as evidenced by a depression in the ground extending ±6' landward of the bulkhead. The adjacent properties both contain single-family dwellings, bulkheaded shorelines, and piers with platforms. Based on available information, there appears to be no archaeological sites on this property or nearby. The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish taking. Overview: The .12 acre subject property has 135 linear feet of irregular shoreline along the Currituck Sound. Site elevation is approximately 2.5 feet above Normal Water Level (NWL). The property is vegetated with lawn grasses. The property is located within the VE floodzone. Water depths 0 to 16 feet from the shoreline are approximately 2 feet below NWL. Existing site improvements consist of a camper/mobile trailer, a concrete slab and a storage shed. The shoreline is hardened with a failing wooden bulkhead. The highground is eroding through the bulkhead sheeting boards and the tiebacks are failing as evidenced by a depression in the ground extending landward of the bulkhead. Installation of 116 linear feet of wooden bulkhead is proposed. The bulkhead will be located an average of 6 feet waterward of NWL and a maximum distance of 16 feet waterward of NWL. The bulkhead alignment will result in a straighter shoreline. The bulkhead will tie into bulkheads on adjacent properties to the north and south. Clean backfill will be provided from an upland source. The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish taking. The water fetch ranges from .6 mile to 3 miles. The project area is void of Submerged Aquatic Vegetation (SAV). Based on available information, there appear to be no archaeological sites on or near the property. Anticipated impacts resulting from this project are expected to include: the filling of 696 sq. ft. of Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC), and; the disturbance of 1,400 sq. ft. of Estuarine Shoreline AEC. The project site is located entirely within Areas of Environmental Concern. Areas of Environmental Concern (AECs) are designated as "Conservation Areas" as indicated on Page 11-1. As indicate on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long- term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The Conservation class should be applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features." Definitions of key words are provided on page 9-2. These words include "Encourage: to favor or foster", "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply financial support". Land Use Plan policies address the use of vegetated buffers along the shoreline to reduce pollutants and protect water quality. In this case, the bulkhead will eliminate erosion along a pre-existing hardened shoreline. The following LUP policies may be applicable to this request: Land Use Compatibility: Policy ES4, Pages 9-5 and 9-6. "In approving new developments, Currituck County shall support the retention or creation of vegetated buffer area along the ESTUARINE SHORELINES as a simple, effective and low-cost means of preventing pollutants from entering estuarine waters.
