Authorizing development in Brunswick County at adjacent to Cape Fear River, in the Village of
Bald Head Island, as requested in the permittee's email dated 1/16/17.
This permit, issued on February 2, 2017 is subject to compliance with the application (where consistent
with -the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be "subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Offshore Riprap Breakwaters
1) In accordance with commitments made by the perrnittee, this Minor Modification deletes authorization
of the two northernmost breakwaters. Any future request to construct these two breakwater structures
shall require additional coordination and approval from the Division of Coastal Management.
2), This Minor Modification removes the in -water work moratorium found in Condition No. 1 of the
original of Permit No. 80-16 to allow for the construction of the two southernmost breakwaters.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the

In accordance with commitments made by the permittee, no construction equipment shall be permitted
landward of Mean High Water (MHW) between April 1 and September 30 of any year without the prior
approval of the Division of Coastal Management, in consultation with appropriate resource agencies. All
construction authorized under this Minor Modification shall be performed in water from a barge or other
suitable floating platform.
All conditions and stipulations of the active permit remain in force under this Minor Modification unless
specifically altered herein.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
This Minor Modification shall be attached to Permit No. 80-16, which was issued to the permittee on
7/7/16, and copies of both documents shall be readily available on site when Division personnel inspect
the project for compliance.
NOTE:
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
198000291 and assigned SAW 2016-00589.
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 3900 and assigned the project DWR Project No. 20160499.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination.
A minor modification application processing fee of $100 was received by DCM for this project.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

SUBJECT: Modification request, State Permit No 80-16,
Village of Bald Head Island
Brunswick County
Mr. Erik Olsen, as acting agent for the Village of Bald Head Island, is requesting a minor
modification of State Permit No 80-16. State Permit No. 80-16 was issued to the Village of Bald
Head Island on July 7, 2016 for the construction of offshore rip rap breakwaters. The permit is
scheduled to expire on December 31, 2019.
Mr. Olsen is requesting the permit be modified to allow for construction of the southernmost two
detached rock breakwaters closest to the marina entrance jetty during the moratorium of April 1-
September 30 during this calendar year (2017). The applicant states that no construction would
occur landward of MHW and that construction would occur via barge or other suitable floating
platform only. The request is only for the two southernmost rock breakwaters. According to the
applicant, the northern rock breakwaters will not be constructed at this time and this request is to
structurally stabilize the fill that has been placed on the eroded beachfront of row Boat Row (see
attached).
The owner has submitted a check (check No. 2400) in the amount of $100 for the modification
request along with an agent form. As proposed, this office has no objection to the proposed
project. It is the staff's recommendation that the proposed development continues to be
CONSISTENT with the Rules of 15 NCAC 7H. 0208.
By copy of this memo, DCM is requesting that the USACE, DWR and DCM Marie Fisheries
provide any comment that your agency may have on the proposed proj�t to Heather Coats
of DCM's Wilmington office within 14 days of receipt of this memo. ECEIVED
