in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to David and JoAnn Szymanski authorizing development in the Estuarine Shoreline Area of Environmental
Concern (AEC) at 4752 Island Walk Drive SW, in Ocean Isle Beach NC 28469, as requested in the permittee's
application package, dated 26-Aug-15. This permit, issued on 16-Nov-15, is subject to compliance with the application
and site drawing dated received on 05-Nov-15, (where consistent with the permit), all applicable regulations and special
conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil
action, or may cause the permit to be null and void.
This permit authorizes: Single Family Residencd/LandscapinglDriveway.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 05-Nov-15.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 253-2034 for a final inspection at
completion of work.

This permit action may be appealed by the pennittee or other qualified persons
within twenty (20) days of the issuing date. This permit must be on the project
site and accessible to the permit officer when the project is inspected for
compliance. Any maintenance work or project modification not covered under
this permit, require further written permit approval. All work must cease when this
permit expires on:
December 31, 2018
In issuing this permit it Is agreed that this prolect is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) Unless specifically allowed in 15A NCAC 07H-0209(d)(10), and shown on the permitted plan drawing, all
developmenNconstruction shall be located a distance of 30 feet landward of Normal High Water. No portion of the
roof overhang shall encroach into the 30 ft. buffer.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activit14es, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(7) Any proposed for grading within the 30' buffer from the Normal High Water level must be contoured to prevent
additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must
remain in a vegetated state.
(8) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.
(9) The applicant has effectively demonstrated, through innovative construction design, that the amount of impervious
surface areas may be exceeded in a way that runoff water Oil be managed and the AEC protected, so as to allow
31% impervious surface percent of the impervious areas within 75' Coastal Shoreline AEC. All proposed
development and associated construction must be done in accordance with the design specifications of the
permitted innovative design, sealed by design professional, Edward Brunner on 22-Sep-15.
(10) Upon completion of construction and prior to the issuance of a Certificate of Occupancy (CO), a letter of certification
must be received from the designer of the innovative system installed, certifying that the permitted system has been
installed in accordance with this permit, the approved plans and his design specifications. Any deviations from the
approved plans and specifications must be noted on the Certification and a permit modification may be required
prior to receiving a CO.
(11) The landowner or permittee shall at all times provide the operation and maintenance necessary to assure the
permitted stormwater system functions at optimum efficiency. The landowner or permittee shall maintain the
permitted stormwater system for the life of the project.

Deed restrictions are incorporated into this permit by reference and must be recorded
with the Office pf the Register of Deeds prior to the sale of any lot. Recorded deed
restrictions mast include, as a minimum, the following statements related to
stormy+ater management:
a. The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number SW8 060733, as issued by the
Division of Water Quality under NCAC 2N.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
c. These covenants are to run with the land and be binding on all persons and
f parties claiming under them.

Lots within CAMA's Area of Environmental Concern may have the permitted

13. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the }permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been

Subject to the Declaration of Covenants, Conditions and Restrictions for
Tidewater at Ocean Isle, recorded in Book 2725 at Page 171 and that

Grantees are as stated above. The property herein conveyed does not include the primary
residence of Grantor.

appurtenances thereunto belonging to the Grantees in fee simple.
AND the Grantor does hereby covenant with Grantees that Grantor is seized of the
premises in fee simple, that it has the right to convey the same in fee simple, that title is
