Heather & Joe,
I forwarded the site plan on to the Assistant Major Permit Coordinator in Morehead for his
thoughts. He conferred with his boss and since these plans are more detailed with significant
changes, they feel that a new application would need to be submitted with new notifications
sent and possibly another $250 permitting fee. This would also restart the 75 day clock.
Alternatively, you can have the applicant formally retire the major permit application and
submit a CAMA Minor Permit application to me. You will have to renotify and pay a $100
permitting fee, but I can have a permit issued fairly quickly (14-25 days). Since no wetlands are
being filled now, the project qualifies for the minor permit.
I am going to attach the minor permit application so you can get started on it if you choose to
go that route (I would recommend this route). If you will be signing and submitting the
application on behalf of Mr. & Mrs. Morgan, have them fill out the attached agent
authorization form.

would like to know if this would restart the clock for the permit, or if we could move this forward quickly so that we can
start the build for our homeowners.

Morning Lyn and John,
I tried to give you a call this morning but my call could not go through, but I wanted to talk to you about some comments
from the Land Use Plan and the Local Govt. concerning the Morgan project. I have attached the comments above, but in
summary the fill of wetlands for the bulkhead is inconsistent with the Land Use Plan and the Local Govt. Due to an
inconsistent finding with these, the project as design would be denied. If denied there is no ability to request a variance
because of the objections from the Land Use Plan and Local Govt. There seems to be a path forward by revising the
bulkhead alignment landward of the wetlands with no proposed wetland fill. My suggestion would be to request the
project be placed on applicant hold while you discuss and redesign. Then I can recirculate the revised project. Once all
the issues are resolved we can take the project off hold and finish things up. But without the applicant hold and
redesign the project will be denied due to Land Use Plan and Local Govt objections.
Please let me know how you would like to proceed and we can take the necessary steps.

FYI this one is hold DCM hold due to local and LUP objections for the fill of wetlands. This will require the applicant to
either move the bulkhead landward of wetlands resulting in no fill or getting a text amendment to the local ordinances
to allow as proposed. So this could be either a quick change or a longer affair if they go the text amendment route.

The applicant proposes to clear, fill and grade the site (with 404-wetland fill), install a bulkhead,
construct a single family dwelling, an elevated walkway, a driveway and parking area.
The site of the proposed development is located at 12 Rudder Court, lot #12 in Section 2 of
Pirates Cove subdivision, Manteo, Dare County, adjacent to a man-made canal whose waters
connect to the Roanoke Sound.
The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW),
Estuarine Shoreline (ES) & Coastal Wetlands (CW) Areas of Environmental Concern (AEC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:
15A NCAC 07H.0208 Use Standards
Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are
not water dependent within the EW and PTA and lists uses that may be considered water
dependent.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse
impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds,
submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning

Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented
archaeological or historic resources as identified by the N.C. Department of Cultural Resources.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(D) states that development shall not increase siltation.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(E) states that development shall not create stagnant water bodies.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (b) addresses Specific Use Standards. Of these, subparagraph (7) Bulkheads pertains
to this project, and those subparagraphs not listed are not applicable to this project.
Paragraph (7) Bulkheads
Subparagraph (7)(A) states, 'Bulkhead alignment, for the purpose of shoreline stabilization, shall
approximate the location of normal high water or normal water level."
Consistent: The proposed bulkhead alignment is landward of NWL.
Subparagraph (7)(B) states, `Bulkheads shall be constructed landward of coastal wetlands in
order to avoid significant adverse impacts to the resources."
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (7)(C) states, 'Bulkhead backfrll material shall be obtained from an upland source
approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a
part of a permitted project involving excavation from a non -upland source, the material so
obtained may be contained behind the bulkhead."

Subparagraph (7)(D) states, `Bulkheads shall be permitted below normal high water or normal
water level only when the following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results from
natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep
grade bank, which will cause the applicant unreasonable hardship under the other provisions of
this Rule;
(ii) the bulkhead alignment extends no further below normal high water or normal water level
than necessary to allow recovery of the area eroded in the year prior to the date of application, to
align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the
unusual geographic or geologic features;
(iii) the bulkhead alignment will not adversely impact public trust rights or the property of
adjacent riparian owners;
(iv) the need for a bulkhead below normal high water or normal water level is documented
by the Division of Coastal Management;
(v) the property to be bulkheaded is in a nonoceanfront area.
Not Applicable: The bulkhead alignment is landward of NWL.
1 SA NCAC 07H.0209 Coastal Shorelines
(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph (c) of this Rule. These uses shall be limited to those types of development activities
that will not be detrimental to the public trust rights and the biological and physical functions of
the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid,
mitigate or reduce adverse impacts of development to estuarine and coastal systems through the
planning and design of the development project. In every instance, the particular location, use,
and design characteristics shall comply with the general use and specific use standards for
coastal shorelines, and where applicable, the general use and specific use standards for coastal
wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section.
Development shall be compatible with the following standards:
(1) All development projects, proposals, and designs shall preserve and not weaken or eliminate
natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress -gum
protective fringe areas adjacent to vulnerable shorelines.
Consistent: The proposed development is consistent with the intent of this rule. RECEIVED
(2) All development projects, proposals, and designs shall limit the construction of impeows 9 2020
surfaces and areas not allowing natural drainage to only so much as is necessary to adequately
service the major purpose or use for which the lot is to be developed. ImpervioussurfeeM64HD CITY

demonstrate, through innovative design, that the protection provided by the design would be

equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas
exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are
not increased and the applicant designs the project to comply with the intent of the rule to the
maximum extent feasible.
Consistent: The proposed development is consistent with the intent of this rule.
(3) All development projects, proposals, and designs shall comply with the following mandatory
standards of the North Carolina Sedimentation Pollution Control Act of 1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.
Consistent: The proposed development is consistent with the intent of this rule.
(B) No development project proposal or design shall permit an angle for graded slopes or fill
which is greater than an angle which can be retained by vegetative cover or other erosion -control
devices or structures.
Consistent: The proposed development is consistent with the intent of this rule.
(C) All development projects, proposals, and designs which involve uncovering more than one
acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of
completion of the grading; provided that this shall not apply to clearing land for the purpose of
forming a reservoir later to be inundated.
Consistent: The proposed development is consistent with the intent of this rule.
(4) Development shall not have a significant adverse impact on estuarine and ocean resources.
Significant adverse impacts include development that would directly or indirectly impair water
quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic
Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or
cause degradation of shellfish beds.
Consistent: The proposed development is consistent with the intent of this rule.
(5) Development shall not interfere with existing public rights of access to, or use of, navigable
waters or public resources.
Consistent: The proposed development is consistent with the intent of this rule.
(7)., Development shall not cause irreversible damage to valuable, historic architectural or
archaeological resources as documented by the local historic commission or the North Carolina
Department of Cultural Resources.
Consistent: The proposed development is consistent with the intent of this rule.

(8) Established common-law and statutory public rights of access to the public trust lands and
waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach
upon public accessways nor shall it limit the intended use of the accessways.
Consistent: The proposed development is consistent with the intent of this rule.
(10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new
development shall be located a distance of 30 feet landward of the normal water level or normal
high-water level, with the exception of the following:
(A)Water-dependent uses as described in Rule 07H .0208(a)(1) of this Section;
Consistent: The proposed development is consistent with the intent of this rule. A
bulkhead/retaining wall is listed as a water dependent structure.
(G)Grading, excavation and landscaping with no wetland fill except when required by a
permitted shoreline stabilization project. Projects shall not increase stormwater runoff to
adjacent estuarine and public trust waters;
Consistent: The proposed development is consistent with the intent of this rule.
Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application and plans, I recommend a permit be issued to Matthew & Kristin Morgan
for the development as proposed, provided that the USACE approves the project.

property does not present a threat to health, safety and welfare of the community, the Town is not making an
exception.

I am writing to request the Town's input on a proposed project's consistency with the CAMA certified LUP
(Town of Manteo 2007 Land Use Plan certified by the CRC on July 27, 2007, as amended through February
12, 2009)
as it relates to WQ Policy 36 on Page 116.
Matthew and Kristin Morgan have submitted a CAMA Major Permit application to develop the property at 12
Rudder Court in the Pirate's Cove subdivision. The proposal is to install 84 linear feet of bulkhead, construct
a single-family house and boat garage with associated driveway and parking improvements, and install a 4
foot wide by 51 foot long elevated walkway. As proposed, the bulkhead will be landward of wetlands except
for a 250 sq. ft. area of Section 404 wetlands that will be filled when the lot is filled and graded. See
ATTACHED site plan.
Below is the policy in question, along with its referenced policy:
WQ Policy 36, Page 116.
"To improve water quality, mitigate storm hazards, and protect resources providing important
biological function, no new development or filling should be allowed within upland wetlands. Site
specific delineations of wetlands are needed due to the dynamic nature of wetland systems. This policy
is more stringent than state and federal regulations. When this policy presents a threat to health, safety
and welfare of the community, the Town may make an exception so long as it adheres to all other
policies of the Land Use Plan. In this case, mitigation measures should be required as described in
Water Quality Policy 37. The following activities should be allowed in uplandmetlands: hiking,
walking, bird watching, stormwater interventions and educational/research activities. Impacts from the
construction and maintenance of public boardwalks and pathways are allowable in accordance with
CAMA regulations."
WQ Policy 37, Pages 116.
"When mitigation is required for wetland loss, it should be implemented
on Roanoke Island. This exceeds current state and federal regulation,
which allows for mitigation within the eight -digit unit of the Pasquotank
River Basin. Allowing mitigation to occur off island would result in net
wetlands loss on Roanoke Island and compromise the vegetative
integrity of the Town of Manteo and Roanoke Island."
DCM is seeking the Town's input, given the use of "should" rather than "shall" in WQ Policy 36.
Please let me know if the Town considers the proposed bulkhead and fill impacts to Section 404 wetlands, to
be "consistent" or "inconsistent" with the CAMA certified LUP with an email response.

SUBJECT: Major Permit Request by Matthew and Kristin Morgan to install 84 linear feet of
bulkhead, construct a single-family house and boat garage with associated
driveway and parking improvements, and install a 4-foot wide by 51- foot long
elevated walkway; on property located along a manmade canal that connects to
the Roanoke Sound at 12 Rudder Court, in the Pirate's Cove subdivision, in the
Town of Manteo.

Consistency Determination: The request is inconsistent with/ in conflict with the Town of
Manteo 2007 Land Use Plan certified by the CRC on July 27,
2007, as amended through February 12, 2009, relative to
development and fill in upland wetlands (WQ Policy 36, Page
116).
Overview: The vacant, .26 acre (11, 305 sq. ft.) subject property has 84 linear feet of shoreline
along a manmade canal that connects to the Roanoke Sound. The site contains 252 sq. ft. of
Coastal Wetland fringe along the shoreline extending 3 feet landward of Normal Water Level
(NWL) to a 3,329 sq. ft. area of Section 404 wetlands that transitions to 7,724 sq. ft. of high
ground. Site elevations range from .5 feet above NWL within the Coastal Wetland fringe to 3 feet
above NWL within the high ground area. The site is vegetated with lawn grasses and small
shrubs. The western third of the property along the canal is located within the National Flood
Insurance Program (NFIP) AE (4) Flood Zone, with the remainder located in the area of .2 percent
annual chance of flood hazard. Although there are no on -site improvements, a 6-foot wide
elevated community walkway with a 5-foot wide by 12-foot long floating dock is located waterward
of the property line.
Installation of 84 linear feet of bulkhead, construction of a single-family house and boat garage
with associated driveway and parking improvements, and installation of a 4-foot wide by 51-foot
long elevated walkway are proposed. The bulkhead will tie into a bulkhead on adjacent property
to the north and end in a 20-foot long return wall along the property line to the south. The bulkhead

will be landward of wetlands except for a 250 sq. ft. area of Section 404 wetlands that will be filled
when the lot is filled and graded. The bulkhead will have a height of approximately 4 feet above
the adjacent wetland substrate. Fill material will be brought in from an off -site source. The
elevated walkway will connect the house to the community walkway, extending across highground
and over Section 404 and Coastal Wetlands. The house will be served by a central wastewater
system and municipal water source. Building elevations were not provided. Site area to be
graded, filled, or disturbed, as indicated in the application, is 2,952 sq. ft., or 26.1 % of the lot.
The waters of Roanoke Sound in this area are classified as SA:HQW and Coastal Waters and
are closed to shellfish taking. Based on available information, there appear to be no
archaeological sites on or near the property.
Anticipated impacts resulting from this project are expected to include: the filling of 250 sq. ft. of
Section 404 Wetlands within the Estuarine Shoreline Area of Environmental Concern (AEC); the
disturbance of 2,952 sq. ft. of High Ground within the Estuarine Shoreline AEC, and; the shading
of 72 sq. ft. of Section 404 Wetlands within the Estuarine Shoreline AEC and 18 sq. ft. of Coastal
Wetlands AEC.
Basis for Determination:
The subject property is designated as "Single Family Residential', on the "Town of Manteo Future
Land Use Map." As indicated on Page 129, this designation has a density of 4-6 units per acre
with building heights of 12 to 24 feet and lot coverage of 30-35%.
Definitions of key words are provided on Page 94. These words include "Continue", "Encourage",
"Identify", "Implement", "Protect", "Enhance", "Maintain, "Should", and "Support'.
"Should": An officially adopted course or method of action intended to be followed
to implement the community Goals. Though not as mandatory as "shall", it is still
obligatory course of action unless clear reasons can be identified that an exception
is warranted. Town staff and elected and appointed boards are involved at all
levels from planning to implementation to maintenance.
The request is inconsistent with/in conflict with the following policy relative to proposed
development and fill in upland wetlands:
Water Quality:
WQ Policy 36, Page 116.
'To improve water quality, mitigate storm hazards, and protect
resources providing important biological function, no new
development or filling should be allowed within upland wetlands. Site

nature of wetland systems. This policy is more stringent than state
and federal regulations. When this policy presents ,a threat to health,
safety and welfare of the community, the Town may make an
exception so long as it adheres to all other policies of the Land Use
Plan. In this case, mitigation measures should be required as
described in Water Quality Policy 37. The following activities should
be allowed in upland wetlands: hiking, walking, bird watching,
stormwater interventions and educational/research activities. Impacts
from the construction and maintenance of public boardwalks and
pathways are allowable in accordance with CAMA regulations."

The Town concurs with this determination as indicated in the ATTACHED email. Additionally,
the Town has decided not to make an exception in this case, since the policy to not allow new
development or filling within upland wetlands on this property does not present a threat to
health, safety and welfare of the community and there is no opportunity for wetland mitigation at
the site.

8. PROJECT SUMMARY: The applicant proposes to clear, fill and grade the site (with
404-wetland fill), install a bulkhead, construct a single family dwelling, an elevated
walkway, a driveway and parking area.
Protect Setting
The site of the proposed development is located at 12 Rudder Court, lot #12 in Section 2 of
Pirates Cove subdivision, Manteo, Dare County, adjacent to a man-made canal whose waters
connect to the Roanoke Sound.
The property is a vegetated, vacant lot that is ±11,305 ft2 (0.26 acres) in size. Elevations range
from ±0.5' above Normal Water Level (NWL) within the coastal wetland fringe along the
shoreline to ±3' above NWL with the highground area. The site has ±7,724 ft2 of highground
area that is separated from the water by areas of coastal and 404-wetlands. The highground
area is mostly cleared of undergrowth and is vegetated by grasses and small shrubs. Based
on available information, there does not appear to be any archaeological sites on or adjacent
to this property.
The shoreline is ±84' in length and is vegetated by 252 ft2 of Coastal Wetlands along the
entire length. The coastal wetland has been identified as black needlerush (Juncus
roemerianus) and extend ±3' landward of NWL to an area of USACE 404-wetlands adjacent
to the highground area.
The adjacent property to the north is bulkheaded and contains a single-family dwelling and
driveway. The adjacent property to the south contains a single-family dwelling and driveway
as well.
The waters of the Roanoke Sound are classified as SA:HQW, are closed to shellfish taking
and are considered coastal waters. Water depths and SAV presence were not evaluated as
water dependent development is not proposed.
Development Proposal
The applicants are proposing to construct a ±84' of bulkhead which will tie into the northern
property's bulkhead. A 20' return wall will also be constructed along the southern property
line. The bulkhead will be landward of the wetlands except for an ±250 ft2 404-wetland area
that is proposed to be filled when grading and filling the lot. Fill material will be brought in from
and offsite source. According to the submitted plan, the bulkhead will have a height of 2W
above the adjacent wetland substrate.
After the bulkhead is completed the site has been filled and graded, a single-family dwelling
with be constructed >_42' landward of NWL. In addition to the dwelling, a driveway, parking
area, boat garage and walkway to community dock will be constructed. The total impervious
coverage in the 75' estuarine shoreline AEC on the lot will be ±2,952 ft2 (23.5%). Total
disturbed area is anticipated to be ±3,682 ft2. The dwelling will connect to the -

Anticipated Impacts
• Grading and filling of the lot will result in ±250 ft2 of USACE 404-wetlands being filled.
• The total disturbed area will be ±3,220 ft2.
• Sediment and erosion control techniques are anticipated to be needed along the
bulkhead to prevent unconsolidated material from flowing over the wall into the adjacent
wetlands until the area is stabilized by vegetation.
• Proposed impervious surfaces within the 75' Estuarine Shoreline AEC total ±2,952 ft2
or 23.5%.
• There are no known archeological resources being impacted by the proposed
development.

Morgan Major Permit Narrative for proposed bulkhead at 12 Rudder Court Manteo, NC 27954.
The proposed project will consist of following:
1- Removal of brush and trees at 12 Rudder Court in proposed project area, along and inside of
proposed bulkhead layout.
2- Constructing a vinyl bulkhead connecting to existing bulkhead at 13 Rudder Court then crossing
12 Rudder Court ending with return at 12 Rudder Court.
3- Install elevated walkway from house at 12 Rudder Court to community walkway.
The bulkhead will be constructed with interlocking vinyl sheathing on a pile and wale frame. The height
of the bulkhead will vary from 3' to 4' along the property. The bulkhead will begin at the corner of an
existing bulkhead located at 13 Rudder Court. The bulkhead will continue in a south direction along
property at 12 Rudder Court and then end at proposed bulkhead return for 12 Rudder Court.
Equipment to be used for the construction of bulkhead will be a land -based excavator. Backfill will be
installed by dump truck and skid steer loader after bulkhead completion using clean fill from an upland
source. Once all backfill has been placed and graded, a seasonally appropriate grass will be spread.
Once bulkhead and associated backfill is completed, we will then install a new 4' wide elevated walkway
connecting to the existing elevated community walkway. The new elevated walkway will be constructed
using 6"x6" pilings with 2"x10" girders and 2"x8" joists topped with 2"x6" decking.

The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application fora development permit in an AEC as
designated under the CAMA was received on 05/04/20. Matthew & Kristin Morgan
proposes to fill and grade the site with 404-wetland fill, install a bulkhead, construct a
single family dwelling, with an elevated walkway, driveway and parking area located at
12 Rudder Court, Lot 12 in Dare County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-
3901 during normal business hours. Comments mailed to Braxton Davis, Director, DCM,
400 Commerce Avenue, Morehead City, NC 28557, prior to 05/30/20, will be considered
in making the permit decision. Later comments will be considered up to the time of permit
decision. Project modification may occur based on review & comment by the public, state
& federal agencies. Notice of the permit decision in this matter will be provided upon
written request.

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval to fill and grade the site with 404-wetland fill, install a bulkhead, construct a
single family dwelling, with an elevated walkway, driveway and parking area located at 12 Rudder
Court, Lot 12 in Dare County.
It was received complete on May 4, 2020 and appears to be adequate for processing at this time.
The projected deadline for making a decision is July 18, 2020. An additional 75-day review period
is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from May 4, 2020, you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of
your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will fend a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your
property, or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
