Per staff at the NC Division of Coastal Management Morehead City District Office, this work could be authorized and permitted under the CAMA General Permit process with the 15 'riparian line setback waiver from the adjacent riparian property owners. However, the adjacent riparian property owners have not agreed to waive the 15 riparian setback. The 15' setback lines into Mr. DeMent' s riparian space would leave a triangular area of only 16.5 ' wide at the bulkhead (base) by a 25' long (height) at the waterward point on Mr. DeMent' s property. That riparian configuration would cause Mr. DeMent not to have reasonable riparian use of his property; nor would Mr. DeMent have the same or similar docking facility that was authorized by the DCM that had been existing since 2005. Therefore, Mr. DeMent is applying for a CAMA Major permit to replace the structure that was previously authorized by GP 39640. Bogue Banks Marine Construction (BBMC), Authorized Agent for Mr. Rick DeMent, is applying for a CAMA permit to replace the dock on his property located at Lot 32, 207 Smith Street, Atlantic Beach, Carteret County, NC in accordance with the NC Division of Coastal Management CAMA General Permit 39640. GP 39640 was issued to the property owner at that time, Mr. Larry Burke, on 03/21/2005. The permit authorized an existing dock to be reconfigured to make room for an uncovered 12 ' by 12' boatlift, a 13.5 ' long by 6' wide side -to platform, and to conduct maintenance excavation dredging. The permit was conditioned to place the structures within the applicant's property's riparian area; to locate the southwest comer of the boatlift piling no closer than 7.5' of the shared riparian line between lot 27 (Nunn) and lot 32; the development was to be staked and approved by [DCM] prior to construction; and the spoils were to be contained in an approved highground location. Having existed since 2005, the existing dock needed repair. Mr. DeMent hired Bogue Banks Marine Construction (BBMC) to replace the pier and obtain the necessary CAMA permits. Prior to consultation with the coastal management representative, BBMC began the disassembly of the existing pier, leaving only the existing and previously authorized freestanding boat lift and several remnant pilings. That is the status of the existing structure. RECEIVED AUG 2 3 2017 DCM- MHD CITY GP 39640 describes the reconfigured dock length as 45' in length from the edge of marsh at the time the permit was issued. The marsh no longer exists as it did in 2005. The overall dock length would now be determined from existing records and files at the Division of Coastal Management in Morehead City. These documents show on a survey from Stroud Engineering, dated 6/23/2000 the overall dock length from the existing bulkhead to be at or near 57'-9" long by 5' in width. Mr. DeMent proposes to replace the overall dock length at 57' - 6" waterward from the bulkhead, parallel to the surveyed northern riparian line shared by lots 32 and 33 to the north as shown in the 6/23/2000 survey. The 6/23/2000 survey shows the dock was 5' wide at the bulkhead and tapered down to 3' -4" at the waterward end. Mr. DeMent proposes a 4' wide dock tapering down to T -4" at the waterward end. The reduction in width would betaken from the northern side of the proposed pier alignment and the southern side of the proposed pier would remain static in its original location, thereby reducing the proximity of the proposed pier to the northern shared riparian line between Mr. DeMent's lot 32 and Lot 33 (Coley). At the proposed western or waterward end of the pier, the northern side alignment of the proposed pier would be located to south of the shared riparian line between lots 32 and 33. This would also eliminate the approximate 6' long by up to four inches (4") width of encroachment over the northern shared riparian line as shown in the 6/23/2000 Stroud Engineering survey. BBMC also proposes to verify 7.5' distance from the northern side of Mr. Nunn's dock to the outermost edge of the southwest comer piling of Mr. DeMent's existing boatlift as per GP3964O. If the distance is less than 7.5,' the piling would require moving to be consistent with the 7.5' shown,on GP 39640. This could also require the other three pilings to be moved slightly to reasonably accommodate the existing boatlift bunk and beam supports. If it does require moving, the boatlift would be in the same area. Before proceeding with construction, the riparian lines would be set as per the 6/23/2000 Stroud Engineering survey by a professional land surveyor and strings would be set in place to correctly place the pilings and structure entirely within Mr. Dement's riparian area of Lot 32, 207 Smith Street. BBMC would use typical marine construction methods, a barge, and mechanical equipment to remove the remaining pilings and set the pilings by vibratory or agitation hammer.
