subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification ofthe adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and beliet certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Sir:
I received a phone call on 6-22-22 from Mr.Andre Webb informing me that the property owners
of7524 Sound Drive desired to build a pier/boat lift extension next to my property at 7522 Sound
Drive and did I have any objection. I told him if it met all the required set-back requirements I
had no objection, and requested a diagram of the plan. I asked ifthere were any CAMA setback
requirements and he inferred there were not. He said he would send the drawing that evening, or
the next moming. When it did not come by email, I notified him,
When the diagram arrived, it appears that the pier/boatlift touches our property and does not meet
what I understand is a 15' setback unless waived. A copy is attached.
I have emailed him the following email:
Mr. webb-l have rec'd your diagram ofthe requestfora pieratT524Sound Drive. lt appears that the new pier extends to
the riparian line, and does not meet the required setbacks.
According to CAMA, all piers, etc. must be set back 15'from the riparian property line unless a waiver is obtained. I OO NOT
agree to this waiver variance request.
I am confused about this for when I questioned you on the phone about setbacks you said there was no restriction, which
does not seem to be the case.

Unless I am mistaken about the requirements, I Do Nor waive any riparian rights. My source
for the setback requirement is the form (Adjacent fuparian Property Owner Notification Form) I
received earlier when the project request was for a 144'pier extension. I would appreciate your
correction if I have misunderstood.

Chris-l wanted to forward this additional email since I had sent a letter to you. Mr. Webb
clarified the pier request and I believe the issue is resolved. I am not waiving any riparian
rights regarding pier construction.
Apparently the existing piling are already on the line. To my knowledge I never waived any
riparian rights to the previous owners, but that is where the confusion lies'
