Docking Facility This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Signature of Permittee Zwaek Permit No. 20-17 Page 2 of 3 ADDITIONAL CONDITIONS - - 1 - -- - The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. This permit authorizes a maximum of 3 formalized boat slips. The pier and associated structures shall have a minimum setback distance of 15 feet between any parts `'of the structure and the adjacent property owners' riparian access corridors. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. No portion of the expanded docking facility shall encroach into the channel portion of the waterbody, as depicted on the attached workplan drawings. General The permittee and/or his or her contractor shall meet with a representative of the Division prior to oroiect initiation. This permit shall not be assigned, transferred, sold, or otherwise disposed, of to a third party without the written approval of the Division of Coastal Management. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury r " )which may be caused from existing or future operations undertaken by the United States in the public interest. No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. CE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2016-02540), which was issued on 12/29/16. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. (not counted due to alignment) Existing fixed platform = 12 ft. x 12 ft. = 144 sq. ft. (72 ft. not counted due to alignment) Existing floating platform = 8 ft. x 32 ft. = 258 sq. ft. Proposed fixed platform = 10 ft. x 6 ft. = 60 sq. ft. (not counted due to alignment) Proposed Boatlift = 13 ft. x 13 ft. = 100 sq. ft. = 169 sq. ft. (not counted) Total counted= 328 sq. ft. The docking facility would provide docking space for the total up to three (3) vessels at this location. It is staff's recommendation that the proposal appears to be consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the %width rule, the eight square foot rule and the pier width rule. The proposed structures would be located over open water. Any permit issued should also include a condition stating that no portion of any proposed structures shall encroach into the existing navigational channel, as depicted on submitted drawings. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. Turn right onto Porter's Neck Road and travel approximately 1 mile east. Turn Right on Edgewater Club Road at the round -about and continue east for approximately 1 mile until you reach Sea Shell Lane. Turn right onto Sea Shell Lane and travel approximately 0.2 miles until you reach Arjean Drive. Turn left onto Arean Drive and travel east approximately 0.3 miles until it terminates onto Santa Maria Avenue, which is an unimproved road. Continue down Santa Maria Avenue until you reach the property of interest, which will be located on the right. The applicant's lot is approximately 2 acres and averages approximately 30 feet above normal high water (NHW). High ground vegetation that exists on the property consists of native grasses. The applicant's measured natural shoreline is 153 ft. in length. There is an approximately 43 ft. wide pocket of coastal wetlands, consisting primarily of Smooth Cordgrass (Spartina altemiflora), which transitions to Section 404 type wetlands and upland vegetation. An existing 78 ft. long by 6 ft. wide pier extends to a 12 ft. long by 12 ft. wide L-shape fixed platform with a floating dock, measuring 32 ft.in length by 8 ft. in width, positioned parallel to the shoreline. This docking facility was permitted under General Permit 30354D on 5/24/02. An additional General Permit (No. 61568D) was issued on 3/20/13 for replacement of the existing boatlift. The applicant states that a fixed platform measuring 10 ft. in length by 6 ft. in width would extend into Pages Creek from the eastern waterward edge of the existing L-shaped fixed platform located at the terminal end of the pier. A boatlift measuring 13 ft. in length by 13 ft. in width would be installed on the eastern side of the new proposed platform to accommodate one additional boat. The application states that the proposed new docking configuration would provide docking space for up to three (3) vessels within existing water depths ranging from approximately -2.9 ft. to -3.4 ft. at normal low water (NLW). According to the application drawings, the main channel that runs through this portion of Pages Creek would not be impacted by construction of the proposed fixed dock and boatlift (See Sheet 2 of 3). 10. ANTICIPATED IMPACTS The proposed structures would incorporate approximately 229 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed structure would extend approximately 43 ft. into Pages Creek, which measures approximately 190 ft. across in this area. The structures would be located in water depths of -2.9ft. to -3.4 ft. (NLW) and would conform to both the 1/4 width rule and the current pier head line.
