1) Unless specifically altered herein, this Minor Modification authorizes the straightened pier alignment
and tie pilings, all as expressly and specifically set forth in the attached letter and workplan drawings.
Any additional development activities may require a modification of this permit.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
General
2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
3) This Minor Modification shall be attached to the original Permit No. 52-17, which was issued on
4/20/17, and copies of any documents must be readily available on site when Division personnel inspect
the project for compliance.
4) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to any authorizations
required from the Town of Nags Head.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2017-00338.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 12-0646 Q.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

Minor Modification Request
Dear Ms. Carver:
The Divsiion of Coastal Management issued permit on April 20, 2017 for the redevelopment of
the You Can Fly (Kitty Hawk Kites) facility on the Nags Head causeway. The project is now
underway and the owner now desires a change to the alignment of the south (outer) end of pier.
The change straightens the pier which had previously provided a bend at the end which is
dedicated for the dockage of two tour boats to allow for better maneuverability. This shift will not
bring the work within 15' of adjacent property lines. Please accept this request for a Minor
Permit modification of permit 52-17 regarding this change. Included with this package are the
following items:
(1) Minor Modification Fee of $ 100.00
(1) Set of Riparian Letters (two) with graphics and "green cards"
(1) CAMA Modification Plan (dated 1/2/2020)

Minor Modification to Maior Permit
1. On behalf of You Can Fly, LLC, Michael Morway has requested a Minor
Modification to Major Permit #52-17, which was issued on 04/20/2017 and expires
on 12/31/2020. The original major permit authorized upland development that
included the construction of a commercial building, decks, observation tower,
boardwalk, relocation of fuel tank, and demolition activities, as well as a
replacement bulkhead and pier with floating jet -ski ramps and mooring pilings.
2. You Can Fly, LLC has requested to modify Major Permit #52-57 to change the
alignment of the south end of the pier. The original alignment had a bend, turning
the remaining 60' of pier to the west. The new alignment will create a straight pier,
and the location of the authorized pilings will be adjusted to match up to the
modification in the pier's alignment. The shift of the alignment will not require a
waiver from the riparian property owner.

3. 1 conducted a site visit on 12/31/2019 for the preconstruction meeting and to
discuss a minor modification request pursuant to the provisions of reference (a). It
has been determined that the request meets the requirements contained in 15A
NCAC 07H .0208 USE STANDARDS. Specifically, the request to change the
alignment of the pier will comply with 07H.0208(b)(6) for Piers and Docking
Facilities.
4. The required fee of $100, paid by check #2517, has been received by the
Elizabeth City District Office.
5. It is recommended that the Minor Modification request be granted, provided all
the Permit Conditions of the original permit issued on 04/20/2017 remain in effect
and there are no objections from the applicable review agencies.

Upland Development

workplan drawings.

than 30ft from existing normal water line.

ADDITIONAL CONDITIONS
Bulkhead
3) The bulkhead shall not extend waterward more than 2 feet from the normal water level at any point
along its alignment at the time of construction.
4) The alignment of the authorized bulkhead shall be approved on site by a representative of the Division
of Coastal Management within a maximum of 30 days prior to the start of construction.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure
7) The fill material shall be clean and free of any pollutants except in trace quantities.
8) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
9) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
Dockine Facility
10) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust
waters without permit modification.
11) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
12) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
13) This permit authorizes a maximum of 10 formalized boat slips.
14) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third paFtEN0BA*-&
written approval of the Division of Coastal Management.

16) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including, but not limited to any permits
required by the NC Division of Water Resources.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2017-00338).
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.

CAMA Major Permit 52-17 was issued to cover work associated with the redevelopment

I have no objection to your modification with the direction of the dock and dimensions provided together with the
removal of the exsisting Dock and its exsisting 4 mooring pilings that run parallel to the west of the exsisting dock.

CAMA Major Permit 52-17 was issued to cover work associated with the redevelopment
of the You Can Fly LLC / Kitty Hawk Kites site at 7517 South Virginia Dare Trail on the
Roanoke Sound in Nags Head. As work is beginning on this project, there is a modification
proposed to the dock alignment. The revision is being sought as a minor modification
request to the existing permit.
As the Riparian property owner, we are required to inform you of this permit modification
request and allow you to make any comments for a thirty -day period. Any questions or
comments can be directed to me at the phone number and address listed below. You

I have attached a form that you can return with any comments. We are not seeking a
