ADDITIONAL CONDITIONS
2) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
3) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
General
4) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
5) - This Minor Modification shall be attached to the original Permit No. 52-17, which was issued on
4/20/17, as well as all subsequent modifications, and copies of all documents must be readily available
on site when Division personnel inspect the project for compliance.
6) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to any authorizations
required from the Town of Nags Head.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Actin Id. No. SAW-
2017-00338.

The Division of Coastal Management issued permit on April 20, 2017 for the redevelopment of
the You Can Fly (Kitty Hawk Kites) facility on the Nags Heai causeway. As you are aware, the
project is now nearly completed and it was discovered that the observation deck was
constructed slightly skew to the plan location and approximately 7' west (this varies slightly due
to the skew). Adjustments to the ramp configuration to the north side were also made. This shift
will does not affect work within 15' of adjacent property lines. Please accept this request for a
Minor Permit modification of permit 52-17 regarding this change. Included with this package are
the following items:
(1) Minor Modification Fee of $ 100.00
(1) Set of Riparian Letters and signed riparian notices
(1) CAMA Modification Plan (dated 8/31/2020)

Minor Modification to Maior Permit
1. On behalf of You Can Fly, LLC, Michael Morway has requested a Minor
Modification to Major Permit (MP) #52-17, which was issued on 04/20/2017 and
expires on 12/31/2020. The original major permit authorized upland development
that included demolition activities and the construction of a commercial building,
decks, observation tower, boardwalk, relocation of fuel tank, pier with floating jet -
ski ramps and mooring, pilings, and a replacement bulkhead. This MP also
received a minor modification on 03/05/2020 for the pier alignment.
2. You Can Fly, LLC has requested to modify Major Permit #52-57 to reflect a 7-
foot shift to the west in the location of the completed observation deck, and
necessary adjustments for the ramp configuration to the north side. RECEIVED

3. 1 conducted a site visit on 09/03/2020. The modification will not increase the
amount of impervious surfaces as originally proposed for this MP site, and will not
affect work within the adjacent property lines. It has been determined that the
request meets the requirements contained in 15A NCAC 07H.0209 Coastal
Shorelines and 15A NCAC 07J.0405(a), where a permit need not be circulated to
all agencies commenting on the original application if the Commission determines
that the modification is so minor that circulation would serve no purpose.
4. Riparian notification statements of no objection have been received from the
adjacent property owners.
5. The required fee of $100, paid by check #2604, has been received by the
Elizabeth City District Office.
6. It is recommended that the Minor Modification request be granted, provided all
the Permit Conditions of the original permit issued on 04/20/2017 remain'in effect.

This permit, issued on Msreh'5. 2020 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. -
1) Unless specifically, altered herein, this Minor Modification authorizes the straightened pier alignment
and tie pilings, all as expressly and specifically set forth in the attached letter and workplan drawings.
Any additional development activities may require a modification of this permit.

Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020

2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
3) This Minor Modification shall be attached to the original Permit No. 52-17, which was issued on
4/20/17, and copies of any documents must be readily available on site when Division personnel inspect
the project for compliance.
4) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that maybe required, including but not limited to any authorizations
required from the Town of Nags Head.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2017-00338.
