This permit, issued on April 25, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Second Dockine Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 3 formalized boat slips, for a combined total of 6 slips at both
docking facilities on the property.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owners' riparian access corridors.
7) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
8) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
9) The authorized covered platform shall be single story, and shall not be designed to allow for second story
use.
10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
14) No excavation or filling of any open water area orgetated wetlgnds is authorized by this permit.

NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2017-00647), which was issued on 4/21/17.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
2017-0292.
NOTE: An application processing fee of $250 was received by DCM for this project.

RECOMMENDATIONS FOR: R. Whitaker March 10, 2017
The proposed construction would provide docking space for three (3) additional vessels at this
location, bring the total vessel count to six (6). It appears that the project is consistent with the
use standards set forth in NCAC 07H .0208(b) (6), including the ''/. width rule, the eight square
foot rule and the pier width rule. The proposed structures would be located entirely over open
water. This office has no objection to the proposed work provided it is consistent with all other
state and federal permitting requirements. It is recommended that any permit issued should
include standard conditions for private docking facilities.

This project is consistent and not in conflict with the Topsail Beach Land Use Plan
update. --
The applicant is proposing to install a second access pier, floating dock and platform with
two boat lifts. The project is located at 1122 Channel Blvd., adjacent to Topsail Sound in
Topsail Beach, Pender County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PT.
Waters at the site are classified as SA and are open to shell fishing. The area is not a
Primary Nursery Area.
I have reviewed this proposal for consistency with the Topsail Beach Land Use Plan and
offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation.
In general, the Topsail Beach Land Use Plan allows development in Conservation
classified AECs which is consistent with the State's minimum use standards. The
Topsail Beach Land Use Plan contains some policies, which exceed the State's minimum
use standards. However, none of these more restrictive policies appear to be applicable
to this project.
This project is consistent with the Topsail Beach Land Use Plan Update.

learned of your request to expand an existing docking facility at 1122 Channel Boulevard along
Banks Channel and Topsail Sound, in Topsail Beach, Pender County, North Carolina.
Coordinates are: 34.3608 N,-77.6374 W.
On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, pilings, mooring buoys, dolphins, jetties, groins and breakwater structures in
navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the
Rivers and Harbors Act of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans and the revised plans received on 20 April 2017, which are a part of this permit.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to

As we discussed, I revised part 5.d. of the attached MP-1 form for Dickens.
This makes it consistent with the dimensions on your MP-4 form and I
believe is more clear, given the other structures you list in this field. If this
doesn't appear correct or if you have any questions, just let me know.
Otherwise, please initial next to the revisions.
And as for Whitaker, as you can see, you have both the existing and
proposed dimensions listed, and I think you just crossed out the wrong
platform dimensions in 1.3. Your narrative and plans show a proposed 12'x
20' deck with a 141x 14' roof. Please also include a note regarding the roof
dimensions on the MP-4 since it will exceed the footprint of the 12' wide
deck. I leave you to make the changes on this one since it's already been
crossed out once.

On March 10, 2017, the Wilmington Regional Office of the Division of Energy. Mineral, and Land Resources received
a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on
March 13, 2017 has determined that the development activities proposed at this time will not pose a threat to surfaace
Water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by
the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are
informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
Ore required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All tempora
built -upon area associated with the construction of the project must be removed within 30 days of completion of th
project, or when it is no longer needed, whichever occurs first. I

9. PROJECT DESCRIPTION:
Trip Pippin, on behalf of Mr. Robert N. Whitaker, has requested authorization for the construction of a
second access pier, platform, floating dock and two boatlifts at 1122 Channel Blvd., adjacent to Topsail
Sound, in Topsail Beach, Pender County. To find the property from the Wilmington Regional Office, take
Highway 17 North from Wilmington approximately 20 miles and turn right on N.C. State Highway 210.
Travel approximately 2.8 miles to the intersection of NC 210 and NC 50. Turn right onto NC 50/NC 210
and travel approximately 1.9 miles onto Topsail Island. Turn right onto S. Topsail Dr. NC 50 and travel
approximately 7.0 miles to Crocker Avenue and turn right. Travel approximately 0.10 miles on Crocker
Avenue and the property will be located on the left-hand side of the road, at the intersection of Crocker
Avenue and Channel Boulevard.
Currently, the property is developed and contains a single-family residence, bulkhead, access pier, platform
and floating dock with two boatlifts. The high ground portion is elevated approximately 4'-6' above the
normal high water (NHW) level and vegetation consists of lawn grasses, scrub vegetation and ornamental
landscaping. Just waterward of the existing bulkhead lies an area of Coastal Marsh that spans the entire
width of the property, out to a distance of approximately 70' offshore. The property has approximately 157
linear feet of shoreline which again is stabilized by an existing bulkhead. Residential properties border the
site to the south, north and east, and Topsail Sound borders the property to the west.
The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina
Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the
North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Based on visual
observations made by DCM staff during a March 2017 site visit, there appears to be a few small areas of
Submerged Aquatic Vegetation (SAV) along both the northern and southern portions of the property.
According to the latest Google satellite imagery, it does not appear the planned development would impact
any areas of SAV; However, the only way to know for certain is to field verify the location of the SAV
beds. Water depths in the vicinity of the existing facility range from -3' to -6', relative to normal low water
(NLW).
The existing pier is located on the northern portion of the property and extends approximately 145' into a
water body measuring approximately 1,200' across. A 20' x 22' partially covered platform is located at the
terminal end of the fixed access pier, and spans toward the west. An 8' x 19' floating dock extends along
the northern side of the fixed platform, running perpendicular to the shoreline. Currently, two (2), 12' x 12'
boatlifts are located on opposite sides of the fixed platform, near the terminal end. The existing docking
facility is in alignment with the existing piers (on either side) and within '%4 of the width of the water body.
According to DCM records, the only permit history for this property is a General permit authorizing a pier,
platform, floating dock and boatlift. The permit (No.-16390) was issued on March 26, 1999.
PROPOSED PROJECT:
The applicant proposes to construct a second access pier, platform and floating dock, along with two new
boatlifts. The proposed pier would originate from the existing bulkhead, and would extend toward the west
along the southern end of the property. As proposed, the access pier would measure approximately 164' in
length, and approximately 6' in width. The access pier would terminate into a partially covered 12' x 20'
"L-head" shaped platform. As designed, two boat lifts (each measuring 13' x 14') would be installed
immediately adjacent to the platform, with one on each side, at the terminal end. Just south of the
southernmost boat lift, the applicant proposes to install an 8' x 32' section of floating dock RECEME D
as well as for access to the proposed boatlift.

The floating dock would run parallel with the proposed access pier, and would extend no further waterward
than the outermost boatlift pilings, and/or terminal end of the proposed platform.
The applicant's proposal to add a second pier and docking facility would bring the total number of slips at
the property to six (6), or three (3) at each dock. Water depths near the proposed structure(s) range from -
3' to -6' (at normal low water).
10. ANTICIPATED IMPACTS:
The proposed structures would incorporate approximately 678 sq. ft. of Estuarine Waters and Pubic Trust
Area. The proposed structures would extend approximately 184' feet offshore and terminate inshore of the
existing pier -head line, which is located at the waterward end of the existing pier. The docking facility
would remain consistent with the %4 width rule and established pier -head line along a water body that
measured approximately 1,200' in width. Minor increases in turbidity should be expected during
construction.
As previous mentioned, and as demonstrated on the applicant's drawing #1 of 2 dated revised 3/8/17, an
area of SAV appears to exist along the southern side of the proposed project area. Based on the site plan
drawings, in addition to measurements taken from Google Earth, it appears the area of SAV is located along
the inner side of the proposed docking facility (boatlift and floating dock). As a result, it does not appear
the existing bed of SAV would be impacted as a result of the drawing. However, if the area of SAV is found
to be located with the footprint of the proposed development, the applicant should consider extending the
pier X number of feet offshore to avoid any impacts.

The Division of Coastal Management hereby acknowledges receipt of your application, submitted on
behalf of Robert Whitaker, requesting authorization under the Rules of the N.C. Coastal Resources
Commission for development activities at 1122 Channel Blvd., adjacent to Topsail Sound, in Topsail
Beach, Pender County. It was received as complete on March 9, 2017, and appears to be adequate for
processing at this time. The projected deadline for making a decision on your permit application is May
23, 2017. An additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as your notice of
an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 9, 2017, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
