This permit, issued on February 15, 2017 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Bulkhead
1) The alignment of the authorized bulkhead shall not exceed a distance of two feet waterward of the
existing deteriorated bulkhead.
2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is
not authorized.
4) The bulkhead shall be constructed prior to any backfilling activities.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure.
6) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or
other suitable materials approved by Division personnel.
7) All backfill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the bulkhead cap immediately following completion of backfilling activities.
General
10) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 2017-
0051.
NOTE: The U.S. Army Corps of Engineers authorized this project by Nationwide Permit 3 (Action ID No.
SAW-2017-00194), which was issued on 2/6/17.
NOTE: An application processing fee of $400 was received by DCM for this project. 10

Dear Mr. Whitman:
On January 3, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received
a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on
January 20, 2017 has determined that the development activities proposed at this time will not pose a threat to
surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and
approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the
stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter,
we are informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

Recommendations for State Permit — Spence Whitman 12/28/2016
It is the staff's recommendation that the applicant's proposal to install approximately 127 linear feet of new
bulkhead, resulting in the filling of approximately 50 sq. ft. of coastal wetlands appears to be
CONSISTENT with the Rules of 15 NCAC 71-1.0208 (b) (7) (D)(iii) Use Standards for Bulkheads and
Shore Stabilization Measures states "the bulkhead alignment will not adversely impact public trust rights
or the property of adjacent riparian owners." It appears that removal of the existing, failing bulkhead and
construction of the new bulkhead on the landward side of the area of coastal wetlands would create greater
environmental impacts with potential erosion and washout during the construction process due to the height
of the existing bulkhead (approximately 8'-9') and the close proximity to the existing dwelling.
It is the opinion of this office that the proposed bulkhead is CONSISTENT with the Use Standards for
Coastal Wetlands, Estuarine Waters and Public Trust Areas, as set forth in NCAC 07H .0205, .0206 &
.0207. In the absence of any concerns from the commenting agencies, it is recommended that a permit he
issued subject to the standard conditions for bulkheads

This project is consistent with the 2016 New Hanover County Comprehensive Land
Use Plan.
The applicant proposes to install a new bulkhead immediately waterward of the existing,
failing bulkhead. The project is located at 11 Saltmeadow Road, adjacent to Banks
Channel on Figure Eight Island in New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA-ORW and are open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2016 New Hanover County
Comprehensive Land Use Plan and offer the following comments.
The general area of the project is classified as Conservation.
In general, New Hanover County allows development in Conservation classified AECs,
which is consistent with the State's minimum use standards. The Wilmington -New
Hanover County Land Use Plan contains some policies, which exceed the State's
minimum use standards, however none of these policies are applicable to this project.
This project appears to be consistent with the 2016 New Hanover County
Comprehensive Land Use Plan.

The project site is located at 11 Saltmeadow Road, on Figure "8" Island, adjacent to Banks Channel and
Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater
Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen
causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South
and travel south approximately 1.15 miles until you reach Saltmeadow Road, which will be located on the
right hand side. Turn right onto Saltmeadow Road and the property of interest will be located on the left
hand side of the road at address No. 11.
Existing structures on the property includes a single-family residence, a failing timber bulkhead and a
private docking facility. The project site is approximately 0.44 acres and is vegetated primarily with
maintained lawn grass and ornamental landscaping. The project site has approximately 127 linear feet of
shoreline frontage along a man-made basin bordering Banks Channel. Located waterward of the bulkhead
is an area of coastal wetlands consisting primarily of sparse Smooth Cordgrass (Spartina alterniora),
which measures approximately 2'-25' in width. The property to the east of the applicant is developed
(residence, bulkhead and docking facility); however, the property to the west is undeveloped (natural
shoreline and upland area).
The applicant currently maintains an existing residence and private docking facility on the property, which
is adjacent to a man-made canal off Banks Channel, in Middle Sound. In addition, the shoreline is currently
stabilized by a wood bulkhead; however, rainfall from Hurricane Matthew has scoured and undermined the
existing wall, resulting in partial failure. As a result, the applicant is requesting authorization to install a
new bulkhead immediately waterward of the existing wall, just above the normal high water level . An
existing access pier, measuring approximately 6' x 32' extends in a southerly direction along the central
portion of the property, out into the man-made basin. The pier terminates onto an uncovered platform,
measuring approximately 14' x 16', creating an "L-shaped" configuration towards the north. An access
ramps leads from the terminal end of the fixed platform to an 8' x 32' floating dock that runs parallel with
the shoreline. In addition, a 13' x 13' boatlift is located on the northern side of the existing floating dock.
The existing docking facility, which originates from a timber bulkhead, appears to accommodate two
vessels within waters with depths of approximately -6' through -10' @ normal low water (NLW).
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground
portion of the property as Conservation The waters of Banks Channel and Middle Sound are classified SA-
ORW by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA)
by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to construct approximately 127 linear feet of new timber bulkhead waterward of
the existing, failing wall, resulting in approximately 50 square feet of Coastal Wetland fill. The new timber
bulkhead would be located along the property's southern shoreline, bordering the man-made canal.
As proposed, the new timber bulkhead would be aligned an average of 1.5' waterward of the existing
bulkhead, with a maximum distance of 2' waterward from the existing wall, and would span the entire
length of shoreline. A small wing wall would "tie" back the southern property corner, whereas the northern
comer would "tie" into the northern bulkhead. The applicant is proposing to install the tie -backs thru the
existing wall to prevent land disturbance associated with removal of the old wall. The limits of disturbance
would be located approximately 18' landward of the proposed new bulkhead alignment.

This method of construction would also aim to alleviate threats to the existing residence which is located
approximately 20'-30' landward of the existing timber bulkhead.
10. ANTICIPATED IMPACTS
The proposed new bulkhead construction with associated backfill and tie back/anchor system would result
in the filling of approximately 50 sq. ft. of Coastal Wetlands. The new wood bulkhead would transect the
normal high water boundary along its alignment. The bulkhead backfill would impact approximately 50
sq. ft. of Smooth Cord Grass (Spartina alterniflora), located below the normal high water line, in shallow
bottom area. The proposed bulkhead construction would result in the disturbance of approximately 2,286
square feet of high ground for the anchoring system. Minor turbidity increases can be expected during the
construction process.

The enclosed CAMA Major Permit Application for Mr. Spence Whitman, 11

The Division of Coastal Management hereby acknowledges that on December 22, 2016, we received
a completed application from you requesting State approval for the development of property located at 11
Saltmeadow Road, adjacent to Banks Channel and Middle Sound, on Fig. Eight Island, Wilmington, New
Hanover County. The projected deadline for making a decision on your client's application (Spence
Whitman) is March 7, 2017. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from December 22, 2016, you may
request a meeting with the Director of the Division of Coastal Management and permit, staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

Dear Mr. Flynn:
The Division of Coastal Management's Wilmington Regional office received a CAMA Major Permit application from you
December 15, 2016, requesting approval for development activities at 115altmeadow Road, adjacent to Middle Sound,
in Figure Eight Island in Wilmington, NC. In reviewing your application, we have discovered that additional information
is needed to complete the review process. Accordingly, I am requesting that you submit the following additional
information to this office:
V) Please provide the signed certified mail receipts for/from the adjacent riparian property owners.
Please provide a processing fee of $400, made payable to NCDEQ.
On the MP-1 Form, Section 4.(a), please indicate the "total length of shoreline on the tract".
4) On the site plan drawing(s), please label and locate the area of Coastal Wetlands adjacent to the existing
bulkhead. Also, somewhere in either the project narrative, application package and/or site drawings, please
indicate the area of proposed Coastal Wetlands fill (square footage calculation).
5) Please revise either the application package or site drawings so that the information detailing the
application package is consistent. Specifically, your application package notes that the bulkhead would be
placed at or no more than 2' below the normal/mean high water mark; however, the site plan (survey)
performed by Pat Bristow shows that the proposed wall would be installed well above (landward) of the
normal/mean high water line.
You may send the requested information to me direct at the below address.
In accordance with the Department of Environment and Natural Resources regulations, we note that the partial
application, as submitted on December 15, 2016, is incomplete for processing. Upon resubmission of a complete
application, a local decision will be made in 150 days, provided this period is not extended as provided by law. Please

The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for development permits in
Areas of Environmental Concern for projects in New Hanover County as designated under the
CAMA: On December 9, 2016, Susan Lamy proposed to install a boat lift and perform new
excavation at an existing docking facility at 9 Bermuda Dr., adjacent to Lees Cut, in
Wrightsville Beach; and on December 22, 2016, Spence Whitman proposed to replace an
existing bulkhead at 11 Saltmaeadow Rd., adjacent to Banks Channel (Figure 8 Island), in
Wilmington. On December 21, 2016, the NC Wildlife Resource Commission proposed to re-
develop and improve a public boat ramp, and perform maintenance dredging at 656 Island
Dr., adjacent to the AIWW, in North Topsail Beach, Onslow County. Copies of the applications
can be examined or copied at the offices of Tara MacPherson (Lamy) or Jason Dail (Whitman &
NCWRC), N.C. Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal

Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to January 27, 2017 will be
