This permit, issued on August 15, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation terms may be subject to fines, imprisonment or civil action; or may cause the permit to ne nuu ana voia. Docking Facility 1) This permit authorizes only the piers, docks, and other structures and 'uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public . Trust, waters without permit modification. 2) This permit authorizes 4 additional formalized boat slips for a maximum of 9 formalized boat slips at this docking facility. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on August 15, 2027 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. ADDITIONAL CONDITIONS Permit No. 85-22 Page 2 of 3 3) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 4) No portion of the authorized docking facility shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high-water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Deed Restriction 8) 15A NCAC 07H .0208(b)(6)(D) of the Rules of the Coastal Resources Commission require that the combined area of all "T"s, finger piers, platforms, and decks not exceed a combined total area of eight square feet per linear foot of shoreline. In order to ensure consistency with this requirement, a deed restriction shall be placed on Lots 1-4 dedicating the entire shoreline of this lot to the proposed community access facility. The deed restriction shall further state that no T's, finger piers, platforms, or decks shall be allowed off of Lots 1-4 in the future as long as the permitted access facility is in place. This deed restriction shall be recorded with the Pender County Register of Deeds, and copies of the recorded deeds provided to the Division of Coastal Management, prior to the initiation of construction of the access facility. Sedimentation and Erosion Control 9) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) All construction debris associated with the removal or construction of the permitted docking facilities shall be contained within the authorized project area and disposed of in an approved upland location. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. including but not limited to any authorizations required from the U.S. Army Corps of Engineers. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4501 and assigned the project DWR Project No. 202104342. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the mean high-water level. It appears that the project is consistent with the use standards set forth in NCAC 07H .0208(b) (6), including the'd width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open water. This office has no objection to the proposed work provided it is consistent with all other state and federal permitting requirements. It is recommended that any permit issued should include standard conditions for private docking facilities. Due to the presence of SAV within the project area this office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to SAV. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed so as to avoid significant adverse impacts. As stated previously, the prior CAMA Major permit (No.143-04) included a condition which required deed restrictions be placed on Lots 1-4, allocating their shoreline toward to the community docking facility. Any permit issued in favor of the proposed development should include the same language. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 176 Hammock Watch Way along the community easement adjacent to the A1WW in Hampstead, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A- 100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16 U.S.C. 703-712 et seq.). The applicant proposes to expand an existing five slip docking facility to create nine permanent slips. The existing gazebo and pier will remain, but the finger piers and boatlifts would be removed and relocated to avoid closure of shellfish waters. A new 5' by 42'finger pier would extend north from the gazebo to connect the new nine slip facility. A longer 4' by 84' finger pier would extend north, running parallel to shore. At the terminus of this pier would be another 4' by 44' finger pier that runs perpendicular to shoreline to create slips 7, 8, and 9 with two 3' by 30' finger piers to provide access. Three 3' by 30' finger piers would be installed perpendicular to the 4' by 84' pier and provide access to slips 1-6. Lifts would be installed in each slip. Water depths in the vicinity of the slips range from -1.9' to -2.5' NL W. The area in the vicinity of the structure is classified as SAV habitat. The Al W W in this location is classified SA ORW by the Environmental Management Commission and is open to shellfish harvesting. Page 2 8. PROJECT DESCRIPTION The project site is located near the end of Washington Acres Road, adjacent to the AIWW, near Long Point Estates, north of Hampstead, Fender County. To access the site from Wilmington, take US Hwy 17 N. Travel approximately 11 miles to Washington Acres Road. Turn right onto Washington Acres Road and travel approximately 1.7 miles to Long Pointe Lane. Make a right on Long Pointe Lane and continue to its end. The site is located ahead and on the left An easement for the Hammock Watch development leads from the end of the road southeast to the AIWW. Hammock Watch consists of a 10.3-acre tract, subdivided into 14 lots, averaging approximately % acre in area, and a highground island measuring approximately % acre. A residential development, with associated roads and utilities, was authorized under State Permit #143-04 issued to Hammocks Watch Subdivision c/o Jerry Reeves on 10/11/04. That permit was subsequently modified on December 4, 2007 to include the addition of a 5- slip community docking facility. All work was completed prior to expiration of the permit (December 31, 2010). The background information on the property, as described in the September 5, 2007 Field Investigation Report (FIR), (prepared by Heather Coats) is stated below. Hammock Watch consists of a 10.3-acre tract, subdivided into 14lots, averaging approximately % acre in area, and a high ground island measuring approximately % acre. A residential development, with associated roads and utilities, was authorized under State Permit #143-04 issued to Hammocks Watch Subdivision c/o Jerry Reeves on 10/11/04. The permit expires December 31, 2007. At this time, the tract has been cleared and road grading has been initiated. CAMA General Permit #35161D was issued him on 1/20/04 for the construction of a 630' pier, located primarily over mixed high and low marsh. The permit also authorized a bridge/elevated wooden walkway, measuring 70' in length and 6' in width, spanning marsh between two upland areas and a 20' in length by 8' in width floating dock. It was renewed on 4/21/04 (Permit #37966D), and was renewed again on 11/22/04 under permit #39725D. CAMA General Permit #42394D was issued on 9/6/05 for a second bridge/elevated walkway, located landward of the first, also measuring 70' in length and 6' in width. These structures were all constructed with the exception of the Floating dock. The combined shoreline for the four waterfront lots measures approximately 488 feet in length. The high ground transitions to high marsh, which includes the following vegetation: Bulrush (Scirpus sp.), Black Needlerush Uuncus roemerianus), Salt Meadow Hay (Spartina patens) and Spikegrass (Distichlis spicata). The two hummocks are vegetated primarily with mixed Section 404 and coastal wetland species, including Sea Oxeye (Borrichia frutescens), Groundsel bush (Baccharus halimifolia), Salt Meadow Hay (Spartina patens), Marsh Elder (1va frutescens) and Wax Myrtle (Myrica cerifera). Page 3 Cordgrass (Spartina alterni%lora). The pier crosses another section of highmarsh at approximately 350' from its origin, which spans a distance of approximately 200'. Vegetation in this area consists of Sea Oxeye (Borrichia frutescens), Spikegrass (Distichlis spicata), Glasswort (Salicornia spp.), and Sea Lavender (Limonium carolinianum). This transitions to a narrow margin of Spartina alterniflora, approximately 10' in length, at the waterward edge of marsh. The waters of the AIWW adjacent to the project site are classified as SA-ORW by the North Carolina Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Pender County's Land Use Plan (LUP) classifies the upland areas as limited transition and all other areas as Conservation, however, the Land Use Plan includes all Areas of Environmental Concern (AEC) as well as the 404 wetlands in the Conservation class. It should be noted there are scattered beds of Submerged Aquatic Vegetation (SAV) throughout the vicinity of the project and the area surrounding the existing docking facility has been identified as SAV "habitat". Under CAMA Major permit 143-04, deed restrictions were placed on Lots 1-4 preventing future development on this lots, as the shoreline was dedicated/allocated toward the community docking facility. PROPOSED PROJECT According to the project narrative and application package, the applicant is proposing to expand an existing 5-slip docking facility, creating a total of nine (9) slips. To avoid a shellfish closure in the vicinity of the proposed docking facility, the applicant has proposed to re -locate the terminal end of the existing five slip facility. As designed, the existing pier and gazebo would remain in place, and the finger piers and boatlifts associated with the existing five slip facility would be removed, and a new nine slip facility constructed. A new 5' x 42' finger pier (labeled as "Component C" on the work plan drawings) would extend north from the existing gazebo, and connect the new nine slip facility to the existing pier and gazebo. This shorter finger pier would then connect to a longer finger pier (4' x 84' and identified on the work plan drawings as "Component D"), which would also extend to the north, running parallel to the shoreline. At the terminus of this finger pier, another 4' x 44' finger pier would be constructed ("Component E" on the site plan drawings). This finger pier would run perpendicular to the shoreline and would provide access to slips labeled "7, 8 and 9" on the work plan drawings. Along the later ends of slops 8 and 9, the applicant proposes to install two - 3' x 30' finger piers. These two finger piers would provide access to slips 7, 8 and 9. Page 4 Three additional 3' x30' finger piers would be installed perpendicular to the 4' x 84' finger pier and would provide access to slips 1-6. In each slip, the applicant proposes to install boatlifts ranging in size from 12' x 14' to 12' x 16'. As designed, these lifts would support boats ranging from 21' to 35' in length. The design of the proposed docking facility can be seen on page 3 of 3 on the Stroud Engineering, P.A. site plan. According to the survey/site plan, water depths around the proposed facility measure approximately -1.9 to -2.8' in depth, relative to normal low water (depths taken from Stroud Eng. P.A. survey). In addition, the proposed boatlifts would be located in waters that range in depth from -1.9' to -2.5', relative to normal low water. Although it was not noted in the 2007 FIR, the area surrounding the proposed docking facility has been identified as SAV "habitat" and based on historical satellite imagery, there appears to be beds of SAV in the vicinity of the proposed project. However, according to the "Project Narrative Page 15 of 19", a member of the HOA performed an SAV evaluation of the proposed project on 3/27/21 and reported there was "no evidence of rhizomes within the evaluation area". Please be advised DCM staff has not validated these statements. It is recommended a site visit be conducted by resource agency staff in the upcoming weeks (beginning of growing season) to determine if SAV is present in the location of the proposed slips. 10. ANTICIPATED IMPACTS - The proposed structures would incorporate approximately 2,896 sq. ft. of Estuarine Waters and Pubic Trust Area. The finger piers and boatlifts would remain consistent with similar pier length requirements (established pier -head line) and would be located outside of the adjacent channel, and riparian corridor setback(s). Minor increases in turbidity should be expected during construction. Water depths in the vicinity of the proposed project range from -1.9' to -2.8' @ normal low water. Please see Attachment for details. 3) Existing Conditions: Currently, the project contains the remnants of three sections of 6' wide dock(i.e., Al-A3), which provides access to a 17' x 17', measured from the drip line, covered gazebo and 5 slip docking facility, with boat lifts. Part of the structure (i,e., Al, A2 and A3-Secl) was severely damaged, during Hurricane Florence, which took place in 2018. The first section of dock (i.e., Al) is approximately 102 linear feet and extends from the upland access point, across a Section 404 wetland area, to another area of uplands. The second section of dock (i.e., A2) is approximately 75 linear feet and extends from the upland area, across an area of coastal wetlands, mostly comprised of Black Needlerush (Juncus roemerianus), to an upland island, where a footpath extends across to the third section of dock (i.e., A3), which has been broken down into two sections (i.e., A3-Secl and A3-Sec2). A3-Secl is approximately 560 linear feet and spans an expansive area of coastal wetlands, consisting of Smooth Cordgrass (Spartina alternaflora) and Black Needlerush, and an upland sand bar, where vegetation consists mostly of Salt Meadow Cordgrass (Spartina patens) and Salt (or Spike) Grass (Distichlis spicata), before connecting to A3-Sec2, which is approximately 169 linear feet. At the terminus of A3-Sec2 is a 17' x 17' covered gazebo (Component B). A 52' x 5' fixed platform, with three (3), 24' x 4' finger piers off its east side, extends north off Component B. The existing structure provides 5 boat slips, which contain lifts of random lengths, but all 12' wide. Approximately 544 square feet of platform area is currently in place. Hanover Design, PLLC performed a mean low water (MLW) depth survey, on 16 December 2021, using NAVD 1988 MLW Datum, where 0.00' MLW equals 2.60' NAVD 1988. MLW depths, in the area of the existing docking facility and the area where the proposed slips are to be situated, range from -1.4' to -2.6' (see Attachment 7). Substrate, in the area of the proposed work, is comprised of a layer of compacted muck, overlain by a relatively thin sand layer, with little or no shell matter. While SAVs have been mapped in the area, a review of aerial photos revealed SAVs do not typically grow in the location of the existing or proposed boat slips (see Appendix 8). Additionally, Mr. John Raynor, member of the Hammock Watch HOA, performed an evaluation of the area, on Saturday 3/27/2021, at approximately 1:30 PM (low tide). At the time of the evaluation, the water temperature was in the mid to upper 50's, air temp was —75 degrees, and it was partly sunny. Mr. Raynor used a standard garden rake, to pull along and below the substrate (i.e., 2" — 3"), at approximately 10' intervals, within the proposed docking area. A snap with Mr. Raynor's coordinates has been included (see Attachment 9). The project site is directly across the Intracoastal Waterway from Green Channel therefore, development is restricted by the US Army Corps of Engineers' Navigational Channel Setback line. The Sewre, LLC 5 slip, docking facility is situated approximately 45' south, and the Long Point Estates, 9 slip, docking facility is located approximately 210' north, of the existing Hammock Watch docking facility (see Photos 1 and 2 below). This could be due to a slight shift in the riparian corridor, as a result of more accurate mapping. The northern riparian corridor is approximately 170 linear feet away from the proposed northern most pilings (see Attachment 7). 4) Proposed Development: The proposed work consists of relacing approximately 737 linear feet of fixed dock (Components Al, A2 and A3- Sect. 1), repairing 169 linear feet of fixed dock (Component A3-Sect. 2), as well as the fixed 17' x 17' gazebo (Component B) and repairing and reducing, by I 1 linear feet, Component C. New work will consist of connecting a an 84' x 5', fixed platform (i.e., Component D), with three 30' x 3' finger piers, and a 43.5' x 4', fixed platform (Component E), with two 30' x 3' finger piers. Component C will provide access to Component D via the southernmost proposed finger pier. Each slip will also have pilings installed for lifts. Which will range from 10' x 10', on center, to 14' to 16', on center. The new structure will add 465 square feet of platform area, for a total of 1009 square feet. The barge will be moored, when not in use, in an area where it will not rest on the bottom. 5) Threatened and Endangered Species: To ensure protection of the West Indian manatee (Trichechus manatus), the work will be undertaken between November I and May 31. If this is not possible, the Applicant will adhere to the US Fish and Wildlife's guidance entitled "GUIDELINES FOR AVOIDING IMPACTS TO THE WEST INDIAN MANATEE, Precautionary Measures for Construction Activities in North Carolina Waters" (see Appendix 10). 6) SAV Habitat: As noted previously, SAVs have not typically been found and there is no evidence to support that the flora has ever colonized in this area. However, it is the Applicant's intention to protect the resource, should it emerge, by limiting the width of Component E, to 5'and orienting the proposed structure to face as close to due west as possible, which will allow for maximum sunlight exposure. Additionally, to prevent docking on the west side of Component E, where water depths are more shallow, additional pilings will be used. 7) Shellfish The area is open to shellfishing (see Attachment 6). However, there is no evidence of shellfish, within the project area. Due to the close proximity of the Sewre Dock (i.e., —47% SEGi reached out to Mr. Justin Humphrey, with the NC Division of Marine Fisheries, Shellfish and Sanitation Unit, to ensure that the proposed work would not provoke a closure. According to Mr. Humphrey, the proposed 9 slip docking facility is more than 100 linear feet away from the nearest 10 slip docking facility to the north, and therefore, the proposed plan is not anticipated to trigger a shellfish closure (see Attachment 11). 8) Adjacent Riparian Property Owner Notifications: In accordance with 15A NCAC 07J .0204(b)(5), the adjacent property owners (APO), as identified in the permit application, have been notified via certified return mail. The manatee is also listed as endangered under the North Carolina Endangered Species Act of 1987 (Article 25 of Chapter 113 of the General Statutes). The U.S. Fish and Wildlife Service (Service) is the lead Federal agency responsible for the protection and recovery of the West Indian manatee under the provisions of the Endangered Species Act. Adult manatees average 10 feet long and weigh about 2,200 pounds, although some individuals have been recorded at lengths greater than 13 feet and weighing as much as 3,500 pounds. Manatees are commonly found in fresh, brackish, or marine water habitats, including shallow coastal bays, lagoons, estuaries, and inland rivers of varying salinity extremes. Manatees spend much of their time underwater or partly submerged, making them difficult to detect even in shallow water. While the manatee's principal stronghold in the United States is Florida, the species is considered a seasonal inhabitant of North Carolina with most occurrences reported from June through October. To protect manatees in North Carolina, the Service's Raleigh Field Office has prepared precautionary measures for general construction activities in waters used by the species. Implementation of these measure will allow in -water projects which do not require blasting to proceed without adverse impacts to manatees. In addition, inclusion of these guidelines as conservation measures in a Biological Assessment or Biological Evaluation, or as part of the determination of impacts on the manatee in an environmental document prepared pursuant to the National Environmental Policy Act, will expedite the Service's review of the document for the fulfillment of requirements under Section 7 of the Endangered Species Act. These measures include: 1. The project manager and/or contractor will inform all personnel associated with the project that manatees may be present in the project area, and the need to avoid any harm to these endangered mammals. The project manager will ensure that all construction personnel know the general appearance of the species and their habit of moving about completely or partially submerged in shallow water. All construction personnel will be informed that they are responsible for observing water -related activities for the presence of manatees. the rt\It t 2. If a manatee is seen within 100 yards of the active construction and/or dredging operation or vessel movement, all appropriate precautions will be implemented to ensure protection of the manatee. These precautions will include the immediate shutdown of moving equipment if "a manatee comes within 50 feet of the operational area of the equipment. Activities will not resume until the manatee has departed the project area on its own volition (i.e., it may not be herded or harassed from the area). 4. Any collision with and/or injury to a manatee will be reported immediately. The report must be made to the U.S. Fish and Wildlife Service (ph. 919.866.4520 ext. 16), the National Marine Fisheries Service (ph. 252.728.8762), and the North Carolina Wildlife Resources Commission (ph. 252.448A546). 5. A sign will be posted in all vessels associated with the project where it is clearly visible to the vessel operator. The sign should state: CAUTION: The endangered manatee may occur in these waters duringthewarmer months, primarily from June through October. Idle speed is required if operating this vessel in shallowwater during these months. All equipment must be shut down if a manatee comes within 50 feet of the vessel or operating equipment. A collision with and/or injury to the manatee must be reported immediatelyto the U.S. Fish and Wildlife Service (919-856-4520 ext. 16), the National Marine Fisheries Service (252.728.8762), and the North Carolina Wildlife Resources Commission (252.448.1546). 6. The contractor will maintain a log detailing sightings, collisions, and/or injuries to manatees during project activities. Upon completion of the action, the project manager will prepare a report which summarizes all information on manatees encountered and submit the report to the Service's Raleigh Field Office. 7. All vessels associated with the construction project will operate at "no wake/idle" speeds at all times while in water where the draft of the vessel provides less than a four foot clearance from the bottom. All vessels will follow routes of deep water whenever possible. 8. If siltation barriers must be placed in shallow water, these barriers will be: (a) made of material in which manatees cannot become entangled; (b) secured in a manner that they cannot break free and entangle manatees; and, (c) regularly monitored to ensure that manatees have not become entangled. Barriers will be placed in a manner to allow manatees entry to or'exit from essential habitat.
