PROJECT SUMMARY: The applicant is requesting reauthorization of the Town's beach nourishment project to include approximately 13,200' of oceanfront shoreline, from approximately 4,000' north of Avon Pier to the southern limits of the Village of Avon. PROJECT DESCRIPTION: The Village of Avon is one of seven historical villages on Hatteras Island in the Outer Banks with the National Parks Services' Cape Hatteras National Seashore and the community of Salvo to the north and National Seashore property and the village of Buxton to the south. It is also bordered by Pamlico Sound to the west and the Atlantic Ocean to the east, with a total land area of ---2.4 square miles. Avon Pier is located near the center of the village. The northern end of the Avon oceanfront shoreline has historically been stable and accretional overall. However, the area south of the pier has experienced significant erosion due to long-term processes and storm damage with loss of the frontal dune system and frequent overwash and flooding of NC Highway 12. Furthermore, NC-12 is the sole roadway into and out of the Village for residents, visitors and emergency responders. As a result, Dare County conducted a feasibility study to assess the erosion and potential solutions in 2020, The study documented accelerated erosion over the past 20 years, with erosion rates as high as 20'/year and established 5 reaches within the area based on shoreline volumes. The long-term erosion rate for the proposed project area ranges from approximately 0.5-6.5'/year. The Division's calculated l 00-year storm recession line for the Town is predicted to be 30'. The waters in the project area fall within the Pasquotank River Basin, as classified by the NC Division of Water Resources (DWR). The waters of the Atlantic Ocean are classified as SB by the DWR. The NC Division of Marine Fisheries has NOT designated any of the areas to be impacted as a Primary Nursery Area. PROPOSED PROJECT: After evaluating current conditions and potential alternatives, the applicant is proposing a beach nourishment project at Avon along with the addition of engineered dune construction along the part of the shoreline with most severe erosion south of Avon Pier. The project site extends along approximately 2.5 miles (13,200') in total, with 4,000' of that length to be beach fill only (no engineered dune construction) north of the pier. A permit application has also been submitted to the National Parks Service for their approval of the nourishment project. As proposed, the beach berm would be filled to an elevation of +7' NAVD 88 with a 15:1 slope out to tie into existing grade at approximately -4' to-10' NAVD 88. The berm would be constructed at a variable width ranging from —38- 115' at the north end of the project where no dune construction would occur, to a berm width of—70-200' waterward of the proposed engineered dune at the southern end of the project. As proposed, an engineered dune would be constructed along the southern 9,500' of shoreline at a crest elevation of -+-13' NAVD and an average 20' crest width, with a 3:1 slope down to the +7' berm elevation. The applicant states a maximum volume of up to l million cubic yards of sand would be excavated to construct the template, which is intended to achieve a 5-year design life, given normal conditions. It is currently estimated that 77 acres would be filled below MHW. Approximately 23 acres of beach fill material would be placed above the MHW line. Sand fencing and vegetative plantings are also proposed. The plan shows sand fencing installed in 10' long sections spaced a minimum of 7' apart and installed at a diagonal orientation (Sheet 13). American beachgrass, sea oats and bitter panicum (or potentially other dune plant species) would be installed immediately adjacent to the sections of sand fencing. The narrative also states (page 10) the planting of vegetation is proposed along Reach 3, where no engineered dune is proposed. The narrative further states that land -based equipment will be brought to the site over public roads and will enter the beach at designated beach access areas. Any alteration of dune vegetation/topography necessary for equipment access will be authorized prior to undertaking any work and be repaired to pre - project conditions. The applicant is proposing to use a ---250-acre borrow area located. approximately 3 miles northeast of the Avon shoreline. Two dredge depths are proposed based on evaluation of compatible material from the 12 vibracores collected within the borrow area. Zone 1 (called Borrow Area 1) would be dredged to a depth of 10' with final excavated elevations ranging from approximately -40' to -6 1' NAVD 88, and the second area (Borrow Area 2) located immediately to the south would be dredged to a depth of 6', which would result in final elevations ranging from approximately -40' to -5 5' NAVD 88. The borrow area as a whole is currently estimated to contain approximately 3.4 mcy of material, based on bathymetric data collected by CSE in July 2020 and proposed dredge depths. Composite samples for a 10' dredge depth for Borrow Area 1 were determined to have a mean grain size of 0.308 mm with an average composite sand content of 96.6%. The average composite gravel content for material within proposed dredge depths in this part of the borrow area was 0.1 %, with an average granular content of 2.6%, average fines content at 0.7% and calcium average carbonate at 16.4%. Composite samples evaluated for a 6' dredge depth in Borrow Area 2 yielded a mean grain size of 0.331mm, with composite sand content at 91.6%, 0.7% gravel material, 5.1% of granular material, 2.6% fines and 16.8% calcium carbonate. A submerged cultural resources survey was conducted by Tidewater Atlantic Research in July 2021. Three magnetic anomalies were found within the proposed borrow area, however the applicant states they appear to represent small ferrous objects and not potentially significant cultural resources. Therefore, no buffers or avoidance areas are proposed within the borrow area. The native beach was characterized through collection of samples at 5 transects. The mean grain size was calculated at 0.289 mm. Granular and gravel material were calculated at 1.7% and 0%, respectively. Fines were calculated at 0.1% and calcium carbonate at 4%. Large sediment material was calculated along the project area, resulting in an average of 5 shell fragments over 3" in size per transect and less than l sediment sample per transect on average measuring greater than 1" in diameter. While individual samples of vibracores collected within the proposed dredge limits show elevated content (>19%) of calcium carbonate, and AV-19 also has elevated fines (indicated as mud) material of —24% from 4-6' depth, the composite (weighted average) content levels when taken for the borrow area as a whole compared to the native beach meet the threshold requirements described in 15A NCAC 07H .0312(c). The applicant has committed to ensuring material is inspected daily to monitor material and contacting DCM and the USACE if non -compatible material is encountered (in accordance with the standard permit condition and as referenced as Condition No. 29 on page 7 of Appendix B). The applicant has further stated that the large borrow area, containing an estimated 3.4 million cubic yards of sand when only 1 million cubic yards of excavation is proposed, offers ample flexibility for the contractor to relocate to suitable areas should they encounter incompatible material. Construction is proposed year-round due to weather -related constraints. The narrative states that construction is anticipated to take 3 months if conducted during the summer months. Additional mitigation and monitoring measures to account for work outside of the environmental window are also proposed, as described in Appendix B. An interagency scoping meeting was held on March 4, 2021. 10. ANTICIPATED IMPACTS The proposed dredging associated with the project would result in impacts to up to 250 acres of submerged bottom at the borrow area. The project would result in the fill of approximately 77 acres of upper beach (above MHW) and would fill approximately 23 acres of intertidal area and nearshore shallow bottom. The dredging and beach fill would result in temporary increases in turbidity. Temporary impacts to benthic and invertebrate infaunal communities can be expected. The applicant states they propose to dredge year-round due to weather constraints, and have proposed mitigative measures as outlined in the narrative and anticipate permit conditions similar to the original permit. The applicant has committed to utilizing existing beach accessways with heavy equipment to minimize impacts to the dunes. Such a meeting will be held within five working days from the receipt of your written request and shall include the applicant and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post copies of this notice at a conspicuous point along the project area where it can be observed by the public. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
