This permit, issued on August 17, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Archeological Resource Investigation 1) The Division of Natural and Cultural Resources (DNCR) has authorized this proposed project by way of Permit No. 17PAS654. Any violation of the permit approved by the DNCR shall be considered a violation of this CAMA permit. 1. 2) No excavation shall take place outside of the area indicated on the workplan drawings. 3) No excavated or fill material shall be placed at any time in any waters outside of the alignment of the fill area indicated on the workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee - ....._..._...............m� Coastal Studies Institute (East Carolina University) Permit No. 97-17 Page 2 of 3 ADDITIONAL CONDITIONS This permit was issued based upon at determination that while the area to be excavated is immediately adjacent to areas containing actively growing submerged aquatic vegetation (SAV) beds, the area of proposed excavation would not directly impact actively growing SAV beds. During all authorized excavation events, the permittee shall implement all available precautions to ensure that damage to SAV beds does not occur. Spoil Disposal All excavated material shall be confined to the areas indicated on the application and attached workplan drawings. In accordance with commitments made by the permittee, all excavated areas will be backfilled with spoil to pre-existing contours. General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. Any mitigative measures or environmental commitments specifically made by the applicant for this project shall be implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. CE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the archeological site to prevent navigational conflicts and habitat impacts within adjacent waters. This should include appropriate signage, ingress/egress routes and public outreach. The pemuttee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. The permittee is cautioned that no permanent or temporary structures, whether floating or stationary, are authorized under this permit. Any structure whether floating or stationary, may require permit modification. Contact a representative of the Division at (252) 264-3901 prior to commencement of any such activity for this determination. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2017-01391). The N.C. Since 2010, maritime archaeologist Nathan Richards (UNC-CSI and ECU) has been periodically researching the wreck in association with training exercises. This has included site drafting (Figure 1) as well as extensive historical research into vessel types and specific watercraft,, and the procurement of historic photographs and blueprints in an attempt to learn more about the wreckage. Due in part to an NCDOT-funded interdisciplinary grant associated with the nearby Rodanthe-Stumpy Point Emergency Ferry channel (2015-2017), research in late 2016 and early 2017 now suggest that the wreckage may belong to an important shipwreck. This has been borne out by a recent assessment by Panamerican Consultants Inc., who recommends that PAS0001 is eligible for listing on the National Register of Historic Places, but enhanced with research by Richards that suggests potential connections between PAS0001 and the U.S. Lighthouse Service, U.S. Coast Guard, NCDOT road construction projects, and American steel -shipbuilding (amongst other themes including local folklore and connections to nineteenth and twentieth century international conflicts). Public outreach and education programming will occur parallel with research and fieldwork N E activities. The work is considered a component of the mitigation required for TIP B-2500. W j c 4a: U 0 Received ' N 16 107 Work will be conducted under the supervision of Dr. Nathan Richards (RPA), and under full supe= of an EMT -trained diving safety officer, and by ECU's most experienced graduate students (all hol WEC AAUS scientific diving certification). Work would occur with the permission of and under a permit from the NC Underwater Archaeology Branch, and all artifacts would remain the property of the State of North Carolina. ECU and CSI already have the major tools to engage in drafting, 3D modeling (terrestrial and aerial photogrammetry and Rhino modeling), magnetic prospecting (metal detection and gradiometric recording), in addition to accurate position fixing capabilities (total station and GPS). Tasks would become part of report writing and class assessment. Need Definition: The need for this research includes: • Research undertaken by the author suggests that the remains of PAS0001 is not a non-descript and insignificant barge as outlined in previous research. Assessing its significance and extracting archaeological and historical information from it is imperative in light of pending bridge development. • Current research suggests that the remains of PASOOOI may be those of a late -nineteenth or early - twentieth century steel -hulled ship. Based on a current list of five (5) promising historical candidates there is a chance that the vessel was once an ex -Light House service and ex -Coast Guard buoy tender, with some candidates also serving in the Spanish-American War, the First World War, and the Second World War. • The recent completion of a consultancy report (Panamerican Consultants, Ltd.) for NCDOT included a statement that the vessel was pre -maturely identified as non -significant, but that the wreckage is eligible for inclusion on the National Register of Historic Places under the National Historic Preservation Act of 1966 (NHPA), hence full assessment and mitigation under Section 106 is warranted as a result of adverse effects to the vessel. Research Objectives: Building upon an extensive amount of work already undertaken by Richards, and based on conversations held between Richards, North Carolina Underwater Archaeology Branch staff (John Morris, III and Chris Southerly) and NCDOT's Archaeology Group staff, this request pertains to completing a full assessment of PAS0001 in order to a) Assess the site's significance (and potentially identify it); b) Record the vessel before any potential impacts from bridge construction occur; and, c) Ground -truth magnetic signatures around the vessel that may belong to it, and which may also impede bridge construction (all tasks assist in the mitigation of PAS0001). RECEIVED Research Methodology and Tasks: Specific research methodologies and tasks will include: JUN 2 9 2017 0 Continued historical research into vessel identity candidates; DC M- M IA D MY • New detailed (scaled) drawings of the wreckage (plan, profile, and feature detail drawings). Previous site drafting was done at an inadequate scale for proper comparison of historical candidates and archaeological remains (i.e. 1 "=5' scale); • 3D modeling where possible (photogrammetric modeling and RhinoCAD modeling); • Limited excavation of portions of hull in order to ascertain the configuration of bow and stern features. Critically, this will also include three excavated transects in order to determine hull cross-section information; • Assessment of material inside the hull (excavation); Received • Environmental impact of the hull; • Excavation of areas adjacent and associated with the hull; and, • Education and outreach events. Signiflcance of Proposed Work: DCM-EC The proposed project is mostly significant because the work needs to be done as a part of Section 106 mitigation due to the hull's eligibility for inclusion in the National Register of Historic Places (National Historic Preservation Act,1966). However, it also has separate historical, archaeological, interpretative, and educational significance on face -value, with all of these values potentially enhanced via scholarly investigation: • Kstorical significance: Historical research has now focused on five potential candidates for the hull. These promising candidates are individually nationally significant. The research undertaken in the fall of 2017 would help include or exclude candidates based on correlations between historical and archaeological data; • Archaeological significance: The remains of PAS0001 may represent the remains of a late - nineteenth century or early twentieth century American steel -hulled shipwreck. Investigations of the vessel may provide clues to American shipbuilding practices in this time; Interpretive significance. There are very few opportunities for members of the public to directly engage in an exposed, potentially -significant shipwreck. The wreckage, properly interpreted provides an exceptional opportunity for members of the public to directly interact with a shipwreck. With or without a bridge covering the wreckage, PAS0001 may also provide an opportunity for economic enhancement for Hatteras Island by being a component in a future road- side or kayak -based heritage trail — drawing people into the Sound, with all the usually knock -on effects of economic benefit to local stores and businesses; and, Educational significance: in addition to drawing on expertise already established for the site, the project allows for significant training of ECU graduate students in archaeological techniques d ,- historical research — in a real -world scenario. Additionally, through local community train ) — initiatives on the Outer Banks (e.g. ECU and CSI's Nautical Archaeology Society training initiative) this vessel holds great potential for public -oriented maritime history and aAchaeoloo N training. a W � U 0 Anticipated Research Products: Quarterly reports in addition to a final report will be produced for this project. The final report will include: • Research design; • Methodology; • Description of the work; • Scale site map; • Three transect profiles; • 3D Rhino reconstruction (if possible); • Recordation and assessment of all construction features and details; • Photomosaic; • Vessel history and ID if possible; • Site history; • Assessment of material within hull; Received � 16 iQil D M-EC RECEIVED JUN 2 9 2017 DCM- MHD CITY • Environmental impact of wreck; description of current environment as pertains to wreck; • Wrecking sequence (or deterioration sequence as is most likely the case); • Results of ground truthing of prioritized magnetic anomalies within likely impact area; and, • Recommendations. The report itself may have potential to become a book -length manuscript, and many of the above bullets had the potential to become separate scholarly works in the form or papers, web content (social media posts and blogs) or form the core of other public outreach products. Hence, this project would propose to include the following products • There would be two public outreach events coordinated between the NCDOT, NC Underwater Archaeology Branch, East Carolina University and the UNC-Coastal Studies Institute: o An introduction to the aims of the work (within the first week of class, i.e. 4-8 September). This would include a presentation by relevant individuals about the background (ECU & CSI), legal aspects of the work (NCDOT & UAB), and an introduction to the students. o A public presentation day relating the conclusions sometime during the week of 27 November to 1 December. This would include presentations by the students on the components of the report they worked on (i.e. associated with section of report writing). • Project website —coordinated by UNC-CSI personnel (under the supervision of John McCord) and populated with project results — some created by ECU graduate students; and, • Project video pieces— created by John McCord for use in NCDOT media, on project website, and on Dare County TV. At least two media pieces will be produced. Utilization of Research Products by NCDOT: All of the proposed products represent an opportunity for NCDOT to further advertise their support for scholarly research, to illustrate the way that important heritage sites are can be preserved in concert with development, highlight collaborations between three state agencies (NCDOT, NCUAB, and the university system), and also their support for tertiary education in the state. The proposed products will be key elements of the B-2500 mitigation required for adverse effects to the vessel. In addition to the creation and dissemination of the products listed above, there are additionally, two opportunities to extend the results of this project: • Potential trail signage: There is the opportunity to turn the information gleaned through this research into road -side or in -water signage as a part of NCDOT trail development, or as a part of other trail initiatives connected to scenic byways or the US Coast Guard; and, • Potential exhibits: There is the potential to turn the content of this project into a stationary exhibit at a location such as the Outer Banks History Center, or a traveling exhibit. Discussion of Impacts The archaeologists will be digging shallow areas within the hull of the shipwreck with hand tools (e.g. shovels, and hand trowels) and depositing within feet of the excavated area. Areas external to the hull may require some hand tool use, but will mainly utilize a hand-held, scuba diver -deployed induction/venturi dredge, which allows for discharged sediment to be stockpiled a short distance from the excavation site. We estimate that around 323 sq. feet of submerged bottomland will be disturbed during research excavations — accounting for the planned depth of excavation this will come to around 1001 cubic feet (37.1 cubic yards). We plan to pump disturbed material inside the hull of the adjacent hull, undertake recording of hull construction details and then pump sediments back into the excavated hull (before moving on to the next area of excavation). Pumping sediments into the internal areas of the hull will allow for the capture of sediment (reducing the spread of suspended sediments in water currents), will reduce or negate any impacts on adjacent SAV, will allow for sediment to be pumped a short distance, and may assist archaeologists in their tasks by not reducing underwater visibility during the project. If this plan is not possible in any specific area, a close location without SAV will be used. It should be noted that during underwater excavations, we intend to screen some sediments, but in no case, will sediments be captured above the water (sediments will remain underwater always). I understand that this shipwreck is the wreck described as the "Pappy Lane Wreck" in the Record of Decision for Phase IIb of the Bonner Bridge Replacement Project. In a letter to NCDOT, dated October 27, 2016, the North Carolina State Historic Preservation Office ("SHPO") stated that the Pappy Lane Wreck is eligible for listing on the National Register of Historic Places and recommended that a 100-meter buffer be maintained around the Pappy Lane Wreck during construction of the Phase IIb Bridge. The Phase IIb Record of Decision, which was released on December 15, 2016, explicitly references the SHPO's letter and recognizes the National Register -eligibility of the Pappy Lane Wreck. Nonetheless, the Record of Decision states, without any elaboration, that "the wreck does not warrant preservation in place" and that FHWA and NCDOT will therefore "develop a data recovery program for approval by SHPO and implementation in accordance with the stipulations of the [Programmatic Agreement]." Moreover, the excavation referenced in Dr. Richards's May 15, 2017 letter conflicts with the plans for the Pappy Lane Wreck described in the 2016 Revised Phase IIb Environmental Assessment issued in May 2016. Rather than excavate the wreck, the 2016 EA states that "[p]rior to construction, the construction contractor will buoy the bow and stern of the site to ensure the site's visibility and will not disturb the site during construction." Based on these facts, I have a few questions regarding the proposed excavation of the Pappy Lane Wreck. They are as follows: 1. This Permit prohibits the use of devices, including propwash deflectors, "blowers" or "mailboxes," which force water onto the ocean floor and displace sediment for the purpose of discovering, exposing, or excavating shipwrecks, or any portions thereof, or their associated cargoes, tackle, and materials. The use of handheld excavation devices, such as induction dredges or airlift systems, is permitted as long as the user maintains proper archaeological controls. All excavation methods must be approved in advance by the Deputy State Archaeologist, UAB. L. Before undertaking recovery of any artifacts, the Permit Holder shall demonstrate to the satisfaction of DNCR that they have provided for facilities within the State of North Carolina, sufficient in size, security, equipment, staffing and supplies to perform stabilization, conservation, and analysis of all recovered artifacts M. Stabilization, conservation and documentation of all recovered archaeological materials covered by this permit shall be performed to professional standards comparable to those found in 36 CFR 79, Curation of Federally Owned and Administered Archaeological Collections, and in procedures established by the UAB for artifact collections recovered from archaeological sites in North Carolina waters. The Permit Holder is responsible for proposing methods for stabilization, conservation and documentation, subject to advance review and approval by of the State Archaeologist or Deputy State Archaeologist, UAB. All associated costs for artifact conservation and documentation shall be borne by the Permit Holder. N. Recovery of cultural materials during this phase of the project shall be limited to diagnostic samples to facilitate site identification and dating. Diagnostic artifacts recovered under the terms of this permit shall be Iimited in size to those items that can be brought to the surface by an individual diver without the assistance of vessel -mounted, mechanical lifting devices (e.g. cranes, davits, capstans, winches, or windlasses) or pneumatically inflated flotation devices commonly know as lift bags. Q. All artifacts and other materials recovered during this investigation remain property of the State of North Carolina, P. The Permit Holder shall ensure that all recovered artifacts are properly documented. That documentation shall include an inventory of recovered materials with assigned identification numbers; date of recovery, general artifact description, provenience, and storage location. Artifact inventories shall be submitted with required monthly reports (Condition S) Q. The Permit Holder shall keep all cultural material recovered under the terms of this permit in secure wet storage until approved conservation procedures (Condition K are initiated. Once artifact conservation and documentation have been completed, the UAB shall be notified and artifacts shall be transferred to the approved curation facility. R. If, for any reasons enumerated in the Permit, the Permit is revoked or future Permit renewal requests are denied, all materials recovered under terms of this Permit shall be returned to DNCR custody as soon as possible, at a time and place determined by DNCR and the Permit Holder. No materials may be removed from the territorial limits of North Carolina for any reason without the prior written authorization of the State Archaeologist or Deputy State Archaeologist, UAB. S. The Permit Holder shall keep a daily log of activities conducted under this Permit including a list of recovered artifacts with assigned identification numbers, provenience, labeled digital images, and current disposition. The Permit Holder shall submit copies to UAB of this log on a monthly basis during field operations by mail or email (nathan.henry@ncdcr.gov). Daily logs shall include precise location] data (corrected GPS coordinates) for all actual or potential targets or finds, and more generally for all areas of exploration conducted during the reporting period. If no work is conducted during a given month, the Permittee shall notify DNCR of this fact in writing. My understanding is that this is the "Pappy Lane Wreck" described in the Record of Decision for Phase IIb of the Bonner Bridge Replacement Project. The Pappy Lane Wreck lies directly offshore from my property, and I frequently explore the wreck via kayak and paddle board. The wreck is likewise a significant source of enjoyment for guests who rent my property, and I often see other people exploring this unique attraction. In addition to providing a first-hand encounter with history, the wreck is known for its excellent fishing. For these reasons, I object to the excavation of the Pappy Lane Wreck. In addition to these personal reservations regarding excavation, I also have concerns regarding the legality of the plans described in Dr. Richards's May 15 letter. The North Carolina State Historic Preservation Office ("SHPO") wrote a letter to NCDOT on October 27, 2016, stating that the Pappy Lane Wreck is eligible for listing on the National Register of Historic Places and recommending that a 100-meter buffer be maintained around the Pappy Lane Wreck during construction of the proposed new jug -handle bridge. The Phase IIb Record of Decision references this letter and recognizes the eligibility of the Pappy Lane Wreck for listing on the National Register. That said, the Record of Decision states that "the wreck does not warrant preservation in place" and that FHWA and NCDOT will therefore "develop a data recovery program for approval by SHPO and implementation in accordance with the stipulations of the [Programmatic Agreement]." How can you reconcile the proposed excavation with the SHPO's determination that the wreck is eligible for listing on the National Register of Historic Places? Specifically, given the SHPO's determination that the wreck is eligible for listing on the National Register, what is the basis for the conclusion that "the wreck does not warrant preservation in place"? Similarly, what steps have been taken to ensure that the proposed excavation has been approved by the SHPO and will be implemented in accordance with the Programmatic Agreement? Moreover, the excavation referenced in Dr. Richards's May 15 letter conflicts with the plans for the Pappy Lane Wreck described in the 2016 Revised Phase IIb Environmental Assessment issued in May 2016. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H .0208 USE STANDARDS (a)(1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches; Consistent: The proposed development of dredging is an acceptable water dependent use. DATE: July 10, 2017 Consistency Determination: The request is consistent with/not in conflict with the Dare County 2009 Land Use Plan certified by the CRC on February 24, 2011. Overview: The project area is in the Pamlico Sound, 1,246 feet offshore of Rodanthe due west of Banzai Landing Road. The area is designated as ShipwreckNC#PAS0001 (Pappy's Lane Shipwreck). The 40 foot wide by 158 foot long shipwreck is located 3 feet below Normal Water Level (NWL) with a portion of the stern above water. The sound is classed as SC:HQW at the project area and is open to shellfishing. A review of Submerged Aquatic Vegetation (SAV) was not provided. Excavation of sediments in five (5) locations around ShipwreckNC#PAS0001 with temporarily sediment stockpiling is proposed. The shipwreck will be dredged with hand tools and a hand held, scuba diver employed induction/venture dredge which allows for discharged sediment to be stockpiled a short distance from the excavation site. Material will be dredged from around the hull of the ship and deposited into another portion of the hull. Dredge material will be returned to previous excavated areas once scientific data has been collected. The shipwreck hull is eligible for inclusion in the National Register of Historic Places, with the remains representing a late -nineteenth century or early twentieth century American steel -hulled ship. The project area may be impacted by pending construction of the future extension of the Bonner Bridge. Assessment of the site's significance, recordation of the vessel before any potential impacts from bridge construction occur, and ground-truthing of magnetic signatures around the vessel which may impede bridge construction, will be conducted. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 11. Issuance or renewal of this permit shall not be construed to confer in the Permittee any right against claims of third parties. Nor shall this permit be construed to create in DNCR or the State any duty or obligation to defend or in any way support the Permittee against claims by third parties. DNCR and the State reserve the right to make determinations on whether to defend or support the Permittee based on the facts and circumstances of each claim. G. Prior to commencing any recovery operations, the Permittee shall be responsible for obtaining all required permits and authorization from other state and federal regulatory agencies and, if necessary, adjacent landowners. H. The Permit Holder agrees to notify the office of the Underwater Archaeology Branch, 1528 Fort Fisher Blvd. South, Kure Beach, North Carolina 28449, phone 910/458-9042, or email (nathan.hemy@ncdcr.gov) at least 48 hours prior to initiating any field activities. I. With regard to the matters authorized and regulated by terms of this Permit, the Underwater Archaeology Branch (UAB) and other DCR agency officials may perform inspections of any operations or facilities of the permit holder or its contractors, on reasonable (24 hour minimum) advance notification. DNCR may require the Permit Holder to reimburse DNCR for reasonable costs incurred by UAB/DCR personnel when performing on -site or on -premises inspections. If required, reimbursement shall be consistent with State laws and regulations governing travel and subsistence allowances of State officers and employees. DNCR will coordinate with the Permit Holder prior to incurring expenses for which DNCR intends to request reimbursement. K. This Permit prohibits the use of devices, including propwash deflectors, "blowers" or "mailboxes," which force water onto the ocean floor and displace sediment for the purpose of discovering, exposing, or excavating shipwrecks, or any portions thereof, or their associated cargoes, tackle, and materials. The use of handheld excavation devices, such as induction dredges or airlift systems, is permitted as long as the user maintains proper archaeological controls. All excavation methods must be approved in advance by the Deputy State Archaeologist, UAB. L. Before undertaking recovery of any artifacts, the Permit Holder shall demonstrate to the satisfaction of DNCR that they have provided for facilities within the State of North Carolina, sufficient in size, security, equipment, staffing and supplies to perform stabilization, conservation, and analysis of all recovered artifacts M. Stabilization, conservation and documentation of all recovered archaeological materials covered by this permit shall be performed to professional standards comparable to those found in 36 CFR 79, Curation of Federally Owned and Administered Archaeological Collections, and in procedures established by the UAB for artifact collections recovered from archaeological sites in North Carolina waters. The Permit Holder is responsible for proposing methods for stabilization, conservation and documentation, subject to advance review and approval by of the State Archaeologist or Deputy State Archaeologist, UAB. All associated costs for artifact conservation and documentation shall be borne by the Permit Holder. N. Recovery of cultural materials during this phase of the project shall be limited to diagnostic samples to facilitate site identification and dating. Diagnostic artifacts recovered under the terms of this permit shall be limited in size to those items that can be brought to the surface by an individual diver without the assistance of vessel -mounted, mechanical lifting devices (e.g. cranes, davits, capstans, winches, or windlasses) or pneumatically inflated flotation devices commonly know as lift bags. 0. All artifacts and other materials recovered during this investigation remain property of the State of North Carolina, P. The Permit Holder shall ensure that all recovered artifacts are properly documented. That documentation shall include an inventory of recovered materials with assigned identification numbers, date of recovery, general artifact description, provenience, and storage location. Artifact inventories shall be submitted with required monthly reports (Condition S) Q. The Permit Holder shall keep all cultural material recovered under the terms of this permit in secure wet storage until approved conservation procedures (Condition Ivi) are initiated. Once artifact conservation and documentation have been completed, the UAB shall be notified and artifacts shall be transferred to the approved curation facility. R. If, for any reasons enumerated in the Permit, the Permit is revoked or future Permit renewal requests are denied, all materials recovered under terms of this Permit shall be returned to DNCR custody as soon as possible, at a time and place determined by DNCR and the Permit Holder. No materials may be removed from the territorial limits of North Carolina for any reason without the prior written authorization of the State Archaeologist or Deputy State Archaeologist, UAB. S. The Permit Holder shall keep a daily log of activities conducted under this Permit including a list of recovered artifacts with assigned identification numbers, provenience, labeled digital images, and current disposition. The Permit Holder shall submit copies to UAB of this log on a monthly basis during field operations by mail or email (nathan.henry@ncder.gov). Daily logs shall include precise locational data (corrected GPS coordinates) for all actual or potential targets or finds, and more generally for all areas of exploration conducted during the reporting period. If no work is conducted during a giver! month, the Permittee shall notify DNCR of this fact in writing. Failure to submit copies of the daily logs or monthly progress reports in a timely manner may be grounds for permit revocation. All logs and reports shall be signed and dated by the Permittee. T. PROJECT SUMMARY: The applicant proposes to excavate sediments from around Pappy's Lane Shipwreck to uncover, record and assess important construction details from the shipwreck prior to construction of the proposed bridge by NCDOT. Project Setting The area proposed for development, known as Shipwreck NC#PAS0001, is located 1,246 feet off shore in Rodanthe North off Blackmar Gut in the Pamlico Sound, Dare County. Currently located on the site is an old shipwreck 3 feet below normal water level with a portion of the stern above water. The soil in the vicinity of the shipwreck is Carteret Sand (CeA). The water classification for the project area is Aquatic Life, Secondary Recreational, Salt Water(SC) and High Quality Waters(HQW). Development Proposal The applicant proposes to dredge 5 locations around Shipwreck NC#PAS0001 with hand tools and a hand held, scuba diver deployed induction/venturi dredge, which allows for discharged sediment to be stockpiled a short distance from the excavation site. Approximately 776 square feet of material will be dredged from around the hull of the ship and deposited into another portion of the hull. Once all scientific data is collected from each area the spoil material will be returned to the previously excavated area of the hull. Anticipated Impacts The anticipated impacts of the proposed dredge project are temporary turbidity in the areas being excavated.
