This permit, issued on January 26, 2017 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this expanded docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the expanded docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.
Signed by the authority of the Secretary of DEQ and the
Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 3 formalized boat slips.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owners' riparian access corridors.
7) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
8) The authorized covered platform shall be single story, and shall not be designed to allow for second story
use.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
13) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant shall
implement the U.S. Fish & Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements within. The guidelines can be found at:

Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of normal high water.

The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit

The total area of the existing and proposed structures was calculated as follows:
Shoreline length = +/-130 ft. x 8 sq. ft =1040 sq. ft. allowable.
Authorized (GP#18260, GP#30362, GP#54540):
Platforms =10' x 27' = 270 sq. ft.
Stepdown Platform = 5' x 15' = 75 sq. ft.
Proposed:
Stepdown addition = 5' x 14' = 70 sq. ft.
Platform = 5' x 19' = 95 sq. ft
Cover Dripline = 23 sq. ft.
Total = 533 sq. ft.
The proposed development would provide docking space for a total of three (3) vessels. The
proposed docking facility currently extends approximately 30' into the waterbody, which
measures approximately 120' across, which is CONSISTENT with NCAC 07H .0208
(b)(6)(G). The application also appears to be CONSISTENT with the remaining use
standards set forth in NCAC 07H .0208(b)(6), including those which dictate the maximum
allowable platform area (the 8 square foot rule), the 15' riparian setback and federal flat setback.
Provided the resource agencies do not have any concerns regarding significant adverse impacts
resulting from the proposed project, this office has no objections to the issuance of a permit.

DETERMINATION:
project is consistent with the 2005 Surf City Land Use Plan Update.
The applicant proposes to construct two platform extensions and a roof, relocate an
existing jetski lift, install a new boatlift, and add one (1) private slip to an existing
docking facility adjacent to the AIWW. The project is located at 7123 Seventh Street in
Surf City in Onslow County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA and are not open to the harvest of shellfish.
The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Surf City Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Conservation.
In general, Surf City allows development in Conservation classified areas and AECs,
which is consistent with the State's minimum use standards. The Surf City Land Use
Plan contains some policies and discussion, which exceed the State's minimum use
standards. However, none of these policies are applicable to this project.
This project appears to be consistent with the 2005 Surf City Land Use Plan Update.

On November 2, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and Land
Resources received a copy of the LAMA Major Permit Application for the subject project. Staff review
of the plans and specification on November 2, 2016 has determined that the development activities
proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director
has determined that projects that are reviewed and approved by the Division as not posing a water quality
threat from stornwater runoff should not be subject to the stormwater management permrttmg
requirements of 15A NCAC 2H.1000, the stormwater niles. By copy of this letter, we are informing you
that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runof,
then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater
discharge requirements. You are required to have an NPDES permit for stormwater discharge from
projects meeting these criteria. All temporary built -upon area associated with the construction of the
project must be removed within 30 days of completion of the project, or when it is no longer needed,
whichever occurs first.

Through coordination with the North Carolina Division of Coastal Management we have
learned of your request to reconfigure and expand the existing docking facility at 7123 71n Street.,
along the AIW W in Surf City, Onslow County, North Carolina. Coordinates are: 34.4532 N, -
77.5200 W.
On January 1, 2011, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans received on 15 November, 2016, which are a part of this permit.
2. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
http://www.fws.gov/nc-es/mammal/manatee guidelines.pdf.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies

9. PROJECT DESCRIPTION:
The project site is located at 7123 7s' Street, on a manmade canal adjacent to the AIWW, in Surf
City, Onslow County. To locate the property from the WIRO office, drive north on NC Highway
17 for 20.26 miles and turn right at Highway 210. Follow Highway 210 east approximately 2.85
miles to Roland Avenue (Hwy 50). Turn right on Roland Avenue and follow it for approximately
1.87 miles to N. New River Drive. Turn left on N. New River Drive and follow it Northeast for
approximately 2.25 miles to 7`s Street. Turn left onto 7a' Street and travel approximately 0.63
miles to the end, the property will be located straight in front at house number 7123.
The property consists of a 13,732 sq. ft. (0.32 acre) parcel that is situated on land that is
approximately 3-5 feet above Normal High Water (NHW) and is vegetated primarily with lawn
grasses. The parcel is improved with a single family residence, driveway, bulkhead, boat ramp,
and two (2) slip docking facility. The approximately 130' shoreline is stabilized by a wooden
bulkhead, and there are no coastal or 404-type wetlands present waterward of the bulkhead. The
width of the waterbody measures approximately 120' from the existing bulkhead to the opposing
edge of marsh. No submerged aquatic vegetation (SAV) exists in the proposed project area.
Currently, water depths in the vicinity of the proposed platform are -3.0', relative to Normal Low
Water (NLW).
The original docking facility was authorized under CAMA General Permit (GP) # 18260 in 1998
to the previous owner James Keene for a 4' wide by 16' long fixed pier and 10' wide by 16' long
fixed elevated platform. The docking facility was modified via GP #30362 by Anthony
Thornton in 2002 to include a 5' wide by 15' long step down platform addition. The docking
facility was modified again in 2010 via GP #54540 authorizing a 5' wide by I l' long addition to
the existing platform, a 12' by 12' boatlift, and an existing jet ski lift that had not been
previously permitted. Two (2) slips exist for this docking facility.
The waters of the AIWW are classified SA-HQW by the Division of Water Resources. The
project area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of
Marine Fisheries and is CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to modify a private docking facility adjacent to Surf City canals leading
to the AIWW. The applicant proposes to add a 5' wide by 18.7' long fixed platform to the
southeast corner of the existing platform, to construct a 5' wide by BY fixed stepdown
platform on the northeast corner of the existing platform, to construct a 4' wide by 6' long stair
leading in to the water from the existing pier, to install an additional 12' wide by 12' long
boatlift off of the proposed stepdown platform, and to relocate the existing 3' wide by 10' long
jet ski lift to the northeast side of the proposed boatlift. According to the applicant, the existing
and proposed platforms would be partially covered by a 15.8' wide by 18.1' long roaf—

cover. The proposed structures would provide docking space for up to three (3) vessels in water
depths of approximately -3.0' at NLW. (See Sheet 1 of 1)
It should be noted the applicant's proposal would not result in an increase in the length of the
docking facility in to the water body. Also, based on the work plan drawings, the applicant's
proposal is located within his riparian corridor, outside of the adjacent 15' riparian corridor
setback and would not exceed '/< of the width of the waterbody. The applicant did not require a
waiver from either neighbor for the proposed development, however both neighbors waived their
15' setback requirements.
10. ANTICIPATED IMPACTS
The proposed modifications would result in the shading of approximately 187 sq. ft. of Open Water
area. The proposed docking facility would extend approximately 30' from NHW (at the bulkhead)
in to a manmade canal which measures approximately 120' in width across this section.
The docking facility would not exceed the '/< width distance rule nor encroach into the adjacent
15' riparian corridor setback. The docking facility would provide docking space for a total of three
(3) vessels in water depths of approximately -3.0' at NLW. Minor increases in turbidity should be
expected during the construction process.

The Division of Coastal Management hereby acknowledges receipt of your CAMA Major Permit
application, submitted on behalf of Anthony Thornton, requesting State approval for the development of
the property located at 7123 71 Street, in Surf City, Onslow County. The application was received complete
on October 20, 2016, and appears to be adequate for processing at this time. The projected deadline for
making a decision on your permit application is January 3, 2017. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from October 20 2016, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a 'Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

The Division of Coastal Management's Wilmington Regional office received a CAMA Major Permit
application from Weston Lyall PE, PLS, PLLC on August 9, 2016, requesting approval for development
activities adjacent to your property located at 7123 Seventh Street, in Surf City, Onslow County NC. In
reviewing your application, we had discovered that additional information was needed to complete the
review process. On September 21, 2016, we received a revised application for the aforementioned project.
After reviewing the revised application, we have determined additional information is still needed, with
the majority of the information from the first request still deficient. Accordingly, I am requesting that you
submit the following additional information to this office:
1) On the MP-1 Form, Section 3. (c), please identify the canal as "manmade".
2) On the MP-1 Form, Section 4. (b), please include the size of the parcel.
3) On the MP-1 Form, Section 6. (f), please include the names and address of the adjacent riparian
property owners.
4) Please sign and date the MP-1 Form.
5) On the MP-4 Form, Section 1. (b), please indicate if facility will be open to the public.
6) On the MP-4 Form, Section 1. (e), please include the size of the two proposed platforms.
7) On the MP-4 Form, Section 1 (0, please include the size of the proposed boat lift address the
relocation of the existing jet ski lift.
8) Please provide the original, or copies of the "signed certified mail receipts (Green cards)
verifying that notice was provided to the two adjacent riparian property owners. The two form
you provided will suffice for waiving the setback, however, our Rules require that you provide
the signed certified mail receipts along with your application.
9) Please provide signed agent authorization form for allowing Weston Lyall to act as your agent.
10) On the site plan, please located and show the following:
- Normal high water (NHW)
- Normal low water NLW)
- Water depths around the docking facility relative to NLW.
- The width of the water body.
- The'/e width of the water body line.
- Please remove the "100' canal" notation. The width of the water body here appears to be +/-
120'.
- Indicate on drawing the new location of the "relocated" existing jet ski lift.
- Number all existing and proposed boat lifts.

- The southern riparian line appears to be off and extends at a 60-degree angle to the canal. The
riparian line should run perpendicular to the adjacent channel or edge of deep water and
connect to the shoreline where the property intersects the normal high water line. Please
revise the plan to reflect this change.
Due to the amount of deficiencies in your application, it is being returned in its entirety. Once you have
addressed all of the items mentioned above, you may re -submit the package for review.

In accordance with the Department of Environment and Natural Resources regulations, we note that the
partial application, as received by DCM on September 21, 2016, is incomplete for processing. Upon
resubmission of a complete application, a local decision will be made in 150 days, provided this period is

This letter is with reference to your application for a Coastal Area Management Act Major
Development permit, acting as agent for Anthony Thornton, to undertake development
activities at property adjacent to a canal off the AIWW, at 7123 7th Street, in Surf City, Onslow
County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary
that the standard review time be extended. An additional 75 days is provided by G.S.113A-122(c)
which would make March 19, 2017, the new deadline for reaching a decision on your request.
However, we expect to take action prior to that time and will do so as soon as possible. In the
