This permit, issued on June 20, 2017 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
to tines, imprisonment or civil action; or may cause me permit to De nuu ana vota.
1) Unless specifically altered herein, this Minor Modification authorizes the reconfiguration of the
permitted docking facility to allow for two additional finger piers, all as expressly and specifically set
forth in the modification request and in the original permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This Minor Modification does not authorize any new formalized boat slips.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor to the west.
4) Should the adjacent property to the east be sold prior to the initiation of construction, the permittee shall
be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement
of any structures within the 15 foot riparian corridor.
5) In order to ensure compliance with 15A NCAC 07H .0208(b)(6)(G)(iii), the authorized 5' wide finger pier
shall not exceed the outer limits of the existing boat lift pilings.
6) The authorized 2.8' wide walkway shall not extend more than 30' into the waterbody, nor shall it extend
onto the adjacent property or into the adjacent riparian corridor.
7) The permittee and/or his or her contractor shall meet with a representative of the.Division prior to
project initiation.
8) This Minor Modification shall be attached to the original permit, which was issued to the permittee on
1/26/17, and copies of both documents shall be readily available on site when Division personnel inspect
the project for compliance.
9) All conditions and stipulations of the active permit remain in force under this Minor Modification, unless
specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
. 197800056 (Action ID No. SAW-2016-02309), which was issued on 12/5/16.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
2016-1101.

Dear Mr. Thornton:
Through coordination with the North Carolina Division of Coastal Management we have
learned of your request to add a 5' x 32' and a 3' x 3 0' finger pier from an existing bulkhead at
7123 7" Street, along the AIW W in Surf City, Onslow County, North Carolina. Coordinates are:
34.4532 N,-77.5200 W.
On January 1, 2017, we renewed general pem-dt No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, pilings, mooring buoys, dolphins, jetties, groins and breakwater structures in
navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the
Rivers and Harbors Act of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans received on 1 May, 2016, which are a part of this permit.
2. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
htto://www.fws.gL)y/no-es/mammaVmanatee euidelines.pdf.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies

Andy Thornton has submitted a request to modify CAMA Major Permit No. 12-17, which was issued on
January 26, 2017, authorizing a private docking facility. Mr. Thornton has determined additional finger
piers are necessary to safely load/unload vessels at the existing boat ramp, and to access the outer edge of
the existing boat lift. As designed, a 5' x 32' finger pier would extend from the existing bulkhead along
the western side of the existing boatlift and another 3' x 30' finger pier would extend from the existing
bulkhead along the eastern side of the existing boat ramp. The proposed 5' x 32' finger pier would be
located outside of the 15' riparian access corridor shared with the adjacent property owner to the west;
however, the proposed 3' x 30' finger pier would be located within the 15' riparian corridor setback
shared with the neighbor toward the east. The permittee has received permission from the adjacent
neighbor to the east (Darryl Evans), and a copy of the initialed waiver form is included in the
modification package.
Based on the existing platform and boat lift layout, the proposed finger pier extensions would be in
alignment with the outermost pilings/platform, or within the pier -head alignment along the shoreline. The
applicant has approximately 130 linear feet of shoreline allowing up to 1,040 sq. ft. of platform or
docking space. Currently, the applicant's pier/platform totals approximately 656 sq. ft. of shaded area.
The additional finger piers would add approximately 250 sq. ft. of shaded impacts, totaling approximately
906 sq. ft., which is within the allowable limit.
Check # 677 in the amount of $100.00 has been submitted to cover this request.
At this time, this office has no objection(s) to this modification.
By copy of this memo, DCM is requesting that any comments provided by your agency (COE and
DWR) be directed to Heather Coats of DCM's Wilmington Regional office within 10 days of receipt
of this memo.

Docking Facility
1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other

facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the expanded docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.
