Glasgow, 217 Rudolph Dr., Beaufort NC 28516 Authorizing development in Carteret County at along the Newport River, at 217, 219 and 221 Rudolph Dr., near Beaufort as requested in the pemrittee's application dated 9/12/17, including attached workplan drawings (2), both dated 9/12/17. This permit, issued on November 22, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation ii mese terms may oe suoiect to rtnes, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization — Offshore Sill 1) The alignment of the offshore sill shall not exceed the alignment as depicted in the attached permit application and workplan drawings, and shall not extend into either adjacent riparian corridor. 2) Should a co -applicant property be sold prior to the commencement of the offshore sill, the permittee shall obtain a written agreement from the new owner waiving the minimum setback and submit it to the Division of Coastal Management prior to initiating construction of the offshore sill. 3) Should either adjacent property be sold prior to the commencement of the offshore sill, the permittee shall obtain a written agreement from the new owner waiving the minimum setback and submit it to the Division of Coastal Management prior to initiating construction of the offshore sill. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Hastings & John M Glasgow Peridit No.129-17 Page 2 of 3 ADDITIONAL CONDITIONS 4) The alignment of the authorized offshore sill shall be staked by the permittee and approved by a representative of the Division of Coastal Management. 5) The offshore sill material shall consist of clean oyster shell, rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. Sill materials shall be of a size sufficient and design to prevent its movement from the approved alignment by wave or current. action. The permittee shall be responsible for immediate removal of any materials or debris that becomes dislodged or moves outside the authorized alignment. 6) This permit does not authorize any fill to be placed landward of the offshore sill alignment. 7) The offshore sills shall be marked at 50 foot intervals with yellow reflectors extending at least three feet above normal water level. 8) The offshore sill shall have breaks and a designed baffle, all as depicted in the attached permit application, narrative, and workplan drawings. General 9) This pemut shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 54 (Action ID SAW-2017-02073). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4097 and assigned the project DWR Project No. 2017-1215. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. Division of Coastal Management State ofNorth Carolina I Environmental Quality I Coastal Management Morehead City Office 1 400 Commerce Avenue I Morehead City, NC 28557 2528082808 Project Narrative Newport River Living Shoreline (Rudolph Drive) Applicants: Thomas Steepy, Jane Hastings & John Glasgow 217, 219, & 221 Rudolph Dr, Beaufort, NC 28512 Date: September 12, 2017 Three properties in the Deerfield Shores neighborhood on the Newport River in Beaufort, NC in Carteret County (see Project Location Map) have significantly eroded through the years due to storms and boat wakes, resulting in the loss of over 25 feet of fringing salt marsh habitat. To address this loss of wetlands, the landowners would like to install a living shoreline along the three properties to restore oyster and salt marsh habitat and to reduce further erosion. The living shoreline will consist of a 300 linear ft. oyster shell bag sill with landward salt marsh grass plantings and will function as a barrier to wave action. Once in place, the sill and plantings will require little to no maintenance. The oyster shells inside the bags will provide a hard surface for naturally occurring oyster larvae to attach to, a limiting substrate for oysters in our coastal waters. After a few years, the sill will be a fully functioning and productive oyster reef. The roots of the salt marsh plants will help to hold the sediments together, thereby reducing erosion of the shore. The marsh grass blades will slow waves during storms and provide a sheltered place for recreationally and commercially important fish and crabs to live and grow. These restoration activities will not only help to stabilize the eroding shorelines, but will also provide habitat for wildlife, finfish and shellfish. The restored marsh and oyster habitat will help to filter nutrients and pollutants, and thereby improve the water quality of the Newport River. The overall goal of this project is to re-establish fringing salt marsh along the three shorelines and to enhance oyster growth in the Newport River. This will provide the landowners with extremely valuable estuarine habitat for which they will become long-term stewards of The restoration effort will be financially supported by the landowner and through the NOAA Coastal Ecosystem Resiliency 2016-2018 Grant Program that was awarded to the North Carolina Coastal Federation, the Authorized Agent for the three property owners, in December 2015. Restoration Methods and Techniques: Oyster Shell Bag Assembly Recycled oyster shells will be purchased from Quality Crab Co. Inc., a seafood company in Elizabeth City, NC. The shells will be delivered by tractor trailer to the federation's headquarters office in Newport, NC, where the landowners and federation staff, volunteers and/or contractors will place them inside mesh bags using PVC tubes and wooden or aluminum bagging frames (Figures 1 and 2). The bags will be stockpiled at the federation office and gradually transported to the three properties using dump trailers and then stockpiled in upland areas until receipt of the permit and permission to begin construction of the oyster shell bags sill. Oyster Shell Bag Sills (see Work Plat Drawings 1 and 2) Three, 100 linear ft. oyster shell bag sill sections will be constructed parallel to the three eroding shorelines in the Newport River. The location of the sill footprint is shown in Figure 3. The distance of the sills from MHW will range from 100 ft. to 130 ft. with an average distance of 115 ft. from MHW. The sills will likewise be placed at a distance ranging from 10 ft. to 50 ft. waterward of the existing vegetation with an average distance of 30 ft. from the existing vegetation. To construct the sills, the landowners and federation staff, volunteers and/or contactors will transport the oyster shell bags from the upland stockpile site to the existing docks using carts or wheelbarrows. To prevent foot traffic and trampling of the existing salt marsh vegetation, the loaded carts will then be wheeled down the docks and the bags will be passed by hand directly into the water and placed along the sill footprint. The bags will be placed perpendicular to the shoreline to avoid rolling (3 bags high and 3 bags wide) on top of a base layer of biodegradable jute matting to minimize bag burial. The width of the sill will be no wider than 6 ft. Five foot gaps in the sill will occur every 100 ft. to allow water circulation and fish passage. A 10 ft. baffle will be constructed with the bags, 5 ft. waterward of the southernmost gap. Marsh Grass Plantings (see Work Plat Drawing 2) The area landward of the oyster shell bag sill will be planted with plugs of smooth cordgrass, Spartina alterniora, the spring following construction of the sill. The landowners and federation staff, volunteers and/or contractors will use dibble bars to create 6-inch V-shaped holes in the intertidal zone about 6 inches apart (Figure 4). Salt marsh planting technique. additional spring plantings may be necessary for 2 to 3 years until the vegetation becomes established. These additional plantings will depend on the availability of funding and plants from nurseries. The purpose of the living shoreline (oyster shell bag sill and landward salt marsh grass plantings) is to restofe oyster and salt marsh habitat along the shoreline of the three properties and reduce further erosion of the fringing salt marsh. The living shoreline will function as as a barrier to wave action from boat wakes and storms. Once in place, the sill and plantings will require little to no maintenance. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. All work will be done by hand by the landowners and by federation staff, volunteers and/or contractors. Bags of recycled oyster shells will be assembled offsite and transported by trailer to the three properties. To minimize foot traffic and trampling of the existing salt marsh vegetation, the bags will be temporarily stockpiled above mean high water prior to construction or immediately placed onto carts and wheeled down the existing docks. The bags will then be passed by hand from the carts to the sill footprint. The sill footprint will be located an average of 115 ft. from MHW (an average of 30 ft. waterward of the existing salt marsh vegetation) and will extend 300 linear ft, along the shoreline of the three properties. The bags will be placed perpendicular to the shoreline (3 bags high and 3 bags wide) on top of a base layer of biodegradable jute matting to minimize bag burial. These waters of the Newport River are open to shellfish harvest and classified as SA; High Quality Waters. This waterbody is not a Primary Nursery Area. This proposal will not pose a hazard to navigation. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) Offshore sill sections shall be setback 15 feet from the adjoining property lines and the riparian access dividing line. The line of division of riparian access shall be established by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. The setback may be waived by written agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are co -applicants. Should the adjacent property be sold prior to the commencement of the breakwater, the permittee shall obtain a written agreement from the new owner waiving the minimum setback and submit it to the Division of Coastal Management prior to initiating construction of the breakwater; 2) The applicant shall be responsible for immediate removal of any materials or mesh bags should the degradation of materials or the bags themselves become a source of marine debris, dislodged or displaced from the authorized footprint, and/or is not performing the function for which is authorized by this permit as an effective marsh sill; 3) Sills shall be marked at 50 foot intervals with yellow reflectors extending at least three feet above mean high water; 4) The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Overview: The applicant is proposing to construct a series of three 100' long oyster rock sills in front of the natural marsh shoreline. The 300' sill would run parallel to the shorelines with an average distance of 30' waterward of the edge of the Coastal Wetlands. The sill would be constructed no more that 6' wide. There would be a 5' gap every 100' to preserve water circulation. A 10' long baffle would be installed five feet waterward of the southernmost gap. Upon completion of the sill the applicants wish to plant plugs of Spartina alterniflora in the areas between the sill and the shorelines. The project is located at three private residences located at 217, 219, and 221 Rudolph Dr., Beaufort, Carteret County. These properties are developed with single family residences. There is a combined 300' of shoreline along the three (3) lots along the Newport River. Vegetation onsite consists of shrubs, trees, coastal wetlands, and lawn grasses. Areas of Environmental Concern (AECs) in the project area "Estuarine Waters" and Public Trust Areas". The project is located in the Newport River, the water is classified as SA (Market Shellfishing, Salt Water), HQW (High Quality Waters), and is open to shellfishing. The area is not a Primary Nursery Area (PNA), and Submerged Aquatic Vegetation (SAV) is present. Water depths range from -.03' to -2' at NLW. There is not a cultural resource in the vicinity of the project. The adjacent shoreline has a RV resort, marina and thick fringes of Coastal Wetlands. Anticipated impacts resulting from this project are expected to include: the filling if 1,800 ft2 of shallow bottom habitat. Basis for Determination: The project site is located in Carteret County and is subject to the 2005 Carteret County Land Use Plan Update. The adjacent properties are similarly developed. The average elevation of the high ground of the parcels is about 7' above the normal high water level (nhw). There is a combined total of 300' of shoreline on these 3 lots along the Newport River. Vegetation on the property mainly consist of shrubs, trees, coastal wetlands, and lawn grasses. Immediate offshore water depths adjacent to the parcel range from —0.3' to —2' normal low water level (nlw). The subaqueous substrate is firm with shell. There is no submerged aquatic vegetation in the nearby vicinity of the project area. There is not a cultural resource in the nearby vicinity of the project area. This waterbody is approximately 2.5 miles across at this location. These coastal waters are not classified as a Primary Nursery Area and submerged aquatic vegetation habitat is present at this location. This project area is within the White Oak River Basin. Proposed Develonment: The applicants wish to construct oyster rock sills within the Newport River, near Beaufort. These waters of the Newport River are open to shellfish harvest and classified as SA; High Quality Waters. This waterbody is not a Primary Nursery Area. This proposal will not pose a hazard to navigation. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) Offshore sill sections shall be setback 15 feet from the adjoining property lines and the riparian access dividing line. The line of division of riparian access shall be established by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. The setback may be waived by written agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are co -applicants. Should the adjacent property be sold prior to the commencement of the breakwater, the permittee shall obtain a written agreement from the new owner waiving the minimum setback and submit it to the Division of Coastal Management prior to initiating construction of the breakwater; 2) Sills shall be marked at 50 foot intervals with yellow reflectors extending at least three feet above mean high water; 3) The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: This permit does not convey any rights, either in real estate or material.
