General Statutes, 'Coastal Area Management"
Issued to Sand Dollar Island, LLC, authorizing development in the Ocean Hazard (AEC) at 96 Beach Road South, Figure
Eight Island, in Wilmington, NC, as requested in the pemtittee's application, dated April 1, 2011. This permit, issued on
April 26, 2011, is subject to compliance with the application and site drawing (where consistent with the permil), all
applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes the installation of a lawn area to include movement of earth and creation of a berm with plantings. Addition
of brick pavers to create a patio under existing deck. Construction of elevated wood walkway and 120 square foot deck. Removal of
existing decking and part of existing walkway Installation of an outdoor shower
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on April 1, 2011.
(2) All construction must conform to the N C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site, Contact this office at 910-798-7116 for a final inspection at

In issuing this pi it is agreed that this praiect is consistent with the local Land

(5) The structure must set back a minimum of 60 feet from the first fine of stable natural vegetation, as determined by
Me DCM, the Ll or other assigned agent of the DCM.
(6) The pernittee 1s required to contact the Local Permit Officer at 910-798-7118, shortly before he plans to begin
construction to arrange a setback measurement that will be effective for sixty (60) days baring a major shoreline
change. Construction must begin within sixty (60) days of the determination or the measurement is void and must
be redone.
(7) All buildings constructed within the ocean hazard area shall comply with the NC Building Code, including the
Coastal and Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage
Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code
or a flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more
restrictive provision shag control.
(8) Dune disturbances will be allowed only to the extent necessary for development and if the dune's protective value is
not weakened or reduced. Disturbed dune areas will be immediately stabilized.
(9) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted ar>d
mulched) within 14 days of construction completion.
(10)Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by
changes In shoreline configuration. The structurefs) shall be relocated or dismantled within two years of the time
when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural
shoreline recovery or beach renourishment takes place within two years of the time the structure becomes
imminently threatened, so that the stricture is no longer imminently threatened, then it need not be relocated or
dismantled at that time. This condition shag not affect the permit holder's right to seek authorization of temporary
protective measures allowed under CRC rules.
(11)The oceanfront, uncovered deck within the setback area shall not exceed a footprint of 500 square feet and shall
be storcturally independent from the house foundation pilings.
(12)The accessway over the dunes must not exceed six feet in width and shag provide only pedestrian access to the
ocean beach. The accessway must be constructed so as to make negligible alterations to the frontal dunes,
That portion of the accessway crossing the frontal dune must be constructed on raised posts or pilings of five
feet or less in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any
alteration to the dunes. In no case shall the dune be altered so as to significantly diminish its capacity as a
protective barrier against flooding and erosion

This notice is intended to make you. the applicant, aware of the
special risks and conditions associated with development in this
area.,which is subject to natural hazards such as storms, erosion
and currents. The rides of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and
acknowledge that notice in %%riling before a permit for
development can be issued.
The Commission's rules on building standards, oceanfront
setbacks and (torte alterations arc desigmed to minimize, but not
eliminate. property loss trim harards, By granting, permits:. the
Coastal Resources Commission does not guuranfee the sality of
the development and assumes no liability for future damage to

The best available information, as accepted by the Coastal
Resources Commission, indicates that ire annual long term
average ocean erosion rate for the area where tour property is

photographs of tire wastline taken over the past 50 years.
Studie also indicate that tire shoreline could move a; hutch as
':119 .52 feet landward in a major storm.
The flood watem in a major storm are predicted to be abnut
feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, grouts, jetties
:ud breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The applicant must acknowledge this information and

Dear Mr. Carter:
The enclosed permit constitutes authorization under the Coastal Area Management Act for you
to proceed with your project proposal. Please sign both sides and return one original to our
office within fifteen (15) days after receipt of this letter. If the signed copy is not returned to us,
then the permit will become void after fifteen (15) days. Signing the permit and proceeding
means you have waived your right of appeal described below. Please retain the other original,
as it must be available on site when the project is inspected for compliance.
If you object to the permit, or any of the conditions, you may request a hearing pursuant to
NCGS 113A-121.1 or 113-229, Your petition for a hearing must be filed in accordance with
NCGS Chapter 1506 with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your
permit, You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all
work must be carried out in accordance with your application. Modifications, time extensions,
and future maintenance require additional approval. Please read your permit carefully prior to
starting work and review all project plans, as approved. If you are having the work done by a
contractor, it is to your benefit to be sure that he fully understands all permit requirements.
