workplan drawings (2) 1-2 of 2 both dated Received DCM Wilmington 2/9/18.
This permit, issued on March 23, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
subject to fines, imprisonment or civil action; or may cause the permit to be nuu ana vora.
1) This Transfer/Minor Modification shall be attached to copies of the following attached permit
documents, which includes all application forms and workplan drawings:
a. Permit 39-17, issued to SEL Property Investors, LLC, on 3/27/17;
2) Copies of the above referenced documents shall be readily available on site when a Division
representative inspects the project for compliance. In accepting this Transfer/Minor Modification,
the new permittee agrees that all conditions and stipulations of the active permit remain in force,
unless specifically altered herein.
3) Should the adjacent property to the south be sold prior to the initiation of construction, the permittee
shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the
placement of any structures within the 15 foot riparian corridor.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
in issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall install and. maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) This permit authorizes a maximum of 2 formalized boat slips.
5) In order to satisfy concerns of the resource agencies, physical stops shall be placed on the boat lift at a
minimum height of 18" above the bottom substrate to prevent the lift from disturbing the bottom substrate.
The physical stops shall remain in place for the life of the docking facility.
6) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2017-00217), which was issued on 3/13/18.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
2017-0090.
NOTE: An application transfer and minor modification processing fee of $200 was received by DCM for
this project.

Mr. David Logan, acting as agent for SEL Property Investors, LLC, is requesting to transfer CAMA Major permit No.
39-17 to the new property owners, Patrick and Holly Smith, of 5912 Nautical Isle Court, Wilmington, New Hanover
County, North Carolina. State Permit No. 39-17 was originally issued to SEL Property Investors, LLC on March 27,
2017 for the construction of a new private docking facility that included an access pier, partially covered platform, and
one boat lift into Masonboro Sound accommodating one vessel. State permit No. 39-17 is due to expire on December
31,2020.
All construction has been completed on the permit, however the new owners would like to request a modification to add
an additional 13' by 14' boat lift on the south side of the existing fixed platform. This boat lift would encroach into the 15'
Riparian Corridor Setback Area for which a waiver has been obtained (Abbott — attached). The application for State
Permit No. 39-17 states that the water depths in the area of the proposed lift are approximately -1.5' at normal low water
(NLW). SEL Property Investors, LLC has submitted a check (#6077) in the amount of $200.00 for the transfer and
modification request, along with the deed and letter of request. This office has no objection to the transfer and
modification of State Permit No. 39-17, provided it is consistent with all other state and federal regulations.
By copy of this memo, DCM is requesting that the USACE, NC DWR, DCM-Fisheries, and NC Wildlife Resources
Commission, provide any comments that your agency may have on the proposed project to Heather Coats of
DCM's Wilmington office within 14 days of receipt of this memo.

their existing MP #3917 to the new owners the property: Patrick & Holly Smith. The property
deed indicating this transaction is attached herewith.
In due order of succession, the new owners of the property Patrick & Holly Smith wish to
MODIFY their MP #3917 by adding another boat lift to the south side of the platform. The boat
lift on the north side was previously authorized under the existing MP. A Work Plan drawing
indicating this modification is attached herewith.
It may be noted that the previously authorized pier and platform is built in accordance with MP #3917.

Through coordination with the North Carolina Division of Coastal Management, and on
behalf of SEL Property Investors, LLC, and new property owners, Patrick and Holly Smith, we
have learned of your request to modify your existing Department of the Army (DA) permit,
issued on February 6, 2018. Your recent request involves adding an additional 13' x 14' boat
life on the south side of the existing fixed platform at 5912 Nautical Isle Court, adjacent to
Masonboso Sound, in Wilmington, New Hanover County, North Carolina. Coordinates are:

Your proposal continues to be consistent with the provisions and objectives of general
permit No_ 197800056 (copy enclosed). The permit is hereby modified. It is understood that all
other conditions of your permit remain applicable.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified. Your Department of the Army permit will expire on December 31, 2021.
